Yeah. Yeah. But I have to do the video for, you know, all those people out there just clamoring to watch us talk tonight. Do you ever check to see if anyone here's the thing? Some people do watch the town council meeting, but I think it's Scott when he doesn't come to the meeting. I think he watches it from home. Okay. I believe for the elite. I'm ready. Okay. Are you ready? I think we are ready. I call the Rome City Planning Commission to order on Thursday, February 19th, 2026. 6:31 p.m.
Stephen Cole, Quin, Ellie Morris, Joe Bertell's, and Brent Lighter not here. Lee Prer, I'm here. and Barb here. We have a quorum here. I make a motion we wave reading the favor. All motion carry new business. We have standard subdivision 2026. Scott's here. Scott, he's right there. Let me get your drawing up here. Maybe. No,
I know. I was trying to get it up on the screen. No, I had problems. All right. So, I just did the front page, Scott, because I didn't think they really cared about the other two pieces of your correction of the previous, right? Correction of a previous survey. Yeah. Yeah. Correction. Does everybody know where this is located? because I did do a beacon. Yeah. Yeah. It's out off of Northport. So if you go out past Silven Sellers and the first road that runs north is 200. Yeah. The cemetery. Correct.
Yeah. It's further up. Same road. So that's where it's located. Yeah. Same road. So that's this one. This is what they want to do. All right. Sorry, Scott. I interrupted you. So, just before you get going, they're keeping their this house.
That's already a separate par. So, the carpenters have 27 acres. They're not house. So, we want to divide this into three three lots. It would be approximately 9 acres each. on slightly left behind over lot one will have existing buildings and then lot two and three will have two additional homesite there's a county legal drain open drain on the north side of the property meandering line there back there's still plenty of room on the eastern half of that lot to build there's quite a bit of relief there it's farmed as hay or uses for hay ground right now where it's pretty rolling at least on that northern ideal for road be I'm pretty sure I don't know 100% but I believe it was three Amish lots
so they've already been sold as went to auction yeah obviously subject to black will divide everything but yet there was an yeah that wasn't too long ago yeah divide so I believe we meet all the minimum standards and subdivision ordinance as far as widths and size lines. Where will there be an access to lap two?
I would imagine there's there's sight distance all the way down there, but the uh the line that's dividing that is just to slightly north of the existing fence lines being put on there. So, I'm not exactly sure, but my guess is probably toward the southern end of that that lot there. But there like say there is sight distance good sight distance all the way through there. So the highway had no restrictions for driveways. I think there's a field entrance where they come in to make hay or can come out almost up to the ditch is where they can come in and out field but I would imagine they stay away from and same way on lot three that's got it's fairly flat road right in there pretty good site anywhere along thereite So the carpenters aren't keeping that one. They're selling it all.
Yes. Three lots. Correct. That little tiny piece that had been pulled off previously bought
any questions? No, I know the area. This is weird. One with the drain on it. That's the existing property. We could put horses on. Yeah. I mean,
what do you need from us? Well, probably just a motion. I fill this thing out.
Well, it's a long legal description because when Scott was doing it, he found an error. So, then he had to correct it. So, that this was the old one, I believe, on the top and that was the corrected one. He put his work in on that one. And whoever had to type it. Yeah. Yay. Where is it? Oh, um, yeah, we got to do interested parties. Oh, there we have to do findings for this.
I don't know. I just found it and I thought we should be doing them. Um, interested parties. They sent out to three and two returned. So um um because of their names that just escaped me on the north bid wells on the the west responded no comment and um Emerson they across the street. Oh and Bidwell do them above too. Yes. Yeah. And and the little house on the corner. I didn't hear from them, but they did get notified because but nobody had any comments. So,
but nobody had any comments.
Yeah, I think it's it meets everything. So, we don't have a problem with it. No, just a standard minor. Do you want us to sign these? Okay. Yeah, we can. But we got to make motion first. Okay. We make a motion we approve
standard subdivision 2026-07. the ones the county has been chair copies I never get copies from them don't you no I know I'm going to have to I have about 10 I have 10 that I need I'm going to have to go over and get copies okay with
and I try to tell them the reporter that I have to have copies back and she just looks at me and I I give up. I can't.
I don't know that I have a blue. Anybody got blue? Does it have to be blue? Okay. Yes. Yes.
Maybe it doesn't copy very well. Maybe I should um get some blue pens. I just keep them out here. Yeah, you can switch.
I'll let you sign them all and then I'll Yeah. They'll probably say it's too messy. They can't accept them. Signature. This right here.
Because it's There's always something period instead of a count and they refuse the deed closing. They refuse the deed. I like well can't you just make a little tail. Look away. Look away. That's what I would have done. I That's what I would have done. I would have just sent it back.
Yeah, if you would. Oh my god. because of
I use crimp all these things too. That kills my hand. get a different stamp. Well, now they just have the ones you just
I know. Was it my Okay. Reach that for you. Sorry. They don't know what this is either over there. you run into that. Do they have a seal? They've not seen a seal like this. They've seen the stamp seats
because you know Yeah. And and they were going to refuse it because it wasn't stamped and I'm like h it's been used that way for I don't know hundred years probably even longer. had another good one where we have to do the letter of authoriz authorization signed for us to file stuff on our clients have been notoriized and one of the secretaries over there we can't accept that because um the notary is now expired three months earlier and but when it was signed the notary had
that's when did you go to law sign before is completely no good because we can't. So did you fight that? I just laughed and hung up because I didn't like what do you say? What do you have? Yeah, you can't fix stupid. So I don't mean danger. Yeah, this ain't working. He has some strong paper. It's really paper.
You know what Bill did? He took a quarter and he slammed it down. Slam the thing down on it to make it look like it. But that's the only way we could get it to That's what I'm going to have to get a stain. Now, of course, it doesn't sit flat either. You can give it a shot. You have stronger hands than I do. You probably do. It's just really thick paper.
We got one more to do. Bless you. Here.
I got one. That's all I need. Yes. So, I don't know what they do with that extra one because I always add one on and they never give it to me. So, probably have to go to the surveyor's office and spend a half a day there sometimes because I have them give me one landowner one for us.
Yeah. Or you could take it up and drop it off to Teresa and she'll get it to me. You know, I mean, if you're not got another client over here, there's no sense in coming to Rome City with that. Yep. Thank you.
Subdivision 2026-06 Noble Trails. Next So, everybody knows where it's located, right? Okay. So, I'll go to the survey. This is a fabulous pen.
Yeah, that was mine, wasn't it? Okay, I'll take my pen back up here. All right, I think I'm ready. come up and tell us what you want to do.
Hey provided by we trails this section. What we want to do is keep this track right here. Put a trail across. crossover track one will be particular We'll try to count
agricultural and possibly unlikely that it's not just Just a second, sir. Sir, we'll we'll ask you in just a second question, but anything to be addressed
I just told him I don't know who she is, Right. Stuck.
Is the 40 acres where the golf course used to be? Okay. Okay. golf course. Yeah. Okay. Okay. Yeah. We also almost got a strip of people with
Yeah.
You go west of the golf course and then the field east of the woods there. Yeah, your name's on this one right here. Oops.
And then Weiss songs on the the back
along the back. And then David Ray kept the parcel on the right, didn't he? turns into like a triangle piece. I think For what it's worth, there's a lake difference. Yeah. And the reason it's coming to you is because there's an easement
and we can't do it with it. It has to be subdivided if there's an easement. Don't really know why, but that's easement for the back track two to get to their easement to 3 850 or 350. See where it's he's pointing right there, Kelly? That little yellow piece is where these people would be able to put their drive to connect into the drive to get out.
Otherwise, they'd be landlaped back there. So, and if you didn't have screen also be additional. Yeah. So, the there's a variance for road frontage. So um if the board is immediable to
this proposal, we would have to approve it pending positive approval of the variance by DCA because they don't have any road. Yeah, they don't really need road frontage, but it's a track of land, so that's I mean, the trail itself doesn't care that they don't have road frontage. They don't need it.
So, Lawrence, did you have a question about any of it? Sure. What involve me in any way? family. I just don't know. It's also over there on Northport Road. Oh, yeah. That one's that one was they we already approved that one. So, that's being split into three lots. Nine. They're about nine acres plus or minus.
Eventually, we have to slow down. Even when we don't want to. I lost lost four out of the five fields that I was farming few years ago. Just recently all sold. Yeah. By the four corners on Lindar's place.
And say the last one I quit was this murders on the left side. farmed it from BK for years for many years anyway and they were going to sell at least part of it now I guess they evidently sell most yeah they were in here last
yeah they sold the house and then they split split it in two pieces and sold the land and then they're whoever bought thought that's going to subdivide it into smaller pieces. Pretty soon we won't have any food grown anywhere because it'll all be housing storage. They don't know what they originally told me that I'm just going to sell a little of it. It's still I can still farm it if I want to do. Well, it's kind of small anyways, right? A lot of work into that, isn't it? Then they told me they want to sell it all. They're gonna force you to slow down. There you go. Right.
All right. And the rest of parties subdivision 2026-6 um sent out notices to everybody and everybody returned. Wow. My goodness, that is a no comments, but they returned. No comments. Unbelievable that everybody Yes, they returned them. excited.
Yeah, Terry probably already talked to him. I know the Moody's knew about it. So, Moody and Ray knew about it. Any other interest? Yeah, probably. I make a motion we uh allow minor subdivision 2026-06 pending.
So Terry when they when you talked to is it Miller that did it the survey? tell him to label it as Noble Trail Subdivision. That's how it was notifed by in the paper because he didn't have a name. So, I just picked a name. Uhhuh. Sounds pretty. Yeah. And then um we'll have to sign the forms once we get approval at the next meeting. Yeah.
Oh yeah, you put condition up on approval of variance 2026-05. You're all Anything else on the agenda this sour? What's that?
Have a good evening. Could be a quick one, please.
Good night. Good night.
Good night. probably fingers crossed that we have nothing for this month. We already we have people visit my bird so tiny that I have to fill like every day. But all I get is sometimes a cardinal The weather changed. Maybe some he did get scratch on Andy. Okay. No word on garage any
I saw that he sent to me the other day. I was like well right here inspection perform January. Everything was in order file is closed. It goes with this. Oh just separated for whatever reason. Who knows why I do what I do when I type them up. We are ready. City Board of Zoning Appeals in order Thursday, February 19th, 2026. Um, Kelly Morris, Derek Bur, Tom Clifton, and Chris Co is absent.
We have a quorum. minutes from the last meeting. I make motion from the last meeting. All in favor? I close. Under new business, we have various 2026-05 bills. Yep. Now, Terry, you got to go through your spiel again. Sorry, but I can change here.
I don't know what this is. I'm out. Okay, that was concerning. There we go. question. Okay.
All right. making trail out this way down east side.
Right. Yeah. So this situation where I'm asking to subdivide this property that's we bought the entire property because that's the way they sell in order to get this piece of property in order for us to be able to trail along here the railroad. And so we're asking one and track two which we're selling to our planning to believe in agriculture so many agriculture are present what we And they will they may probably will trail.
He's got that on his brain. And we have we have a already selling this property to their interest party. permanent across their property in order to connect with this property which we would
yeah we know we know
so what we want to do and then David Okay. And the county drive. There's always a possibility that they might raise, but I'm not promising.
So, I'll be happy to answer questions. I'm really excited about this. looking for the exit every time coming off the airplane. Yeah.
But that time works. And I really worry that someone is going to be online because we really want to get people out because there's no real place to go no place to hide. Yeah. I know. Okay. Well, I'm sorry about
No, no, it's okay. It's it's I I live here. I understand. Yeah. I just don't understand how they get going that fast head west when they're going around hairpin turns. Yeah. Well, you know, crazy. I know. But they have brakes, too. Do they just forget to use them?
The section of the trail that goes behind the sour that's still going to be left. There's like an additional access point. That's correct. That will still be there. will still be there. We're not going to chair it out and so people from especially on hilltop you know it's ideal for them
which I mean I would have assumed but some people in some organizations make weird decisions sometimes But no, we don't maintain. You do a fantastic job of maintaining the trail. Greatly appreciated.
He used to do It's got a lot of trash collectors, right? Yeah. Isn't a shame that we need that? I think most of ours in alliance drive section comes from the recycle or off of State Road 9. Yeah.
It was that stretch between bouts of snow and everything melted off just before my dog and I were on that section of the trail over by the GSP. You know, you look at the curb before you head up to the road and you see all that that cleared path right there. I'm sick and big trail kept going instead of turning to the road. So, so it might be might be a bias for unless somebody is angry or has some feedback. I already think
Lawrence, you have anything to say? I know that we just did this. I feel like you just did it, but separate. We have two separate meetings. up to you. Maybe they'd go across that Todd McCertton's land. Uh I farmed it since the 50s. You mean the trail? Yeah. I thought the trail would come about on there. I think they might have.
So the parcel right across the street is Todd Mcller's 900 is what he's talking about on 900D up there.
Just couldn't get it done. So during a great time understand I'm not sure whether a trail is positive or negative attempting to sell it or thinking about its difficult difficult I know a big teles but dad had a few years then he had it years I expect that
I think this is going to be trivial I like it I like That's really awesome.
Yes, M. He has worked hours and years on this. So, he's done his due diligence before you vote. And second of all, I'm so glad you're mentioning safety. There are so many little Amish kids on those bikes with no helmets, no shoes, no long pants. I see. It's just a matter of time before a tragedy happens on that curve. I've seen that with that infant. Just literally riding the infant on his chest, which was really It was really
It's so scary. It is so scary. So, three or four months old. And there are two businesses on that trail that are going to definitely benefit,
you know, the tea house and coffee shop. I'm going Saturday for tea. I I like it's it's definitely I'm I'm more like What's that? Take your daughter. Oh, yeah. She love it. Oh, yeah.
All right. So, what would you like? Motion would be fine. We had nothing from interested parties on this one. Nope. They were here and spoke and the other ones um returned with no comments. We approved variance 2026. When will it be done?
I've seen that today when I can't because you know the
we made an area just east of Lion's Drive. Our plan is to put bicycle parts into the ravine. So, you're going to go there and then cross get out and still That be nice.
I'm not gonna be able to get You can. They're leaving it open. The only time it'll be shut is maybe for a couple hours during the daytime if they're, you know, working in that specific area.
But it didn't say how long. What sidealk?
We have not been down there. So, I don't know what that is. That's probably their I don't think so. Who knows? Thank you. Keep up the good work. Thank you.
It's Lawrence Emerson. works.
Okay. They're hoping
Yeah. trails.
So, we had I'm sure it's been an adventure. You've learned all things about adventure. Thank you. Thank you. All right. Under old business, we finally have a Wow. completed, finished, done, paid. It's off your agenda. And Dustin can give you an update on Weisenberger. Um, one for April 6th.
No. So the the attorney for them, well one of the several attorneys for them, they kept pushing the brief timelines back because they got to prepare the initial brief and then I respond and then they get another brief and theirs are going to be hundreds of pages. Mine will be still awaiting that report on Yes. I've tried to get Scott to be my arborist. I assumed he knows plenty about plants to be an expert.
But um so we finally came back to theirs was going to be due again and their attorney came to me with this two-page spreadsheet of all the documents they claim are still missing from the record that we certified already. That's already 488 pages. So I guess there's things missing. The one page was all emails that were in the report or in the record but had attach like it had in the subject line that there were attachments included but then the attachments aren't with the emails. My problem that they got them messed away from the email. I don't know. I haven't had the time to go through it all to look because I'm I'm guessing a lot of the
I'm guessing a lot of the attachments appear somewhere else in the pilot papers because there's a lot of duplications through it. There's several pages that appear several times. Oh, yeah. Well, yeah. So, there's that. And then the second page was a list of emails that didn't get in there at all. and I'm somewhere with me, which I don't even know if they're part of the I mean, I'm an attorney. I don't know that I'm necessarily by any, but if they didn't get in there at all, how would they know that? That's what I'm saying. I don't understand. It was like the emails with me were them sending me stuff, they were going to present it. So, I say if they sent it in there somewhere,
if they sent it, they should have it. It's their email. It's their email. It's not my email. And why should I have to put that in the record? the second page. Let's go. All right. Well, but they also ask for videapes and I we've told them 550,000 times there's no video. No video. Never has been video. I have no video of anything. They recorded everything. They recorded it. I don't know.
If not them, the previous law firm did. So I think I think that they were looking at the transcript. The transcript from the hearing that they have transcribed mentioned some video. So I don't know what it don't know because there aren't any. I know. I was like I don't because I asked her I was like is it something you guys provided as a part of your Yeah. Still I don't Is it possible that they were somehow somebody referenced like a neighbor having taken away? Could be, but that doesn't make it part of the record if it was never submitted to he was videoing the neighbor. So, they could probably get that from the client.
Well, but if it's not something that was submitted during during a hearing, none of that stuff was submitted. I don't know. So, we're so we're we're twiddling our thumbs to some extent. I had a phone call with her the other day because I she has been trying to corner me to talk to me about it and I told her gave me heartburn just looking at their spreadsheet and I have no interest in doing it right now. Correct. And and I have even less. Well, that's what I said and she's like, "What do you think you can get it done?" I wouldn't would have time. It could be weeks. It could be months of year. I don't know when we'll have a job again.
So I said, "Look, we're we're a small town. We have, you know, five employees. I guess maybe eight if you count the cops." And you know, we're a small town. We don't have somebody that does all the jobs. Lee's the town manager and the administrators, breast club, several hats. I mean, I'm sure that, but like just have time to sit down spending a day and a half doing and considering that I've already done it three other times. Yeah. And they keep coming back with they don't have it at some point. If you think there's something missing, then you file here. Here's what I said. Yeah. Why don't they submit it themselves? Why can't you just say that? Submit it because they wanted us do to put the transcript in as part of it's like, well, we didn't record it. It's not our business. I don't care.
It's your transcript. You want to submit it as a supplemental record? I'm fine. I'm not going to object. I don't We don't have a transcript. So very hard for us to give them something we don't have. Well, his attorneys aren't gonna rush it because they're getting paid. I'm sensing that that she doesn't like calling me because I send a lot of passive regressive emails that I'm really irritated that I have a lot of our providers and how dumb this is and I didn't go to law school for this and good for you. So, okay, that's where it is. It's it's purgatory be at the same place next month. Yeah.
I'm just telling you because broken because uh spring break for the week because Tuesday I'm getting a redone redone after. Yeah. after 20 years it's like break so it's like hey at least I didn't even get that
all right is that it that's it
I second that motion all in favor I thank you Let me get this shut off here.
I got to take a picture. Have yet to figure out how to get out of this thing.
