There's one major change involved with it that the mayor's touched upon. Basically, what that is, is right now homes, single family homes and duplexes are not allowed in the commercial zones. So we get situations that people come in for land use changes and rezonings because they want to reoccupy the houses after more than a year. This creates the limited use category, which would allow homes to be in the existing homes with certain stipulations to be in the ROC1C2 zoning district. Correct except it's a little bit more than that. They can build, they can build back within 2 years of destruction or demolition partial or wholly. They can do other things that I'll touch upon in the PowerPoint later. So it's kind of a limited use. So it kind of falls. It's not prohibited. Like, it is now. It's not a use by right. It's not a specific use. It's kind of a limited use. So that way they can bring these houses back online.

We're getting we're getting a lot of zoning applications to rezone single lots and commercial areas for a house. So people can reoccupy it and most of those are passing. So. Figure this is a way to take that we don't need a whole bunch of little dots of residential zoning areas. So this allows them comes in to start buying up any properties for commercial. This allows those homes to be reoccupied. Okay.

And right now, there's one of our car wash full serve self serve in the C2 category of use is blank. If it was prohibited, there would be an X or a P for permitted or an S for specific use. So the Texas Comptroller basically is the person filed in the wrong city. They did the work somewhere else, but filed in our city. So

Yeah, it's a contractor that's located here and we don't know who they won't tell us who, but the tax supposed to be paid where the work is done. They did the work in the other city, but they filed the taxes here. And so when they went back and audited, they discovered it. So we have to reimburse the comptroller. It happens both ways because I think it was December. We got like an additional $108,000 from it happening somewhere else. So it's just those businesses are supposed to file a separate tax form for that, but it's not convenient. So a lot of times they just do one and then let the comptroller sort it out, not worrying about the impact it has on cities. They do tell them it's a problem, but they will not tell us who they are. They just told us it's not the same company that we did last year, correct?

It's kind of on the businesses to know that they're supposed to pay the taxes where the work is done. You know, I have a feeling we'll get some of these over the next time because we didn't see a big sales tax jump from the Walmart construction. And I know there was a lot of taxable construction in there. So those apparently got filed somewhere else. So I anticipate over the next year, we may get a few. they do the audit because these are about a year behind so this is for like last year yeah they don't actually look back three years let's think about three years so we can initiate that no i don't think they let us initiate those audits do they well if we if we look through the listings and see something that looks abnormal we can contact If we see a business we know is open here and we don't know and they're not on the list or something like that. But the problem with this is we don't know who those subcontractors were that did work. And some of that's taxable and some of it's not taxable. So that's going to be hard to go in and say, hey, you need to check on this or that because we don't have a listing of all their contractors.

Last month, our group, Lost Pets of Robinson, addressed the council about some challenges we were facing regarding animal control in our relationship with RPD. Honestly, it was a little intimidating knowing the city has more high priority issues. We did not know if we would be heard. Tonight, on behalf of our team, I want to thank the council for being so attentive and our mayor for putting our issue on the agenda. This allowed open communication and dialogue. We appreciate you all and appreciate the Chief's willingness to hear us out and make changes. We would also like to thank someone who works hard behind the scenes for us and all the citizens, and that's Lieutenant DeLillo. Since February, he has been our go-to person. He has shown us grace, empathy, and patience. What some of you may not know is when our group wants to put out a formal announcement, we run it by him and he gets approval from the city's public relations team. This way, we are putting out consistent information to the public. Just recently, he was able to have Officer Feller work a few hours on July 4th night. This was unprecedented and the impact amazing. We feel it really deterred people being casual about their pets knowing Caden would be on duty. She did an amazing job and the results successful. last but certainly not least we thank officer feller for her energy attitude and professionalism she is one of robinson's greatest assets so we felt like if we could come up here and publicly complain that we can come up here and publicly thank you all for being so pre-act proactive thank you

So, on June, 14th, 2026, the city of Robinson experience severe flooding that resulted in rapidly rising water, numerous road closures, stranded motorists and life threatening conditions throughout the community. Members of the Robinson police department responded immediately to assist residents, coordinate emergency operations and conduct rescue efforts under extremely hazardous conditions. Sergeant Atkins, Corporal Foster and Officer Sheldon each demonstrated exceptional courage, professionalism and dedication to duty while responding to this emergency. Despite the significant risk presented by the flooding, they work tirelessly to rescue stranded citizens, secure flooded areas, coordinate emergency resources, and protect the lives and property of residents in the City of Robinson. Their actions exemplified the highest standards of public service and reflected great credit upon themselves. The Robinson police department in the city of Robinson. And recognition for their outstanding performance and selfless service during this emergency. Sergeant Atkins corporal foster and officer Sheldon have been selected to receive the police department. The Robinson police department commendation metal for everybody in the crowd. The commendation metal. In the 14 years I've been here, I have not seen given out 1 dot. So this is a big deal. It's very important that you guys are recognized for this because you guys all earned it. How do you want to do it for photo?

The amount of agencies were out there were at least 6 or 7 agencies between all the cities that were out there, including the state. Mayor and council, thank you. Just a moment here. Technical difficulties. There we go. You have to move it. You have to move the mouse. Yeah. Yes. Tonight this item is just a new car wash and existing car wash facility. This site has 2 base. 1 of the base is enclosed automatic tunnel and the other base of self survey. The new owner will be converting the enclosed automatic tunnel into a self serve bay. So there'll be 2 of them. The only change concerning the new business is the only change concerning the new business for the site. This is the only change for it. And since the car wash has been vacant for over 1 year, they need a new specific use permit for that new business and the C1 zoning category. Hence the request. As stated part of the actual parcel itself, the C1 category right there, rocket car wash orders, Robinson drive and Baker lane. Site access is off Baker lane. This is the current layout of the site. The app is currently working with staff in regards to site buffer, landscaping and lighting issues to work these out and anticipation of the being approved tonight by council. Under section 354 of the city code, there are 8 findings of fact. Those are denoted within your packets. Staff interpretations are in those based on the evidence presented in the packet. You're free to come up with your own determinations for the findings of fact, based on the evidence and what is presented here tonight. Now, staff believes the request will not be detrimental to the area because the site was a car wash. It's just a reintroduction. They're removing the automatic bay, which should reduce noise next to the residences and the site has available facilities to operate a car wash. Under city code requirements, you may impose additional reasonable conditions necessary to protect public interest and welfare, including any time periods. And these can be in relation to adjacent property, protecting adjacent property from excessive noise, offensive views, dimension of property values, or any other undesirable conditions. So known from the presentation and the evidence in your packet. And based on the information within your packet staff does not have issues or concerns with the request as exhibit a of the proposed ordinance as the conditions of the specific use already within city code. So, each use has certain supplemental standards. We've just pulled those forward from the code and are in the ordinance now. So there's no other changes that staff feels necessary for this. And at the July 16th meeting, the planning and zoning commission recommended approval 5 0 for this item. Thank you mayor and council originally the applicant file. This is for a new business at the location originally the applicant filed what we call certificate of occupancy to open business all businesses in the city file this to get basically zoning building and fire approvals to open up the business. This business did open without the CEO in place and is in the process of complying with city code requirements. And this process of the sup for the use as part of that process, and in order for the CEO for us to sign off in that CEO, the council would have to grant this specific use permit request for this use in that category. Site has a 28,819 square foot warehouse building with associated covered area and gravel site parking. Site plans within your packet as well. There is no proposed change to the existing layout of the site. And this business makes just travel trailers and it has storage on site. This is similar to the previous business at the site, which had outdoor storage as well site will have enough space to exceed. Basically, the site will have enough space to exceed minimum parking requirements. Now, based on the site plan, that's with the packet and the applicant can't use more than 20% of that site for outdoor storage. And he meets that requirement now, based on the site plan that's with your packet. This is the site plan to the left is the survey of the existing site and you can see the future layout of the site that's within your packet. Labeled areas that are labeled future are in grass. Now, this is not allowed by our code standards. You have to park on an improved surface. And this can be resolved with a condition being put in place on this. And I'll touch upon that here a little later in the presentation. Parcel is zone C2. There are C1 zoning around with RO zoning. There are some residences to the north and south as well within the commercial zoning category. As stated earlier, you have 8 findings of fact of which you have to find the findings of fact in determining whether or not to approve a specific use request. Staff believes the request will not be detrimental to the area. With certain conditions, the site was previously a truck related business that outside storage as well. Adequate systems on the site exist on the site to support the business. Surrounding residential is larger lots in relation to the business and these are staff interpretations again. You're free to come up with your own interpretations based on what's presented at the hearing and within the evidence in your packet as well. And as I stated earlier, you can impose reasonable conditions on the property to mitigate certain factors, like, noise, offensive views, dimension of property values, any other undesirable hazardous condition. You think this use would have on neighboring properties. Although exhibit a, the proposed ordinance itself adds the conditions of the specific use within the city code. That's the supplemental standards. There are some issues and concerns I stated earlier. There are some stuff that doesn't meet code standard, but I think this can be mitigated pretty easily. and with the following additional condition that areas used for parking and trailer storage outside the gravel area must submit a site development plan be approved and constructed within one year of the date of the approval of council. So if you were to grant this tonight with that condition, the applicant would come forth with a plan on how to do the additional parking areas from the grass that they're gonna deal with the drainage and that sort of thing associated with it. The staff would look through that site development plan when it meets code standards, approve it, then they would construct it. And that would all have to be in place within one year from tonight's date, if you so choose to bring this condition forward. At the July 16th meeting, the planning and zoning commission recommended approval 5 0 with that condition. I just indicated to you here a moment ago. And that concludes my presentation mayor counsel. Many of the leaders of this company graduated from Robinson high school. And we're really proud to come back to our hometown and start a business here in town to both employee people to contribute to the economy. And 1 of the major changes is what this does is it establishes the limited use category to the use table right now you have permitted uses. John Pimentel, Specific uses and prohibited uses the limited uses fall into as a new category, which means the use is limited within that within that zoning district to certain things. John Pimentel, And then the additional changes are as follows here. John Pimentel, what's been done here, this is one of the major changes so for car wash self service or full service as you're aware, tonight, you had an item and see one that was an ass for specific use. Originally, this item was blank here and according to the zoning code either has to be an S for specific use a P for permitted use or if it's prohibited there's an X. So the fact that this item was blank I just added a P in for permitted use in the C2 because that's our highest commercial zoning category. The next change down here is basically, you see here, residential uses. So if you look under the ROC1 and C2, those used to be Xs, but they're crossed out with the word L. That's the creation of the limited use district. And what that does is basically the limited use, this would allow for residential single family and duplex in the commercial zoning categories, ROC1 and C2 as a limited use. Now within our zoning code, we have supplemental standards. And what this does is it kind of spells out certain things. You probably heard me talking to the, I'm bringing the supplemental standards from the code over and putting it with the ordinance. This creates a new supplemental standards and subset and new subsection 49, the supplemental regulations. Limited use for single family and 2 family duplex and residential commercial zoning districts. So, in essence, you can have a residential use in those zoning districts that meets all these standards. A residential use can be allowed if there was a residential building on the site, and this is a reuse of an existing residential building within those zoning categories. So we have situations now where we have commercial zoning commercial enemies. We have residential uses on property. So they're like, single family homes, but if they go more than a year. They become nonconforming and people have to change the land use to low density, residential or rezone and rezone back to a residential zoning in order to do them. This limited use would basically allow that now in the commercial zoning on a limited basis for Pre existing residential. And in particular, a residential use, then the building cannot be enlarged beyond its original floor area as it existed on January 1st, 2026. Floor areas defined as living space and includes garages, carports, and breezeways. and this regulation is not applicable to any additional screened and unscreened balconies decks and porches so i'm allowing additional additions of balconies decks and porches screened or unscreened more additional non-living space than you would normally get uh under a prohibited use so we're loosening the regulations in that way and also see if this is partially or wholly destroyed or demolished the actual residential use You can build it back to the original floor area as of January 1, 2026 provided a building permit has been issued within 2 years of the date of the demolition or destruction partial or whole. So, basically, it allows you to build it back. So, if it catches fire, let's say an act of God or something along those lines in that zoning district. If you get a building permit, you can build it back within a two-year window. So it allows them to build back to the original floor area. That doesn't mean the original footprint, the original floor area. And there's also other minor changes as well, such as relocation of existing code portions to new sections, relabeling of existing sections, and correction of Scrivener's errors as well within it, which was part of the big, long verbiage error that you read. Planning and zoning commission recommendation they met on the 16th about this. They recommend that approval 3 to 1 with the following conditions. If you desire those conditions, you'd have to bring them forward. As well, so subsection 49 B was changed. They had a discussion in regards to. Well, if you allow them to build back, they should be able to build back. If it's going to be a situation if the situation they exist now, they should be able to enlarge the building and they recommend that. Uh, 50% maximum so, in theory, where the limited use would not allow you to increase floor area. They want to allow an increase in floor area of up to 50%. And this is independent of what we discussed as far as the percentages and the original subsection from staff didn't allow for any enlargement beyond the original floor. So they want to loosen it to allow more floor area. More no more than 50% of the building. Now, this was, this was found after the fact, in regards to this, if the council desires to bring a condition forward, or the commission recommendation forward, or change the percentage of that in some way subsection 49 C needs to be changed as denoted in blue.
