3:49Speaker 7

Okay, and you drew your right hand, so I'm going to swear you in. Do you solemnly swear or affirm that the testimony that you shall provide today will be the truth, the whole truth, and nothing but the truth?

3:58Speaker 7

All right, thank you. Go ahead and tell us what your plans are.

4:00 – 4:18Speaker 1

Okay, we was... been working on 1641 Southeast 9th Street, and we was looking to bring in a restaurant and a tavern, which had been at establishment for a long time, but had been abandoned. So we was wanting to open it back up and bring some stuff back to the community.

4:19Speaker 7

Okay. All right. Thank you very much. Mr. Moore, would you go ahead and tell the board what staff's recommendation is with any conditions?

4:33 – 5:05Speaker 6

Our staff has recommended approval of the special exception subject to the following conditions. One, the applicant shall obtain a certificate of occupancy for the entertainment establishment abutting a residential district use of the building within 12 months of the granting of the special exception. And two, the operator of the entertainment establishment abutting a residential district shall only conduct the amplification of music between the hours 11 a.m. and 10 p.m.

5:08Speaker 7

Okay. Board members, do we have any questions at this time for the applicant or for staff?

5:17Speaker 3

Mr. Chairman, one question. Have you had any conversations with any of the residential neighbors behind the property?

5:26 – 5:51Speaker 1

Yes, sir. We went through, talked to the Boys and Girls Club, the 7-Eleven, and there's only one residence behind us. And we spoke with them, and everybody was on board with everything. I let them know the day of the meeting if they had to speak out on everything, and they was fine. Because we was asking, could we actually do the entertainment to 12? Because it's like three buffers between the building and the building is solid concrete, so the noise wouldn't escape out to reach the residents.

5:51Speaker 7

Thank you, Mr. Brown. Mr. Moore, I just had a quick question. There was some discussion about amending one of the conditions. Has that language been updated in the second?

6:01Speaker 6

You all would need to have that conversation and then amend the recommended conditions.

6:10 – 6:31Speaker 3

So just so you'll be aware, we had some discussion earlier in our work session and intend to... And a condition that just says that your amplified sound will be inside. Yes, sir. Okay. And you're aware of the other conditions that were proposed?

6:32Speaker 3

All right. Thank you.

6:37 – 6:53Speaker 7

We need to open the public hearing. Have we received any public comment on this application? We have not, that I'm aware of. Okay. At this time, I'd like to go ahead and open up the public comment portion of this application. Scott, do we have anyone ready to speak today on this?

6:54 – 7:18Speaker 7

All right. Is there anyone out in the audience that would like to speak on this application today? Okay. Here you're saying no. I'll go ahead and close the public comment portion of this application. Board members, I guess we need to make a motion to amend The condition, and do you have the big language?

7:20 – 7:43Speaker 6

What I've come up with is number two would be revised to read. The operator of the entertainment establishment, but in a residential district shall only conduct the amplification of music between the hours of 11 a.m. and 10 p.m. The amplification of music shall also be limited to the interior of the only enclosed building on the subject property.

7:45 – 7:59Speaker 3

Mr. Chairman, I move that we amend the application subject to the conditions, the amended conditions as recommended by staff. Okay. Thank you, Mr. Logan. Do we have a second? Second.

7:59 – 8:10Speaker 7

Okay. Thank you, Mr. Garner. Ms. Clark, can we go ahead and take the vote on amending the application with the conditions proposed by staff as well as the additional condition?

8:11Speaker 5

Yes. Ms. Ervin? Aye. Mr. Garner? Aye. Mr. Logan?

8:16Speaker 5

Mr. Varney?

8:18Speaker 7

Aye. Okay, Board Member, before we take the final comments, do we have any other questions or comments that we'd like to make?

8:26 – 8:38Speaker 2

Just like Mike mentioned, there was a letter in here from Larry in reference to the Golden Horseshoe. Was that the previous name?

8:40Speaker 2

And he made mention of the fact that his van got started there. And it's in the mention of Donald Vance. Now, I hope you follow that.

8:46Speaker 1

Yes, sir. That's the original owner, Dale Wolf. All right.

8:50 – 9:12Speaker 7

Thank you for that, Mr. Garner. Are there any other comments or questions, board members? Okay. We have an amended application before us, so we have a motion to approve the amended application. All right. Thank you, Mr. Garner. And we have a second. Thank you, Mr. Logan. Mr. Clark, can we go ahead and take the final vote on this application?

9:13Speaker 5

Yes, Mr. Ehrman. Aye. Mr. Garner. Aye. Mr. Logan. Aye. Mr. Barney.

9:19Speaker 1

Aye. Congratulations on your special assignment. Yes, sir. Backed out so much. Very well. Yeah, have a great day.

9:25Speaker 7

Ms. Clark, do we have any other new business to attend to today?

9:29Speaker 7

All right. Hearing none, let's adjourn. Thank you, everyone. We'll see you. The Schleiner side?

9:37Speaker 5

I'm sorry? I thought we were here for the architectural review. No, no, that's tomorrow night. To my right.

9:43Speaker 8

Okay. All right. Again, let's adjourn.

9:47Speaker 7

Thank you. You're next. I heard. Did I ever get an item on this agenda?

9:53Speaker 6

I hope not. Same number. Yeah, I got that. It was.
