I wanted to come here tonight and ask permission to put a handicapped parking spot in front of one of our tenant buildings. I want to introduce Mike and Shawna Minnick. They are the tenants and they are opening a medical facility in our building.

Hi, thank you for seeing us tonight. We have moved our office in Fort Wayne to Roanoke, and we are in the building right next to the wire station. We have Medicare, Medicaid privileges, and we have a lot of Medicare management that we do with our patients. So they're seen weekly, some are monthly, and a lot of them are handicapped, and there's no handicapped parking for them to access. So they park across the street, As long as it's a nice day, like today it's probably okay, but in the weather or if they're in a wheelchair and they drive themselves in, like by having a broadband, they can't get through that. It's just not safe for them. And so we're just asking for a parking space right in front of our building to give us access for that patient. Because it also needs to be van accessible. So it has to be large enough that they can park the van.
I would also say that there's not one handicapped spot on that street, on my street. In order for somebody to try and navigate that, even coming from across the street or using a place where they can have a clacker to beat the mark, they basically have to go about a block to get to that. So that is not the kind of environment where we want to welcome those individuals with disabilities and make our business accessible to the community and everyone here.
have there been any other considerations because that spot is also an emergency parking spot for our emergency people?
Correct. We are very much aware of that. We are absolutely not trying to take that from them whatsoever. But because we are a Medicare and Medicaid provider, ADA compliance states that a federal law trumps any local ordinance. So it says that we have the right to put in a handicapped spot for these individuals. And when we measure it, there's plenty of room to put what we need, almost up to their sign. But if we go past that, then it hinders anybody parking in the Waterville parking spots at the back of that building as well.
Erin, have you looked at and measured everything out? Would it work to put anything out there? I would .
Another aspect of this is that with state law and parking, whether volunteer or not, my wife and I are both first responders so we understand paul i retired from federal law enforcement she was in the m2 and she's also a nurse so we totally get it we're not trying to negate that but the way the law reads that parking if it is supposed to be there should be there for officially designed designated apparatus not for personal parking and we've got photos that show even when those vehicles are parking there they're encroaching on the back side of waterfield's parking which would block any type of vehicle that they're parking there from coming out of those spots if they're out of an emergency. Because that gentleman, whoever it is, if he goes to a run, he's got a trailer with lawn mowing equipment on there extending past that sign, encroaching past that curb into the parking area and then he's going to come along with the property there as well.
Public safety is obviously our first- For sure. 100% commitment to that. I just need to be able to have patients come to their doctor's appointments and because certain Medicaid patients have to see certain providers.
So the only request is to make that spot designated, any path, not even the entire spot, just like, yeah, just a spot.

So the way it looks from, there's a picture that Sarah sent us, there were two spots there, does that seem right, Randy? Yeah.

There's actually probably three if you look at it, because we have a picture of, there's a car and then a truck and a trailer, and the trailer does go past the sign, but if it were three cars, you could technically get three sedans there. And I realize that not everybody drives a sedan, so, but yeah, so we just wanna, we're not trying to cause any trouble with anybody. We truly just wanna get along with our community and bring people to the community, but we have an obligation to our patients, too, that we do this, so.
And with compliance on a federal level, in order for us to meet that compliance and accept the community, those individuals that have Medicare, Medicaid, all of those things. It's important that we open our doors for those. So again, I've been here recently. I know one of the things is that in this community, being a small community, it's tough sometimes to have certain businesses enter into this market here. And that's one reason why we want to come here and provide that service as well to other individuals outside of the Parkview medical area.
Do we have a designated spot on High Street for fire emergency trucks or anything, and for a vehicle? I'm just curious.
I thought there was a spot back there. Well, the problem was, Friday and Saturday nights we come down, there's no parking. And so that's why we asked to have those spots designated for our personal vehicles, because we respond to the station. And there's several times during the middle of the day, too, that comes in handy. So those are designated as that. And then obviously across the street, because we don't want to swing the fire trucks out for the flight floors, we said that that can't be in parking because we can't get the trucks out. So then obviously in front of the station, it's all no parking designated for that. So that was just, I think, something you guys did for us to have that parking spot kind of set up for us.
And we thought about that because we've been down here, we've had a little park as well. And we have said, well, how are the fire departments going to do it? What are they going to do if there's no place for them to go? And so we completely understand that. But we are willing to say, too, that we really only see these patients a couple hours a day, Monday through Friday. So anything after 5 p.m. could be open to them, anything on weekends. If I see people on weekends, they're not typically in mobile. It's usually more for the aesthetic side rather than a family practice side. And if there were a run... They need that spot. I am all for the parking. I can take myself across the street and bring in a patient if I need to. I've done that many times. So I'm not trying to take a spot from them at all.
One of the things, too, is that I know this is tough because I know everybody. But the thing is that if I watch them navigate, come in and out, we have photos as well. But if navigating the apparatus is part of those vehicles or part of when they bring the apparatus in, So I see what you're saying, but they're already built up and they're navigating because of what the state standard is for spacing. That area there isn't really necessarily required for state spacing by the law, by state law. So there's plenty of room to bring a vehicle in and out of those spaces. And most parts of the park they're running on city land.
Do we actually have a sign up that says restricted fire department? That's what I'm asking. So on the side of the building, what street is that?

Yeah, and as long as we can park, like I said, the biggest thing is going to be night and weekends. when we utilize those sponsors.
I mean, if it's painted handicapped, no one else can park there.
From an enforcement standpoint, if that's labeled as handicapped and it's not a fire parked there, how do you enforce that? If it's not a fire responder parked there, how do you enforce that? Write citations to the vehicle.
But I mean, if the street is painted for handicapped space, no one else by or otherwise can park there.
So the fire couldn't park there even if they're trying to make a run since it's marked as handicapped.
You could make a little ordinance that says for them or us during those business hours and I think that would be, I just would rather work with them than to have to have some law or rule written up.
And I would agree. I've studied and researched on the side of the building by the fire department there. There's quite a few spots that usually don't have any occupants in them. Most of the days, usually they take the first two or three spots there to go to the businesses. I used to be a criminal, so I did my research on this and wanted to make sure that we had, you know, we didn't want to come in here with false information or anything like that. But there is space along that side of the building that's just as fast to get there. It could be designated, since it's not used heavily, but not in front of our building where we can get in any kind of spot. And again, we're willing to split the front of our building, our business, as long as we just have a handicraft spot there. They're welcome to have the other spot, which I think gives them like 20 feet when I measured it, and still gives us one spot there.
And I think what you suggested is not a bad answer. If Brandon's okay with it, then we'll move. Give you two spots right around the corner there on first street. Yeah, at least one, two.
Yeah, I guess all I ask too is if there's something we can say. I don't know. That, you know, if it's a Friday night at 6 o'clock, if we can use that handicapped spot, too, because literally, I mean, I know everybody's seen it, but we have seven guys responding, and if we can't deliver, we have two department spots. Yeah, so the more we have, the better.
So that's why I'm getting that from an enforcement standpoint. Could you throw a placard up in the windshield or something like that so they know that it's one of the vehicles that's out on our road?

Being in the law enforcement, you're probably familiar with those individuals that are doing these wrong things. So I know that car. I know that car. They're doing the wrong thing. And this business is closed. And we are perfectly fine with that.
We just want to have it. And you should know, Fridays, I'm out by about 3 o'clock anyway.

So you're just asking us to make it a handicapped spot, like the ramp and stuff? Who's paying for that?
No, we'll take care of all that. We just need a spot.

Good afternoon, everybody. My name is Gene Lee. I live at 524 South Main Street. I talked to Erin earlier this year about paving our road, or lane, or whatever you want to call it. Because in our subdivision, they paving all the courts, all the lanes, and everything. It looks fabulous. I live in a remote village, block 40. And I talked to Aaron, and he said it's not on his list to do, but he thinks he might be able to get to it this year. But I checked with him just a week ago, and he said that I need a town council, since I live on a private lane, and that he cannot pay the accrual from the town council. If you turn to page two on this handout, there's a, where it says private there, that's what the world I'm talking about. And I have a original owner, I'm the original owner of this subdivision. And I just don't get it, why is it private? And when I talked to Aaron, I said, it's private, who owns it? And I don't remember what exactly he said, but who's the owner? You know, I'm just, I'm lost. I never, when I moved there, I bought this lot, I saw the paved road, I just assumed it was part of the street, and owned by the town, and owned by the subdivision and developer there that It would be taken care of, but everything else has been taken care of now in my subdivision except for this road. And I'm here asking the town council for permission to let Aaron pave that road.
I'm looking for that agreement. Yeah. There was a 1999 agreement for
I think whoever lived up there then and the snow removal owner. So that's what we have. I mean, and I'll be honest, I went and looked at the street. It's paved. Why are you wanting it paved?
It's paved now, but it needs to be resurfaced. That's what it needs to be done because it's cracking and it's sinking and It's not level to our driveways anymore. We all have four driveways that connect to this, and it's sunk down to the point where when they plow our street there, it hits my driveway and breaks the concrete. And I've been temporarily putting patches on there, trying to keep it up, but it keeps sinking, and it overlanes the resurface like the rest of the roads in Roanoke Village.
So I think to explain kind of where Erin is, or what the situation is, is we have, it's the MBH fund. So basically we're given, she'll give me pay and get back, a certain amount of money based upon how many lane miles we have and how many count. That is considered a private road. And so for last year's road asset management plan that has to be submitted to NDOT and LTAP, that road isn't on there because it's a private road based on previous owners when they came in, and purchased that property or built. It was made private. I don't know the history of why, but that's what it was done. Because it wasn't tech, it's part of the development in a sense, but back then it was very different how they set it up. So in order for us to get funding for that road segment, it would need to be considered part of our road asset management plan. And in that point, we would actually be generating money or getting money back for that. Right now, we aren't getting money for that segment.
How was it determined it was private to begin with? That's what I don't understand.
That was before my time.
Yeah, we don't know. John Stokely, former council member, when this happened, I've been in contact with DCD and everybody. I had them pull the original plaque. For the life of me, I remember this issue coming up, but I cannot remember exactly what it was. I asked Bob Rose. He was on the council as well. but yeah we pulled the minutes from uh the zoning board or whatever that was and uh there was nothing mentioned in there now i don't believe on the plaque that that is even marked and bob this triggers something it almost seems like the developer carlin samson had this piece of ground and shoved a street in it and I'm shooting from the hip here, but there was only one home built there. I don't know if that had any influence as to why it isn't a street, but with all that being said, we had an oversight on our part, and I can easily say it was the developer's part. There's nothing on any record that shows anybody responsible for that particular ground.
We have, and I think get you a copy of this, but it's short. I can just read it to you. It's dated January 6, 1999, signed by Dick Smart and Tom Ayers, who is the property manager of 5617 South Roanoke. And it says, whereas this agreement is between the Roanoke Town Council and the owner of the private drive south of Hillside Avenue, the agreement states the Roanoke Town Council has agreed to provide snow removal services only, which is online, to this stated private drive, and the quotation is With the understanding that the town of Verona will not be held liable for damages of any kind while providing this service, there's also the understanding that this service is for the main drive and does not include the individual driveways to the homes. This agreement is meant to provide the homeowners access from the end of their driveways to South Main Street only. With this, Dick Smier, signed, Tom Amers.
Well, I would say that that agreement was between the town and the developer. And it's similar to the retention ponds that they put around town. All of a sudden, who's going to maintain these? We always want to have the developer you maintain because you're required to do so. So that's kind of where I'm looking at. But even with all that being said, is the town open to putting its 222 feet by 15, that section, on the street roster. And there's another street very similar to it, which is Warren Street off of 8th. It's in bad shape. It needs paid. And again, I would throw that street the same as Warren Street. I've got it wrote down on here what these folks have paid taxes for and stuff. So I don't know. We're not getting any revenue off that property because they're not paying the taxes. So I don't know. But again, I'm thinking that agreement would have been, wouldn't you agree that would have been between the town and Carlene? Yeah. And we had a lot of issues with that developer. So I don't know.
Go ahead. I would say if we have to probably get it out as a plan and figure out how to turn it into a regular street.
At this point, I think we're open, but take it under advisement to figure out how to navigate it.
Well, I'm going to do some digging on that. I don't know. If we don't know who owns it, it's going to be hard for anybody.

So I don't know. We have to pursue a quick claim deed or something from her estate.
So there are four properties there now, but none of those four...
It's like going out to the country and a farmer subdivides and puts four plots on for his family, and they have a private road, access road, and then they have easements to all the properties. That's private, not public. That's basically what they did there, from what I can tell.
I think they ended up building a house at the very back of the lot, which would have been this John's, and then Gina's. It was the last one.
It was the last one there.
But I think, you know, the first home got built, they had to have access to it. And that's where...
But that's like any property. It's a private access road. It's a private driveway.
I don't consider that a private driveway, no. You may not, but legally it is.
But what I'm saying is, when it was done, based on what's been presented and what we can find, it was a private road just like you would... anyone else created and subdivided off their property, and they give access to the other homeowners that are buying their land to build, and it's all private.
Out of sight, out of mind. She's dead. Nobody addressed the issue after she died. It's the only street in town that is private. I have to interrupt you, but I drove down today. Alleys are paved. All this stuff is paved. They're paying taxes.
remember the homeowner association and i don't know why they still don't know why when i bought the lot it's never told me this was a private land here's a broad map road road and our our road up here and it even shows this is a woman houses and a lot of numbers and everything but no one informed us of the private length that we happen to deal with this They are.
And that's where I was coming from. I'm sure nobody told any of them that it was a private drive. They saw it. They built it.
I don't know. And like Tanisha said, we're not against figuring this out. We just can't say right now how to figure it out. OK. Take a little digging. We'll work on it and dig and see what we have to do.

Darling Ross, 239 South Wayne Street. I want to give a little feedback, I think, to define after last council meeting. And this is my perspective, so you can take it for what it is, but I found your approach to Brianna and Rob Flowers' tree issue that night unprofessional and without any consideration. And I say that because I know she talked to you, Mandy, and you told her you would put it on the agenda. You did. You put it on the agenda at the very end. Brianna was ill that night, which is not your problem. But I think where your lack of consideration and professionalism came in is you didn't provide her with that document ahead of the meeting.
you could have we didn't have to vote on it that evening i had given her the order we were advised by the attorney to present that document to the homeowner but i told her she could take it review it she could make a decision that night we were on our advisement of our attorney thank you personally i thank you for your comments i don't agree with them but that's that's fine but i'm just saying you could have ahead of the meeting so that she wasn't exactly blindsided by
You could have emailed it to her. You could have dropped it off at her house.

That is the same ordinance. We obtained that ordinance for multiple communities in the state of Indiana. That is not bold. I can send you documentation. Mike Hartberg is our town attorney.

I get the sidewalk ordinance, but not the trees. I'm looking at Donnie Mendenhall's tree across the street. He would never be able to afford to do anything. You guys would penalize him to death if something needed to happen to that tree.
And you say that ours is stricter than Huntington's, and I can tell you that Fisher's in Indiana is stricter than ours.
Well, Fisher's is even bigger, so. That wasn't part of your criteria, nobody made a statement. It wasn't. Are you passing this tonight or just? Well, we don't know until we vote. Well, how about you offer it out on social media so that other property owners who have trees like the dining in the halls or Brian Deardorff or whoever else in this town has trees in the tree lawn, so they know what they are going to be expected to take care of. This is like ambushing somebody. Yes, they could come to the meeting, but the only time they can speak to it is
not say what to put in the ordinance, but she wanted an ordinance passed sooner rather than later. So now here we are doing what she asked and you're going to complain about that too.
No, I'm complaining about the content of it. Brianna, it doesn't matter to her now because she doesn't have a tree. But she was, she was doing it for the benefit, hoping for the benefit of others. And this, I guarantee you, was not the ordinance that she thought would come out of that. So. So my objection is to right-of-way.
I want us to find right-of-way, because if you take the board, you're adding on to the private citizens the town's trees and the maintenance of town trees, because that's the way it reads.
So is it the town's lawn that you're going to mow as well? No. then what's the difference what's the difference what's the difference what's the difference we're going to talk about trees if the trees on this real estate and the town is responsible for the tree wouldn't the town then be responsible for the lawn as well no just ask how is that different how is that different it's the same thing Because in my stance is, where do you draw the line on who's responsible for what?
If I put a tree in my tree lawn, we obviously, the town took our tree, did a great job, at no expense to us.
But to the expense of all the other residents of the community.
True. Right? Right. If I put another tree there, I would be responsible for that. Huntington has done that recently.
So you're going to put like a placard on that tree then and say, I planted this tree, so I'm responsible? Because where does that? I think I wouldn't be permitted to come to you guys and say, hey, my tree is here. That's where I'm getting at. Who becomes responsible at what point? OK, you sell the home. Does that transfer to the homeowner that they're now responsible for that tree? Yes. then where does that line get drawn? Because now, look, I put the responsibility on the tree, now the homeowner needs to be responsible for the mowing, but all the other areas are mowed by the town. Where does that delineation of the line cross?
100 years ago, when some of these trees were planted, the homeowner didn't plant them, the town planted them. So doesn't that make it a town tree? It's not planted in the land in the property owners on the other side of the sidewalk. It's planted.
And that is why we're trying to look at an ordinance to establish who is responsible for what. Okay. That way we have clear lines drawn on who is responsible for what.
Then I would suggest that it's tonight that it's obviously being talked about, but it's not being shared. So you have a whole community of individuals who have trees out in front, in the tree lawn of their property. And they are not going to know when that tree goes down or dead branches fall from it or need to be cut. They will have no idea that the town is going to come after them to take care of it.
Most people who have a good realtor know that they're responsible for the sidewalk entry.
This isn't about a realtor. This is about understanding. It's about understanding.
It's about responsibility and how to establish them on the spot. But I think we've hit the three minute mark.

The sidewalk got put in, so that area needs paid. So I'm asking you guys whether you want me to try to solicit multiple quotes, or if I can just try to send it to you.
That one might be cheaper.
I want to try to get it done before, because that's what you talked about when the bridge came out and the hole was there and all that.
Is there a price point you think would be reasonable?
Unknown? Unknown. I wouldn't say. I'm just trying to think, because having some alleys done, I'm just trying to think. It'd probably be around $2,000.
What's the, is it just that curb section? It's just the curb section.
And then everything that's cracked, and that's the current mistake. I talked to Jeff this morning. I talked to him a couple weeks ago. I finally got all the permits through. He hoped he could get it done. He said he could get it done before September, probably this morning. Some rain that's in the forecast, you don't want to know if that'll happen. So if that's the case, we'll have to push the pinball court after the fall festival. If that happens, is it all right? I'll reach out and get somebody to pick it since our next meeting will be right before the fall festival. And I can send you guys the quotes. I go higher and say 5,000.
I'll make a motion to pass it not to exceed for Aaron to pave the area down where the bridge was removed, not to exceed 5,000.

We went to the township. Terry you can speak however you want to do it and they were willing to or able sorry to give eleven thousand six hundred towards the tools so with the money we got from the insurance which we have that already they sent us the check for it they were gracious enough to not charge us the deductible since it's our first claim so that's that coming in and I mean if you guys can match what the township did that puts us you know um you know really close to what we were talking about anyway as far as the we did we'd have to give an extra twelve hundred dollars but we're willing to do that to make that work to be able to get the new tools so 16,000 I gave you the exact number it's All right, I just put, I don't remember. You're good. It's, let me see what that's at real quick here, I'm sorry. 16,585. And Sarah, we got 10,000 left in there.
in the LOWIT. So what would we do with it? There's a CUNE fire fund that had $5,900 and CUNE fire. I'd really not like to use all the LOWIT funds because of the police department. So if we could figure out... So the CUNE fire is at $5,900? So if those funds are used, then the fire truck will get paid off next year instead of the end of this year.
And then $5,000 of what, or whatever some of you guys want to do?
Because they are using a backup set of tools that are not reliable if things are wet, so it becomes kind of a safety issue. No, I don't know how to do it.
I'm just trying to figure out where the money is coming from. That's all. I'm going to make a motion to give the fire department $11,600 with $5,900 coming out of the fire fund and then $5,700 coming out of the lower fund. I'll second that. All those in favor say aye.

I'm carrying my old one. So, the Sheriff's Department has offered to sell us Allen's old firearms for $1,200.99. I got a quote from Kiesler, they're about the same as everybody else. If you add their firearm cost plus the site and the length of the firearm, it'd be $1,493.75, but it'll take 90 days to get here. We can have the guns from the Sheriff's Department tomorrow. How old are they?

There are things to update. The north water tower finally got power washed a couple weeks ago, which was nice. It's not so dry anymore. We have fluid testing on the wells and high service pumps. Our town is charming. We would like to keep that charm. And so it would be, to make sure I get this right, just kind of the commission to that people would come to, before they make any major building changes, that could change the appearance of our town. Especially in the downtown district. In the downtown district, yeah, is the biggest part. So you did get from Brian today a template. It's kind of just like a, it's from, you know, Landmark. And it's kind of a- It's a boilerplate. Yeah, it's a boilerplate that other communities have used. Just it's kind of giving permission for us to go ahead- Keep moving forward. With this commission and keep moving forward.
And it's my understanding the commission doesn't have the authority to pass any zoning or anything right now. Anything that you would want to present would come back to town council.

So that we can actually, if there's, it's kind of the VCA, if there's an issue, they meet, they discuss it, And then what would be like a zoning, in a sense, board, whatever you want to call it, to you, a discussion of developer X wants to do this, this is our advisement, and then you guys make the final decision. Try to find a win-win, but not just get steamrolled either.
