under God, indivisible, with liberty and justice for all. Call to order the meeting of the Toronto Town Council. Uh March 3rd, 2026 Town Council meeting minutes. Are there any changes or questions for Sarah? I'll make a motion to accept March 3rd, 2026 Town Council meeting minutes as written. Second. All those in favor say I. I. All oppose. Next, um from the Department of Community Development, Hey guys, it's been a while.
Um, what I'm here for today is to have you consider a moratorum on data centers, battery battery energy storage systems, and carbon sequestration. Right now, our ordinance doesn't have any specific design standards for that type of project. Um, so right now, if somebody were to apply for something, we wouldn't have anything in place. we would require them to get a variance of use but then put the pressure on the BCA to come up with conditions for design standards. So um the moratorum puts a hold on it basically a pause until ice miller can get a new ordinance drafted and we suspect sometime within the year we'll have an ordinance similar to what we did with the solar.
Yep. Same concept. Yep. So I'm happy to answer any questions you might have. Um, I think it was an eight nine to one vote at the Rena Plan Commission in favor. Right. Any questions? All right. Um, I'm going to go ahead and make a motion to pass ordinance 202601, the moratorium on data centers, BESS, and carbon. Second. All those in favor say I. I. All opposed.
Okay. Thank you. Have a sign on the in favor side. both. I'll leave one for Sarah. You go into the Dominican
No. Thank you. I'll take this. All right. Thank you. Thank you, Cam. All right. Citizens comments. Yeah, I'll let you. Do I have to give you my name? Yes, please. and your adults too. Like a cow uh with the neighbors in that disaster with the town's tree. What's the plan that we
um well the first of all the residents will have to come and discuss it with us. Um but it's on the easement and it's their property and they're responsible for that. So, and I thought that was town property. Correct me if No, it's on the easement and now you're it's just like when you mow your grass, you have to mow on the other side of the sidewalk. That is your the homeowner's responsibility. Well, you know, the town removed a tree that was sick that was on the east in front of my place. It didn't cost me anything. They also trim Oh, yeah. They also trimmed that tree. Yeah, that did nice job. It's no complaint, but I'm going 80 ft down the street and that's theirs to take care of.
I mean, that's just how law the law works. It's on the easement. It's the homeowner's responsibility. Now, if they want to come and talk to the town and make and we can work something out, that's one thing, but it's it's it's not town property. That's on the homeowner. That's the home. 54t wide. Town Street is in town street is 54t wide. That's town property. The only street in town that's not 54t wide is vine. It's 44 feet street wide. I don't understand that. Is there some ordinance that says that if it's on the town's property and it's a town's tree, it is the homeowner's responsibility.
Is it is it the town's responsibility to shovel your sidewalk? Because that's not We're not talking about sidewalk. But it's the same sidewalk. It's not in the town. The town starts on the outside. If I'm looking up the street, I got a curb. I've got grass. I've got sidewalk. But the sidewalk belongs to the It's part of that easement because your property will end at the beginning of that sidewalk. It is. I didn't know what sidewalk was. Show us in writing. What? Find it in writing. Yeah. I want to see what that writing. I'd like to see that. We'll find that. We'll get that information. But that's not a town ordinance. That's I That's pretty much I think that's state, isn't it? Yeah. when this happened. I had had Googled that just to see kind of a cursory investigation into it.
