Um and you'll So that was for the site or excuse me, the the subdiv was for the reszone. It wasn't for the general plan because that's not relative. So you'll see that on um reszones uh site plans mostly. So, we're not we haven't changed it. It's just still happening. Councelor Steph, I think what you're maybe referring to is it was almost like a routing sheet, right?
And and you just initial that you you had seen it. Um, you know, because you could see everybody's handwriting. And I've not seen that. That might be the the executive summary. I've seen that that has people's signatures. But what Mike did was just an email. I haven't seen it since I've been on the council. I've only It's been a long time. Okay. I'll
I was just thinking, you know, like with this one, you know, Sean was sitting there with his face down the whole time and I'm just like, you said if people flush the toilets up there that our sewer system can't handle it and I I mean, is it still true or is it not true? Did we fix it? Did we do a camera and go, "Oh, yeah, no, that's resolved." Or But he's never said no. So any development in that area I think of what he said back then you know he still has those same concerns that's in your packet um water and sewer.
Yeah it did give a little bit of comfort. I know it was and there was just more space to it and you were kind of like okay this is the fire chief's got thing you know and they're like hey no concerns I can get my truck through there you know and the police are like no we have no concerns. It was mostly no concerns, but it still just made us feel like, okay, Larry used to put sorry, but anyway, Larry Hansen used to give a little brief synopsis in typically in handwriting. Yes, he did it too. He did the uh um routing sheet with handwritten scribbles, comments. So, I'm familiar with a routing sheet and what it's intended to do. I just haven't seen one here. So, we can implement that if Steve is okay with that. Um, but I don't think my packets are are lacking information. I But I mean, I I figured it out, but I I did like what what he's talking about because then you could just

I I just it really helped to know because like with this particular unit application, you know, I was talking to each one of these guys at various things. I can't remember where I ran into Chief Hennessy, but I said, "What are you thinking about this Riverwell thing?" And he was like, "It's a joke. I mean, it's they have they have nothing to fight. Ogden's going to have to fight it, honestly. So, it just just stuff like that. And I think if when we go through and and we don't have, you know, your your comment just bothers me to no end when we have all this discussion and and they come in with a site plan and they're talking about the fence and all the things that we're going to do and they say, "Well, it wasn't in the motion." Are you freaking kidding me? So, it's like That's that's crazy because it's the site plan that was put to us. And if I made the motion, that's that's one of the reasons I say as stated within the packet because that's a broad um motion.
I like as stated within the packet. And if they change anything that wasn't in the packet, because that's I don't know if I made that motion, but if they they stated a fence in the packet, and it wasn't a three-foot fence. It was the same thing Bart's talking about. That was a six-foot rod iron thing that people just couldn't jump over because it was it was to protect the police because we didn't want people parking along the street right there and just hop in the fence to go over to their thing. They don't even need to hop a fence now. They just park on the street right in front of their house and walk up. Yeah.
Yeah. And I looked because I I was thinking there was a fence there too based on some conversations I was having. And all the approved documents that Mike uh left for me had no fence in the site plan. So they're they're building the approved site plan. Now they have all that extra parking and everything that they're not done with it, but yes. Oh well. Mhm. They're not done with the parking, right? There's one in in the in the structures. There's one parking space. all the uh
most of the parking was outside of the interior. It was kind of stuck on that weird parcel. So, they're not done with that. Um I haven't done the final. So, I do a walk through on the landscaping and the site plan. Uh they're actually changing the site plan from where they have that interior area, the common area. It's kind of small, but they're putting a tot there or they want to. So, we're working through that. Um but, uh yeah, we do a we do a thorough final inspection. We count all the plants. We make sure it's um consistent with the landscape plan. We look at the parking. Jeff does all the building plan review or building inspections. And so yeah, we're we're right on the same page. We want them to build exactly what was approved.
And did they make any agreements with the commercial properties to the north of them about weekend and night parking? Um not that I know of. They purchased that extra piece for the guest parking that was required. So they own that, but I don't know of any agreement that was It was part of just the discussion that we'd had. Wasn't in the motion now. So, it probably wasn't. I believe it's fenced now. Yeah. I think it might be fenced off all the way across now. I I Yeah, it's got the little white Yeah. When we were over there, it wasn't closed off when I went over the other day. Yeah. They put a picket fence or a rail fence and then there's a sixoot fence that covers that building on the other side.
Is there still cross access from the commercial side? Oh, there is. Yeah, I don't know of a recorded document, but I can find out if that was part of the motion. Okay, cool. Any other comments from the city council? Councelor Anderson, sorry.
I don't know procedural whether this is the place to bring it up, but I had a a citizen reach out to me and said that they're uh having a rat problem. Now I question him if it was a rat or a muskrat because I danced with a muskrat a few years ago out in the street and it charged at me and I dispatched it. But um he's saying that some of the neighbors have traps out and so do I report that to Steve and have them look into it and give the information to follow up? Yeah. Yeah.
I mean it could be depend on what it is. Could be code enforcement, could be we've had to trap animals before. So, yeah, it's it's um Kim, right? Kim, what's u who's animal control? Who's under and they they can give a trap, but it's it is it in our neighborhood. No, it's not in our neighborhood. Charlie Tate over um Oh, that's a weird place. Yeah. He was thinking maybe that it was the drainage ditch on Parker was, you know, the culprit as to where those are being. Hey, I because two two things
in our area we have feral cats and the other is um we have raccoons that will actually use the water drainage. I've watched them in my culde-sac come out of a and I trapped them. Um but anyway, it's and it's really um they're on their own the homeowner, but they can get traps from Kim. Okay. And that's a great way to address it. Yeah. What's that? They're raccoon traps. So, they won't they wouldn't work for rats. They may not work, but we can look into it. We can look into it. Okay.
And then just one thing I would say to all you guys too is every now and again you do get people that will have uh concerns and different things and some of those things it's awkward for you to maybe get involved in. So if it's a police matter, you can just refer them directly to the police and then sometimes that removes you guys from the equation because sometimes what they want may not align with what we're able to do at certain times. And so sometimes it's easier just to say, "Hey, let me refer you to the police and then we'll take our action and then for some reason if that doesn't align, we can discuss it later." But a lot of times it's best just to refer it directly to whatever department it may be, whether it's snow issue. You know, Sean Douglas, here it is. Sometimes it's good to help and get involved, but a lot of times it's good to remove yourself and just refer it to the department head to handle it. So, that's just my suggestion, but it's up to you guys how you handle it.

Um, in reading title 10 today, it said in our design reviews that we're supposed to have somebody that either the mayor or not the mayor or a designate and the chairman of the planning commission or designate. Do we have do we do that as all design review are supposed to be recorded and published? They are recorded and we have minutes. We don't know where to publish them. It says they're supposed to be published because maybe the state website I guess or I don't know like the meeting noticed or not the meeting notice
from my understanding of reading it. It's so there's supposed to be you, Steve, as as the attorney, the mayor or his design, the the planning commission chair or his design, the public works director in all design reviews, and then Michelle and the uh deputy public works director are supposed to be alternates in order to have a quorum. But anything supposed to be any design review is supposed to be recorded with minutes and published. It is recorded to have minutes. I just they're not a body. So yeah, a government body has to be it's it's just wrong in our code because I mean I I read it again. I mean I'm
I can send I read the whole thing today. So I mean it's not We'll take a look at it. Yeah. But yeah, we've been following that. We have a full committee that meets on that. Like reading a book on blackjack and then you shuffle the cards and you're all screwed up. Okay. Any other comments? Comments from the city staff?
Yes. Um when I'm telling you I'm the bearer of bad news. Um so it's kind of a long story, but uh you've seen some some of our remodel here. It's mainly paint and some stain. We wanted to kind of touch up this building's um it's just falling apart. If you saw the email I sent you, we we've had two of those big windows just blow out recently, blow inward. Um then while they're trying to fix that, they broke one of them. They just came back today, in fact, and fixed that. Some of the trim along the front of that building's dropped down. We've had numerous leaks and that's kind of what got this whole thing started. So we were we had a big one right there in that little foyer as you walk in. And so we had passed it together and everything. Um, and as we were talking there with Sean and Cody that day, you know, we were thinking this, you get looking around and even in this room, you can see a lot of the watermarks and things like that. We've just never put any money and time into this building. It's getting old. It's just falling apart is what it is. So anyways, we were talking about that. We um did that uh the roofing project a little bit ago and there was a little bit extra money in the budget. So, we said, "Well, let's let's look at painting this and kind of sprucing this up so it looked a lot better." So, that's where we got started with it. So, they had initially told us they'd come in this weekend where we had the 3-day weekend and get that thing done. We plan on it's just the two lobbies uh knocking some paint out and and looking at uh staining that wood a little bit different color. If you'll notice that all the doors, they're just beat up. The bottoms of them there's chips and everything. It just looks bad. And this is the the main two areas that the public comes in and sees us the most from is those two lobbies right there. So anyway, um the wallpaper was had gotten ruined during co um there's just so many things going wrong with it up there. So anyway, we had this group come in and then yesterday and again it's just one of those things I want you to be aware of so you I don't want you hearing it from somewhere else.
Michelle, do you have those pictures there? So, Friday, these guys came in and they used a stripper initially on that uh wood to get some of that varnish off so it stains better. And the smell in here was horrible and I was nervous about it then. It was so strong. Um, and then yesterday I get a call from Mr. Carden and he informs me that our building had caught on fire. And so I'm in full panic mode and come running into Ogden. And that's where I was wondering if I was even going to be able to hold this meeting. But uh do you have those pulled up, Michelle?
I was just going to show you um what what we had here just so you didn't hear from somebody else. Everything's turned out fine, but for the moment it was kind of a full panic mode, all hands on deck kind of thing. So, but I did want to show you we have a video and um uh some pictures there too that we can show you on this thing. This is going to shock you. So, this is them. Now, if you you all got see the guy that's kind of bent over. The lady told me that this has never happened in 36 years. For some reason, um, he was using steel wool to take that off and it it jumped from there's a there's an electrical outlet right there and it the the electricity jumped and watch what happens here. Now, I told Matt I was a little disappointed. He just didn't look at that.
Oh my gosh. This is right up in our lobby here. It gets worse. Now, watch how this thing takes off. Oh, look at that. And they'd taken down all the fire extinguishers to put No, luckily we had one over by the bathroom. That guy that just went over there to the left, he went and grabbed it right there. And that's what saved us. Now, watch the girl in the stairwell coming up the stairs. They just they just drench her. We look at her. She comes walking out of the mist in the fog there. You know, he's burning right. Yeah. Look, he's still on fire. He doesn't know it. Oh jeez. Holy cow. So anyway, we almost got a new building for you yesterday. Didn't quite happen. And I told Matt you guys responded too too soon.
Our insurance paid up.
Yes. Thank goodness. Here's the scary thing about that is our fire department, if we ran this video, you'll see them eventually get there. Our alarm didn't call us in. So it was a good training. We don't know why. Um but that should have immediately gone to dispatch and gone to our fire department. They got a separate call when they got here, but they were here before dispatch reach out reached out to them. So, that's a little scary. That thing could have gotten way dangerous really fast. So, needless to say, they had to do a lot more sanding than what they were planning on there. Um, but I didn't want you to hear that one from somebody else either that we caught your build your building on fire. But, I don't know if you guys have any input on that. Um, we were looking at going with a darker stain rather than that uh blonde oak. You don't see that anymore. That stuff's as old as Cody. All that stuff up there. The only thing that's was more recent was the wallpaper. But we we Some of that was just flat out ruined. We had to take it all down. So, um right now we're looking at a darker stain rather than that light one. If you could really care less, we'll just handle it. But I do have a sample upstairs if you want to look at. She did one post right there at the top of the stairs just to show us what the darker wood would look like. And then next year as part of the budget, we'd probably look at maybe doing this down here too if you want that a different color rather than this light one like that. But anyway, just wanted to let you know that uh we had a fire here yesterday. So
So I've recently had this conversation with my wife and and she's like, "Hey, I want to change this." I'm like, "Why why are we doing this? We don't like blonde. We're going dark." I mean, that's that's it's ridiculous that we're even doing this. Golden Maples out. Come on now. Hey, come on. Yeah. Dark is so 70s. Yeah. So 70s. It is. It is pretty old stuff. This is When were you born? The 80s probably, right? This building was built in 85. And you were born before that. It's not as old as he is. 84 years. It's a it's a year newer than him. But
like I said, we there's there's some things we got to put into this thing cuz it's just it's just getting old. That's all there is to it. Um fortunately Sean and those guys um were able to find those leaks. We've been following those for a while. That's just been causing all kinds of damage. But um it's all holding up now. We think we've got that worked out. Demo for us. Sean's got all the rem the popcorn ceiling and the popcorn walls. Is that asbistus? No, no, it's new enough now that we wouldn't have to run into that, but we got some modular units that aren't being used over at Riverdale Elementary. Yeah. Anyway, that's all I had. I thought you'd get a kick out of that seeing that. Yeah, that was interesting.
Hey, maybe there's some empty units at the senior housing that we could shift offices to.
Um, okay. I uh just real quick, I I shared this in department heads, but we had some vandalism uh down in uh Council Richtor's neighborhood uh last week, last Sunday morning. Someone had been uh bashing in on the vinyl fences, kind of doing the Kool-Aid Man challenge, running through them, and uh I got a message on Facebook early in this morning and someone wanted me to address it and and uh I was like, "Yeah, yeah, no problem." You know, and he was sending me pictures and I was trying to figure out where it was at. And I got dressed and and drove out there and police were already there. Officer Farnsworth already had it well under control and was documenting each each incident of it. And it looks like most of the houses are already fixed. So, uh, anyway, they're just the the Rudolph police are just absolutely incredible. And, uh, it's so nice for me to be able to be like, "Hey, yeah, the police, you know what I mean? The police are already there." Like I was like, "Let me handle it. Let me let me see what I can go find out." And then I just got back and said, "The police are there. They're taking care of it." And they'll do their best to solve it, you know? So, anyway, thank you, Chief. Like, make my job easy. All of our jobs. So, uh, and I don't have anything else. Let the record show that all members of the RDA board are present and also members of the city staff are here today. Um let's see. I can't get my agenda to pull up here. It's saying an error. I don't know what's going on. But anyway, uh we will just Yeah.
All right. Uh public comment. Seeing no members of the public, we'll move on to uh there's no presentation reports. We do have consent items. Consideration to approve the meeting minutes from our September 16th uh 2025 RDA board meeting and work session. Any changes or corrections to those minutes? Seeing none, we need a motion to approve. All right. Any opposed? Okay. Those minutes are approved. Uh action items. Number one, discussion and action regarding the Ballard RDA loan repayment appeal. Oh, yes. Okay. Uh Mr. Brooks, you going to take this?
Yeah, I will. Um I'm I put it in my executive summary there. So, when we give out these loans, if you'll you'll see the contract. This is actually the last page of her contract, it states that if they no longer live there, they have to pay the loan back. So, we called that due. We've had this happen every couple years. One of these will come up. Um, and she wanted to file an appeal. We we have no process to deal with that. And so, I thought that's not really something I can do. I mean, we already denied it once. So, without some direction by the board, I just felt like I was kind of stuck. Normally cities would have an appeal process or some way they could jump through some hoops. Um I I that's just where I'm at. I mean I'm stuck with the language of that contract. I think they're in violation and therefore they'd need to pay it back. Hers is a little bit different because in the past these people move away or they do whatever. And so I think the intent of that language is that somebody shouldn't be making money off of our money kind of thing. So that's why it's in there. And I still feel that way. But this one's a little bit different in the sense that um they just went away for school. I think he's in PA school or something. He's coming back in a year or two and they they're renting their house, but they're not selling it because they intend to come back. So, I didn't know if that was something you guys wanted to consider, but it's really not something I can do the way it's currently standing. I don't really feel like I have the authority. We just followed what we we did. So, um if if you want to do something, we'd need to do something in place or just leave it as is. So, is it
board member Stevens? Thank you. Yeah, Mr. President. Uh, chair. Chair. Okay. So, is is he not wanting to make payments while he's while he's not done? Well, they're making the payments. They They didn't do that. They just the loan would be called in. Yeah. They just It's a violation of the loan agreement. Sold the property. No. And if he did, they would all come do anything. Right. Right. If he did, I wouldn't even be bringing it to you. We' just say, "No, it's there. We're not doing that. This is a little bit different. But because he's making payments, um, is there a Well, because he's gathering rent, could you include a feature that says that accelerates the payments?
Well, that's kind of what the contract doesn't let him do is to gather rent because then they are using our money to make money kind of thing. So, it's probably why that language was originally originally put in there. And this is the contract we have in place now. I mean, we'd have to draft up a new contract if we were going to put something different in that doesn't apply.
I think everything we do, we have an appeals process. And I think to have them come before the board and appeal it and then we look at the contract and I mean, we adjudicate it with the board. It's just what we do on the council. Someone wants has a problem with their utility bill and they say, "Hey, I didn't know it was leaking and I owe $500." and they can come into the council and we can knock it down. But same thing, they could come into the board and appeal it. That's what she intended on doing. That's why she asked for this.
I think that would be great. I mean, we could say no. The language of the contract says this and no or yes. I mean, and then if we say yes, we can modify the contract to allow this type of thing or whatever. But I I think having the appeals process just come before the board. But I'm fine with that. But I mean, this is what she's going to bring in right there. So, yeah. What? I'm sorry. Okay. What What uh what clued you off that they weren't dosiled there? Um and I can't remember what happened. If you got a mechanism in place to know who who's there, probably an ex-wife
usually. Yeah. No, because they're still married and and they both just moved away to school. I don't remember if they mailed in a payment and it came from a different address or something and Stacy followed up on it or something like that. That one good job. They're just doing their job, you know. I don't remember for sure. I I found out about it through Stacy. So, she came and asked me what I thought and I said, "Well, by the strict interpretation of the language, it's it's a violation. We don't um the other people have actually ended up paying them off once we called them due. These people just didn't want to. You don't know what the balance is right now? Uh, we do. I just don't have it with me. A little over 12. Is that what it was?
A little over 12,000 then. Okay. So, where where are they at? What's where? I don't remember that one either, but it was out of state. I know that. Does the contract say when they sell the home or no longer live there? That covers it, too. Yeah, that both of them. What What does it say? I think it's missing a comma in the contract. It's what you know. Did you guys I I included that last page. It should be in your packet. That's what that's the contract. I highlighted the term I didn't go past ordinance. It's in there. It it seems like so what they want us to evaluate is the discontinue the residency whether that means right
is this a temporary discontinu permanent that's that's would be the basis. Barfield by tradition we've enforced that. If they're not there then then we do that. This one is different, but so it feels like we have a little bit of discretion there. If they came in and we could say, does this constitute a disc, do they discontinue residency? Have they suspended residency? Have they Right. And I guess that's where the attorneys would have to get involved. I mean, they technically are not there. So, uh, it would be a violation of the contract. But whether or not we want to be hardcore on it, I mean, if they're making the payments, maybe you wouldn't want to be. I don't know. That's up to you guys. Are we appealing it now? Are you coming to ask us now?
Well, this is this was what she submitted to me. So, I'm I mean, you could make a decision on it now. That's what we were. Says that action. Well, do we So, they're only gone for like a year or two. I think she said, was it two years, Brandon? Yeah. If it's PA, it's at least two. Is it not going to be paid off before they come back? Is there still going to be I doubt it. Most of those payments are pretty small. So, Yeah. What does what does discontinue residency mean? Like that's a good question. Like I I would like I mean I think you give them two years or give them if they're not there in a PA school or something. Proof that they're at school or something.
Yeah. We want to see his grades. I I would be interested in when they're coming back, right? So I mean 10 years. No. Um, I put a max time limit on it because I can think of other cases where someone might leave temporarily if it's a rental and they might already be, I don't know, 18 months into it. I don't know how far it could turn into how far into the program they are. I He's just started within the last six or eight months. So, he's still got a little bit left. Not a ton, but a little bit.
I' I'd reach out to him and find out their rental agreement and see if there's an ending date on that or something. and somebody rented it for two years or you know if the people living there or their family or something that it looks like it's a short-term thing or the rental agreement with the house here. Yeah. I I mean just a thought. I don't know. Sometimes too if uh depending on who they're renting it to, if it's a family member, I know in certain mortgage cases uh if it's a family member that they've worked with them on that,
I'll do whatever. I just didn't feel that I had the authority to do it. So I guess my last question is in your opinion, is there room here? In other words, I don't want to be arbitrary saying yes or no. If we say this discontinue the residency, is there any wiggle room that we could then define discontinue versus a temporary suspension or or are we grasping at straws here if we Well, I think that's the purpose of having an appeal board is you have some leeway in that. I mean, I look at that as an attorney and I say it's a violation, but you guys may look at it differently. You're the ones who are are authorizing these loans. So, well, go ahead.
We we would have to address this as part of the process to establish appeal board and their contract isn't under that right now unless we grandfathered them in. I mean, they're in violation of it right now unless we change something that we do. That's what I feel. I listed three things on there that we could do um as options if you wanted to go there, but um I think we we need to establish an appeal board or we don't have that in place. So, the only option I had was to come to you.
Okay. So, real quickly, um, not understanding entirely, does this, um, encumber the the like is this treated like a second on on the on the residence this the RDA loan? The lean it's so it doesn't we have a lean in place. Yeah. Okay. All right. And how long have How long has this loan been outstanding? Is it I mean, they're usually multiple years. It just depends. They're all different. So, this one, what have they been doing it? Two or three years? Five? I don't know. Been a while. Yeah. 2012 is when they entered into the contract. Okay. That's right. I did see that. Is it like a 30-year loan then or I don't know what that one is. Do you know? Was it 30?
They've been paying. We have those different for 13 years. Yeah.
So, what we need to decide is if we're going to do some sort of appeal process or amend our agreement or nothing. tell him that he is has accesses to large amounts of student loan money and that he should, you know, get No, I had a son-in-law who just graduated medical school and his classmates were banking as much as they could because when they go to do the residency that gives them the down payment um for a house during residency. Well, I guess I guess if you want me to work with her, we we can come up with some parameters and stuff that we can use and live by, but I just need to get you're okay with doing that.
I think what Annie said earlier today about the R4 is if we work with them, we open it to work with everybody, right?
And I I think we need to have an appeal board. She can write a letter if it's say he's in PA school, she can write a letter and say this is why this is who's living there and if they treat it with no respect to the process and she said because we're in PA school, we say no. And if they say, you know, my brother's living there for two years till we're we come back, then we we have some sort of something to say yes to. Well, maybe moving forward. I mean, the board might be interested in an exception for like a temporary because I would I think you could argue discontinued means permanent versus, you know, there might be two-year exceptions or something that besides just school that we would be willing to grant people depending on the circumstances. But,
and that's where I wish our contract said that, but it doesn't right now. And that's the dilemma we have. So, for sure. I mean, that's something to address in the future, but for the appeal board, it's it's a reasonable exception to hear. So, if you want to set up an appeal board, is that something you guys want to do, or do we want to hire somebody to do it? Some cities have administrative law judges that handle all that stuff. Why would you hire when we're free? According to this, it says that they can assume the loan. So there is a I mean there's a feature there within the contract that says that they can assume the loan can be assumed. That's just in that first paragraph on the document.
