Yes, we create a romantic atmosphere here by turning off the light. After that, I prayed to lead us in faithfulness. So, thank you very much that you are all here. We thank you for your presence here with us tonight at the meeting of the City Council of Streetsboro on September 16, 2026. And we ask Council Member Riggins to speak this prayer at this time.

4:05 – 4:59Speaker 8

Father in heaven, thank you for this day, thank you for the guidance and direction. We are grateful for the opportunity to be together as city councilors. We are grateful for the mayor for everything he does to build this community. We are grateful for the citizens of this community. We are grateful for their love for this place and for everything they do to make it a great place. We are grateful for the freedoms we have and may the doubts be cleared. Protect these freedoms. and live our lives in such a way that others are blessed. We are once again grateful for this opportunity to be together here tonight. Pray that your Spirit may be with us, that our conversations of your Spirit may be guided and be guided. We pray in the name of Jesus Christ. Amen.

4:59Speaker 7

Amen. Thank you. Please rise now and repeat with me the solemn oath on the flag of our United States.

5:08 – 5:20Speaker 5

I swear allegiance to the flag of the United States of America and the Republic, for which it stands, a nation under God, indivisible, with freedom and justice for all.

5:24Speaker 7

Thank you all. This time we would like to continue with the call of our council members and we ask our city councilor Deborah to do this for us.

5:32Speaker 2

Council Member Riggins.

5:37Speaker 3

Ratsvorsitzender Eric Erickson, Ratsmitglied Heigen, Ratsmitglied Johnson, Ratsmitglied Colleen Erickson.

5:58 – 6:18Speaker 7

In order, point 3 of the agenda is an application for change of the agenda according to Idaho State Statute 742044B.6 . This is an application for change for the approval of the financial aid agreement with the Idaho Transportation Department . At this point in time, I hear an application for change of the agenda.

6:22 – 6:36Speaker 8

6:40Speaker 6

Ich werde unterstützen.

6:41 – 6:56Speaker 7

Unterstützt wird er von Ratsmitglied Colin Erickson. In Ordnung. Danke.

6:57Speaker 8

Also, Deborah, würden Sie das bitte tun?

7:02Speaker 2

Ratsmitglied Wiggins. Ratsvorsitzender Eriksson.

7:06Speaker 6

Ratsmitglied Tegern.

7:07Speaker 2

Ratsmitglied Johnson.

7:10Speaker 3

Ratsmitglied Erik. Erik, Entschuldigung. Colin Eriksson.

7:13 – 7:54Speaker 7

Ja. Genau. Danke.

And you can submit comments online. You can send us e-mails with comments, but we're not making any decisions tonight. It's just about everything possible. It's just about a discussion about it. So from the council level.

8:28Speaker 3

So if we want to submit public comments in this forum, when would we do that?

8:34 – 9:10Speaker 7

If yes, you can do that to us at any time by e-mail. We currently have no public forum planned to discuss this, but if the council wants to hold a public hearing on this at a later date, we can do that. So... You will not receive any public comments. Not this evening, no. Okay, um... Okay, has anyone registered online?

9:12Speaker 2

Normally, we don't have an audience discussion if we only have one presentation, because that's just one presentation. It's not a public hearing or anything like that. We will only have a presentation from our city lawyer to inform the council a little about IPRs. And when we decide to continue with this, we will hold a kind of public hearing at a later time. That's as far as we are this evening.

10:23Speaker 1

Why can't the public speak up against the vlog cameras?

10:27Speaker 7

I'm sorry, I can't hear you well.

10:42 – 10:56Speaker 1

My name is Kenneth Sellers and I live in 295 Liter A Lane, Rexburg. Why can't the public speak up against the vlog cameras? If we misuse them, why do we have to submit them online and can't discuss them publicly?

10:58 – 11:33Speaker 7

Because they can. Thank you for your comment. You can always tell us everything by e-mail, Mr. Gambelin. You can send e-mails to your council members. You can send me e-mails at any time. This is just a question of our council meeting. We have public hearings. And these are the times when we take public testimony to different points. And these must be on the agenda. And then there are times when we just have presentations, when we listen to information about our own construction and our own knowledge. And that's what's on the agenda tonight.

11:33 – 11:44Speaker 1

Okay, I don't want to argue about that, but I just say as a voter from Resrexburg, I should be able to discuss this publicly with you and don't have to submit it online.

11:46 – 12:02Speaker 7

12:52Speaker 5

Okay, danke.

12:53Speaker 7

In Ordnung. Ja.

13:07 – 15:58Speaker 5

My name is Troy. I am Troy and I live in the Central Park Apartments, 450 West 4th South. Troy, can you please say your last name? Seemann, Seemann. Okay, thanks. I've been living in Drexburg for about eight years. Central Park is a pretty pleasant place to live in. Everything is mostly okay, but only a few houses that are three or four times as big. Und ich denke auch, das ist vor allem wegen der College Kids hier im complex on the other side of the road, sometimes to the fire arms, there are three exits, two of which are blocked, one of the frontier pies and one of this running construction project. I just asked myself if that was the case. Since they called us a predetermined end date for the project, since they called us the start date on July 6th, it still looks like a trench out there. But the other point I just had was 450 West 4th South. I spoke to the house manager today. Um, not with the head of Redstone Residential, but with the current managing manager. Hey, it was just about the dog coat stains that are everywhere on the lawn in front of this section of Central Park. They said that their mayor is not responsible for it. They also said that they cannot recognize whether it is a resident or not and that strict standards apply for e-satire, which was not told to me. The manager said that their gardeners do that, but I have to walk this way to work every day because of all the chaos that is going on here. And I know exactly that they don't clean it up and or about it. Man. It would be nice to walk on clean grass on the way to work, but that's pretty much it for tonight. I hope the streets will be finished soon. Hopefully it will look like a rainbow street when they're finished. But that's all I have to say for tonight. Okay, thanks.

15:58 – 16:43Speaker 7

Yes, construction work is always impractical. We try to finish it as soon as possible, but yes, that's up to us. Thanks. The thing with the dogs, that's a matter of private property. Jawohl. Kommt.

16:50Speaker 5

My name is Jason Sellers.

16:51Speaker 1

I live behind L.A. Lane 295.

16:53Speaker 7

That was a nice excuse. L.A. Lane. L.A. Lane, okay.

16:59 – 17:14Speaker 1

When I first moved into this area, there were the Wendys and all the things on Moody Road, not yet. Or when they were built, traffic became a bit more chaotic. My concern lies in Winco and all the other things that are being built. Are there plans in the city to relieve traffic?

17:21Speaker 7

Leiter des öffentlichen Bauwesens Davidson. Haben Sie die Frage gehört?

17:26Speaker 5

These are improvements that we are considering at the intersection of Moody and Second East.

17:50 – 18:09Speaker 5

My question, my follow-up question to this is whether there will be a detour from Winco Park to Second Street? Or will everyone drive in via Moody Road? There is a access to Second East south of Moody Road.

18:12Speaker 7

Okay, danke. Ihnen. Danke.

18:52Speaker 8

Damit jetzt alles, was eine Durchsuchung ohne Durchsuchungsbefehl wäre.

19:03 – 19:33Speaker 7

There are always things here and there that we have to investigate. Thank you for paying attention to some of these points.

20:00 – 24:13Speaker 6

Please move your microphone a little closer to you. Okay. In addition, the GPS devices that can be attached to the golf cart can be finished in June. There are some resupplies. You said you should be ready for use by the end of September, October. That would be such a good thing. You can then control the golf cart and see where you are, check the game, accelerate it and keep it running like that. That's from the golf club. The school club I took part in. Just a few things from them. Them. The bus depot, the workshop, is out there in University Avenue. Done. The new district office is currently being completed in 12th West. You can see how the bar is full. You are ready for the foundation. And I just want to tell the city council a few good things. Hm. You reported that you have a junior high and I was happy to be there. They sent the junior high to New York to play at the Lincoln Center. They took 141,440 students and 141,141... parents and family members to New York to play in the Lincoln Center. I have to say, I was very restrained with my wife to act as the hostess, because I often had to do with children at school age. I sat there and thought to myself, bring her to New York, take care of her and bring her back to her parents' house. But I was amazed when they played in the Lincoln Center and the people They said they were middle school students. They were amazed by our student class in New York. That was very interesting. I wanted to show that as something positive, that our community in the entire United States and also in New York is playing there. And then a few other things I would like to address. Spencer has really done a good job to pass on the information to our police chief. They will clarify the public very well about it and try to clarify the parents and children so that in the end no one comes to life with it. It's crazy how fast these motorcycles are on our roads. The police chief said he will really push this forward next week, get in touch with the school and also try to discuss it with the security authorities. Only so that the council knows that Spencer and the chief of police will do that. Thank you very much, member Johnson.

24:15 – 24:33Speaker 2

Thank you, Mr. Mayor. I have a few things for parking and hiking this evening. Just a few news. The Pickleball places are finally ready for their big opening. That will be next week. When I spoke to John on Monday, he didn't know when yet. I don't know if anyone has heard when. Have you heard when? It will be next week at some point.

24:33Speaker 7

Yes, I don't know exactly.

24:36 – 24:55Speaker 2

So it's exciting that they're finally done.

24:56Speaker 7

Wir sollten hoffentlich nächste Woche in Asphaltierte fliegen.

24:59Speaker 2

Danke, das ist alles herzlich.

25:01Speaker 7

Okay, danke. Arztmitglied.

25:06 – 26:13Speaker 3

Hier ist also meine monatliche Bitte.

26:16Speaker 7

Vielen Dank, Ratsvorsitzende Eriksen.

26:19Speaker 6

In Ordnung, Ratsmitglied Rieken.

26:31 – 28:46Speaker 8

And today the decision was made to continue the proposal to the district so that the district sees it. And the process is moving forward. The property owners were contacted, they are contacted. So the process for the West Highway District is working. We also talked about the city center. And that also includes the property on which the, I don't know if you call it high school or junior high school or whatever, right? Whatever. Whatever, we call it Dry Sea North and First West, right? Opposite of Bolams, this property. In just two days there will be a new issuance to get offers for the purchase and construction of this property. The issuance will be issued in two days. In addition, we have approved the issuance for demolition of this building. We will therefore raise a few prices for what it will cost to demolish this building. And just to reassure everyone, everyone is really working together with the monument protection committee to preserve this old seminar building. But it will be part of the exposition.

28:48 – 29:02Speaker 7

Vielen Dank. Ich schätze Ihre Arbeit in diesen Ausschüssen sehr. Alles klar. Fahren wir nun mit unseren Mitarbeiterberichten fort. We start with our financial report, with our CFO, Mr. Matt Nielsen.

29:05 – 33:11Speaker 5

All right. Good evening. She will call up this report and ... I'll just show you real quick. It's okay. All right. For the Schatzmeister report, we are at 92% of the year. There is basically one more month left in the business year, right? And overall, when I looked at the report, we have spent about 64% to date. If you look at some of the major operating funds, such as general funds, we are at 92%. So we are pretty much at 92%. So we are pretty much where we would expect it to be. A few things I would like to mention, a few smaller funds that might go beyond that. There could be a very small subsidy for leisure programs that I saw there. We only spent a little too much on DARA, but they have the money for the fire protection fees. Will we lie a little over it, just because we took so long to complete the follow-up estimates? And then I would like to keep you up to date. So we are getting closer to the topic of roads. Hopefully we will conclude this in the next month. But we will meet with the committee for a follow-up assessment. And it will be the same people who have been dealing with it for the last few years. We have connected with them, so we will meet with them in October. Hopefully we can start presenting some things to the city council by November. And then it will of course take several months until this process is completed, because there are regulations and public hearings. And that's why I would really expect that the closing costs and all recommended changes will probably happen at the beginning of next calendar year. That's probably the best case scenario, I guess. And so we're going to close that up and then, uh, where is she now? Right here. And when I look at it like that, there are a few that are pretty big, but they are to be referred to, for example, that we had one that came from the prepayment for the bridge over the Teton River, which we had to pay in advance. And then I noticed something else when you look at the construction funds. I mean, of course we build a lot. Let's take the construction of the clearing system. We have invested over three million dollars there. Or excuse me, 4 million dollars this year. And then we have spent over 3.4 million dollars in this business year from the LED building materials and more is being paid for it. And then there is the large drain line that you are working on, which is supposed to lead to the new temple area. We have spent over 2.5 million dollars on that this year. So if we look at this report and then look at the raw materials and investments, then in my opinion the big story is that we are currently spending a lot of raw materials. And as I worked together with our controller, Scott, we had to convert some of our total investments into LGIP, which is basically how raw material is not true. We can buy that in less than a few days. And then we have, I sent an invoice so that you know. Hopefully, in the next three months, we will complete the new lifting system and the new heavy-duty line at which Teton, Schukka and Rexburg are involved. And with that, I have submitted my last application for payment of the 5 million dollar federal subsidy. We have to let you get a few more documents before we can get them. So we have to withdraw about 740,000 dollars from the federal government. And then I put Sugar and Teton's overall contributions into account, which amount to about $3.4 million. And hopefully we'll see that within 30 to 60 days. That will improve the cash flow. So far we are. Are there any questions about the financial reports? Do the council members have questions for Matt?

33:14Speaker 7

Okay, I don't see any. Thank you. I appreciate that. Okay, we will now hand over the word to our city attorney Spencer Amel, who will explain the IPR systems.

33:45 – 43:08Speaker 4

Mr. Mayor, members of the City Council, thank you. Before I start, I would like to clarify what this evening is about and what it is not about. This is just a teaching, teaching and informative point. The City Council does not have any measures in place. And the Council will not vote on measures in connection with sign readers or vlog cameras. For this reason, this is not a public hearing. And this is not a forum for a debate on this topic tonight. The members of this council have heard many concerns from the public. And as I know from conversations with members of the city council, they are interested in the thoughts of their voters of the city of Rexburg and would like to get information about where the city is. This is the purpose of this presentation, to give some information about what we have or will not have when it comes to ALRPs. As the mayor already said, there are various possibilities for the general public to express themselves to discuss these points with members of the city council. This is also not a point that is an action point. The debate is Therefore, a member of the city council can discuss these points freely with his voters and pass on these concerns to the employees and make recommendations after they have heard these things. I think I'll get to the point in a moment. The city of Rexburg has no vlog cameras from the city of Rexburg. We have no intention of signing a contract with Flock. And the city does not operate a passive tracking system. The state regulates LPRs. The Idaho Code Section 49-5032, approved in 2025, sets the rules for every city, every district and every state authority in Idaho that would use them. We stick to this law. If an authority imposes ALPRs for the prosecution, the data can only be used to investigate crimes or to investigate traffic accidents or to search for missing or endangered persons. The law also allows authorities to use the technology to investigate and control the traffic flow. It prohibits the use of ALPR data to prosecute routine traffic accidents that are not related to traffic accidents. and it prohibits the personal use of political activities and surveillance that are not in line with the legally allowed purposes. All authorities that use ALPRs must restrict access to authorized personnel, school their users, protocol every search and check these protocols twice a year. Abuse can lead to disciplinary measures, administrative penalties and, if necessary, criminal prosecution. In fact, I have made it very clear to our employees in the city of Rexburg, especially our department heads, that every contract or proposal that could implement the use of ARPR must first run through my office. Last year I was made aware of a problem in which the criminal prosecution authorities had to order a third person to supervise the parking space. Okay, I think it's time to discuss what the city as a municipality can control and what we can't legally control within the city of Rexburg. The right to privacy and the right to private property are also based on the same basis. Borders. And these are borders for the government. The protection that keeps the city out of its affairs is the same protection that keeps the city away from the property of its neighbors. Many of the data protection concerns that I have heard in relation to vlog cameras and other APR systems are based on the right to the private sphere, which convinces me that the government should not follow up where law-abiding people stop. This concern is justified. For this reason, the legislative body of the Federal State of Idaho has made strict restrictions on the use of this technology by government agencies. As the members of this council and the city staff know, I see myself as a city lawyer responsible for following the laws of the federal state. But the same principle that the government keeps out of its affairs also prevents it from intervening in private property and writing to a business owner, a house owner association or a neighbor which devices it is allowed to use legally. The city has the duty to maintain every single one of these rights, not only those that are comfortable or popular. The constitution protects certain rights, to photograph and record everything, what everyone can see from a public street and a number plate can be public or deliberately brought to the public. In fact, federal courts have lifted a law in Idaho that put certain registrations under penalty. So there is this balance between what we can control as a city and what we can't. What can we control as a city? In the city council we can control whether we use ALRPs If we decide to terminate these contracts, what regulations and control mechanisms will come into play? We can decide to stick to the law of the state of Idaho. When this topic was addressed in 2025, strict protocols and penalties were introduced for those who violated the law of the state of Idaho. What we cannot control, what is outside our range as a government, is to tell a private company that it is not allowed to use a security system. Now we can prevent these systems from being attached to our way of law or to our masks. Or that we contribute to a contract or use the data that they may provide. That's what we control. And that's why I still believe that the state has appropriate procedures. I would like to repeat once again what I started. The city of Rexburg has no flood cameras that are used or commissioned by the city of Rexburg and that are on our property. And we do not intend to terminate any of these contracts. If a department head gave me a proposal that would use these things, I would make it a priority to present it to the city council. And if this is a point of action, it should be carried out as a public hearing and the laws of Idaho to public hearings should be adhered to if this is necessary under these circumstances. I would like to answer all the questions that the city could have.

43:09Speaker 6

City members, City President Eriksson, Mr. Mayor, we have installed sign readers, right?

43:19Speaker 5

In the city. No vlog cameras, but we have sign readers.

43:25Speaker 4

When I spoke to the police chief, I said that we do not use any data that is controlled by the city of Rexburg.

43:35Speaker 5

So the city of Rexburg itself does not collect any data?

43:44 – 46:13Speaker 4

The only thing that recently came to our attention was an application for public registration. And the only thing that was available was a possibility of the city of Rexburg's security system that could possibly use an ALPR. You can do that. We have it, and it also applies here, that the technology is at a point where it can quickly develop. There is a difference. That's why I met with the police chief to talk about your surveillance cameras, your body cams and your father cameras. We have signed contracts with Exxon. Exxon offers a free service where you can use a fingerprint reader. None of our vehicles that are currently being used by the police use this system via Exxon. A follow-up question. Who has access to this camera from the city? From the city. Will that Controlled? That will happen. After I was appointed as a city attorney, I underwent a kind of legal examination and I went through our department manual. Mr. Mayor, please be aware of this. I thought about certain things and I put it into words. Mr. Mayor, I'm not trying to appropriate your authority or bury you. We had an older manual in which certain security cameras and certifications were determined, which were all given to the mayor. And as elected official I said, first of all, I think this is for the protection of the mayor. We have to restructure that so that not everything, when it comes to a violation of these things, falls back on the mayor. And I don't think it was handled that way anyway. I think it was done through IT and others.

46:16 – 46:39Speaker 5

So you are convinced that all the data that we possibly capture with the help of the installed security cameras is strictly controlled and the access to this data is very limited, right? Yes, please, if you could.

46:42 – 48:07Speaker 4

We record all surveillance cameras for up to 30 days and then the data is deleted and transcribed. The only people who have access to our surveillance cameras are the department heads who are in their own area. The parks, for example, have their own parking cameras. The only people who have access to all cameras are the CIO, myself and the police. There are several cameras in the police department that only two people have access to. Not that I have access to it, because it is a proof of evidence. And they just want to make sure that the cameras are there. And that, and now again, that should clarify the statement I made. When I spoke to the boss, he again explains that the police department has no independent contracts or independent access to ALRS. And so I never saw anything of it again before I worked here. I worked as a district attorney and was nie darüber informiert oder habe nie in diesem Sinne NALP aus dieser Hintergasse genutzt.

48:08Speaker 8

Again, and we can, again, even with the functions of these security systems in the back alley, which we have discussed, how we believe that people may abuse this in order to use the exchange of insurance rights, whereby it develops into a kind of larger matter with requests for public recording. We can conduct this discussion about whether these character readers are needed in this back alley. Because again, there is no real, I have not seen any functional use.

48:53Speaker 5

We have not received any inquiries for it at all.

48:57Speaker 4

Have we made any reports with it? No. So again, even with these three, which may be in the back alley and are controlled by our IT department, we can also conduct this discussion.

49:05Speaker 7

Is there anything else? Yes, Council Member Johnson and then Council Member Ericsson.

49:13 – 50:02Speaker 2

Thank you for all this information. I really appreciate it. I have the feeling that this is a problem all over the country. Our residents have concerns about this, so it's nice that the information is being presented. I just had a question. So I know when you talk about budgets for the police or budgets for others, then we have individual posts, but sometimes the lines are wider like with small tools or something. That's why we don't really approve everything individually.

When I spoke to Chief Roach, he told me that there would be nothing in this way. Our city clerk explained to me that we have a security system that could possibly use this function. I had the impression that it does not actively collect this information. I think that we can do without it for the purpose for which it is used. In this sense, a regulation, in my opinion, would essentially regulate something that does not happen. The other thing is that the state, when I read the state law and the notes of the state committee, set strict limits for how we can use these things. So if there are growing, commissioned companies or individuals who deal with traffic patterns and traffic flows. And then I talked to other lawyers in the city about it. If you restrict or prohibit use within the city, this could be a violation of state use if you use state-controlled traffic signals. And so it exists. And again, we don't know if Second East is controlled. Is it a state road or not? Second East, Main Street. Main Street. And Kief, what else do you still control in the city? A part of Second East. Okay. To the Yellowstone Highway, in between. And some people will say, hey, I see this camera or I see something on this traffic light. This is a traffic light that is waited for by the state of Idaho, installed and essentially paid for.

53:03 – 53:16Speaker 2

All I'm asking is whether we can have a kind of guideline or a regulation according to which the police authority must submit this contract to the council for approval. That's all I'm asking for. I'm not saying we should forbid it. I'm not saying I want the council to see it.

53:18 – 53:46Speaker 4

Yes, and I would say that there are already internal guidelines for this, in which we have these checks and evaluations. If the city wants to recommend this, a department that wants to use it must first explicitly approve it. We can talk about where this approval should come from. If you want it to go through the department head, if you want it to go through the legal department, if you want to bring it to the city council as a measure point, we can talk about it and we can definitely implement these safety precautions.

53:49Speaker 2

Yes, yes, I would like to put it on a future agenda to talk about whether it can be followed up by the council if it is possible. Council Member Eric.

53:54Speaker 7

You can implement it.

53:59Speaker 4

Excuse me, Council Member Johnson, we could also implement it through the city's manual and the manual of the department head.

54:06 – 54:35Speaker 6

Mr. Mayor, thank you for that and thank you very much, Spencer, for providing us with this information. I know we've all heard a lot about the vlog cameras and I understood the difference between Flock and simple LPA. Your AI-generated information, your AI-generated collections, they are nationwide connected to each other to generate information about individuals. And I'm so glad that we don't have any here and don't plan to have any.

54:36Speaker 4

Let me make this very clear. If we're talking about these hindrances, this security system, then it's not a Flock system.

54:42Speaker 6

That's not what you're saying.

54:43 – 54:56Speaker 4

Yes, so we don't have a contract with Flock. We don't have the intention to close a contract with Flock. Once again, if we are talking about a security system here, they will openly report to you, they will report to the mobile phone. You can call the mobile phone of a person a number reading device.

54:59 – 56:00Speaker 6

That's what I wanted to say. We don't have anything in our city that drives the AI generation forward and allows the persecution of people whose observations or similar things. We don't have that and we don't plan to do that either. I like the idea of leaving a guideline. I have a good feeling about our police chief and our department there. If they ever decided to do that, we would see that in the budgets and would have to approve it. So if we want to introduce such a guideline, I have no problem with it. But I think our boss would discuss this with us before we even buy it and bring it to the market. At the moment we don't have that. We also don't plan to get it ever. We don't need that. We can use other things for information and don't have to collect information about our citizens. Thank you for mentioning that. I hope this will clear up our citizens a bit so that they can better understand the topic of hard cameras. Die anderen Gerichtsbarkeiten haben das, wir nicht. Vielen Dank dafür.

56:01Speaker 7

Okay, danke. Hatten Sie noch einen Kommentar?

56:04 – 56:26Speaker 3

56:28 – 57:25Speaker 4

No. And I think that the city government and even city politics sometimes prefer checks and balances. And I think every system in which we move in the direction of checks and balances, and we do that again, instead of having the placement. And again, and in some of these older manuals there was something like, oh hey, the placement, the security and the maintenance of these cameras fall into the responsibility area of the mayor, fall into the responsibility area of the mayor. And it's like, hey, the mayor doesn't do these things. And so follows what Patrick said, IT, the department head and then certain people. And then there are also checks and balances within this department to ensure that these people do not have access to information that they should not have. Well, that also applies to the majority in which we run an open book. I mean, most of what we have, apart from some employee information and things like that, is rare that we have something that is not available for registration requests from the public.

57:27 – 57:53Speaker 7

Are there any questions from the council? Thank you. Attorney General Ramel, we appreciate this report and this information and the discussion. We now move on to point C, our report on public works with our head of public works, Mr. Keith Davidson. Point 1 is the permission for the overhaul of the Ford pick-up of the waterworks, whose engine must be overtaken.

57:55Speaker 5

Thank you, mayor and council members. We only ask for the permission of the council for the overhaul of this Ford truck from our waterworks.

58:08Speaker 7

Okay. Does anyone else have any questions? If not, I would like to make an application for an exemption for this particular point. Is there such an application?

58:18Speaker 5

Mr. Mayor, I would like to request that we continue with the exemption and approve the exemption of this particular pick-up. All right.

58:27Speaker 7

Thank you very much, Mr. President Ericsson. Is there a second vote?

58:31Speaker 3

I support that.

58:32Speaker 7

Supported by Council Member Teig. Are there any further discussions or questions? Is there no vote for it?

58:38 – 58:58Speaker 7

Disagree. The application has been accepted. We come to point 2 of the approval of the dates for the autumn cleaning from October 22 to November 16, 2026. Does anyone have any discussion points on this particular topic? If not, I would make an application for approval of these dates for the autumn cleaning.

58:58Speaker 2

Mr. Mayor, I make the application that we approve the dates for the autumn cleaning from October 26 to November 16.

59:05Speaker 7

Okay, thank you very much. Council Member Johnson, is there a second vote on this application? I support that. And from Council Member Regans, are there any further discussions or questions? Yes, Council Member Teague?

59:15 – 59:26Speaker 2

Are there any preconditions for the case that it will snow in my first year or we won't be able to do it? Can we extend it if necessary later? Or does that mean I won't hold it for a year?

59:27 – 1:00:01Speaker 5

Sometimes someone comes by with whom we can work together. But in general, we want to limit it to this time window. And we always hope that at this point all the leaves of the trees are there, so that we can then remove all these materials in the whole city. Okay, thank you.

1:00:03Speaker 7

Good question. The council before Brexit.

1:00:05Speaker 1

And Mr. Mayor, can we make sure that we record this early enough in the newsletter so that you ... We will note that.

1:00:13 – 1:01:03Speaker 7

City writer Lovejoy, right? Oh, that's right. That was a question. Excuse me. We have a request and a second one. Are you all for it? Me. Disagree. All right, thank you. The request has been accepted. Point 4 is the approval of the FTA 5.3 of the Idaho Transportation Department. Can you tell us a little bit about it? Excuse me, point 3. Approval of the contract for planning the dewatering of the replacement and the modernization of the drying plant. Please tell us more about it.

1:01:04 – 1:02:16Speaker 5

Yes, so this contract would be closed with Aqua Engineering and we are checking the modernization of the plant at the Talln River to process the clear sludge that comes from our plant. So the process would be, we would install a dewatering system to dry the bio-containers. In this way we achieve a nitrogen content of about 16, 8 or 18 percent. Then we direct them through a drying system with natural gas that brings them to 90%. This makes them class A. So they can be used everywhere. This is the process we want to develop. It will also help us to remove the smells in the system and ensure that we do not cause any disturbances with our asphalt. Okay, question. Councilor Ericsson. Mr. Mayor, that was my question. Is this a reaction to the complaint of... Well, I say, so to speak, a reaction. The reason why I say that is that we have already planned this before the complaint, because we knew that we would improve our clarification of the... We are already there.

1:02:16Speaker 6

That's why I said so.

1:02:18Speaker 5

This will be the abdication.

1:02:22Speaker 7

Okay, another question. The city of Rattia.

1:02:26Speaker 2

Wie lange würde der Designprozess dauern? Etwa ein Jahr oder so?

1:02:30Speaker 5

No, that's a good question to understand the process and the timeline.

1:02:57 – 1:03:25Speaker 7

Yes, good questions. Any more questions? Okay, then... So, the contract... We don't have a contract with a traded price. No, we have a price in the contract. The contract says $8,583. That's still okay. That's three. That's not it.

1:03:25 – 1:03:40Speaker 5

It's only 16 pages to remember where it was. But yes, it costs 48,000, 1,050 dollars. That's a lot of money.

1:03:45 – 1:03:57Speaker 6

That was my question, Keith. Do we think that's a good offer for the design? That's a lot of money. It is a lot of money, but when you have to deal with wastewater, it's unfortunately all a lot of money.

1:03:57Speaker 5

Yes, we had the feeling that it was a fair price when we negotiated with him and got the contract.

1:04:05Speaker 6

And I say that to many citizens, clean water and dirty water both cost a lot of money in the world. I just want to make sure that we weigh it down.

1:04:16Speaker 7

So do we have an estimate of what the actual, I mean, the design is of course not finished yet, but only rough numbers, what the modernization will cost roughly?

1:04:23Speaker 5

If I go through the design, we will find out more, but it could probably be 14 to 20 million. That's more money.

1:04:31Speaker 7

Now that's a serious matter. A thought. Please.

1:04:42 – 1:05:09Speaker 8

Keith, like you, I'm sure you've already thought about it. But if you design it, we'll be counting on 20 years. We'll be counting on growth. We'll be looking at all these things so that we're talking about a lot of money for design again, right? And so, you know, I think we have to think about it. We hope to look 20 years into the future.

1:05:09Speaker 5

But mostly it's about growth. No, I agree. It's not a joke. No, we simply don't know, but... Yes.

1:05:16 – 1:05:28Speaker 7

Thank you. You're welcome. I think the answer to this question is that we are trying to plan far into the future. You never know how far that will take us, right? There will be the only modernization while we advance, right?

1:05:28 – 1:06:23Speaker 5

There are always new modernizations that have to be carried out in the clearing system. Only the different processes If you look at the processes in the clearing system, each process has a certain capacity that we call MGD, right? Million gallons per day that you can process. At the moment we are modernizing our pre-clearing tanks, right? Our pre-clearing tanks have a capacity of 6 million gallons. We equip them with 12 million gallons per day so that they can process this capacity if necessary. And each of the different processes has a certain capacity. At the moment, our last work is the next process that we have to modernize. Then we will look at our oxidation graves and then our clear basins, tear basins. So there are all these processes that we have to continuously modernize in order to manage the additional capacity. So you just take them piece by piece and then modernize this section. And if you have excess capacity, you go to the next tight fit to modernize it.

1:06:24 – 1:06:38Speaker 8

And because we had problems with it, right, because a government authority has to approve what we design and look at us. Or is there...

1:06:38 – 1:07:01Speaker 5

Yes, it goes through the DEQ. They look at it and so all these processes are checked. We want to make sure that the DEQ is approved, that this dry cleaner reaches class A, which we want. And so we make sure that these steps are taken. That's a good question.

1:07:02 – 1:07:44Speaker 7

And the other, the good news, I guess the bad news is that it could be 16 to 20 million dollars. But the good news is that we have a lot of reserve money that we have saved through our wastewater fees, so that we will hopefully have the money we need to be able to carry out this modernization. Am I right?

Richtig?

1:07:55Speaker 7

Okay, that's good.

1:07:57Speaker 5

Are there any further questions on this point?

1:08:01Speaker 7

In order, if there are no further questions, I would make a request that we approve this special contract. Is there such a request?

1:08:10Speaker 5

1:08:17Speaker 7

In Ordnung, danke, Ratsmitglied Action.

1:08:30 – 1:08:44Speaker 7

Is there an opposition? This application has been adopted. We now come to point 4 of the approval of the financing agreement FDF 5 part 3 11 of the Ministry of Transport of Idaho for rural areas. Mr. Davidson, can you explain to us a little about this point?

1:08:45 – 1:09:55Speaker 5

Yes, thank you. We received the announcement in June that we were granted the grant. We have therefore waited for the actual consent to be made with the agreement that I received yesterday. I am grateful to the Council that it has changed the agenda so that we can tackle the issue and move forward, because it starts on October 1st. Thank you for changing the agenda. This consent deals with public transport. So we want to investigate the gaps in our transport system and find out what would work well for our community and what might not, and where we have to start with this study. This is what this grant is used for. It is an 80-20 grant. 80% of it will be over the grant amount of USD 200,000, so that we get USD 160,000 from it. So we are responsible for 40,000 US dollars of this grant. That's what he was thinking, and that's why we have carried out a budget adjustment.

1:09:55Speaker 7

Yes, council member Theig.

1:09:59Speaker 2

Is this an affordable grant? Do we pay everything and then?

1:10:05Speaker 7

Yes, council member Johnson.

1:10:07Speaker 3

And did I see in the documents that BYU Idaho is donating 20,000 US dollars of these 40,000 US dollars?

1:10:13Speaker 7

Yes, and that's part of the budget adjustment. Yes. Yes, that's a good question or a good comment, yes. Yes, Council President Ericsson.

1:10:21 – 1:10:40Speaker 6

Mr. Mayor, is the scope of this study only locally limited or does it also extend to other areas such as Sugar City, Rigby, Idaho? Is this a regional study on public transport or only for Rexburg?

1:10:41 – 1:11:17Speaker 5

In the first place, we are only looking at the local level here. What are our needs in the city of Rexburg?

1:11:17 – 1:11:28Speaker 6

I'm just wondering if it wouldn't be at least nationwide to include my Sugar City and the surrounding areas that could benefit from some kind of public transport.

1:11:31Speaker 7

That's definitely my only option. Okay, any more comments or questions? Yes, it was with Deed Johnson.

1:11:37Speaker 2

I only have one more question. If it is approved, do we have a time plan for it? It's like a year.

1:11:41Speaker 4

Oh yes, it's two years.

1:11:43 – 1:11:54Speaker 5

Yes, we can spend up to 80,000 per year for it. Or 100,000, I should say, because 20,000 of it would be our money. And so we want to roll it out over a period of two years.

1:11:57Speaker 7

Okay, are there any more questions? If none come, I would make an application for approval of this financing agreement. Gibt es einen solchen Antrag?

1:12:11Speaker 6

1:12:19 – 1:15:06Speaker 7

In Ordnung, danke, Ratsvorsitzender Ericsson. In Ordnung. Sie hat auch ein paar Mannschaften geschickt, um Brände in anderen Gebieten zu bekämpfen, aber sie haben uns versichert, dass sie immer mal have a solid group of people here to take care of our local needs before they actually rejected some inquiries to go to other places, because they know that their function is very important here. That's why they always have enough people here who can take care of us. And they also have replacement people who can fill out these positions when these people are gone. We have approved the exchange of two bushing vehicles. Two of them have been quite scrapped over the years and the funding for the exchange of these vehicles is available. One of the good news from our fire department is that our fire department in the city of Rexburg has improved from class 3 to class 2 and in the district from class 4 to class 3. And the good thing is that the residents thus save money, their fire insurance policies. So if you go from class 3 to class 2, it helps you to save money. So the budget is fixed. Weitern. Ja.

1:15:07Speaker 2

As far as the fire ban is concerned, it means that it is because we let it go, but we do not raise the ban. Can the residents still make a fire?

1:15:15 – 1:16:08Speaker 7

Yes, you can now make a fire because the district said it. Yes, the district said it. I just want a clarification. Yes, yes, you are allowed to do that. Okay, point number, let's see where we are. I have to go back to my right side. In order, point number 8 is a recommendation of the employee to make a change to the decision. In order, point number 8 is a recommendation of the employee to make a change to the decision. In order, point number 8 is a recommendation of the employee to make a change to the decision.

I know that Brandon made us aware of this, our director of staff, and he said that we can be punished if we stick to these guidelines for too long. And that's why we decided to adapt the preservation regulations to the federal regulations. So we do not violate the regulations unknowingly. Okay, thank you very much.

1:16:32Speaker 7

Any questions for Deborah? If none are present, I would ask for a motion to proceed with this special resolution.

1:16:39Speaker 6

Mr. Mayor, I ask for a motion to approve Resolution No. 2026.13. Okay, thank you.

1:16:50Speaker 7

Is there a second for this motion?

1:16:53Speaker 3

I support it.

1:16:53Speaker 7

Supported by Council Member Johnson. Are there any further questions or discussions? Is there none for it?

1:17:00 – 1:18:15Speaker 7

Against? In order. The motion is accepted. We now move on to point 9a, the Car-Hole. Now we have a point on the table and we will leave the point on the table, unless someone wants to continue discussing. At the moment we are still in talks with Basic American Foods and we hope to be able to continue this well. But thank you very much for that. So yes, the consent agenda includes the protocol of the session of September 2, 2026 and the approval of the payment of the bills in the city of Rexburg. Do we have comments on this special point? Yes, please, city council. Excuse me.

1:18:15 – 1:18:28Speaker 3

Nur eine Anmerkung zum Protokoll vom 2. September.

1:18:29Speaker 7

In Ordnung.

1:19:19Speaker 7

In Ordnung, danke.

1:19:26Speaker 6

Ihr unterstützt den Antrag.

1:19:27Speaker 7

Unterstützt von Ratsmitglied Eriksson. Gibt es noch weitere Diskussionen oder Fragen? Eine Stimme dafür?
