Hi. Okay. Um Chris, are you going to read the meeting procedures or give us the meeting procedures since we have uh two public hearings? Certainly. The planning and zoning commission holds public hearings as required by law and provides recommendations to city council on matters relating to land use planning, zoning, and the subdivision of land. Any person who has an interest in the subject matter of a hearing will have the opportunity to provide testimony and present evidence to the commission during the public hearing. Speakers are required to conduct themselves in an orderly and respectful manner. Disruptive behavior, including applause, yelling, speaking out of turn, or other inappropriate behaviors, will not be tolerated. Additionally, the following applies to any person addressing the commission. Speakers are limited to five minutes unless authorized additional time by the chairperson. Speakers must speak at the podium unless previous arrangements have been made by the chairperson. Speakers must legle legibly print their name and address on the sign-in sheet at the podium prior to speaking. Speakers must begin by stating their name and address. The speakers should speak clearly and into the microphone. The chairperson will announce the subject of the hearing followed by a report from staff. The chairperson will then open the public hearing to the applicant followed by those in favor of the application and those opposed to the application. The chairperson will close the public hearing during this time. Then the commission will discuss upon amongst themselves. The public may not address the commission after the close of the public hearing unless requested by the chairperson. The planning and zoning commission shall base their recommendation and/or decision on information and evidence presented during the public hearing. This decision, if required by the application, will be forwarded in writing to city council for further consideration.
Thank you, Chris. Uh we'll move to the first public hearing which is VACA26-00001 public hearing and possible vote to recommend the approval of an application to vacate a sewer easement located in the Boyce Hills subdivision. Somebody going to give us a report? Yes. Good evening.
Good. Thank you. This is case VACA26-00001. As Chairman Ellis noted, um Jeffrey Boyce Enterprises LLC is requesting the vacation of a sanitary sewer easement located in lot 6A of Boyce Hills Subdivision at 3429 East Bristol Street. The requested vacation is of a 15 foot wide sanitary sewer easement that runs both parallel and perpendicular to the eastern property line of lot 6A and is in total is approximately 4,195 square ft or 0.10 acres. The portion of the sanitary sewer main occupying the easement has been rerouted to a new location to allow for future development. Vacating this easement will allow the preferred configuration of a new commercial building to be constructed on lot 6A. The future sanitary sewer easement will be located to the northeast of where the current easement to be vacated is located and will center on the newly installed sewer main. Once the easement is vacated, the associated development rights will be given to the property owner Jeffrey Boyce Enterprises LLC. staff is recommending approval of the requested sanitary sewer easement vacation and we are available for questions.

Yes. City of Republic has applied on a special permit to operate a veterinary facility or similar est55 East Sawyer Road.
Thank you. The subject The subject property of this application is comprised of one lot approximately 3.1 acres of land and is zoned light industrial M1. The lot is currently vacant. The applicant is requesting a special use permit to allow for the operation of a veterinary facility or similar establishment at the site. The property is surrounded by Henkins Farm Plan Development District, PDD zoned properties to the north, east, and west, which allow for uses in line with the city's light industrial M1 zoning district and light industrial M1 zoned property to the south across Sawyer Road. Rescue 1 is proposing to locate a veterinary facility that includes overnight boarding for animals on the subject parcel. The city special use permit ordinance section 405.670 authorizes upon approval of the city council uses which are otherwise prohibited by the subject zoning district when appropriate conditions and safeguards may be imposed to protect the public welfare and to conserve and protect protect the condition of the value of property in the neighborhood have been met. Special use permits are required by section 405670 for veterinary facilities or similar establishments in the light industrial M1 zoning district. The site does currently have access to city of republic's water and sanitary sewer services. The property will be required to connect to city water and sewer prior to the occupation of the site. The special use permit, if approved, would remain valid until an alternative use occupied the parcel or until substantial changes to the approved development plan occurred. Changes in use or significant reconfiguration of the property would void the special use permit. Furthermore, the applicant is required to abide by any additional conditions that may be placed on the
permit at city council's request. A traffic impact study was not required due to judgment that no impactful change in trips are generated by this use. The subject parcel does contain area designated special flood hazard area and all construction will be required to conform to chapter 420 flood damage prevention of the city's adopted municipal code. The subject parcel does not contain any sinkholes. If approved, the construction of a new commercial building on this parcel will require adherence to the city's adopted plans and ordinances. The next step in the process would be the construction of a new building once an application for a new commercial building permit has been issued. Staff considers the proposed special use permit request for a veterinary facility or similar establishment in a light industrial M1 zoning district to be generally consistent with the city's special use permit ordinance and able to be adequately served by the city's transportation network and city's municipal facilities. Based upon this analysis performed without the benefit of evidence and testimony of a public hearing, staff recommends the approval of this application. Let's start with the applicant. Good evening chairman, members of planning and zoning commission. My name is Chris Wyn, uh civil engineer with CJW Transportation Consultants located at 5051 South National Avenue, Sweet 7A, Springfield, Missouri. Um, per usual, I think Chris has done a great job. Um, representing what we're looking to do here on this property. Um, as you're aware of the area, this is across um, Sawyer Road from the Amazon distribution center. It's a property that's currently owned by the city of Republic um, which would um, ultimately be sold to Rescue One upon approval of this application. Um, as as Chris mentioned, um, the property is in a flood zone. Uh, we do have a little bit of flood plane on the property as well as some floodway. The building itself is completely out of both the flood plane and the floodway. We do have a little bit of flood plane that affects the um drive on the north side of the site. Flood plane development permit will be um provided at the time of uh construction. Um, utilities are available to the site. the site's generally conforming to um Republic's code. We have met with the city of Republic staff as well as fire to make sure that this um the site plan that's before you guys is generally acceptable by the city um barring any civil engineering and architectural drawings. I think we're moving in the right direction here. Um just going through the process trying to get this permit so that we can uh keep things moving forward. I do have a representative with rescue one here as well as um inform architecture that could speak to the building or to the operations of the facility if you do have any questions regarding that. Um other than that, I'm here to answer any questions you would have regarding the site plan or the development of the property. So without without anything else to add, turn over any questions you guys may have for me. I don't think so at this time during the
