Yes. Good morning, madam mayor. Council members, I'll cut straight to the chase. This is a resolution for the consideration of settling the case that's gone on since September 2021, City of Port St. Lucie v.

2:49 – 3:32Speaker 4

Waste Pro Florida Inc. What we have before you is the resolution and a corresponding joint stipulation and order of dismissal. The settlement terms are included in that document. Just for the council's information, it's a total value of $24,000,000 potentially plus, laid out as follows: Within thirty days of the entry of the order, Wastepro will pay the city $21,000,000 and there will be two subsequent installments of $1,500,000 due on 01/31/2007 and 2028, respectively. There are provisions in this settlement for interest, but there's also provision for early payment as well.

3:34 – 3:55Speaker 4

Also, to this settlement, basically dismissal of the claims. All claims, counterclaims, appeals, everything's done as a result of this that the counsel approves today. In the audience, by the way, is outside counsel, Mr. Daniel Abbott from Weiserota, our outside counsel on this matter in case counsel has any nuanced questions on the mechanics of litigation or where we go from here.

3:55Speaker 1

Okay. Thank you. Counsel, any comments?

3:59 – 4:15Speaker 3

Just want to thank our outside legal team as well as our internal legal team for I know this litigation has been difficult, it has been challenging. And I just want to thank you for your hard work in bringing this forward to the council for consideration.

4:16 – 4:37Speaker 1

Any other comments? So I'd like to thank our council and outside counsel as well. I know you put a lot of hard work into this and really appreciate it. I'm extremely happy that we're able to come to this resolution today and close out this chapter for our city and more importantly for our residents. With that, is there a motion? Motion to approve.

4:38 – 4:50Speaker 1

We have a motion and a second. Any final questions? All in favor? Aye. Any opposed? Motion carries. Okay. Does anyone else have anything?

4:50Speaker 3

No, madam here.

4:51Speaker 1
