On May 5th, 2026, an inspection was done and photos taken showing the following violations. Section 4108, subsection B, exterior property areas, high grass and weeds over 12 inches. Section 4108, Hotel 1, exterior property areas, obstructions and swales prohibited. Photos depict an accurate representation of the property at the time the photos were taken. Notice of violation was issued on May 5th, 2026. Respondent had until May 15th, 2026 to bring the property into compliance. Compliance was not achieved by such date, so a notice of violation was furnished on June 12th, 2026 by certified mail. On June 24th, 2026, proper service was achieved by posting the property with a notice of hearing. City requests that the respondent, Sean L. There was like a real estate sign that was there for so long it's actually rotted and fallen over.

It's still there, but that can be abated when we have somebody cut the grass. We didn't specifically address that because it's fallen over. So, okay. I mean, if you want, you could probably close that violation.

Section 41.09 B swimming pools unsecured 41.08 B is going to be removed from this case. It's coming to compliance and then section 41.09 A unmaintained pool. The photos depict an accurate representation of the property at the time the photos were taken. And notice the violation was issued on May 26, 2026. The respondent had until May 27, 2026 to bring the property into compliance. Compliance is not achieved by such date. And so a notice of hearing was furnished on May 27, 2026 by certified mail. After that, the city is authorized to enter the property, abate the swimming pool violations, and assess the costs.

In violation of the section 11121 of the city code during my investigation, I confirmed that the business known as Near Me Pro Services LLC operating at a subject location. I verified through the city business tax office that a valid business tax receipt has not been issued to the operator of the business for this location. A search of the property appraiser's record confirms that the respondent is the owner of the property where the business is operating. A notice of violation was issued to the respondent on April 16, 2026, given the respondent until April 22, 2026, to correct the violation. Compliance was not achieved by the deadline, and notice of hearing for today's proceeding was issued on June 9, 2026, and proper service was completed in accordance with city code. The recommendation and request of this order is the city respectfully ask the special magistrate to make the following findings a fact. A business is being operated at 2191 Southwest Barthel Street.
