Project Address: 1173 W. Phillips Boulevard Project Applicant: Moussa Construction Project Planner: Irene Mouré, Assistant Planner Council District: CC District No. 2 A request for a Variance to deviate from the Build-To development standards due to an irregular angle of the primary street lot line for the proposed new construction of a two-story, residential dwelling of 2,220.9 square feet within the Activity Center District 1 (ACD1) zoning district. Staff has determined that the project is exempt from environmental review in accordance with California Environmental Quality Act (CEQA) Section 15305, Class 5 (Minor Alterations in Land Use Limitations) of the CEQA Guidelines. Recommendation Staff recommends that the Planning Commission approve the variance request and adopt Resolution No. 26-016. Project Address: 3272 N. Garey Avenue (APN: 8367-001-087) Project Applicant: Gurinderjit Kehr, Dutch Bros. Coffee Project Planner: Alan Fortune, Associate Planner Council District: CC District No. 6 A request for a Conditional Use Permit (CUP) and Development Plan Review (DPR) for the demolition of an existing 4,700 sq.ft. building and construction of a new 1,025 sq.ft. drive-through restaurant, along with associated on-site and off-site improvements on a 0.86 acre property; as well as a Variance (VAR) to deviate from the Front Yard Setback and Frontage Coverage development standards of the Neighborhood Center segment of the Pomona Corridors Specific Plan (PCSP). The City of Pomona, as lead agency, has conducted an environmental review of the proposed project per the California Environmental Quality Act (CEQA). The proposed project meets the criteria for a Class 3 (New Construction or Conversion of Small Structures) Categorical Exemption pursuant to Article 19, Section 15303 of the CEQA Guidelines in that the project consists of the construction of a 1,025 sq.ft. restaurant. The proposed project described above hereby meets the guidelines for a Categorical Exemption, therefore, no further environmental review is required. Recommendation Staff recommends that the Planning Commission approve CUP-000549-2025, DPR-000550-2025, and VAR-000553-2025 and adopt PC Resolution Nos. 26-013, 26-014, and 26-015, subject to conditions.
