Okay. Next item is our approval of our agenda. Do I hear a motion to approve our agenda? Mr. Chairman, I would like to make a motion that we amend the agenda as presented and continue case S-25-017 Trinity Roland for a possible procedure procedural issue. Second. So I have a motion to um amend the agenda. It is seconded. Mr. data act. Do you have any information on this? It might help us as we're deciding on this issue.
Yes, chairman. Thank you. Um, as you saw in the staff report, the planning commission made a motion on August 5th to recommend approval. That motion failed two to four. There were no subsequent motions on action by the planning commission. Therefore, the planning commission has not technically acted yet and the BCA cannot take on SUPs that have not been acted on by the planning commission yet. So, by October, you will have uh by your ordinance, it will come to you automatically due to passage of time since the planning commission looked at in August, but at this point technically, procedurally, it should not be before you yet.
Okay. So that basically we cannot vote on it because they did not deny it. They didn't approve. They voted not to approve it, but they didn't vote to deny it. And so it has to lay over for 60 days. Correct. Okay. Anything we did might not add up. Yeah. You'd be you'd be acting prematurely to act to to to act on it tonight because there technically there is no action by the planning commission to you which is required the first step. Thank you. So, we won't go back to the planning commission. We just wait 60 days and then we hear the case.
Correct. Um because planning commission has already met in September. Um and there's nothing for it to go back. The planning commission simply will not have acted. Um, pursuant to article B, Division 7, the Pennsylvania County Zoden ordinance, we, the board of zoning appeals, have been empowered to hear and decide specific applications and appeals in support of said ordinance. In accomplishing this important task, we are charged with promoting the health, safety, and general welfare of the citizens of Pennsylvania County. We must ensure that all of our actions, all of our decisions um and recommendations be directed to these goals and that each be consistent with the environment, the comprehensive plan and the best interest of pit best interest of Pennsylvania County, its citizens, and its prosperity. Anyone here to speak to the board other than the applicant regarding zoning cases will be limited to three minutes. like to read our first case?

Robert Taylor has petitioned for a special use permit on 11.93 acres located on State Road 878 Duncan Drive in the Westover Election District to allow for a private garage mechanic shop in accordance with Pennsylvania County Code 35-223. On August the 5th, 2025, the planning commission recommended by a 6 to zero vote with no opposition that the petitioner's request be granted with conditions. Okay. Repair activities shall be contained within an enclosed structure. Inoperable vehicles shall comply with chapter 9 of Pennsylvania County Code. It must be stored in area screened in accordance with uh Pennsylvania counties 35-201. Um Mr. Taylor, are you aware of those? Um okay. So, you're in agreement with repair activities be contained with inside. Gotcha. And of course, vehicles be stored in a fenced area. All right. Uh, any other We did have a question about
Can you mind come up there so we can get it on? We did have a question about the privacy fence part because if you see the site plan, as he was saying, it's off the road and it's behind our house and then there's a complete tree line. We have no neighbors nowhere. Like the backyard is completely a tree line like and it's miles of trees. So I mean do we need to still have a complete like privacy fence built? I mean because there is it's not citable to nobody now as it is. Staff could you answer that question for us please?
Yeah. Let me uh look at section 35 121 here. The actual storage part of it will be behind the shop. It's It's really not visible. You You might have some glimpse of it in the fall when you have no leaves or something, but I'm also I'm not trying to get into the motor and transmission part of it to where you would have stuff sitting around for a while waiting on parts. I'm basically going to keep brakes more more or less service, inspection stick or alignment, tires and wheels. That's what I'm going to keep it at. Old changes.

I'm I'm going to recommend that we follow the guidelines established by the county because if we change something, make an exception for something, then every time we hear a public garage of that nature, then we're going to have to addressing gesture. So, we've got a we've got a code. I'd recommend that we follow that. Yeah. And the point of that section regarding fencing and screening is really just to prohibit visibility of the inoperable vehicles. Um, so man-made fencing, uh, no less than six feet in height. Okay. Um now if you have a strip a vegetative buffer uh of trees or shrubs um cannot be less than 15 ft in height uh or excuse me 15 feet in width and not less than 8 feet in height. So it's got to be kind of dense um to prevent visibility there. So, um, and if we look at your site plan, see, while I'm pulling that up, how dense is that vegetative buffer?
Well, it's it's real dense on like the Berry Hill side of the property, Berry Hill Roadside. And then we do have a neighbor close by on this side. Yeah. I mean, you know, like I say, you could get you could peek through some holes there during the fall. Okay. I'd say if you had to put a footage on it, probably 10 foot. Okay. Old style trees. It's not, you know, just grow up stuff. It's full grown trees and stuff there. based on that and probably the seasonality of the vegetation. So would would like a privacy fence on his side of it be sufficient or do you need the whole thing?
I I think you could probably have a use a combination, right? But where it's thinner and maybe not at the 8t height minimum. Um certainly augment that with a privacy fence. you based off the what you've said is that privacy fence and or a 15t buffer at least 8 ft high, right?
