The Planning and Zoning Commission welcomes comment on items relevant to the Planning and Zoning Commission not already scheduled on tonight's agenda. No formal action, discussion, deliberation, or comment will be made by the commission. Each person providing public comment will be limited to three minutes and will be asked to state his or her name and address for the public record. Is there anyone present wishing to address the commission? All right, hearing none, on to our consent agenda. Item three, all matters listed under the consent agenda are considered routine by the commission and will be enacted by one motion. These items include preliminary and final plats where staff has found compliance with all minimum subdivision regulations. All items approved by consent are approved with any and all staff recommendations. There will not be separate discussion of these items. If any commissioner desires to discuss an item on the consent agenda, it will be moved to the regular agenda for further consideration. I do have an item. So the items, the items that we're going to be voting on consent, item three, a two zero two six dash zero nine zero two approved the planning and zoning commission minutes for August 3rd, 2026 regular meeting skipping item three B onto item three C two zero two six dash zero eight seven seven approving a final plat for the Broadstone Weiss A 20-acre tract located generally southwest of Weiss Lane and Pleasanton Parkway intersection out of the Kirkland Survey No. 7, Abstract No. 458 in Travis County, Texas, FP-2026-000187, Item 3D-2026-0878. approving a preliminary plan for Carmel East Revision 2, an approximate 289.069 acres of land out of the John Lee Survey No. 18, Abstract No. 496, and the Joseph Weil Survey No. 8, Abstract No. 802 in Travis County, Texas, PP2026-000132. Good evening Chair and Commission. The item before you is the Heather Wilde Commons Subdivision Preliminary Plan. We are recommending denial of this because of the note that was mentioned on the plat stating that the requesting waiver from connecting utilities to one of the lots. So there are basically three lots in this preliminary plan. Lot one is a drainage lot. phase one is a lot connecting to a lot basically being done for Encore and phase two is develop a lot and Sorry, I'm a little confused, but yes, so the requesting this item to be pulled because there was a note mentioned on the preliminary plan stating that A waiver will be granted with this preliminary plan to not connect utilities till all the lots have been platted. That is essentially a subdivision waiver and cannot be granted with a note on the preliminary plan, so we are recommending denial for this.

Okay, so for PLATS legally, what you are allowed to do is either recommend approval, approval with conditions, or denial. Denial would be the most strict, where it would have to reapply to come back for reconsideration at a later date through staff and then back to P&Z. Approval, obviously, we can't get there right now because there is a note that we are not able to have there. We can't circumvent the public process. I would suggest approval with conditions. It's the happy middle where you can just approve with the condition that that one note is struck from the preliminary plat, so that allows the applicant to continue forward with their development, and they would be able to apply for the subdivision waiver as well as that final plat, and that would be all on the same agenda when those come forward.
