Madam secretary, I certify uh that uh we do have form present as all council members are present. call to move to citizen comments uh to comply with provisions of the Texas Open Meetings Act. Uh city council may not deliberate on any item not listed on the agenda. However, the city council will listen to public comment. During public comment, the public shall comply the council's rules of the quorum. Everyone desiring to present comments should have completed uh the public hearing comment card in the foyer and submitted to city secretary. Uh when called to the podium uh each participant shall give his or her name uh to provide a proper record. Council rules uh allow each person three minutes to provide comment. However, I do encourage everyone to be brief and to the point as possible. uh people who signed up to speak on specific items on the agenda will be called when those items are presented. Good evening everyone. Thank you mayor. This is a request by Mario Moreno, applicant and owner, for approval of a conditional use permit for accessory dwelling unit use within the single family residential 1 R1 district on approximately 1.001 acres of land generally located at 1325 Loki Road here in Perland. Uh-oh. Hold please. And for those uh who may be joining live
stream at home, uh we're just having some minor difficulties. So sit tight. All right, we're back. Thank you for holding. All right, the applicant is proposing the construction of an 18,000 or 1,856qt accessory dwelling unit to be built concurrently with the primary dwelling. The accessory dwelling unit is for the parent or the parents of the owner as stated in their letter of intent. And within the R1 district, a CUP approval is required for this land use.
As of today, we have received one. Excuse me, Miss Copeland. I think that uh you may have missed the address or the general location. I think that happened right when the technical difficulty happened.
Thank you. The general location of this property is located at 13025 Wilkkey Road here in Periland. All right. So, as of today, we have received one written comment in opposition to this request. We did receive we did send public notices out to seven properties and a notification sign was posted on the property by the applicant. Here we are in the city of Perland off of Wilky Road and Scott Lane. The current zoning again is R1 and the future land use type is established residential estate. Little history on this property. It was annexed into the city in 1960 and 1983. And originally in 2012, it was platted as a single lot. And then in 2024, it was replatted into two parcels with 81 ft wide each for the lots. And then in 2026, in February of this year, the plat was amended to go back to that same configuration in July 2012. So back to one lot. Here is the applicant's site plan. On the left side of the screen, you can see the primary residential structure as well as the accessory dwelling unit highlighted in red. On the right side of the screen is the floor plan for the accessory dwelling. Staff analysis concluded that the proposed conditional use permit meets the established criteria for approval of a conditional use permit. It also was consistent with the policies listed in the comprehensive plan as well as the future land use map and the thoroughare plan. And with that staff recommended approval of the requested cup with a condition. The cup shall only allow for
the accessory dwelling unit to be occupied by a person who is related to the person who occupies the primary dwelling unit on the subject property. Planning and zoning commission had a regular meeting and they recommended approval with a vote of 5 to one. And that concludes staff report. Back to you, mayor. Thank you. Um, good evening. My name is Mario Moreno. I'm here for the uh is the ADU that I'm trying to build. So, basically what I have is my parents. Um, after COVID, my dad lost his job. My mom, she's been sick for a long time now. They currently live with me right now in Sienna where I built my house and I let them move in with me. Um, as you see, uh, I did replat the lot cuz I was planning to build and sell both houses. That's what I do on the side. Uh but after you know life happens I decided let me put it back together um and just build my house and their house in the back and you know cost money to replat and put it back. So I mean that's why I did it. That's it.

No. Does council have any comments? Um, yeah. So, this is currently one lot as was put in the presentation. It was two lots. There you go. Thank you for bringing that page up. So, it's two lots long and skinny. Then, it was replatted into one lot. And this is an R1 single family residential zoned area. Correct. That is correct.
Okay. Um, so kudos to you, sir, for wanting to build somewhere to take care of your parents. You're in the residential construction world like I am, you kind of understand the process. This really needs to be platted into two individual lots because this is two individual homes. This is not, you know, a bedroom with a bathroom that's added onto the house to be an ADU. This is two full freestanding homes. Um, so this needs the correct way to do this to stick with our zoning regulations and the way that we operate in our city is to replplat that into two two lots. Whether you want to create an easement for driveway access to the back lot or do an L-shaped replat so you can gain access to that lot behind it. That's the process this needs to follow in my opinion. I don't know what the rest of council feels. Um but rather than put a cup in place to change the zoning should just have this replatted it'll be individual residential lot zoning will stay the same. You have two homes and then sell one in the future if you want to or both. But in my mind that's the direction this needs to go for the council Patel.
Thank you mayor. Um, yeah. I I would Can you go back to the layout of the house? Sir, when did you buy this property if you don't mind going to the podium real quick? Yes, sir.
I believe it was in 2024 when I purchased the lot. So, you took it from two to one. I guess you No, whenever I bought it, it was one. It was one and I replatted it because the plan was is to build two houses and sell them. Okay. But then I whenever um I was talking to my parents saw how everything was going, you know, I want to have my own home as well, but I don't just don't want to leave my parents out. Sure. Um and I want to have a lot one whole acre to just us and nobody around us. Yeah. So that's why I want to put both houses together.
And and and I do appreciate that. Uh you wanted to take care of your parents. I think that's fantastic. Um but I would say sir I I think long-term wise it would be better when your parents are not here what are you going to do with that house right that's the question we have um it becomes a rental property and that's when the problem happens for us because then your neighbors start coming to us saying hey there's a problem we have noise complaints and stuff like that and I think it's better to have it separated so in the future I think if you do sell it now from the looks of it and I'm not an expert I'm not a home builder and we I have an expert here. If you're worried about the cost of just replplatting when you're building this nice of a house, I think you may be in trouble already. So, I would think it's better to go to the right way for the long term. You may not see it today if it's the right way, but you're not building a small house for your parents. I mean, this is a beautiful house you're building, so good for you. Uh, but I think the right way would be to replat it to have two lots and put an easement. So, I'm going to be against this ADU, so I apologize.

Thank you, Mayor. Uh, Mr. Moreno, I first of all, I appreciate you doing this for your parents. Obviously, um, I agree with members, uh, my council members up here. I I think that one thing that we have to be mindful of is the zoning in that area is R1, and that's the single family dwelling. Um, so it's zoned in R1. And I think what's the blessing is that you do have two, you know, two plats, two, you know, two of them. And if you were to keep them separate and you were to put a home on each one, obviously you eliminate the setbacks in the I mean, you keep the setbacks cuz you're going to keep it. Um, but you can still fence it and you can still obviously be uh very close to your parents. Um, you know, for me and ADU, um, it this, you know, I'm going to be against it just simply because, um, putting two in one piece of land, um, now makes it a multif family dwelling instead of the R1 that it's already zoned for. So, I think in your case, you have the ability to keep them separate and then everything will go go well. So, thank you for being here, but I'm going to be against it. Any other comments? Yep. Thank you, mayor. This is a request by Crystal Duncan, applicant on behalf of Ha Jung Han, owner, for approval of a conditional use permit for adult daycare center use within the neighborhood service district on approximately 5.5394 acres of land, generally located at 7924 Broadway Street, Sweet 102 here in Periland. The applicant is proposing an 18,800 foot adult daycare center within an existing multi-tenant shopping center. The definition of adult daycare is a community-based group program which is licensed by the state of Texas and designed to meet the needs of functionally and/or cognitively impaired adults through in through an individual plan of care. Adult daycare centers generally operate programs during normal business hours 5 days a week and the neighborhood service district requires approval of a conditional use permit for an adult t daycare center. We sent 15 letters out for public notices and a notification sign was placed on the property by the applicant and as of today we have not received any written comments or phone calls. Looking at the surrounding use, we have a property highlighted in yellow. To the north, we have a um an auto repair and a shopping center. To the west, we have a financial institution. To the east, we have vacant land. To the south, we have a multif family apartment complex. And for further clarification, highlighted in blue is the selected suite for the adult daycare center. The future land use map has this area designated as commercial center. And here is the floor plan for the suite. The applicant has noted there is going to be no changes in the interior of the suite.
Staff's analysis concluded that the proposed conditional use permit met the established criteria for approval of a conditional use permit. The proposed use was consistent with the policies of the comprehensive land use plan and future land use map and thoroughare plan and therefore staff recommended approval of the requested conditional use permit for an adult daycare center business within the neighborhood service district. Planning and zoning commission held a regular meeting and voted 6 to zero to recommend approval of the conditional use permit. And that concludes staff presentation. I'll pass it back to you, mayor. Yes sir. Um can you can you explain what exactly this adult daycare is? I try to read it. Is it for certain age group or physically? It's um it's a DOS program. Um they had day activity program for um disabled and intellectual disabled clients. The age ranges will be from 16 to roughly 65 of age. Okay. And and just out of curiosity, out of the design that you showed, how many people would fit in there in a norm I mean I think I read that you guys already have a facility somewhere else. Yes, we're currently located at um Cullen Parkway at 3030 Cullen Parkway and the capacity is about 30 individuals.
So, are you planning on moving that or is this just Yes, it's a larger space. Um so, we're just trying to expand the capacity. Okay. All right. Thank you so much. I appreciate it. Blackburn survey abstract number 160 city of Periland Harris County, Texas being a portion of that certain cult 2acre tract convey to William D. Barios fine instrument of record under clerk file number RP-2021-724669 of the official public records of Harris County, Texas, authorizing the city attorney or his designate and other city officials to take such actions as are necessary to acquire said property located within the city by donation, purchase, or by the exercise of the power of eminent domain.

Second. Motion by council member Byron, second by council McCade. Staff report. Uh thank you, mayor. Uh so this tract is part of the acquisitions over in the lower Kirby area. Um a lot of what I uh said earlier may sound familiar to you because it is very familiar to you. Um we had adopted a resolution earlier. However, at that time, um, when the information went to the attorney that we've hired for the eminent domain, uh, processing of the case, he realized that the initial offer letter actually did not include the corner clip, and the corner clip is necessary for the roads that we're doing. Uh, so the appraisal was accurate that went to the property owner. Um, it had the corner clips in it. Uh, part of the resolution came from the appraisals, some of it came from the initial offer letter, and it was not the same. So, we needed to fix that before we proceed, before we do the filing on the case. Uh, I will say that while the city's offer and its appraisal has not changed at all, uh, Mr. Barios did have a new counter offer. Instead of being 2 million, uh, he would prefer it to be 2.5. Um, of course, we're going to continue to work with Mr. Barios. Um, we have no problems continuing to negotiate. Uh however, in order to keep the city moving on the two roadways that this is meant to impact, uh we do need to move forward, especially with the change between the city's um offer based on the appraisal of I think it was 180,000 uh and the 2.5 being requested by Mr. Barios, we feel as though it's it's best to initiate that eminent domain proceeding and we hope to resolve it without the necessity of actually um having a trial on the case. And if you have any questions, I'd be happy to help.
Was there any anyone to speak up about it? Real real quick, Mayor. Um, where are we with the process of design on that road and construction timeline?
That's being done by the developer and they are just getting ready to go under contract for the design. Okay. Any other questions? Yes, please. Lawrence, are you you're saying that we're going to continue negotiations and while we're building the road?
No. Um, potentially. Yes, ma'am. Uh, what I'm saying is that just because we adopt a resolution and just because we file a lawsuit doesn't mean that we stop talking. We will always continue to work with somebody and try to resolve it. And it may be that before we even file the suit, we resolve whatever the issues are. um that that's always the hope. But if not, even after we resolve the suit, um I'm sorry, after we file the pleadings in the case, we continue to work with property owners. The city's goal is always to resolve things amicably and never through the use of a trial. Um that we can't always reach that. Sometimes the delta between the two is too much, but um it may be that we go to the special commissioner's hearing, which is the first step in the process. they agree that we have the right to take the property for the projects that we're doing and then we'll just continue on with resolving the issue regarding value after we have that permission to take the property for the purpose. So we're always continuing to work towards a amicable resolution with the property owner.

I looked this property up earlier today and our appraisal was fairly close to what HCA has the property at. Has he provided anything to justify a $2.5 million valuation? Uh, that is his opinion of what the value of his property is. That's it. That there was no written information that I'm familiar with. There was no uh counter offer that outlined similar properties going for similar amounts in any other place. uh that type of data is not what we've received. It's just I think the value of my property is X.
