absent is Elana and seated for Elana is Jane I guess um all right uh are there any additions to or deletions from the agenda no sir there are not all right uh approval of minutes are there any additions or corrections to the Planning Commission meeting minutes of the 12th of December 2024 do we have a motion to approve I move we approve the minutes of the last meeting second second it uh seconded by Nick Angela uh and so I'll call the question uh Nick hi Brett hi Angela I ruthanne I Eric I Jane I chair's I approved unanimously next item number 7 a Gladis O'Brien house use special review Cottage Veterinary Edition and we will open the public hearing at 7:02 Amber we're all here thank you good evening chair and Planning Commission this is again the gladus O'Brien house cottage Veterinary Hospital use by special review application request the subject property highlighted and purple is located on the west side of Pikes Peak Drive south of Main Street the property is bounded on the North by private drive and St Matthews Episcopal Church to the east by Pikes Peak Drive and Commercial uses to the South by commercial uses and to the west by public par parking and Commercial uses the applicant spau Veterinary Clinic the

owner of cottage Veterinary Hospital is proposing a use by special review for an existing non-conforming Veterinary Clinic to bring the use into conformance there the request for the use by special review was submitted because Cottage Veterinary Veterinary Hospital is proposing an addition to the existing building and an expansion into the existing storage garage the building expansion is currently under review and will be approved administratively the site is located within the downtown east Zone District the building became a veterinary clinic in the mid 1980s after the 1981 incorporation of the town on October 21st 2002 the greater downtown Pikes Peak zoning District was established and includes the Veterinary Hospital site this zoning did not permit veterinary clinics making the clinic a legal non-conforming use today veterinary clinics are permitted as a use by special review under the new zoning downtown east which came into effect on January 26 2025 approval of the use by special review will remove the non-conforming status for the veterinary use there by allowing the use to expand the property is located within the Main Street master plan area of the town's master plan the existing Cottage Veterinary use operates in an existing building and is consistent with other commercial service land uses on Pikes Peak Drive the use aligns with the character area supports residents abilities to find Services locally and allows for the growth of an established small business there are nine criteria used to evaluate a use by special review these criteria ensure that there will be the use will be compatible with the character of the surrounding areas and neighborhoods The Proposal is consistent with the master plan and adequate Services exist to serve the proposed site after evaluating the proposal and

criteria staff has determined that the proposal meets the nine approval criteria set forth in the lane development ordinance the project is consistent with the master plan and all referral agency comments have been satisfied therefore staff recommends the Planning Commission recommend Town Council approve the cottage Veterinary Hospital use by special review this concludes staff's presentation I'm happy to answer any questions the applicant and the owner are also present and are available to answer questions uh questions for Amber okay questions for the applicant no pretty straightforward okay okay uh since this is a public hearing uh we ask members of the public who wish to comment on this particular item that's before us to come forward and to the podium state your name and address for the record and uh make your comment so we'll open it to public comment now seeing none we'll close the public comment any further questions okay we will close public hearing at 7:06 uh commissioner discussion I'm in support of uh this use by special review this has been a long-standing use in this area uh I see this merely as a technical change that allows them to do the modest very modest addition that they want to do for their property um and uh it's going to fit within the character I'm sure I'm sure staff will keep it within the addition Within the character of the of the neighborhood and the home which is a his I believe that's a historic home um built in 1913 yes so um I'm sure that all of that will be kept uh so I think

it's it's good to bring it in bring it into the legal fold as it were uh yeah I would also like to express my strong support for the Youth by special review for this veterinary hospital um I Echo what Ruth Anne said that this has been a valued part of our community for a long time and you know just because zoning changes have come about since it was established doesn't mean we want to stop uh them providing those essential services to our community um you know as you highlighted the nine criteria were met um and so it's it meets or exceeds what the master plan and the zoning ordinances require so absolutely this aligns with our uh vision and development goals additionally I do appreciate um that the applicants and the staff um brought to us this thorough presentation um and particularly regarding the proposed um building addition um the planned improvements will not only enhance uh the appearance of the veterinary hospital but also provide expanded services that will benefit the community uh and their attention to both function anesthetics demonstrates a commitment to responsible growth and quality development thank you I'll just add I appreciate the uh applicant um going through the actual process I know a lot of um homeowners not commercial businesses necessarily sort of do like uh basement uh remodels or additions kind of under the table and I appreciate everything coming uh to the Forefront and being approved in advance rather than retroactively and that I you guys are setting um rules and guidelines that will be in place to make sure that things are dotted eyes and cross teas so thank you for coming through the process I know it's a kind of a pain to go through the government process but we appreciate you doing
