It is now 5:30 and I will call our March 17, 2026 work session meeting to order. And if we look at our work se session agenda, we have a couple of presentations beginning with update on West Ridge Park. John, you okay, thank you.

Evening, council mayor. Um, pleased to give an update on the improvements that we've made out in West Ridge Park. Uh, primarily most of these have happened over the last 18 months to a year. um combination of parks rec department um public works and some other departments it included um have worked really hard to to get things spruced up out there. Um I think Russell provided y'all with a list with costs on there. Um I'll kind of run through this list and if y'all have any questions be glad to answer. Um so the stuff that we've got that's that's complete and ongoing or near completion. um the renovations to the fields. This includes the infield grading um mounds and bases that was $48,000. Um the fencing project that we completed um that's all the fields. That's a lot of replacement, a lot of repair um including the wooden um perimeter, a lot of the back stops um to get those all the things that were damaged taken care of um and get everything up to spec. That was $85,000. Um, we have a hydro seating project that's still um ongoing as we speak. Um, that's taking care of a lot of the bare areas around the park proper. Um, we've got a few areas we've got to go back and take care of, too. That's $60,000. Um, we've got asphalt removal, playground removal, and and grading in preparation for the new playground. That'll be there. That's $15,000. um the the sidewalks, um ADA improvement and miscellaneous concrete in the area near where the playground's going to be installed. Um that was $120,000. We've done a lot of tree removal and pruning around the park itself for about $50,000. Um the the bathrooms and the press boxes, those have been renovated. That includes new paint, new hardware and fixtures in the bathrooms, ACs in the bathrooms, and new floors. Um we've done a little bit of landscaping out there

about $1,000 worth. Um there's a lot more to come on that. Um the we we've essentially reimpported um the dirt for the infields. Uh we've got new quality dirt in the infields. It's about $10,000 worth. Uh we've done some drainage improvements out there. That's about $2,000. Um it has installed new security cameras to the tune of about $125,000. Um there's new scoreboards at every field. Um that's $42,000. Um to go along with that, there are upgraded control systems for the scoreboards at about $9,000. Um new lighting at every field um for about a million dollars. Um the new surface for the Miracle Lead field, which looks uh unbelievable. Um that just got complete, looks really, really good. Um uh the materials for that were $153,000 um with the installation at $95,000. Um also including new fencing around the Miracle League uh for $14,000. Um got a new playground coming in um will be uh partially ADA. Um that I believe that actually starts tomorrow. Um the installation of that that playground. Um we finished up a little bit of grading work in preparation for that today. Um, and the equipment is $262,000. The new playground installation is $245,000. Um, new American flag, $200. Um, and some new signage out there, um, which is part of the the citywide signage project to the tune of about $22,000. Um, we've got a few other things planned, um, that are are coming up very soon. Um, one of those we're going to be working on this week um, to kind of see what it looks like. these uh some new shade structures. Um the goal is to get those on uh covering all the bleachers. Um we've got um benches, trash cans,

picnic tables coming um for, you know, close to $60,000. Um we're going to be looking at our maintenance facilities, upgrading those facilities out there. Um we've got an irrigation project that is essentially designed. Um we're working on getting that bid out that will fix all the irrigation out there. Um, and that's estimated about $75,000. Um, we'll be looking at um, uh, resealing the parking lots out there and restriping. Um, that one we're we're estimating about $200,000. Um, hopefully will come in a little bit under that. Um, but that's we're working on that as well. Um, we have a an aesthetics master plan um that we have consultants working on um to look at the the park in general um to provide some some guidelines for how we look at um improving some of the other aesthetics with the walking trails, landscaping, things like that. Um we have um some landscaping that we're going to be doing in house um that we're we're currently actually going to start working on um now the spring's here um doing a lot of planting, trees, etc. all those islands in the in the parking lot. We'll be re rellandscaping those. Um we've got um we're going to be doing a little bit more sidewalk work connecting where the sidewalk is now at the uh playground area to an existing sidewalk so that we got some connectivity there. We've got to go over a little drainage path there. So, we're putting a little walking bridge there that'll be coming hopefully this summer. Um and you know, some some more things to to come um that we're working on. Um, and you know, this this doesn't include some some work that was sort of uh done previous to this too, you know, including the the retining of the softball fields and some other improvements that were made sort of before this this last push. Um, and be happy to answer any questions.

I wish there was a way we could work with maybe Lee and get this out because um I think you know it would help especially with little league season about to you know kick off. We got the the the festivities this this coming Saturday. I think it'd be great to tell maybe like a little reel or some just something that we could we could put out and talk about this because I mean there's been a lot of talk about you know West Ridge and and I think we've listened and we're doing stuff. So I think it'd be great a great story to tell. So yes sir,

Um you and I talked, you know, during tail end of last term and um a lot of W five residents use that walking track and the fields and everything. We've had some questions about the traffic signals. Um back last year, several months ago, um I can't remember if this council, last council, but anyway, it was approved to have uh some intersections uh studied and some design work done. The three intersections were at uh Third Street and Second Avenue, uh Wavely Parkway and Dunlop and uh Rocky Brook Road and Marsh Avenue. And so if you'll remember the last meeting we uh y'all approved the uh bid came in at second and third. Uh we felt like that was a a top priority and one of the quicker ones to get done. Having said that, the the decorative poles that we use that those are engineered and they're made specific to the design and so there's a delivery delay uh timeline on that. Uh other work can be being done so that we can install those when we get there. So that's that's the first one. The bid specs are being prepared right now for the Dunlop uh Waverly intersection which is a very busy intersection and uh somewhat I go through it from time to time and it's depending on which way you go and sometimes a little hairy and uh so that will be the next one when we get that done and get the bid done. We'll be bringing that to y'all for approval and we can get those on order. We may even look at ordering the polls early uh since we already know uh what those would be. And then the third to do would be the uh Mars Avenue Rocky Brook and that'll be

at the end and that's that's the way we prioritize those uh based on the amount of traffic and and so that that's where we are on those. Uh, is that just a turning lane on that one or is there a light included? Uh, which one? Mars Avenue and Rocky Brook.

I think there's a turn lane. There's a there's always some improvements on on the design. I can't remember. Seems like there's a turn lane coming out uh so that you don't get backed up during those, but the light will take care of most of that. There definitely will be some turn lanes and some improvements coming on to Waverly Parkway. That's a narrow road. So, there'll be some improvements there. Uh, and a lot of work going on in that area. That that intersection is going to be the hardest to do because there's a lot there's a water man. I can't remember how big. It's a big water man that's got to be moved. And so, uh, which will make it very expensive also to do, but it's it really has to be done. uh they'll leave that under the road. Uh so uh that's where we are on those and uh if you get any questions about it, you can have folks just just give me a call and I'll be glad to u tell them what I know. I drive through the Dun Live intersection twice a day. So it is uh busy. I the the improvements on Waverly look great. Um, I did get a call from someone who was worried that we were going to take the concrete road up and I said, "No, we're not taking it up." So, I was surprised that they were worried about that. But, um, the sidewalks in that multi-use path. Uh, I'm assuming they're going to put a is that are there going to be a bridge right there right across from the on the It looks like they've left a spot out open. It looks like it's going to be some kind of bridge on that multi-use path is what it looks like. It's going to be nice. I'm really excited about it.

I haven't I haven't looked at I don't I don't know. I'd hate to say yes. And then but uh a lot of utilities down through that road. That road's been there for over hundred years. And uh a lot of things run up and down the side of the road there. And it's not under the road. I can tell you that. Thank you. Any other questions?

As we continue with our work session, do any of you have any concerns about anything that's on the regular agenda or consent agenda that we make can have someone answer questions for at this time? Um, yes. I'd like to ask Matt Mosley to come up and explain. There's been I've had a lot of phone calls and there's a lot of confusion of what's going um on the Dunlot property, the White Road. um there's several neighborhoods back there. So just kind of explain an over view of what's going on from start to now please.

Yes, ma'am. So there are a couple different projects that are tied together uh surrounding the White Road uh Dunlop Drive kind of McDonald Downs Harwell Hills area through there. Uh you may remember I believe it's October 2024 we had a development uh Waverly Woods subdivision which was approved uh for a subdivision preliminary plat uh that went from Waverly Place around and would eventually extend and connect to White Road. Uh the developer I think working uh with some of the property owners out there has also looked at uh now this most recent uh project which is before you for first reading tonight not not the public hearing but the first reading of Pawn View Woods I believe is what it's called. Uh that is a request to reszone a portion of that property from uh and this this is property owned by the Dunlop family that touches White Road uh where uh Dunlop Drive currently ends and extends up to this proposed Waverly Woods subdivision, but it would resone part of that to R2, uh the portion along White Road, and then part of it to R3. Uh R2 is kind of a lower density uh resident single family residential goes up to about 15 or minimum of 15,000 square foot lot. So about a third of an acre. Uh R3 is a 10,000 foot minimum lot size which is basically a quarter acre lot similar to what's in the uh Harwell Hills neighborhood. And so with this addition, what they're proposing is to extend uh Dunlop Drive, where it currently ends now in the neighborhood up to the proposed development. We have a plant that is going before the the planning commission uh next week at their regular planning commission

meeting that would be a preliminary plan based on the proposed zoning before you tonight. So, I think there is some going to be some timing that that has to go along here based on what the council's actions are and and the ultimately what the planning commission's actions are. Th those two would would tie together to uh basically take the traffic from Waverly Place around above the uh Harwell Hills McDonald Downs neighborhood and then tie it back to Dunlop Drive. Uh the newest proposed subdivision does remove the access to White Road from that neighborhood. So it would would take the traffic through Dunlop Drive back out to the traffic light. Mr. Vermont just mentioned and then White Road itself would just have the 11 lot single family lots that are proposed in the subdivision plat to be approximately uh 089 almost an acre to one and a half acres in size. Uh there is an additional uh development that's not tied to either of these, but it is on the planning commission agenda and it it it's just south of here uh on the other side of Waverly Road, a Waverly Parkway that is approximately 27 uh single family residential units, but that again is is a separate development. And I did have a few just exhibits uh if you kind of wanted to take a look at these. The first is the

sorry. The first is the actually two separate items is the the current configuration of how Waverly Woods development would align. The second is what is being proposed with the new resoning and potential pl for you and the planning commission.

And so you kind of see the way the the proposed connections would be based on those two. Now the reasoning itself uh the way we've advertised it, we've we've switched around when the public hearing is based on some of the issues with the moratorum upcoming. We're required to advertise two times for zoning ordinance changes. That total timeline based on state requirements moves our advertising period to about 32 33 days with the moratorum and and just timing things. By switching our public hearings from the first meeting to the second meeting, that allows us to have the first meeting while we're advertising it and have the public designated public hearing that's required before we approve it at the second meeting, giving us more time to make sure that people are aware of it and also more time to make sure that the advertisements can meet the state requirements for uh notice.

Matt, can you explain planning commission had a negative recommendation? Yes, ma'am. So, can you explain to us why it's not going back to planning, it's coming here?

Yes, ma'am. So, the uh when it was reviewed by the planning commission, there was quite a bit of the neighborhoods both on White Road and on uh the extension of Dunlop Drive that turned out to the planning commission meeting. The planning commission ultimately felt uh that the proposed reszoning was not in character with the surrounding area. And so they made a uh actually the the request for a positive recommendation to city council failed uh in a I believe it was four against, three in favor and one abstension. So we sent a negative recommendation from the plan commission to you for review. the applicant because of the way zoning works has the opportunity to still have it be heard by the city council because you are the ultimate deciding body for zoning actions. So, uh they are asking you to consider it uh with the planning commission's negative recommendation.

What was the recommendation of the planning department? When we looked at it, we felt that uh that the proposed zoning was uh similar to what is is currently out there. Uh the lots in the McDonald Downs Harwell Hills extension are are very similar in size. I think there's more discussion about the lots along White Road. Uh because while the properties on White Road are are mix of R2 and R1, R1 is very low density, much of the development on R on White Road is a still a very low density even though it has a potential to have more development.

So the planning department recommended to the planning commission a positive recommendation. Yes, sir. and the planning commissioning issued a negative recommendation. Yes, sir. Which is well within their right to do so.

George, we were listening to the residents as as well that showed up at that meeting. We had a good turnout of people that were against what was going on. So, I think we listened to them. Matt, can you explain if going before the council and having the public hearing at our next meeting? Um, if this were to get approved, is it would it everything still be in timeline with the getting it in before the moratorium?

Yes, sir. That's that's why we've we've kind of switched the dates to make sure we can meet those timelines. So, if the uh city council approves it at the next meeting, the planning commission uh has the ability to potentially approve it subject to your uh approval. They may decide that they want to wait and see whether the city council will approve the zoning before they do. So, if they do that, then they would have the ability to approve it at their April 28th meeting, which would still be prior to the moratorum. And my next question is this might be moot because of the moratorum and the timeline of that. But if the city council decides to deny this resoning, what are the restrictions of them coming back before the council and doing resoning typically without the moratorum, right? Because that's going to be a year. So

So if the city council denies the resoning, then they're basically by our zoning ordinance required to wait one year before they can reapply for a zoning amendment. Uh the the zoning ordinance only allows basically it says once you get to a public hearing at the deciding board then that's considered to be have been submitted and and so if you were to deny it they couldn't reapply for that within a year's time frame. So they would be having to wait for the moratorum timeline almost anyway. And reszoning this um it breaks the consistency of what the neighborhood um is already going towards or the way the homes are already built there.

Yes, ma'am. So the the the existing uh Harrow Hills neighborhood there is is roughly quarter acre lots. They were constructed, I believe, in the 80s and 90s. U these homes, although and and we we rarely know the exact type of home that's going to go back on that lot because we don't require them typically to provide us with square footage or value or any of that stuff. Uh it would be roughly the same size of lots there. Now, on the White Road side, you you only have about five or six, maybe eight uh homes on the entire road. And so, most of those are family kind of and some larger estate lots. There are some some smaller lots there, but those smaller lots are still a couple acres in size. They the applicants have submitted a a preliminary plan to the planning commission that does take into account some of the concerns. I think that were raised at that meeting, including some shared driveways, uh some buffering so that there's some additional buffering both on the R3 zone against the the subdivision and then some buffering along the frontage along White Road that would kind of help shield the the houses from across the street on White Road. But again, that would be all things that the planning commission would have to consider.

Robbie, I was looking at our consent agenda and under item number three, we see where the proprietary of Top Chef alternative um applying for a specialty license. Can you explain to me what this special license will entail?

Yes, sir. Mr. President, um you have we've all met um the proprietor um from across the street at TopShelf Alternatives. Um he's seeking originally he was seeking a license um to sell consumable hemp under state law, which is lawful at the moment under state law. Um he was seeking a license which was paired with an alcohol license, but you the alcohol license um was in a special overlay district. um the corridor gateway corridor and wouldn't be permitted there for any alcohol establishment for those sales. Um so he has come back to this body seeking approval for um a special specialty retailer of consumer consumable hemp products alone. Um and at the moment um state law controls um of course the the council could decide one way or the other. Um, still it's up to you under the state code, but operating under state code is what we would be we're in the position of doing at this point to either approve or deny.

Earl is married to Susan Thomas for has been married for 51 years. They are blessed with four children and their spouses and 11 grandchildren. Earl graduated in 1975 from Gla Central High School in Belgrade, Florida. He then went on to

graduate from Asbury College with a BS degree in Christian education. In 1980, he graduated from Asbury Theological Seminary in Wilmore, Kentucky. and in May of 1980 with a master's of divinity degree. In January of 1980, the same year he began serving as one of the pastors of Trinity Methodist Church, Napolica, and continues to serve Trinity as one of the pastors and the congregational care pastor. Earl Ballard exemplifies the true meaning of compassion through his consistent care, generosity, and willingness to serve others. He demonstrates an unwavering commitment to helping those in our city by always supporting them through difficult times. His love of pastoral ministry and helping people discover and grow a new life through faith in Jesus Christ is a passion of his life. Earl leads with kindness and empathy. What makes Earl especially deserving is that his actions are never done for recognition. Instead, they come from a sincere desire to love and care for others the way Christ calls us to. One that's close to Earl told me, "Just being in his presence calms me." Earl's compassion compassion is contagious and residents like him make our city of Opaikica a better place.

Okay. My name is Carolyn Reid and I live at 520 White Road. I just wanted to briefly follow up after the planning commission's review of the reszoning request at 598 Dunlock Drive. While this resoning is accessed from 598 Dunlock Drive, it does directly affect the character and development pattern along White Road. The planning commission, as you know, recommended denial by a 4 to3 vote after discussing compatibility with the existing character of White Road and concerns about the increasing intensity of development along that corridor. White Road today functions as a lowdensity residential area with large lot single family homes and that character was an important part of the commission's discussion. We understand that growth is important to our city and we are not requesting opposition to development. We are simply asking that growth remain compatible with the existing pattern along White Road. We respectfully ask the council to consider upholding the planning commission's recommendation. Thank you for your time. Mr. Mayor and the council, appreciate the opportunity to speak. Buddy Bruce, 505 White Road. Carolyn Reed is my cousin. The Bruces have majority of the property on the right side of White Road if you go down the road. It is a low density residential area. There's five or six houses on that side of the road, a few on the left side of the road. The

character of that neighborhood is large estate lots. Obviously, we'd like that. We're not opposed to development, not opposed to the Dunlops developing their property. the portion wrong that adjoins White Road. We're just asking for lower density than what's there. I know that they've gone from 12 lots, I think, down to eight lots now. And if we just I just learned that they're not going to have any driveways coming out on White Road. I do know the proposed plot plat changes that they have making the lots bigger extend out into the pond. So, half of the lot size will be in the pond. That's not something that you construct houses on. We're just asking for a lower density on the part that adjoins White Road. Uh we just learned it before the last planning commission meeting that we're R2. We didn't know we were even R2 and I know you're planning on making this R2 on that side of the road.
