40:52Speaker 10

Okay, so those are some of the requirements as far as the certification application and issuance. Are there any questions?

41:02Speaker 3

41:27 – 41:45Speaker 7

Thank you so much. I have two questions. I just need a little, I know this is already passed, but a little clarification. I wanted to know if we will be having training for our code department on what this is all about, so they would know precisely what to look for.

41:46 – 41:57Speaker 3

42:00 – 42:21Speaker 10

We've been working closely with code enforcement and giving them an opportunity to input as it relates to the legislation. So they will be available and ready to move forward with the necessary steps in order to make sure that the RVs are in compliance. And if they're not in compliance, what is necessary to cure them.

42:23 – 42:39Speaker 3

42:41 – 43:08Speaker 7

And I want to know that I heard what you're saying, but is there a way that we can just go ahead and create a cheat sheet per se where instead of having all of, you know, all of this, the ordinance bullet points that they could have, because I don't want it to come to the point where we're unsure on what is acceptable and what's not because we're human and we can make a mistake and we don't want to make mistakes with this because we've come too far.

43:10 – 43:29Speaker 3

43:32 – 43:47Speaker 10

Thank you for that question. We will get with code enforcement and pull out those particular bullet points from the ordinance itself to make sure that they will know exactly what they will need to evaluate the situation as it is.

43:48 – 44:03Speaker 3

44:04Speaker 7

My last question is, the verbiage in here says improved driveway. What does that mean? Aquí dice...

44:15Speaker 3

Entrada de auto mejorado. ¿Qué quiere decir eso?

44:23 – 44:50Speaker 10

Thank you for that question. The RV, because it is a vehicle, it needs to be on a paved surface. So it can either be a concrete slab, an asphalted area, or an area with pavers in order to make sure that none of the things relating to the RV may drip into the ground and interfere with our groundwater.

44:51 – 45:13Speaker 3

45:15 – 45:27Speaker 7

If we can also have that spelled out for our residents, because I didn't know what that meant. So they would know exactly what this is, you know, what we're requiring from them. Thank you.

45:27Speaker 3

Okay, thank you. Next.

45:42 – 46:04Speaker 6

Hypothetically speaking, we said that they can park on either side of their house. I don't want to park my RV on the side of my house. I want to park it in the backyard along the... The question is, as long as it's on the approved slab, could I do that?

46:05 – 46:31Speaker 3

Okay.

46:34Speaker 10

Thank you for that question.

46:35Speaker 3

Gracias por la pregunta.

46:36 – 47:09Speaker 10

The main thing is that the RV is either on the side or the rear. We would prefer the side so that we can see basically where the emblem is located so that we'll know that the RV is registered. By parking in the rear, it puts us in an imposition where code enforcement will not be able to determine whether that particular RV is registered, even though we are looking at having not just a registration on the RV, but also a registration on the property itself.

47:09 – 47:36Speaker 3

So you still didn't answer my question.

47:41 – 47:53Speaker 10

It would be preferred to be in the side so that it could be visible from the public right away for code enforcement. But as long as you have the certification on your home, you can park it in the rear as long as it's done properly.

47:54 – 48:07Speaker 3

48:10 – 48:44Speaker 6

This might be a management question, not sure. But did we put anything in place if a homeowner decides that they're going to keep their RV in their yard and they're not going to get the... the registration. What are we doing? I heard about the fines or whatever. We have houses here every day that has running fines and they don't care. So what are we doing? What are we going to do with residents that decide not to participate in RV registration?

48:45 – 49:13Speaker 3

49:19 – 49:48Speaker 10

The city's best utilization for this, and this is not something where we want to charge people for their violations. We want them to come into compliance. So that is really the main thing that we're trying to secure, compliance with the rules and regulations. For those persons who choose not to follow the rules and regulations, liens and citations are our only method of basically getting them to come into compliance.

49:49Speaker 3

Gracias por la pregunta. Nuestra mejor manera de usar esto. That's it.

50:30 – 51:28Speaker 8

Thank you, Mr. Gregory Gay. Commissioner Louis B. Santiago, and I believe that I'm the sponsor of this amendment, these changes that the ordinance had before. And I want to make it loud and clear here in front of my colleagues and in front of these residents, they keep the time today to come here and to really know, okay, what is going on with all this. And we have a couple of points. Yeah, she's going to translate it to me in English because I'm going to explain it there in Spanish. Welcome to all of you.

51:29Speaker 3

Excuse me, I need a pen.

51:39Speaker 3

Gracias. Muchas gracias.

51:44 – 52:01Speaker 8

¿Seguimos? With all due respect, I believe that they deserve.

52:01Speaker 4

That they deserve respect.

52:05 – 52:17Speaker 8

52:17Speaker 4

There is something that hasn't been said that was said when we began speaking of this a while ago.

52:27 – 52:39Speaker 8

Yeah. Mr. Gay, in your department, you bring now and you bring into what are we calling this again? That type of your side plans.

52:39Speaker 3

I don't know if everybody have it with you.

52:40 – 53:18Speaker 8

I don't know if everybody have it with you. My colleague Commissioner Irving brought a good point a good point about this. There are people that do have space behind their house.

53:19Speaker 4

And we had said that yes, that it was going to be permissible.

53:24Speaker 8

53:31Speaker 4

And today we are bringing something that is on the contrary to that in the verbiage.

53:36 – 54:25Speaker 8

In the verbiage that this legislation brings, it does speak of what we spoke about before. Okay. Now, Mr. Gates, I know and I remember that we've been talking about this a long time ago for a couple of times in my office and even in the first workshop that we have. And we have case people that they cannot parking in the side of the RV because they have all the things they are parking and they have in the space in back of the house.

54:27Speaker 3

And we've talked about people not being able to park behind their homes.

54:38 – 54:50Speaker 8

I believe that we know that we're going to create the sticker that you showed a few minutes ago. And if somebody has that recreation truck parking in the back of the house,

54:52 – 55:05Speaker 3

55:07 – 55:21Speaker 8

Se le iba a permitir. They're going to permit it to doing it. always, if they follow the rules and regulations that we already write in here, that that truck has to be on top of concrete or other material.

55:21Speaker 3

And so all of you know, we did not bring this forth for you to rent this.

55:28 – 56:17Speaker 8

This is not for rent. This is only for parking at your home. Because the first time the legislation spoke of putting our vehicles elsewhere and paying rent for them, and I believe that is an injustice.

56:17 – 56:30Speaker 4

So now we are here with this, revisiting this again. Thank goodness. But I do want everybody to please comply with the rules set forth in the legislation.

56:31 – 57:18Speaker 8

And for ending this conversation, Mr. Gates, I love to, you know, to make reviews about that. And yes, I always tell you, you know, everybody had to follow rules and regulations that the city of Opa-locka put in place. That's the motivation that we had to make our city more organized and beautiful. But also, Mr. Gates, we already talking about that before and I want to take note of that because I know that we have some people that they have that RV parking already in the back of the house, and they don't use it for renting. They have access to go out, but they're using the driveway for anything else, for like parking the boat, because they cannot park the boat in the front, you know that.

57:18 – 57:43Speaker 3

Okay.

57:50Speaker 1

They have that truck walking in the back, that sticker.

57:53Speaker 8

Okay, that sticker. That sticker had to be in front of the house.

58:03 – 58:28Speaker 10

Commissioner, I was just going to add on to that. We would prefer that the vehicles be on the side so that code enforcement can see it very readily. But we will, upon the registration, they will have an opportunity to put the decal on the vehicle as well as on the property itself. So that way they'll know that that particular property has a registered RV on the site.

58:28 – 58:57Speaker 3

59:01 – 59:34Speaker 15

I really don't have a question. I want to just make clear in the Legislation Ordinance on the number 3, it talks about side yard, improved driveway, or other lawfully paved parking surface. That is the caption that would capture the fact of being in the back, even though you prefer it on the side. It's actually captured in the legislation. Then you just added the fact you will have a decal opportunity in the front so code would notice it. I want to hear from the community. I want to hear from those impacted.

59:34Speaker 3

I want to hear from the community.

59:57Speaker 17

My question was, it's a recreational vehicle, but so if you have a yacht and an RV, it's a different situation?

1:00:07 – 1:00:18Speaker 3

1:00:21 – 1:01:04Speaker 10

We've actually had conversations regarding that because we do understand that there are some cases where someone may have a recreational vehicle and they may have a watercraft and they take out both of them when they go on their vacations. So it's really going to be measured on a case by case basis. There is already legislation that speaks to the storage of watercrafts. And this is just additional information as to address the art recreational vehicles. Depending on the size of your property, it's really going to determine whether you can store both of those particular vehicles on your site.

1:01:04 – 1:01:32Speaker 3

Okay.

1:01:34Speaker 17

Could you please state your name and address? My name is Emmanuel Fortes, 1105 Salton. Thank you.

1:01:44Speaker 3

Emmanuel Fortes.

1:01:46Speaker 10

Okay, we're about to wrap this up. Just want to go over the prohibited parts, and the commissioner has already kind of alluded to it.

1:02:04 – 1:02:20Speaker 4

If you have any other questions, this is your time to speak while we're here. This is the time. Is everybody happy with this then? Is it going to be $100 or will it go up? Uno a la vez, por favor.

1:02:24 – 1:02:35Speaker 16

Somebody Somebody said before that what you're doing is illegal.

1:02:35Speaker 4

I'm not sure if this was looked at before, but somebody said it was against the law.

1:02:41Speaker 16

Have you been able to check that?

1:03:01Speaker 4

Because you are particularly charging us rent for our own vehicles and on our own properties.

1:03:16Speaker 10

Can you give us your name and address?

1:03:18Speaker 3

Luis Alvarez. Luis Alvarez.

1:03:18 – 1:03:54Speaker 10

Luis Alvarez. Okay. As it relates to the question that you just raised, we looked up the terminologies as it relates to whether you can use the term registration or whether you can use other terminology. We are actually issuing what is called a certificate for you to be able to park your RV on your property. And it is allowed.

1:03:55 – 1:04:09Speaker 3

1:04:23Speaker 4

I would like to know if $100 that will be charged would be yearly or how that would work.

1:04:30 – 1:04:53Speaker 10

As it relates to the fees, the fees are $100 annually for the amount of time that you either have the RV in your ownership or the RV, someone who is a tenant on your property owns the RV and is maintaining that RV on your property. So that is a $100 fee on an annual basis.

1:04:53 – 1:05:10Speaker 3

1:05:13Speaker 10

Okay. The last few points. Any other questions?

1:05:18Speaker 3

Cualquier otra pregunta.

1:05:26Speaker 12

So would the vehicles be able to, with their proper certifications, be able to be on the sidewalk?

1:05:58Speaker 3

Excuse me. Ah, yes. In the back of the house.

1:06:07 – 1:06:31Speaker 10

With the certification, you will be able to park the vehicle in the rear of your property as well as on the side of your properties. With the one caveat, you cannot enter the rear of the property from the city alleyways. You have to be able to enter from the front of your property through the side and park the RV in the rear, if that's what you choose to do.

1:06:32 – 1:06:50Speaker 3

1:06:54Speaker 10

Okay. If there's no more questions, we're going to go over the prohibited uses and utility connections.

1:07:12 – 1:07:34Speaker 10

1:10:41Speaker 10

This concludes the presentation. If there are any other questions that you would like to ask, we're ready to receive them at this time.

1:10:49Speaker 3

Si tienen algunas otras preguntas que quieran preguntar, estamos listos a recibirlas a este tiempo.

1:11:06Speaker 10

Question in the rear.

1:11:07Speaker 3

I have a doubt.

1:11:09Speaker 12

Is it only on pavement that these can be parked or can it be parked on gravel as well?

1:11:38 – 1:11:59Speaker 10

The RVs have to be parked on an improved surface. In most cases, you're looking at either on concrete, asphalt, or some type of paver. A gravel, we have not looked at because gravels have a tendency to be a porous material.

1:12:01 – 1:12:27Speaker 3

1:12:29 – 1:12:53Speaker 10

And just let me add a gravel, a gravel surface can still allow any type of fluids that are associated with the RV, whether it be oils or petroleum, it can still allow that to be, to come off of that particular vehicle and be deposited into our ground and eventually into the water system.

1:12:56 – 1:13:33Speaker 3

Just to add to his question, I know other people, this is not my question. Does the RV have to fully be in concrete or just the wheels?

1:13:37 – 1:14:04Speaker 10

Generally, we would like to see the entire RV on whatever particular surface that you choose to. And because you have those particular liquids that come off of the vehicle, if it was just the wheels itself and wheels really don't contaminate the ground, it's the oils and everything that come off of the vehicle. So it needs to be a fully improved surface, concrete or asphalt.

1:14:05Speaker 3

1:14:14 – 1:15:31Speaker 8

Yeah, Mr. Gay, what are we calling that stone? We're calling gravity? Again? Okay. All right. Let me say this, okay? Okay. And any of them, any liquor for any trucks or cars or buses, whatever we're parking, that thing is penetrating to the ground, on the ground, no matter what. It's a very strong chemical. Okay, with that, what I tried to explain in something that we had to see in the future, Mr. Gay, they have a lot of type of RV. When engine, the motor that you're driving it, and the other one that they pull it. You see the difference? If they parking one in gravel, And the storm, okay, it is not motor driver, okay? That one don't throw anything to the ground. You know, I prefer, you know, all that type of RV. Yes, okay, because it's saving a lot of things for Earth.

1:15:31 – 1:15:54Speaker 3

Can you repeat the last part of that, please?

1:15:54 – 1:16:17Speaker 8

I'm going to say it in Spanish for you to understand. The vehicle that doesn't have a motor, I would prefer it. That doesn't throw any liquid, no gasoline, nothing. And it does the planet good. You're going to say it in English? You want me to say it in English? You did. Oh, okay.

1:16:20 – 1:16:51Speaker 10

Thank you, Commissioner. For the motorized vehicles, it would need to be on a concrete or asphalt surface. For the vehicles that are trailers, That is something that will have to be analyzed on a case-by-case basis. We would prefer that they also be on a concrete surface or an asphalt surface because this is a vehicle that's being parked for an extended period of time.

1:16:51 – 1:17:05Speaker 3

1:17:20 – 1:17:46Speaker 11

Carlos Novo, 1840, Paloca Boulevard. About the gravel, like he referred about that, I did so many inspections on the keys and the driveway that they have with the gravel. And when we use as far, we use oil. The as far is oil. You know, normally I think they should be to go. The gravel, they should be to be.

1:17:53Speaker 3

Yeah, so the driveway has gravel, so it shouldn't make a difference either way before constructing a property.

1:18:28Speaker 3

1:18:36 – 1:18:51Speaker 18

In an as-build, you have the location where the sewer and the plumbing... Clean water and dirty water are going through, you know, so you should have already an idea where it's going through.

1:18:52Speaker 3

Now, for storm drains and sewer drains and all that, it's mostly in the right of way. So that is also, the city also have that stipulated, whether they use either GIS or whatever other form in their plans.

1:19:26Speaker 3

In other words, property...

1:19:33Speaker 18

This is already a property that already we're paying for. We're paying high taxes.

1:19:39Speaker 3

Personally, myself, I'm paying high taxes.

1:19:45 – 1:20:00Speaker 18

And on top of paying a fee, an annual fee, I understand that you want it to be accessible, which there's different type of material that it can be resolved, which...

1:20:01Speaker 3

1:20:14 – 1:20:25Speaker 18

Rubble is one of them. It's inside the property. It's not being transited daily like... public driveway or right-of-way.

1:20:25 – 1:20:38Speaker 3

1:20:38 – 1:20:59Speaker 18

Exactly. So it's because it's more economical. A lot of people here work like you and I. So this will be something additional on top of the annual fee and the maintenance that these RVs require.

1:21:00Speaker 3

1:21:10 – 1:21:33Speaker 18

So, here as OpaLocal citizens, we also want to work with the city and comply. Yes, that's what we're here for. But you also have to have the consideration of what... Yes, complying with the city of Paloca, but also not hurting the residents of Paloca.

1:21:34Speaker 3

Can I get your name and address? Lori, 1840 Paloca Boulevard. Thank you.

1:21:54Speaker 10

That is something that we'll need to further evaluate as it relates to whether gravel can be an option.

1:22:02Speaker 3

1:22:08 – 1:22:26Speaker 5

Good evening, Shemekka Lawson, City Manager. So I just want to add to that. Gravel can be considered an improved driveway when it is a permanent engineered structure, not loose stone. So if it's a loose stone, that cannot be considered. If it's gravel that's permanent, then yes.

1:22:28 – 1:22:40Speaker 3

Buenas noches. Administradora municipal.

1:22:42Speaker 10

So based on that particular evaluation, we're looking at it being, it could be a gravel surface, but it would have to be a compacted gravel surface, not a loose gravel surface.

1:22:52Speaker 3

Okay. Are there any more questions? Okay.

1:23:11 – 1:23:23Speaker 13

Dennis Camacho, 600 Curtis Drive. Going back to the property taxes, 13 years ago I paid a little over $1,000. Now it's over $4,000. So is it going to stay $100 for five years or is it going to be $500?

1:23:23 – 1:23:54Speaker 3

As it is written in the ordinance right now, it is $100 on an annual basis.

1:23:55Speaker 10

In order for the ordinance to change, you will have to come back before the commission for consideration.

1:24:00Speaker 3

1:24:08Speaker 10

Do we have any other questions?

1:24:10Speaker 3

Cualquier otra pregunta.

1:24:14Speaker 10

If not, that will conclude this education session for the RV certification registration process.

1:24:24Speaker 3

1:24:30Speaker 10

We'd like to thank you for coming out.

1:24:32Speaker 3

Gracias a todos por venir esta noche.
