Okay, it's 5:30, so I'm going to call the regular board of selectmen meeting to order at 5:30 p.m. Thank you all for joining us online. Um Jim Lampost and John Misham are online as well as some other um folks in the area. We appreciate you joining us on this snowy evening. Well, it's end of a snowy day. Um [clears throat] I'm just going to go over a brief update. I know Dave Beer is on the line. I see him. But I'm just he sent me a quick report. Um, so I'm gonna go over a few things of this storm and then um if public has any comment or Jim and John if you have questions after that we can take those. But basically um Dave is saying that about 20 ines of snow fell. Um we've travel's been very limited throughout the storm. I know that our plows have been out since 3:00 yesterday afternoon. They've been ready. They did some pre-treat uh but very light because they knew it wasn't going to take care of 20 ines of snow. So uh we've been they've been out since whenever it's been possible with white out conditions. They had to go off the roads at that point in time. We've had one truck that uh had to be um pulled out because it had a problem. Um, so it I guess went off the road a little bit and then we had another truck that had some hydraulic issues and that had to be pulled from service and they reorganized, got another older truck to get out and get going. Um, Dave Roerish has been at the EOC since yesterday
afternoon. We have um had that partially manned and um the [clears throat] Old Lime Fire Department had a shed fire that they reported. No injuries though. And then there was a rolled over back hole on Mile Creek. Also no injuries and everybody is safe on that. Uh we have had about 50 people without power in town. Uh as far as I know, the power restoration efforts are still uh working on and they do believe that those people will have electricity by this evening on Roland and that was caused by I believe a large piece of our tree fell, hit some wires, took down a breaker. We had had one motor vehicle accident. Uh a lot of wires down calls um and some disabled motor vehicles in town that our police department has helped as well as two bar burglar alarms that were activated. Um we continue to work with the state. We've been getting updates every two hours um from them with information on this storm and we continue [clears throat] to do that as often as possible. Um we didn't have any requests for support or shelter at the EOC or respit care and there was only one call there that for assistance on another issue. Um, trash collection is not going to resume tomorrow. Katie will have that up on the website. Uh, CWPM will need another day. Uh, to tell you the truth, it's better because Ed needs to get clearing these roads so that they're wider so we can safely put the trash cans out. Um, the landfill will the transfer station will not be open tomorrow. uh as well. Schools will be closed tomorrow and town
hall will be closed tomorrow and we will are reorganizing some of the meetings for those that we can to um happen virtually. So that's where I am. Do either of you have questions for me on that or information or further communications or correspondence that you'd like to share? I received a call from Alice Burbank regarding her driveway. I know you're aware of it. Um I I it would be nice to try to I know it's kind of an inherited problem for us, but it would be nice if we could try to move that along and possibly come to some kind of resolution.
I spent some time over on Craig Road on Saturday afternoon. Um, I have sent pictures to our town engineer. I explained that my town engineer is not going to really be able to totally assess the situation until the snow dissipates some melts. Um, and uh, this has been an ongoing problem. Uh, and we will see what h our town engineer says once he can completely look at it. I did have a meeting with him this morning about something else, but we did not discuss Craig Road at that time. I'm not sure he'd seen his emails yet. Anything else?
I've received correspondence from Steven Ross on sewers and I've received inquiries from people in Sound View and beaches around here as to when uh the plows would be through. And I understand the situation is uh you know we're we have a lot to do. So, are you still without have you not been plowed down there? Yeah, Portland has about two feet of snow on it right now.
Okay. I'll check in with Ed at the end of this meeting to see or make Dave, you're online. Maybe while you're online, you could make a phone call to Ed uh to mention that uh there are still areas and when are we going to get to them? We need passes at least just a center down the road would be nice. Um
I know that uh spoke with that earlier this or later this afternoon. His crews are still out working and their plan is to continue uh punching out every roadway through the evening and then they once they get every roadway open uh then they'll come back tomorrow. Crew's been out since 3:00 this morning.

We we can totally do that. I don't know if you want to talk about it now or in real life. Well, we can't talk about it during public comment. So, I will add you to the next agenda. Okay. Okay. Yeah, under C the second paragraph uh where Selectman Lampost was commenting, it says I need to speak with one voice. I believe that should be we. Yep. Thank you, John. Please note under new business for some reason I put road in public safety committee but there are no uh there are no appointments to that. I got confused because somebody sits on flood and erosion and I miss things thought but she was. So let's start with flood and erosion control. With that, we have two people that have to be I know I didn't send you Wendel Webbers, but Wendell is already a sitting member and he did send in his application and it was missed the first goound. So Wendell is just a reappoint as an alternate three spot for one-year position on alternate from one for one expiring 131207. And then the alternate twospot, the flood and erosion control uh commission uh has asked that Dawn Kouglto has would be named and uh they sent some very letters of favorable um meeting her to discussing with her that she would like to be a part of this committee. So, can I have a motion to and Dawn would take the alternate two spot. That would also be a one-year commitment to flood and erosion control. So, if I could have a motion to appoint them both, that would be wonderful.
I'll make a motion to appoint Don Kugto and Wendell Weber to the alternate two and alternate three spots, respectively. uh both expiring on January 31st, 2027. Thank you. Thank you, Jim. This is part of one of our uh ordinances which um Vicki and I had a lovely conversation about because it's very uh outdated. So, we'll be making some changes to that. But, um town council is uh Susman and Shapiro for 2 years. Um and I need a motion to do this. I'll make a motion to reappoint Sesame Shapiro's town council for a period of two years.
Okay. Thank you, Jim. John, you want May second? Okay, I'll second. Any discussion? Uh, are we interviewing Have we interviewed any other um uh companies or firms besides the current? We have not. And we just because we are appointing them does not mean we cannot go out and do that. But at this point in time, Vicki would like it if it was just done and tied up because it is a 2-year appointment and it is overdue. Um,
so it's it's actually a term of an appointment, not a term, not a contractual obligation. We don't sign a contract with them. Okay.
So there's no contract, but the the fees have stayed the same. um and I have a meeting with them later this week. Um I certainly can go out, but I will tell you that there are fewer and fewer um firms that want to participate in municipal law. And I know that lime uh did a RFP uh last year and chose out of that chose Susman and Shapiro as well. So that's all I know at this point in time, but we certainly can go out and do that um if that is something that we want to discuss at a further future meeting. So hearing no other conversation, I'll call for a vote to appoint the town council to appoint the town council as Susman and Shapiro for a 2-year period.

And uh it is for Patrick and Diane Looney uh uh for their property at Two Moss Point Trail. So if I could have a motion uh to [clears throat] refund an overpayment of taxes in the amount of $2,984 to Patrick and Diane Looney. I would appreciate it. I'll make a motion to refund $2,984 to Patrick and Diane Looney for overpayment of taxes

I sent you both a letter um that um Rogers Lake Authority had written a letter and let me know that they wrote a letter uh in support of um Senate Bill 145, an act studying the remediation of hydrillaa in state lakes and the expediting of permits related to such remediation. Um I mentioned at that time when Mark Hastings sent it to me that did he want the selectman in both lime and old lime to also write letters to further support it and he said that would be wonderful. So Kate with the help of Katie we uh drafted a letter and um I've sent it both to you but I think it's really important that all three of us sign it. So, we did put space for both of you. If you don't see any problems with it, what I'd like to do is approve it and then we'll put it on the counter and anytime on Wednesday you want to swing by town hall um and sign it. That would be great. And then we'll send it to Martha Mars and Devon Carney. Uh, I'll make a motion to approve the joint letter in support of SB 145 and act studying the remediation of hydrillaa in state lakes.

[clears throat] Any further discussion? just that that you know I I actually am very much in favor of the remediation of that. It's as a boater it's it's terrible uh trying to get a dinghy through it. It's just incredibly invasive and fast growing and uh by August it's it's crazy. We really need to get rid of this stuff. I Any opposed? Any abstensions? Motion passes. The next one is about snow removal on sidewalks. I sent I think I sent you Well, no, I didn't send you, did I? I didn't send you the snow up. So, I did have some information and I will get it to you. This is really just a point of discussion and as we get into um Hall's Road sidewalks of how we're going to maintain them and um so I'm going to send you both the Connecticut General Statute on sidewalks and snow removal. And I think that we need to look at it and have a conversation with Ed and public works um of how this is going to be maintained. As you know, we have one um sidewalk tractor, I guess we would call it, um that does Lime Street [clears throat] and um we have a couple of people who are certified to use it. Uh so will that be enough? It is an older machine. It's been around for what little bit. And will it be enough to also do Hall's Road? How are we going to handle it? So, I just want there to be a discussion on the table and I'm personally hoping that there is no more snow this year. So, we're not going to be talking about it, but hopefully in the spring when it goes away, then we can have a more fruitful conversation with Ed of how he would like to see this done in the future so it can be timely and uh efficient and financially feasible for the town. Okay. I'll I'll volunteer to become certified.
I It does look like a fun machine. I I would like to do it as well. [laughter] We could take turns. Um Jim, you handle the flooding down on Pond. We'll do the sidewalks online. You got it. It's a deal.
Okay. And then I did send you the mailbox policies. Um, you know, as every storm and especially when the snow is heavy and the plows are going down the roads. Um, so this is something that literally Michelle Hayes found last year was after the season, but she had pulled it up. Um, I think it was either Waterford or Madison that her she had seen first. But basically, other towns have policies. This is not an ordinance. It's just a policy. But we've had phone calls where somebody will call us three or four months after a storm and say, "You hit my mailbox this winter and I'd like it repaired." And sometimes Ed will say, "It's the rotten post. It's not it wasn't that we hit the mailbox. It was a rotten post or whatever." And I want the public works to be responsible for those that they get hit. It's an accident. It's not something they intend to do. But I do think that these policies that who we sent to you are fair in the sense that you have to report it within like 24 to 48 hours and that's by sending us an email and then they can put it on a list and they can get to it when they can. Um, so I would love it if the two of you could look at these and we can draft something so that the next winter we would have a policy going forward. The only request for a requirement for a policy is that the three of us vote on it and it becomes a current policy until the next person comes around if they want to change it at that point in time. They're flexible. Uh, I mean, I thought the policy was was pretty um was was pretty good. I didn't see any problems with it. It seems very reasonable.
Do you have one that one town that you liked better, John? Uh, I I saw Waterfords. I maybe I missed the other one, but I Waterford seemed pretty pretty straightforward. Okay. I Yeah, I think I sent a couple of I think there was a couple attached. Stonington. And if you didn't get the whole packet, let me know. I have Westbrook, Stonington, and I thought I sent them all. Um, Brook has some specificity. That's nice. Who which is that? Stony. Westbrook has a little bit more specificity.
Okay. So, I'm gonna do me a favor. Just draft it up. If you see one that you like, why don't you highlight it and then I'll draft something for our next meeting in March. My my only caveat would be that we have so many seasonal properties that a lot of people don't see their property until May. And that's why we have that delay. Um and that can make it difficult for Ed, you know, to say, oh, you know, who did this three, four months ago? Uh so, you know, I don't know. We may just want to think about that, too. I will tell you that the person who um called us months later is actually a year-round resident and it wasn't down at Charlotte. [laughter]
Oh no. Um I think where I don't know it's where you know you all know I mean we've all had our mailboxes. I mean I'm on the fourth hit so
it's I my the road just bends near my house. So, if you you're just not straightened out, it gets a little crooked sometimes. But, um, and at the moment, it's going to stay crooked until spring. Um, but anyways, let's look at those. I'll trying to draft something together. If you just highlight things you see in either one of those, John, if you didn't get the whole packet, let me know. I'll send it to you again and then I'll draft something up and we'll see if we like it. Okay. Yeah, I'll I'll I'll double check that. I
Okay. Not sure. And then I'll also run it by Ed and see what he thinks too just for and Jim if you want to put something in for seasonal that's certainly we something we could do as well but I know there's enough people down there that would certainly notify us if they saw their neighbors box was knocked off. That's true.
Yeah. Okay. And then I sent you the Halls Road grant acceptance. Um I had a meeting with them today um to go over how the grant is run. Um so met with the team. There were three on from uh the state and Aaron was on from Jacobson and I would like to be able to sign this and get it back to them so we can accept it in a timely manner and then go from there. And basically they told if you have any questions I can tell you but basically they're very timely. They ask us for quarterly updates of what we've done. They understand that we're building a committee. Um I shared with you Jacobson's proposal. I will tell you that they are our town engineers. I also know that they told me about another grant we could apply for for some other money up to $2 million. They're not sure that we totally qualify, but it might cover some other things. And I thought it was very nice of them to let me know. And that goes on to I think it's May 15th. May 1st, there's another open um solicitation for another grant that I will look into to see if we are qualified for it, which might give us some additional money for some other things on House Road like the street lights and things like that that we'd like to do. So, [clears throat] I'll check that. But at this point in time, I'd just like to get the grant acceptance approval. I'd like to make a motion to approve the commitment to fund letter
um from Connecticut DOT and to have the first select woman Martha Shoemakers sign it second. Thank you Jim. Thank you John. Any further discussion questions? Are are we looking at any other uh companies besides Jacobson just for comparison? I can also send out take his proposal and send it out. It does there I it's a significant amount of money. I mean it would be nice to have at least another at least one other to to compare it to.
Yes. And I think that we could reach out. I think BSC had given us um some a small a proposal not totally in depth like Jake Jacobson did. He did sit in on the meeting today. He has done other of these connectivity grants for some of the surrounding towns. So he's familiar with it the ins and out. And that would be the only thing that I would want to make sure is whoever we do select has had the um some background working on this connectivity grant.
So I I can try to put together an RFP, but that will delay us. But we also need res people to jump on board to be the Hul Road committee as well. But I'm happy to run with it up until that point in time till some other people join forces. So, I think we have a motion on just to be clear, we're only voting on signing the commitment to fund letter and not committing to
J. That's correct. And I've put in I have given Jacobson's proposal to Anita just to put into the budget, but that's just a holder for it's not for Jacobson. It's just an amount of money for engineering and um permitting and things like that. Um, if we come in lower, that's great. If we come in higher, also great. But I agree with you, John, that it's a hefty amount of money. Um, and I'm not sure what this other grant would allow. So, I'm going to look at that and just see if it has any engineering or permitting into it. It may be why they told me about it.

Any opposed? Any abstension? Motion passes. Okay, we're down to selectman general discussion. Anything anybody want to talk about besides snow? Uh, I did take a quick look at the email from Marielle and Basham and I see that it has an application to the historic district and it looks like the markers got changed. Is that I know we can talk about this in depth but is that the plan is to change the style of the the markers.
Uh there was a lot of push back from historic district on the other signs because of their size and they were mounted on poles. So, they found that there was a smaller size and um they would like to put them as markers on our on either side of that large tree that we put um lights in at the holidays and that would be where they would like to go. I think that's what I don't see in the application, John, you have, but I think she still has it as town hall. Do you know? Can you tell me? Yeah.
So, that is their first choice. Um, but there seems to be some push back from the historic district on whether or not it's really needed there, if it's the appropriate place. Someone had suggested Bon Road Firehouse. I do not feel that is an appropriate place because you cannot really stop to see it. There is no sidewalk to walk by it. Um, so of course if either of you have other ideas, but now her goal I think is to mount these plaques on a stone um, and then place them appropriately in an area. So we'll look at that on March.
Okay. Meeting. Anything else? Yeah, I'd like to um report a little bit on the resiliency committee. Yep.
Um had sent out an email to all the chairs as per our uh charge to uh to have several of the committees and commissions uh appoint a representative. I heard from the Rogers Lake Authority, Mark Hastings will be representative for Rogers Lake and um Russ Linderman with and Renfield as an alternate will be the representative for open space. Russ will also be the representative from Flood and Erosion since he sits on both. Um I have not heard back from the other chairs. Um, I did speak with uh the chair of zoning informally before our um charge, but I have not heard formally from him. So, I thought uh maybe Martha, you may want to reach out to the chairs and also maybe another um uh message to the public through your newsletter that we will be looking for um residents at large.
Do you know how many residents you want? This is going to be uh according to Crant a very large committee. uh they want basically as many people as possible to weigh in on this. Uh so I would say, you know, at least two residents. Um,
and we're going to have a lot of representation or hopefully from um, you know, our beach associations, Rogers Lake, uh, nonprofits, historic district, all the commissions that we mentioned. And the idea is that as the uh project manager, I would be channeling the information from Crant to this broad committee. Uh the committee will comment and I will relay the comments back to Connecticut Crant and the um and the consultant.
Okay. So, I I'm happy to put the word out there for residents uh at large that would be interested in this. Um we've had some couple of conversations because this committee really isn't voting on anything. They're just providing feedback, right? So, you're not going to really have minutes of the meeting or you're just provide a quick summary of where we are. Is that correct? because um I will I will be providing a summary of the comments. Okay,
I'll be providing the information which will be either electronic or all of our meetings actually are going to be virtual. So all the communication will be electronic but I will uh summarize the comments from each party um and send it back to uh to our consultant and to uh Connecticut Crant and of course that will be public. Okay. And then but we don't need to worry about too much of a quorum like you're not going to have to worry if you don't have a quorum on one night. No. Or I don't believe so.
Okay. And because we talked about we figure this is about 18 months, Jim. Yeah. 18 months. Yeah. Two years, I think, all told. Okay. Um, so we just thought about the makeup, but because it's a rep from every um other committee or commission, then I they're already approved. They've already been vetted, right,
and validated that they are residents, uh, that they have an interest. Um, and we're asking for anyone on any of those committees to volunteer. So, we just wanted to make sure because we didn't really I don't anticipate this going up as a committee on our committee and boards page because it's a grant uh that you're working on that we're not even paying for. Um this is a freebie. So,
um, so we'll just maybe make some notes that you can we can share and publicize somewhere and you can talk to Katie and Vicki about where you want to put it. You can put it under the board of selectmen. As far as I'm concerned, it's a working group, right? Um, and we uh we also with the Halls Road sidewalk committee uh there is someone that I know who applied. So I just want to make sure we have an application there and wanted to check on the status of we had more than one person apply. Do you know
there was someone who was validated right at the end. It was like Friday morning. Um, I'm not sure which application that was for, but I did have one validation come in and I just wasn't going to I wanted to wait until we got more than just one because we really can't have a meeting with just one. Um, so we're waiting for a few more and maybe uh Elizabeth's online. Maybe she'll push that in her article today that we're looking for those Halls Road people that would like to be involved. [clears throat] Yeah.
Um, also I did ask for a working committee. Um, I asked for two members of zoning, two members from planning, and two members from affordable housing to work with me on the housing bill that's worked on in the state um to try to come together to decipher it to um decide because we do have some dates that we are going to have to hit. I think it's June or July. I think it's July. I want to say that we have to choose if whether we're going it our own route or if we're going to work with Rivercog and we can run parallel now, but we do need to make some decisions going forward. And I'd really like all three committees to be working together on this. Um,
and so speaking of which, uh, you sent John and I a letter from Rivercog to, um, State Senator Martha Marx, uh, expressing concern over a portion of the housing bill, an amendment that's been proposed. Um, are we going to take a position on that or is that just for our
Well, I was hoping that this group would come together and decide if they wanted to do something, but really and truly our zoning planning and affordable housing commission should be working together on this because this really does affect our whole town and um I would think that the town's people would want to have a voice at this table. Yeah, I would very much support that. I very much support getting ahead of this rather than having a policy handed to us that we would critique that we would um sort of draft a direction that we want to go in um and strategize h how to um approach this new bill and see if there are opportunities that may help us and try and uh mitigate some of the provisions that are not helpful to the town. I do know that I did confirm there that there has been some negotiations going on with the owners of the Hideaway Plaza. I'm sorry. I'm going to call it. It's probably I can never remember if it's the Old Lab Marketplace, whatever, but it's the Hideway Plaza to me that there's been some negotiations going on. I don't know if either of you have heard anything about that, but I have confirmed that with um a reliable source. So, I don't [clears throat] know what their plans will be, but that's going to affect the Halls Road sidewalk committee. It's going to affect planning, zoning, affordable housing. I just happened to see the agenda because we changed it to a virtual meeting for them tomorrow night. So, if either of you have any input on that or if you could um check it, that would be great.

Have we received any uh communication from deep in terms of the meeting or No. And I did um notice that I that I I did receive communication which I believe I forwarded to both of you from the um private beach associations. Um I shared that with legal counsel and um I'm trying to set up a meeting with them later this week. Legal counsel just to review that
with them. And I'll let you know next week what I hear, but I do know that on the email that was sent that Carlos's email bounced back saying he was out of the office until February 26th. So, he's not in the office at this point in time. Okay. [clears throat]
And we I will tell you too that we did have an instance where someone was digging on Hartford Avenue the other day. I got a phone call. Uh it was a contractor named Balthazar. Supposedly they had done their call before their dig. They thought they were in a private beach association. Um a resident called concerned it was a rainy day. Uh we immediately sent down Eric Knap went down explained to them this was not the private beach association. They said they had done six test holes that day. This was the last of them. Then of course public works and ed went down. Ed they said they were going to put a manhole cover on it. Ed said no you're not. You're going to repave it. And they did repave it. Um it was a smaller hole, but um he didn't like the fact that they were digging on our streets without asking us if they had permission to do so. They had called, and I don't know if it was the same contractor, but they had called and asked for permission to dig on 156. I told them they had to call DOT for that. and a resident said that there were surveyors out on 156 doing some surveying, but they weren't sure if it was for the sewer project or if it was for another project. Meanwhile, also on 156, the Armstrong Bridge project is sort of on hold for a while because of snow. And they are trying to get ready for the bridge at 4 mile um at 4 mile on 156 um which is also going to be done. So, as far as I know, I think it was my newsletter last week, we put in the fact that they're putting some materials down over there just to uh to start to get ready.
Martha, Dave. Yeah. Uh just a quick insert, the bridge work on 156 at four mile that is on the east line side. Dave, can you speak up a little bit? Yeah, it's right on the uh east line border. That's on the east line side of uh that se that 156 roadway.
Yes, except for the approach to it is actually part of old lime. So, they keep me informed of that because there will be traffic changes being made there as well. So, they're letting me know about it and I appreciate them keeping me in the loop. Yeah, they're going to have to put a temporary roadway in while they do that bridge.
