29th meeting of the Oklahoma City Planning Commission. Like to call us to order and go over a few housekeeping items. If you have a cell phone with you, please silence or turn it off. Uh when your item is to be heard, you'll be called to the podium. Please come up and give your name and address for the record and you'll have up to five minutes to speak. If you're here to speak on an item with a large group of people, we encourage you to elect a representative to share your group's concerns and some additional time will be given in those instances. uh where several speakers are heard on the same item. Please do your best to limit comments to those that we haven't heard yet. Uh we're just trying to uh limit extensive repetitious comments. Please direct all your comments, questions to the commission. If needed, we'll ask staff or the applicant to respond. Finally, we want to thank everyone for their patience today and their presence and time away from other obligations. We just ask for your cooperation upholding the decorum of the meeting and ask that you not speak from the gallery. So, thank you. And with that, we'll move to item two and the receipt of the minutes.

Commissioner Harrison votes yay. All right. And the minutes are received. Item three is continuence requests. We'll begin with uncontested requests.
Item six, KC777, defer to February 12th. Item nine, case SPUD 1808, request to defer to February 12th. Item 10, SPUD1 1809 defer to February 12th. Item 11, SPUD1 1810, defer to February 12th. Item 12, KC CE 1156, deferred to February 26th. And item 13, case PUD 2121, has been withdrawn. I don't have anyone signed up to speak on those items, so we're ready for a motion.
I would like to make a motion to receive the uncontested continuous request as read. Have a motion to receive the uncontested continuence requests, seconded by Commissioner Meek. Please cast your votes. And those continuous requests are granted. New requests. Item one, KC7780 requested deferred to February 12th. Item seven, uh, annexation deferred to February 26th. We'll move to items be heard individually. Item one has been deferred. So we'll start with item two. Item two is KPC 10994, application to reszone 745 Southwest 119th Street from O2 to C3.
Good afternoon. David Box, 525 Northwest 11th Street. Here on behalf of the applicant, uh, this is a request along Southwest 119th Street to C3. Uh, it is immediately adjacent to a large block of C3 to our west. Happy to answer any questions. Commissioner Newman, this is your ward. Um, I'm guessing there's no one signed up. I do not have anyone signed up. Okay. Um, I took a look at this. It's got retail on one side, offices on the other. There's a bronze and car wash across the street. I don't really have any objections to this. Any other comments, questions from commissioners. All right. I think we're ready for a motion.
I'd like to make a motion to approve PC 10994. Recommend to council approval. Have a motion to recommend the item. It's been second by Commissioner Meek. Please cast your votes. That item is approved. Thank you. Item three. Item three is PUD 2126, application reszone 9700 D'vor Drive from R1 and AE2.
Once again, David Box, 525 Northwest 11th Street. Uh this is an application for a senior independent living facility. Uh this item was deferred from the uh previous hearing to allow for a meeting to take place. There were some concerned uh folks a single family resident to our north as well as the folks that own uh the Catholic senior dependent living to the east and that PUD 676. We did have the opportunity to meet in my office last week and uh were able to resolve I think all of the issues. This is if you were able to join me on a team's call this week. We we looked at Google Earth. This area is uh heavily concentrated with this use. Um lots of senior dependent living facilities in this area. So this is sim uh simply an extension of that. There are three TEES that we agree to. Um part of the agreement that we reached with the neighbors are additions to the pub that we need to add as TE. So TE4 under 9.0 add east to the portion of the structures where balconies are prohibited. TE5 under section 9.1 modify the 70% to be 60. So go 6040 and then move the architectural metal and wood to the 40%. Under T uh TE6 under section 9.2 add that the 20 foot landscape buffer not only on the north but also a 20ft landscape buffer buffer on the east. Uh TE7 under section 9.4 4. No less than a six and no greater than an 8ft high wall or fence shall be required uh along the where it's adjacent to any single family residential dwelling and along the eastern boundary of the PUD TE8 uh under section 9.13 per code. This is dealing with height. So it's per code up to three stories. And then any structure within 55 ft of the eastern PD boundary line shall be a maximum of two stories in height. And finally, TE9 under section 9.14, unless modified herein, yard requirements in this pud shall be the same as the base
zoning district except that no structure shall be located within 55 ft of the northern boundary line of the PUD. Um, all of those changes were already put into the PUD and submitted to both uh groups that we met with this week. We got a um an email back from the law firm representing the the Catholic uh charities group saying that they are in agreement with those revisions and have no intention of of objecting. So all of those have already been submitted and we would ask that you add those to this application. Happy to answer any questions.
All right, this is my ward. Um just want to start off by um expressing my appreciation for the applicant um to hear the neighbors concerns and address those. Um, I know one of the there was a letter in the packet. One of their concerns was threetory uh adjacent the the single family residential and they took care to place those three-story buildings on the south property line as far away. So, I think that was smart. Um, I think this is a great fit for the area um and is very compatible. So, I'm in full support um and and with the additional tees is read into the record. Any other comments, questions? I would just say this is this is a piece of property I'm really super familiar with and I would just like encourage staff to take an extra hard look the drainage issues here. There is like a drainage inlet thing there that is just scary when it rains. Not all that hard. So I I know they do a good job and we'll be thorough, but just a little extra look. I will say one of the um requests was moving that far eastern building and flipping it to where we have the detention area drawn based upon the contours. Um we we deem that to be a problem. The detention pond based upon what you're saying the contours it needs to be where it's drawn and so we kept it as is.
I agree with that. Anything else? All right. Ready for a motion? I would um I'll make a motion to Can I just state the TE's as read? As read and by the applicant. Yes. Okay. Um with that, I'd like to make a motion to recommend approval of PUD 2126 with the three TEES in the application plus the four, five, six, 7, 8, and 9 TE added as read. All right. Good afternoon. Mark Grubs, 1800 South S Road. on behalf of the application. This is a mixeduse PUB at the southwest corner of 149th and Western uh with commercial along the frontage and then uh senior independent living proposed in the in the rear. Um I have worked pretty extensively with uh Commissioner Newman and we have um based on our correspondence we've revised existing TEES and added several new TE's and uh I believe uh Commissioner Newman has a copy of this as we emailed it but I'll read that into the record. Uh T number one, the setback from the south and west PU PUD boundary shall be 15 ft where a budding platted residential lots. One medium tree per 100 ft shall be platted shall be planted within the 15t setback along the southern boundary. T2 specify in the master design statement what type of screening will be required around the pump jack oil battery and we've agreed to cedar sight proof sensing 68 ft in height will be provided around the pump jack oil [clears throat] battery site sidewalks shall be provided along southwest 149th Street and and Western Avenue with installation required prior to the issuance of a CO for each building permit development site TE4 section 8.14 height regulations of the PUD design statement should be amended to clarify that the maximum building height for the multif family development which being track two shall be one story TE5 the following uses will be eliminated from tract one bingo parlors dwelling units [clears throat] and mixed uses retail sales and services pawn shops um and that's above and beyond what we had already agreed to remove TE6 The following uses will be
eliminated from track two and that's three and four family residential two and two family residential TE7 section 8.2B of the PUD design statement shall be amended to include a requirement that one landscaped island shall be provided per two dwelling units and island shall be located in the parking area in front of the dwelling units. We had already made a modification to the PUD to require landscaping within each of those islands and it was one medium tree or equal point value in landscaping. TE8 section 8.8 Eight facade architecture regulation shall be amended to include a limitation of no more than 25% smartboards/sighting on structures within both tracks with the maximum 25% smartboard sighting permitted only on the rear elevation of structures in tract one which is the commercial tract. And with that I'll be happy to answer any questions. We'd ask for your approval. Any comments, questions from commissioners? I I have one um regarding TE1 and the one medium tree per 100 ft. That's pretty pretty skimpy. It's not even I don't believe that to even meet the current code. Um would you be willing to do a little bit more on that? I'd like I mean I'd like to see uh one medium tree every 30 feet 25 to 30 feet.
Okay. So that's just what uh Mr. Newman had mentioned and I agreed to. Um can we go to 50 feet? If you go if you go to a large tree, [laughter] how about 35 feet? Medium tree every 35 feet. Yeah. Okay. And I'm just offering that up without my client's consent. I'll let you hopefully he doesn't make me pay for the trees. Yeah.
Staff have a question on that same TE. Um our TE read shall be preserved within the set said setbacks. Are we striking that in lie of Okay, so we're striking that. And then is it one medium tree for every 35 linear feet or one tree planted every 35 feet? Just need to know for later. One twin tree planted for 35 ft along the southern se. Every 35 ft. Yeah. Okay. I'll give you this. That would be great. Did we have anyone signed up? Nope. Is there any other comments? Any other comments, questions?
Okay. Well, I'm going to go ahead and make a motion to recommend approval to city council on PUD 2127. A motion from Commissioner Newman to recommend the item to city council subject to the amended TEES as read in by the applicant. It's been seconded by Commissioner Meek. Please cast your votes. Item five. Item five is case SPUD 1794, application to reszone 544 Southeast 14th Street from R1 NH and SROD. We have an applicant present. Doesn't appear that we do. All right. Uh, this is ward seven, Mr. Harrison. Um, do we want to continue the item? I would prefer to continue the item. I believe the commissioners have some concerns. I'd like the applicant to be present to hear those concerns.
