Oklahoma City Water Utilities Trust - Regular Meeting

Good afternoon, now it's 2 o'clock and I want to start a meeting at Oklahoma City Water Utilities Trust on September 15th. The next agenda is the agreement for a not-to-land. The not-to-land is a meeting on August 8th and 18th. The not-to-land is in the agreement. Are there any questions or comments about the not-to-land? If not, are there any arguments for the agreement? Because of the uncertain schedule, we did not hold a water trust meeting two weeks ago. So it's been four weeks since we held a water trust meeting. And because of that, we have a slightly longer agreement this evening. There are 34 items in the agreement. Many of them are plans and standard specifications that have been lost, some contract prices, amendments, change orders, payment of our taxes, several consultation choices. Permission. Permission. A number of permissions from DEQ there at the moment. Thank you, TN. Browning. There is one thing that I will discuss shortly by TN Browning, namely about the potential improvement district in South Oklahoma. I don't have a problem with that at all. It's just something we don't usually do, and I think it would be better if we discussed it for a few minutes. So, I want to discuss point number seven. Are there any other things in the agreement that the trustee wants to consider because there is no TN? Browning, can you give us an update on the district's evaluation?

Will it be approved? So we were approached by the Utilities Department. The Utilities Department was approached by citizens from the development of Scenic Meadows, who were looking for an affordable way to connect to the urban water system. They were in the middle of a large rail line, and the sources were damaged or not functioning properly. So they asked us what we could do to help. So, this property is located on the west side of South Council Road and on the north side of Juan X X Street. So, the laws of the state in Article 11, Article 36, 37, and 39 give the authority to the city government to establish an assessment district for the development and financing of this water system improvement. The evaluation district must at least 51% of those in the area agree and have at least 51% of the property. In this case, 7 out of 9 owners of property. Some have several fields of land, several railways, but 7 out of 9 have signed the petition and they collectively have about 91% of the property. So that's according to the law of the state. So they need to sign the petition and hand it over. Panitera Kota has it and after receiving the petition, Panitera held or prepared a resolution to be considered by the City Council. So, the Department of Utilities after the City Council heard it this morning and we will work together with City Engineers to prepare a legal description from the field of land in the Evaluation District, the initial plan for improvements that are being implemented, and the total budget for the project. After that, there will be a second document that will be submitted and then there will be other resolutions that refer to the formation of districts to the City Council and if they agree, then there will be an open meeting. After the city council agrees, we will plan and build as we will do in other public improvement projects. So, after the agreement or completion, the project engineer will determine the final cost and evaluation per land area. The owner of the property has up to 10 years. They can pay face-to-face if they want, but they take up to 10 years to pay back their part of the investment.

So we pay for it, and that's how most of the developers put it in, and they pay for the repair cost of the water. This is the case where the owner of the property does not pay for any water repair, and they need our water system, and therefore they have to pay for it because it is not right for the customer. We are the ones to pay them when we have paid for us. You know, for each of us to own our own water. So, because of that, they have to pay their own costs. And the most just way to do it is to immediately form an assessment district.

Based on Oklahoma law, our tax payers cannot subsidize any improvement for development or for other property owners.

All right. There is a question from TN Browning.

Is there a motion to approve the agreement? And that passes. So the fourth item is a part of the agreement. Last Thursday, TN, StoneCypher, Chris, Josh, and Astada, Charity, Vanessa, Mark Long, and Jared all went to Maggie Creek to meet Maggie Creek and Lake Atoka in Atoga, which was attended by many people. There were 40 people at the meeting. If you can imagine that in the room of the Atokos City Council, some of them were staff. I'm sure you know most of them. They are staff from Oklahoma City, Maggie Creek, and Atoka City. However, as a result of the meeting, there are four items from the Maggie Creek authorities that need to get approval from the Oklahoma City Water Utilities Trust. So, all of those things are in front of us today. And is there a question about one of those things? Many of them are personal issues such as the consolidation of our pension system and bringing it under the jurisdiction of the city of Oklahoma City. With a shallow lake like this, there are several dams and we have to clean up a lot of dead fish and worry about the quality of water in the future if we continue to be at this level.

So the release will start tomorrow.

It takes four or five days to get here. It flows to the North Canada River and then the whole release will take about 10 to 12 days. The idea from the technicians will work slowly so that we do not create a flood situation along the river and then they will work slowly so that the fish are not trapped in the pond when the surface of the river is down. So it will start immediately and bring us back to a pretty good place and hopefully during the cold season, I hear rumors about a wet cold season. Let's see how it is later.

Are there farmers on the map?
