We're going to consider approval of request of Cruz and Franciscoca Fabella for zone change from single family 3 district Retail District 439 acre Bracken land located in section 34 block 42 T2 South TN Railroad County Survey City of Odessa Ectctor County, Texas. generally located on the southwest corner of the intersection of East Clement Street and Dixie Boulevard Boulevard County District 1.

Thank you, Madam Chair. Uh the applicant, Maverick Engineering, and owners Cruz and Francisca Fabella are requesting a zone change from single family 3 to retail on an approximately halfacre tracks uh located uh at on the corner of Dixie and Clemens. Uh the proposed zoning change is consistent with the comprehensive plan. Uh the property is situated near other re uh other areas zoned retail. Uh and the intended use aligns with existing and planned retail and transitional land uses in the vicinity. Uh the proposed retail zoning is not anticipated to have a negative impact on the site or surrounding properties. Uh and retail uses are existing in the area and would be well suited to the intersection of two arterial roads. Uh the zone change represents a logical and reasonable transition between similarly similar intensity land uses. uh it will not disrupt the character of the area and is compatible with adjacent zoning and land use patterns. Uh based on the analysis, staff recommends approval of the zone change request subject to the following conditions. That the property shall comply with all applicable R retail district standards and regulations as outlined in the city of Odessa ordinance. Uh and that multi-tenant shopping centers require site plan approval before issuance of certificates of occupancy. And with that, I'm here if you have any questions.

Okay. My name is Arando Rodriguez. I live at 126, which I live in the oppos opposite direction of that location. One of the thing is a lot of people came to me and talked to me and asked me what kind of business it was. And I said, I don't know what kind of business it is. and they had a lot of concerns and I told them if they had some concerns to you know contact y'all or send the postcard the one they have to send pro to approve it or oppose it and everything else and later on the couple days ago they called me and said we already we already sent some notes that we against it I said okay fine with me I don't have a you know problem because I don't I didn't get the notice so I was not close to that area I was not over the 200 100 f feet from the location and everybody's only concerned if it's going to be a like a retail business or they're very concerned if it's going to be a bar or something else or details and that's what they're concerned with because nothing was built there since a long time because I know they don't have a sewer line or water line there.
