There's a couple of those on Main Street that has a double loft. We're going to be talking about this tonight. And they want the property line moved so they can build a garage. You cannot build a garage if they seem to want to build one on the bottom. So they just want the property line. So anyway, we're going to talk about that later. They voted to approve. I would like to thank the Electric Department for getting out the other day when the power went out in this heat and for the best job they could to get everybody back together. I'd like to thank the people who were so patient on Facebook while they were doing this. And yes, the lady who posted the thing that she would like to start a positive page needs very much thanks. That is wonderful.

I want to thank the city for opening up this building today for people that might have needed a cool place to come. Now, whether anybody came or not, I don't know, but it was open for them if they did.
I had a front row seat coming to our electric department, working on some dowry poles on the massage table. see how quickly our staff, when you were working with local staff that are maintaining your local utility, how quickly they came. It was very hot. Our police officers secured the area. I think it took them, I can't say how long, but quite a while to get those poles reset and the power back up. Thank you to both the police department and the electric department for responding so quickly and it gave some reason that we Remember to be able to have a remote community and local staff that can respond so quickly to our local issues. Good evening, Mayor and Board of Aldermen. I'll start with the Parks Department. They have quite a few recreational assignments going on right now. Soccer signups for ages three through eighth grade are open through August 2nd. Youth volleyball grades three through six are open through August 16th. Men's softball is open through August 16th. We also have fall softball and baseball signups open now. This is the last week for swim lessons. And then we'll continue with aerobics classes and pool parties. We are completely booked up for rest of the season for pool parties and that includes both double bookings on Fridays and Saturdays. We have some turnover in our park maintenance part-time positions so we are needing to fill a part-time maintenance position just to finish off this season unfortunately so I'm working on that now. For wastewater we have normal operations and maintenance We did have to replace two dry units at the southeast plant for the influent pumps. So that was kind of an unexpected repair and maintenance. And then the mission of quotes to add the carport to the street department. So we're going to add a carport so the sewer generator could be more locally in town for on-call needs. And we are starting to get the requests that have come in from the engineers for our wastewater study. So we're trying to compile all that information for them so they can get going on that. And then we did have, if you didn't see on Facebook, we had a Facebook post that recognized all of our wastewater employees for all having their headlights. So I know I've mentioned it to you all before. An accomplishment is not the right word to describe what it means to have all of our crew have an A license. It's really unheard of. So we're levels ahead of other departments, especially of our size. For the finance department, like Torres said, we have issued over $2,600 ECA credits, and that totals $957,000 in ECA credits. So those are coming out on the bill was emailed on Friday. So if people check their email bill, they've already been able to see those ECA credits. And then if they get their bills in the mail, we will send that out later this week. So they're not quite ready to send out. We send that out on the by noon on the last day of the month. So those will be coming in in people's mail relatively soon too. We have 249 business licenses for this year and the audit is wrapping up. They're hoping to be able to present to you all in August. With the sidewalk project, it's still coming along. Their goal is to still get the three quadrants completed before puddle jumpers the second weekend in August. So they're still on track for that as far as I know. They have the curb machine out there for the last set of curb before puddle jumpers. So a lot of progress is being made. For the street and water department, We're finishing up just some roadwork prep before the micro seal comes into place. And then Vans Brothers is responsible for communicating when the streets will be done for the micro seal to the different residents. And we're teaming Leslie up with Vans Brothers so she can help add to their communications plan just so we make sure everybody's very aware of what's happening since it's a little bit different this year. working on that. Finishing up the street cuts and we did have unfortunately some light vandalism to our wells so Darren made a point that it's been probably 12 to 13 years since we've last had any type of vandalism like that at our wells over by the river in Wellington but just want to take note of that that they're it's a very critical asset for us. Also installing water surfaces across town. The building maintenance shed, if you have not been by it lately on North 1st Street, it's coming along very well. It looks beautiful. And then they will be spraying and cleaning up downtown before puddle jumpers as well. So you've noticed the last quadrant that's yet to be done is caught quite a few weeks growing up. So they'll take care of that before the puddle jumpers event occurs. For the police department, we've got the paperwork ready and the FIFA documentation submitted for reimbursement for the mutual aid work that was done. We also submitted a grant to Department of Homeland Security for radio upgrades, which we have not heard back yet, but we should hear back relatively soon. Gaylene and Jenny both teamed up together to apply for a an award for the animal control. So we got the No Kill 2025 shelter award for this year. The last time we got that was in 2023. So this means that every animal that has come into our shelter has been adopted out in the year 2025. We do have four interviews set up for the SRO positions which we partner with the school district for those interviews or to conduct those interviews. And the goal is to have that position filled before the school year starts. And for the electric department, all of the VFW banners have been installed to this point. They've been working very diligently on the sidewalk project, a lot of work for them. So while we fully anticipate Cat and Hopper to get there, get everything completed before the side or before puddle jumpers, the real task and real fee is going to be the electric department to get the power turned on by puddle jumpers. So root for them. Yeah. But they are working very hard in the hottest part of the year, so. We did get our last bit of substation, our quotes for the substation have come in, so we're analyzing those to determine what the best direction is. We do have our small bucket truck out, so all those different minor power outages that occurred, just remember the crew was having to do those with just one truck at this time, so we're hoping to get that repaired as soon as possible. And other than that, working on the mutual aid paperwork that we had from one to Higginsville and prepping for a meeting with the Little League football team this week to just get that project started. For community development, we have currently 19 new construction permits right now. And we've done three certificate of occupancy permits as well. So that's new. When we revised the code for inspections, we added the new business and occupancy sections. We've had three of those lately. And one was for the Indian restaurant. One was for the coffee shop, the change ownership and the ice cream shop in downtown. So we're happy to have all three of those new businesses and they all passed. We also have 10 single family permits right now. And then we have four from Pine Creek and one being our street band. And then like Mike said, we had our PNC meetings. We've been struggling a little bit with quorum. We had quorum at the last meeting, but we didn't have a very strong presence. We had three in person and one virtual. So we, the board, Her commission collectively voted that it would be best to get to the new business at that meeting and then come back for an old business at the next meeting in August, which would be continued parking discussion and then the election of the positions for this year, too. So more to come on that in August. For our city clerk, she has been out for a little bit. And so she's back trying to catch up and work on the work comp audit, risk management duties, and then we're trying to do demos for the timekeeping software that budgeted for this year. So we have a couple of those scheduled for this week. We also have some plant tours scheduled for this week with a vendor that can help us with some, helping us identify some efficiency areas for improvement. So those tours will be held on Wednesday with both the wastewater plants, the water plant, and the electric plant. So with that, and then lastly, I just want to congratulate Mike on his retirement. That's going to allow the carnival to come in and set up, and the other red ones are going to be set up on Thursday. That's the actual closure for the event itself. So any questions about anything you've seen there? Easy. Shona did ask me to comment on the next item up for business, the proposal for $10,000 to do their beer garden, beer tent. And I talked with Tina and I discussed it with the Pell's Arborist Committee and it was unanimous that we were in favor of that through Fedsworth Guardians Committee. So thank you for your time.

The railroad park was not an extra closure. That was just the approval that the board gave that they have alcohol and city property during that BMW beer garden. So there was no extra closure area.

Hi again, guys. I'm back. I don't really have a lot to add this time. I actually have a talk to Lipper Control, and they are all on board, no problem. Everything is online now. All I need to get is a letter of approval from you guys, which then the city can write me the letter, and I can get approval there. So I really don't have a lot to add, but now I believe this is great. I was also printed out that along with beers, we will be offering seltzers if approved. So there'll be a little bit out there, not just beer, if that changes anybody's mind. But now I can ask if anybody has any questions, because I'm actually out there, right? Are there any questions? If the BMW is not having a beer garden, why don't you have a beer garden?
The logistics.
If you talk to the VFW, the reason they're not having the beer garden is the cost of the fencing, the cost of the tent, the cost of the ice, the cost of the trailer to keep the beer cold. So that space for me is entirely too big. That is huge. I would like to do it as just an old fashioned space that's only going to hold like 60 people. I don't want the extra space. I don't want the cortisol. At this time, I'm not ready to accept the responsibility for all of that. I mean, my employees aren't quite like reaching out to volunteers for the VFW. And I truly don't want to put that much money on the line. Where I'm at, I can bring beer out completely closed, already iced down to a tent that I already own, to folding tables that I already own. So this is no extra overhead for me. So that is the only reason that I think that it's gonna work at all. It's just simply a lower overhead than what the VFW has. Does that work? Does that explain it? Well, it explains that.
So I was approached to ask this question. What is your plan If someone in your beer tent tried to hand over a beer. That's not acceptable. I know. I know that. Yeah. I understand you're going to have someone, you know, checking people in. Right. And they were asking, so what would keep someone? And I said, I will ask.
Absolutely. I completely live in that question. And I can make you no guarantees that nobody's going to try. And I can honestly make you no guarantees that somebody's not going to be able to do it. What I can tell you is that all times in there, especially when it's at fuller capacity in the evenings, there will be, my husband will be the one at the door at all times. I actually have two other people each consecutive night. At Thursday, it's one and one. But Friday is Saturday. I have two other people. One will be handing out beer or charging and one will be watching the perimeter. I don't know if you guys have ever been in broken dollar saloon and puddle jumper days, especially in the evenings. We walk. I mean, that's what we do. There is no difference. It's just a full wall. I am going to raise the tent up. So anybody getting over, it's going to be obvious. So I'm going to take a five gallon bucket, fill it full of gravel, put a two by four in, and then you've got four foot on top of that. So you're looking at a five and a half foot fence. Not saying it's not possible, but we're pretty adamant on rules and regulations when it comes to those kind of things. I mean, that's also my license on the line. So I'm pretty strict on all of that kind of stuff inside and out.
This is more probably a comment just for the board and something I've thought about. By moving the beer tent center within more of the puddle jumpers street closures, This may not be the only application that we get now or in the future. I think it's important to think about the precedent and is it preferred to have it more separated or are we okay with in future years considering other applications are similar. So.

Okay. And you and I talked about this one evening. So when Pedal Jumpers started, started in 1978, it was the north block of town. That's all it was. If I remember right, I don't think the Optimus train was even in the four-way stop. I think it was just north of the four-way stop. There was no carnival. There was no all-member vendor booths. It was very simple. There was a stage. I remember there being a fiddler's contest. And after the fiddler's contest, then the band started. And the band started at 8. And you could call it off in all innocence. However you want to put it. The powers that be or whomever it was, there was an agreement. And at 8 o'clock, not before, at 8 o'clock, you could walk out of the bar with a red cup to watch the band, to listen to the band. I'm going to go with it. It started in a small town instance, if you would. Since then, it worked. It has been, that has been done away with. I saw the other day on Facebook, people were talking about how public homes used to be, and the volunteers and volunteer activities that used to be. And they all talked about how we, how nice it was that you could walk around with a red cup. Now, I'm going to be honest with you. I was a red cup participant. I mean, dang near everybody was. And it was, I want to say, your city fair innocence. I guess where I'm going with this is, There are people who don't want alcohol in puddle systems. So we as a board have to answer to them also. We have to explain to them when they come up and say, why did you vote for this? Will you do a good job? I think you very well will. Thank you. But there is that factor. The Red Cups, the Red Cups have gone away for good, bad, or whatever. There is a city ordinance that says you can't. Really part of the reason why. We have other people answered also.
Tina, what were the hours of operation? It's not on your application.
So Based on temperature, to be completely honest, I probably wouldn't open until the evening if it's extremely hot outside.
Could you give me a best case scenario? Absolutely.
So best case scenario, we're going to go 11 a.m. and follow puddle jumper rules. And I believe that is 11 p.m. on Saturday, 12 p.m. on Friday.

Yes. And again, this is my first go-around also. If there's any kind of changes or anything that I can make, I will. I'm jumping in basically to fill the void that the VFW has had for forever. I'm in agreeance with Mike on the red solo cups. I was a user also. I do not necessarily. I do not agree on the red solo cups in downtown Odessa. I do not. I was brought into a meeting about two years ago with the chief of police that this was discussed. I don't believe that. I don't want my name on a cup hitting the street. And then that cup gets into the hand of a 16 year old. And then I get questioned on whether or not I served a 16 year old. Again, that's why I'm trying to keep it small. That's why I'm being completely honest. And I cannot make any promises I will do the best job that I can. But I also said this five and a half years ago when I started Broken Dollar.
Because for those of you that were around that, ain't nothing like that been downtown before either.
There was a restaurant across the street and there was a dive bar. That's what we had. So all I tried to do was combine the two and make something for the best of everyone. And I do believe I brought this up last time also. And to your point, that there are other people that we have to answer to. A lot of those people like broken dollar for its family-friendly atmosphere. If I can't, and I'm not saying I can't control that, but at least with the beer tent, I will have a place for beer, for pedal jumpers, and make the inside of my building more family-friendly for those that want that environment. If I am not able to have the beer, I can't take people out for drinking a beer. That's 60 extra people inside the building having a beer in that environment where I would much rather have them in a beer tent environment with nothing but 21-year-olds. My bread and butter is dinner. My bread and butter are the families that come in there every single day. So I understand 100% what you're saying. I've had to answer those people too, which is why I close my doors now at 10 o'clock. This, I'm just asking to fill the void. So, yes ma'am.
I have a little bit of trepidation about 12 hours of alcohol consumption in a tent in where families would be going by. Okay, that's fair. That is a really long time, and someone could be in there four times during the day, and it's making your building more family-friendly by removing the drinkers, but it's putting them directly into the puddle jaundice event.
Okay, if I rearrange those hours and shorten them to an afternoon, evening time, I mean, like I said, I'm up for all and any comments and suggestions. I'm not opposed to that. I will also say I'm open from 11 a.m. till midnight. I get where you're saying that people could come in four different times and drink. Alcohol consumption is something I'm used to watching every single day. If somebody is drunk, I'm going to be able to tell you that. I mean, I have done that.
You can't be able to do anything but remove them from the tent. It puts them out into the event, and I think we've had some troubles with that in the past. My concern is just the placement. If there is an issue, it's not separated as it has been in the past. It's right there in the midst of the event. That's just my concerns about it and the length of time of serving and consumption.
They're right in the street. I have removed several people during puddle jumpers from inside my place.
This becomes out of the responsibility also if it's on the street, not just yours as a license. So I think we have to be considering what our responsibilities are as well.

One thing to keep in mind, other than our excellent police department, there is not a way to control people from bringing their own alcohol up in a . So I look at it as Tina has a way to kind of control that. That's just my thought. So people are going to do what they're going to do.
There's not a way to contribute. The Puddle Jumpers Committee has discussed this in length. And I don't know if everybody knows Tina, but knowing Tina as I do, I seriously don't think we have anything to worry about. And that's what the Puddle Jumpers Committee has talked about as well. So, you know, I'm willing to give it a try. If it doesn't work out, it doesn't work out. She'll know if it doesn't work out, too.
And on the same note, since my hours aren't posted, if we are more comfortable with me cutting down my hours to, say, 4 o'clock in the afternoon to close, I am okay with that, too. I'm just trying something new.

As a business owner and a police partner, I have a great relationship. And I do believe that if she can't enforce it herself, she will contact And closing earlier than your gardens typically closes will control some of that, some of those calls for service we saw last year. However, I do understand maybe some of the concerns about the location. But I do think that the smaller venue is a little easier for my staff anyway to lease if necessary. Thank you.

Motion for approval to terminate the existing agreement with IDTS and to hire a part-time building inspector to perform building inspections, plan review, and related code enforcement. Okay. So,
This is kind of really just seeking your blessing here. So we've had IVTS for quite a while now. I think the contract says it's 2021. And we are just really, I think, quickly approaching the time frame where we have a little too much development for us to be trying to work with this third party. We're kind of seeing a little bit more of a struggle when it comes to just coordination between us and IBTS. So we feel that we're ready to move on to the next step and hire a part-time inspector. And I did have Jeff look at the contract and we would have to give 90 days from whenever we'd see it not from members, but 90-day notice before we can terminate our contract with them. But really, I think we're still going to need to use them for a while, and we're needing to obviously hire someone, likely train them, and then also kind of time them out with the transition from the 2012 to the 2024 building code, which that process alone requires a 90-day notice. Public notice. Public notice period from when we notify the public that we're going to switch from the 2012 to the 24 voting code. So timing wise, we'll kind of work with those factors. So it wouldn't be an immediate notice to IVTS tomorrow. But I definitely feel that this is a move that we need to make at this time. I will say, Kathy, noted the, I calculated the savings. So I came up with 17,000 was the difference in hiring a part-time position ourselves versus paying IVTS. And I calculated that off of the last fiscal year that we had. So she noted this morning that the last or the first three months of this fiscal year The invoices were significantly higher, which would make the savings even larger. So we arguably, and we'll probably keep tracking that, and we'll start with the part-time person, but I do think that we are 100% trending towards our savings from moving away from IBTS, covering the full-time perspective with it. So I just wanted to note that.
This will be a person who does the fire inspections. Could be a person who does the fire inspections.
As of today, Zingodessa has the fire code adopted, so.

Yes, this would be a building inspector that would also look at fire codes within buildings.
How many hours are you, when you're anticipating or calculating, would you be looking at a 20-hour part-time person or a 35-hour person? So calculate it at 30 hours.
When you open the books.
The contract is up May 1, 2027. Are they requiring 90 days before that date? They're going to make us hit that whole term?
That's what I wanted Jeff to look at based on his professional opinion. He feels like we can give the 90 days any time. It's an either or.
They just drafted it poorly. They say two-year terms, and they say, it's effective until either party terminates the service agreement by providing 90 days written notice in advance of expiration. So I hope a lawyer didn't draft that form.
I was kind of hoping, or I was kind of figuring you'd help us out on that.
And that also begs the question, that's just without cause. Given what Shauna has relayed, we probably have grounds for a potentially for a for-cause termination, which would kick in a 30-day cure period. And my guess is if we talk with them, if it got down to it, that they would rather have an amicable separation as opposed to having to go through the whole part about how they wanted to do. So that would be my thought is this is clearly defensible to do it this way. And we'll give them notice. So it's not like we're cutting out tomorrow or anything, which is awesome.
We also talked a little bit about today, they're a nonprofit organization. And they're very, very good.
So do you have any sense of how difficult it will be to find someone to fill this role?
It can either be very easy or very difficult, one of the two. I know they can still just hire someone, and they do have to go through a full training process with that person. So that would be the most difficult part. I don't think it will be hard to find someone, but Because I know we can hire someone and train them. I would prefer to hire someone that has the experience. I just wondered if it would be part-time. Well, I've had a time to get suggestions to me. There are people in the Oak Grove, Grand Valley area that are retired. A retired fireman and then a lot of fire departments handle building inspections. So they have the experience and they're looking for something that's kind of an in between position.

And I think I can't. Well, I don't see that I know there's operates a little bit different than how I would intend this to be
My question is, you mentioned, obviously, that they would need training. Who would do that training?
It would be all through the international RICCs.
And so it looks like that's study modules and online. So we hire someone who really doesn't know about this. They read a bunch of stuff online, and they go out. I'm not good with that.
i mean we need people that have had hands-on i mean the idea is to hire someone with experience that is the goal 100 that just can be difficult i think you can still have more challenging experience with that because of their location where we're closer to the metro i think we have better odds of irons that's a good fit and i don't think if if it came down to it and we felt like this person has absolutely zero experience and not even in a relatable field, then we'll just put open. We're not in a rush by any means.
About how much is the contract that we have?
It's paid off of per usage. So there's a fee schedule in the back of that. So each plan review for each certain type of permit is a different price. So they bill us monthly for what services they provided. But what I calculated for the fiscal year, previous fiscal year was $63,000. Okay, thank you. Any other questions?

The other barrier that they hit within our code after that was that we have different lot size requirements for residential. So if you're within so many square feet, the frontage and side footage has to be certain dimensions. And so they were falling if they put both of the lots in their entirety together, it created too large of a lot for the frontage that their lot had. So that created an additional problem to where the only option that they could come up with between Jenny and the capital campus to just move the property line back enough that they could put the secondary building on the first parcel. So just a little clunkiness of our code, but created some restriction for the applicant.
