Hello. How's everyone? Sorry, I'm a little late.
You ready?
All right. Good evening, everyone. Everyone wants to uh settle down to take a seat. We'll begin tonight's uh meeting. And I hope you can all join me in stating our um nation's pledge of allegiance. I pledge allegiance to the flag of the United States of America and to the republic for which it stands. One nation under God, indivisible, with liberty and justice for all.
Thank you. Good evening everybody. Uh everyone, uh today is October 8th, 2025. Uh the time is 6:03 p.m. Uh this is the Town of North Providence Planning Board located at 2000 Smith Street, North Providence, Rhode Island. Uh we'll begin tonight's meeting by uh taking um attendance. And if we can start on my right, that'd be great. Mark Andreosi, Warren Richard, David Pari, chair, Jelica Bo, solicitor, Lou Dukio, Steve Patassie, and town planner.
Okay, good evening everyone. Um, we do have an agenda tonight um that three things are listed. Um, however, we um item number one is the approval of the minutes from September 10th, 2025. Those minutes have yet been circulated and distributed to our uh board. So I will entertain a motion to um continue this agenda item until uh the planning board meeting after which the minutes have been distributed to our board. Do I hear a motion? I'll make I'll make the motion. Okay. Warren Richard has made the motion.
Second. Steve Patassi has a second. All in favor? I I.
Any opposed? Hearing none. The eyes have it. Five to zero. Um item number three. Um if anybody in the uh audience is here for item number three uh zero Manchester Farm Road, uh that um project will not be heard tonight due to the applicant's uh inability to um notify uh Abutters. Uh so that um agenda item will not be heard and we will I'll entertain a motion to do we continue it. I'll entertain a motion to continue that project um until the for the next planning board meeting uh after in which the applicant uh notifies the uh abutters per our town's rules and regulations. Do I hear a motion?
So moved. Okay, Steve has made the motion. Do I hear a second? Second. Blue seconds. Okay. All in favor say I. I
I any opposed? Eyes have it. The motion passes 5 to zero. Um, second on tonight's uh agenda, the address is 4143 Maronei Street, Cessor's Plat Lot, Plat 22A, lots 483, 484, 508, formally including lots 502, 508, 478 through 482, 484, and 545 through 550 zone residential general. The applicant owner of Maronei Street LLC and Patriot Builders Incorporated. Um the description is a public hearing remand in accordance with Superior Court decision. Um, and it has come to my attention that uh further uh review of information um is warranted uh for uh this board to make a decision and I will entertain a motion to continue this um here this agenda item um to next month's planning board meeting which is scheduled for the second Wednesday of the month, November 12th, 2025. Do I hear a motion?
My expert wasn't going to be available on that date. So, I think we had come up with another date. I don't know if the board is available on the 19th. I think there are some members unavailable that day as well. That is correct. Okay. Is the Wednesday after that I think is for Thanksgiving. So correct. So what what's the next available date? Because I can't I need my expert here.
There's a planning board meeting scheduled December 10th, which is the second Wednesday of December. December 10th. I just I know I won't be going away to a room or anything, so I'm sure I'll be Let me see. December. Yep. I'll be here.
Mr. Chairman, if I may, um, I just wanted the board to know that I represented the board for the litigation of this matter. Um, I talked to your solicitor and I think what we intended tonight was I would be here for any questions about the decision, but I did not plan on coming again because you're you're basically doing a whole new preliminary plan review. So I just wanted to make sure you understood that. I Yes, I understand that. Want to understand that? Yeah, we have a little a little more clarity from my our attorney on that.
Well, exactly. You you had written a note here to the board. Yes. So
seemed to be changing. So, where we are right now is there needs to be some further discussions between myself, the attorney for the applicant, um, our solicitor, and our planner regarding next steps for this remand and what the board is tasked with doing moving forward. Um, Kelly represented the board on this appeal, so she's here to answer any questions regarding, I guess, the decision, the contents of the decision, and how we got here at that at this stage. But moving forward, there is a remand issued by the judge, and there just needs to be a consensus amongst us before we present it to you guys where we're heading next and what the board is tasked with doing.
So, we disregard your note. Um, I mean, yeah, that yes, and I don't think it's necessary, Kelly, for if you for you to continue to appear at this public hearing, but I know the board apparition, which is fine. I mean, I I don't have any problem with not attending. I just want to make sure the board is comfortable with that, that's all. Okay. Thank you. Nice to see you all. You, too. Can you just state your name and your credentials for the record, please?
Credentials? I have none. Kelly Morris Salvatore, uh, former board counsel, um, and I represented the board on this appeal. Thank you. Thank you. So, is the 1210 good date good for everybody for the public hearing? Yes. Okay. We need a vote to continue it. We do need a vote to continue it. Um, no need to revert, right? I mean, to renotify.
No, it's a formal continuence to a date. Y uh but uh before a motion is made, I just want to um state for the record that the the board um uh has has received the decision and um is is aware of it. Would anybody like to make a motion to continue this agenda item to uh December 10th? So mo um yeah I'll make the motion. Excuse Mark has made the motion to continue uh item two to December 10th, 2025. Uh do I hear a second?
We do not have a public uh hearing at this time. A question. We can Yep. We're in the middle of uh a motion. I hear a second. L seconds. All in favor say I. I. I. Any opposed? Hearing none, the eyes have it. 5 to zero. I will entertain a motion to um adjourn tonight's meeting. Uh a motion to adjurnn. Um can we take it after?
Oh, sure. I'm sorry, Jen. I'm Yep. Can we take that off the table? I'm sorry. I thought we could talk to you after we Go ahead. Can you just state your name and your address for Yeah. Yeah. Jose de la Cruz. I'm in 47 Maronei Street. Um I I just wanted to understand a bit better and since uh we we have council here. Um, is this going to require like is this like a new plan that would be discussed on that later date or are we still kind of like uh talking about the decision that was made by the court?
I guess it would be both. So the judge issued a decision and remanded the planning board to make vacated the original decision. So, they have to make a new decision based on a new public hearing. Okay. All right. Um, and then the second part of my question is right now there's a huge sign sitting there that there's 24 units coming uh for affordable housing, government subsidized housing. Is that okay? Could that still be there even though this this board has not approved that? So, I mean, it's on their the sign's on their property.
Okay. Um the the board hasn't made a new decision yet. So at this point it's their property. They can put whatever sign they want. Um Okay. As long as it adheres to the town sign, right? Um but there will be a new public hearing. That would be on December 10th. Okay. You guys are not going to receive new mail about it. So this would be your notice of 1210 for that hearing. Okay. So the other neighbors won't receive update about the December 10th. No, they won't. if they already received notice in the mail that that it was just continued to 1210. So they're not going to get new mail. So if you want to tell your neighbors about it. All right. December 10th would be the new public hearing. Okay. Okay. Thank you.
Okay. Mark, I'll reenter that motion to adjurnn. Yes. Motion to adjurnn. Do I hear a second? Second. Four in seconds. All in favor say I. I. Any opposed? Hearing none. Motion passes to adjourn five to zero. And
good job, guys.
