1:10 – 1:54Speaker 2

Alright. It is 9AM. I'm gonna call to order, code enforcement hearings for the city of Northport. If everyone could please stand and join me in the pledge of allegiance. You may be seated. Don't have any public comment cards, so approval of minutes. Are there any corrections to the minutes of the code enforcement hearings of 04/24/2025? Hearing no corrections, those minutes are approved. Alright. Procedures are, in a moment.

1:54 – 2:32Speaker 2

Those of you who will speak will be asked to stand. The clerk will administer the oath. The way it will work is, the city will go first. The city stands at this podium over here. Just for the record, if you can state your name for the record, the first words out of your mouth, and also just state that you've been sworn, that's helpful. The city goes first. You get a chance to ask questions of city staff. You don't have to. And then you get to put on your case. Likewise, city staff has an opportunity to ask you questions.

2:33 – 3:01Speaker 2

I usually then go one more time, city, and then I give the property owner the last word. Just ask that there not be any repetition, and, and and then I close the hearing. Typically, I rule after the close of the public hearing. There have been a few times when I have reserved, and I write a more lengthy opinion. So that's the, the procedures, and now the clerk will, administer the oath.

3:03 – 3:17Speaker 3

Can everyone wishing to provide testimony please stand and raise your right hand? Do you swear or affirm that the testimony you're about to provide is true and accurate to the best of your knowledge so help you God?

3:19 – 3:55Speaker 2

Alright. So we take these in the order that you sign the green cards. So we have the first two cases are CECase244292, CE Case 244293. The property owner is Men Nguyen and Men Nguyen, and the property address for both of these is 5200 South Chamberlain Boulevard. We have several people, signed up, so I'll kinda let you decide how you want to present yourself.

3:55 – 4:08Speaker 2

But if you can come to this podium over here because there's a microphone over there. And I see the assistant city attorney here. So do you I'll let you start whenever you're ready.

4:08 – 4:56Speaker 4

Good morning. There was actually a handful of motions that were filed yesterday at about 04:30 in the afternoon, one of which is a motion to continue. So I do think that if we would like the attorneys for the other side to speak to that. I don't believe that the motions were technically properly put onto the docket. The clerk's procedure is for the motions to be filed at least eight days beforehand, But I do think that it would be appropriate for them to be able to speak to their motion to continue considering the, what is presented in the other motions.

4:56Speaker 4

So I would believe it would be appropriate to hear their motion to continue before we move forward.

5:01Speaker 2

All right. Any objection to hearing that first? No, your honor. All right. Go right ahead then.

5:06 – 5:51Speaker 5

I'm Darren Quam, and 401 East Jackson Street. And I represent Lincoln Capital Acquisition LLC. They're the contract purchaser of the property. The seller and the sell the seller's owner is attorney is here, mister Carl Roberts, and they've authorized us to speak. And so so the owner and Lincoln filed a motion to continue yesterday because this is a situation where apparently, allegedly, trees were removed from a section of woods, and there are two pieces parcels of property adjacent. And, apparently, the city and the environmental consultant for the past few months have been discussing the tree situation.
