Um first item on the agenda is roll call. Davies here. MHune here. Sorry I have my Matthews. You can't call the other guy here. Bane here, Fudge, Jet here, Forbes, Whirl, and Van Velson here. We do have a quorum present.
Perfect. A current copy of the Open Meetings Act of Nebraska is posted at the back of the council chambers. Um, second item on the agenda tonight is to approve the minutes of January 27th, 2026 meeting. If you've all read those intently, I'll make a motion to approve it. Second.

I will first read that a public hearing. Uh the planning commission values your input and wants to hear from the audience during public hearings. Anyone wishing to speak must first be recognized by the chair. Once recognized, please approach the podium, state your name and address, and please keep your comments to less than three minutes. Repetitive and excessively long testimony may be ended at the discretion of the chair. We will have a public hearing to discuss and consider action on an application by Dennis and Shirley Ogbornne to vacate a portion of an alley located between 621 and 701 East 12th Street. more particularly described as that portion of the alley located between lot 32 Hastings edition to Northplat Lincoln County, Nebraska and lot one Jurgensson subdivision North Plat Lincoln County, Nebraska running north from East 12th Street approximately 118 ft. Judy.
Okay. You should have all received a copy of the review comments. Attached to that is a location map and then um a plat if this were to be vacated, what that would look like and also an ordinance that would be forwarded on to um the North Plat City Council. Again, the applicant is requesting the alley vacation to allow future reconfiguration of the lot. The alley does not contain any public utilities and is not used for public sanitation collection. a location map um again is here and planning staff has no objections to the requested alley vacation. Um on the ordinance section two um the attorney does need to make a little correction there but other than that we should be good. If you have any questions happy to answer.
So does that just become part of that lot to the west? Um yes but it has to go ahead. Yeah. So, this one has um this one's been in front of city staff for a little while. Um the neighboring property is actually the uh city housing authority. Um and they don't have any interest in taking on half of the lot. And so, uh, the modification that Judy mentioned to the ordinance is that we're going to reserve, we're going to vacate the alley, but then the city's going to reserve all rights to it so that then we can sell it to um the Oborns. And so,
I was wondering how that was working because if not, I'd like to vacate my alley and take up that 16. just say the way the statute reads is that uh we can uh we can vacate and then reserve the property to be sold conveyed or however the city chooses somehow transferred. I mean it just four square alley right there. You never really have a four section. Yeah. Four or four corner intersection at a alley. What's the side streets? Um, oh gosh, the one that goes up to the park. Yeah. Um, all the way and then Yeah. Popppler on the
east on the west. Yeah, on the west. Okay. And then the thing that you see going north from there is just the extension of the alley, too. Oh, okay. But there's addresses on there, right? There's housing on there. Um, it's all addressed off Popler. The rest of it's addressed off of then would be what? 13th Street, 14th Street, 13th Street. Um, and that alley there, his main reason for wanting it vacated is people tend to use that to cut through and coming off of 12th Street and cutting through there. And he's just like, yeah.
Okay. Well, once again, this is a public hearing, so anyone wants to speak. If not, I would entertain a motion to close the public hearing. I move to close public hearing. Okay. File number AM26-00001. Discuss and consider action on an amendment to the North Plat City Code of Ordinances section 33.07 Historic Preservation Commission amending section 33.07 C34 and 9E regarding composition of the board and D regarding annual reporting. Judy.
Okay. And you should have all gotten a copy of the review comments. attached to that is the um changes that are shown. Um the ordinance amendment clarifies and aligns with the um historic preservation commission and city processes. Planning staff does recommend approving the proposed changes and I forgot the first part which is North Plat Historic Preservation Commission on Thursday, February 12th unanimously recommended referring the attached changes to planning commission and city council for public hearing and adoption. Um Kevin Kger is in the audience. He actually takes care of the historic preservation. So if you have any particular questions, he'd be happy to help.

Changes the requirement uh of quarterly to a minimum of four times a year. Yeah. and more officers and more actually less officers I think actually allocates what the staff does sorry oh no I four is gets rid of four we'll get it explained to us name and address please
Kevin Kger this assistant planner grants administrator for the city. So it's just a minor clarification. Most likely when this was originally adopted in 2007, it was using an example that was out probably shared by the state. So during the since then city staff has been performing the roles of secretary and treasur. So, it's clarifying that um these were recommendations by the Historic Preservation Commission and also it clarifies instead of quarterly just changing instead of four times per year and also just clarifies when a meeting right now it says 7 days. If you change it to 48 hours, it aligns with what this commission does, city council and some of the other ones that we give at least 48 hours notice um when a meeting is called.

Let's see if that bunch can be as efficient as we were on this. Huh. Any old business, Judy? Um, I don't have any, but I believe the city attorney has a couple things that he wants to talk about.
Um, yeah, I'll try to remember. Um, last meeting we talked about food trucks and so I have some information that um, because of some hyperlinks and different things that's in it, we're going to send it out to everybody by email. Um, just to review um, couple kind of rough draft versions of what we could look at for revisions to city code for food truck regulations. Um, otherwise I have a um document with links to what a bunch of other towns and cities within Nebraska have done for food food truck regulations. So, uh, we're going to email that out to everybody um, probably tomorrow. Um, that way everyone can look at that and then um, I'm still kind of working on some of the revisions and wrapping my head around like what makes the most sense to include in there. Uh, but we thought it would be good just to get it out to everybody on the planning commission to kind of do the same.

Um, the only other one I'm we're looking at is mobile home our mobile home park regulations has a um provision in that that if you do a mobile home park then you have to build a storm shelter that hits FEMA standards. Um, I mean it's they're pretty incredible to try and do that. And so we do have someone looking at doing a mobile home park, but what they are proposing is to put the mobile homes on permanent foundations instead of having the requirement to have this um storm shelter. Um, it would bring their costs way down. I guess doing a storm shelter was going to end up being like in the millions of dollars, astronomical. And so
yeah, so what Yeah. So what we're looking at doing is if the city engineer thinks that it's going to be engineered well enough that we would maybe put in there that you could either do the storm shelter or you could engineer your Does it still become a mobile home park if they're all on foundation? I was gonna say, so because if you can't move them out of there anymore, it's just a it's a it's a it's not a mobile home park. Be almost a tiny home park. Well, a tiny home, but you know, like you you get all those houses that housing manufacturers put together that are almost be a modular at that point.
That's what I'm saying. It's modular houses. Well, really not because they're still between manufactur. The thing is they're not each on their own individual lot, right? Still the part. Yeah. Regardless of the foundation. Yeah. So, it's not an individual entity parcel, right? So, it doesn't really matter if it's on a foundation. Yeah. Because it would still be over owned. It's still And you can still move. Well, you can move any house. So, that's just it. These are just easier. Yeah. Regardless if they're on a foundation or not, right? Yeah. The wheels and frame are still underneath us and and you just got to hook it up and and attach it.
We might even take the wheels off the foundation. Yeah. You never know. Leave the axle just in case and lay the wheels off to the side. I would leave the I put the wheels on and just let the air out and set on the foundation. Let go. Let Jack there and you're off to go. the wheels. Blow the wheels up and go. Okay. Any other old business? I don't do mirrors. That is the one we're talking about. Okay. Would would that be manufactured home instead of mobile home part? No. Because
um it's the width of the structure that dictates part of it is the width of the structure plus then the chassis that's under underc carriage that's under it. So, it'd still be it'd still be a mobile home. Technically, it's being fixed. Yeah. Fixed with a permanent foundation for just high-end mobile homes because most people think of homes. High-end mobile home. There you go. Luxurious mobile home. There you go. Safe. I'd be afraid if people moved them, you'd have all these sitting foundations. Just it'd look weird. Yeah. But we do have provisions to keep the mobile home park up. So be okay. They won't leave them with sitting foundations.
