Great. Thank you. And with us having a quorum, we are missing one of the parties from the from up here. So, we're one person short. So, Miss Lover, if you'll give them the So, everybody understands that. So we have we're not a full board and um so tonight it will take um a majority of the people with majority of the quorum to pass um a variance request tonight. So it takes four people to pass a variance request. So this first one about the trees would take four. Uh it's my understanding that Mr. McD um Mr. Mr. McGonagle will recuse himself from the next ones and then that means we will require three people to um pass the variance.
Thank you for that clarification and because of that and we feel like we still have some work to do on the two parking variances which include some trees that we're studying. I would like to defer those two to the next meeting. So the only one we remain with would be the slide on the ocean front track. There we go. First item on the agenda. We got number item number one is BZA25-477. We have an application by David Rumy for a variance to remove a tree at 948 Moral Drive. Now the just for everybody understand this has already been closed. We've got a um we've got a letter from arborist stating about the trees are in question or are uh uh dying or dead or not worth you know not not they're not going to survive. Um, Mr. Co, you want to give a little breakdown of what we have on this so everybody understands the tree ordinance?
The tree is dead or dying, we can issue a permit to remove it with a one tree replacement. You don't need to take any. Great. Thank you, Miss Cowwell. Any questions for Mr. Cowwell? So those trees they will have to plant some replacement. One tree replacement per tree. Okay. When you say one tree, is that as equal number of acres? Is that just a tree? The ordinance says a tree. A tree. No size. It could put a twig up and take down a 20inch tree. If it's dead or dying.

So Mr. Chairman, uh just regarding BZA25-47, uh just like you said, want to recap last month, Mr. Rummy came in, had a house in Tidewater Plantation, heavily wooded lots, require tree removal from the actual area of that the house would be built and uh located at. He asked us as a board to consider trees that he thought were unhealthy. We advised him that that was outside of our purview and he would need to hire an arborist to evaluate those trees which he did and we have been provided a letter that the arborist concurred with his assessment that those trees need to be removed and he is meeting the requirements for the city to replace those trees. Yes, sir.

PGI item 2601 and 262. 261 and 21. Okay. Okay. So, do I have a motion? Um,

The next item on the agenda is BZA-26-03, which is an application by Robert Gayton for a variance of the sideyard setback for a proposed slide tower at 1717 South Ocean Boulevard zone resort residential R4 district. Mr. Gayton, would you like to u explain your variance request? Sure.
Thank you, Madam Chairman. Um, as you all have seen in the past, I think every Oceanfront hotel that I've been involved in in the last several years has required some sort of variance. These are all dimensional variances and their constraints both because of Ocean Boulevard and because of the OCRM line, which is not a constant line. It moves from time to time, as well as the Dune line. In this particular case, the building itself is able to fit within that envelope. What we're asking for is relief from the side setback which is 10 feet. It's a slide tower and I want to explain what that is. It's not a building per se, but it's classified as a structure under the code. So therefore, since it's below 35 ft, we still have to ask for a variance. It's essentially a metal circular staircase to allow patrons to get to the slide to enjoy that with the pool. So that's why we're requesting that that side setback be reduced from 10 ft to 6 feet for the slide tower only. Um unlike what you typically see with a building wall or something else, it does not create a shadowing problem which we've seen on the last few buildings on the ocean. It doesn't create any airspace problem between the adjoining properties and it doesn't cut off any view corridor from the street. Um, the neighboring properties were all developed either prior to zoning or under a prior code. So, they're all closer than what we're proposing to the property line for these improvements. Uh, as we said, each piece of property is unique, particularly on the ocean front. There's changes in topography that make that difficult to accommodate. So, we're asking for that to be the relief that we're requesting. The um question as to the previous described conditions unique to this property. They are uh as we discussed the properties on either side are already existing. They were developed under prior codes. The current code
prohibits the development of this property. As you know, one of the things that's made North Myrtle Beach unique is that they are constantly improving the oceanfront property. Um this is another example of that. So we're trying to make sure that this remains a vibrant coastal market. State and federal and local ordinances which are only applicable to new construction is what proposes the change in the current case. Uh why describe why the zoning regulation proposed for variance would prohibit or unreasonably restrict utilization of the property as to the oceanfront property. The hardship imposed would be to require the incorporation of an older concept such as a diving board which is no longer incorporated in a new development as opposed to this airy uh safe and simple uh concept to enjoy the pool on the ocean front side of the property. Describe how authorization of the variance will be in harmony with the intent of the zoning ordinance and will not be injurious or to adjacent properties, the neighborhood or the public in general. As to the oceanfront parcel, the inclusion of the new slide would extend the existing use of the amenities on this property which has been there for many years as a resort and the redevelopment is an increase in value both to the public and to the u visitors to North Merl Beach and the installation of new slide would remain harmonious with the adjacent properties while reducing the potential for guest injury. uh describe how the variance thought is the minimum variance necessary for reasonable development of the site. As we talked about earlier, the OCRM constrictions on where you can place any of the amenities on the ocean side allow us only this area. If we are incorporating the resort amenities that you would expect in this sort of property, this is the only place it can go and a 4ft variance is less than 50% of the remaining setback. Describe why the granting of the requested variance will not confer on
the applicant any special privilege that is denied by the zoning regulations to other land owners in the same district. Again, the proposed variance is a dimensional variance applicable only to an exterior elevated slide adjacent to the oceanfront pool and the pool existed in the prior property for many years. So, there's no change in the use there. Continuing that use with a newer, more attractive, and safer slide preserves the current use of the property and does not expand the use since no other adjacent properties incorporate an ele elevated slide with an exterior oceanfront pool. Okay. Uh, petitioner Robert Gayton has submitted an application for a variance to reduce the required sideyard setback in the resort residential R4 district CBN ocean overlay at 1717 South Ocean Boulevard. Section 23:22 requires a building setback of 10T for the first 35 ft in height and 15 ft for buildings in excess of 35 ft in height. Mr. Mr. Gayton would like to reduce the sideyard setback for a proposed water slide tower less than 35 ft tall. The setback for that part of the building less than 35 ft tall is 10 foot. The applicant is asking for a reduction in setback to 6 foot from the side property line. That's the northern side property line. Uh staff recommends that the board review the variance application and attach drawings and review section 2322. Can you explain um the OCRM line and why that why that changes and why that affects the setback?
The OCRM setback line is a line um between the beach and the developable part property and it will move from time to time. Um but that's not set by the city. That's set by that organization. Uh a state organization. Yes, ma'am. Okay. And so what is how often do they reassess that line? I don't know. Okay. I think it's been done a few times in the past 20 years. They issue it when they do that, they issue some kind of a plot or a platter or Well, when surveys are done, the surveyor will locate where that line is on the property. And certain things can't go past that line.
Okay. And so, is it my understanding that the reason this is a water sliding board, right? This is a I believe a staircase for the water slide. Staircase for the water slide. Yes. And you the city is considering that a building and that's why they need a variance. Uh stairs are not something that's allowed to encroach into sideyard setbacks. They need to meet the required sideyard setbacks. Okay. So that's what the variance request is for. Okay. So but really when you read this section of the code, it says sideyard building setback. So, this is not really a building. It's a staircase.
We call it a building setback or a setback line. And there's only a few things that can encroach into a required sideyard setback. And stairs are not one of those things. Okay. Like overhangs, things like that, right? Uh yeah, overhangs cannot go into sideyard setback, but things like uh air conditioners and generators can. Okay. So, this the slide itself is not over the line. the stairs to climb up to the top of the slide. It appears to me that the slide is meets the required 15 foot setback and just a portion of the stair tower goes six foot into the required sideyard. I'm sorry, four foot into the required sideyard. And this is not going to be an enclosed staircase. You'll be able to see through it. Uh
that's probably a better question for the applicant. Okay. I haven't seen plans for it other than the drawing that you have in your packet. Yeah, I was wondering if there was a picture somewhere. Is there a photo of a something similar somewhere on another property? Uh, I don't have the particular one here, but I think I have one for something similar if that would be helpful. And while you're looking for that, I guess some of the things that just popped in my head were you said it was made of metal? Yes. So, is there going to be a noise issue for people that are on the other side of of the resort? It's only foot traffic coming up there, people from the pool. So, okay. It is open air. It is open air. Okay.
So, it's not going to affect in any way people's visibility to the Can you put that on the resort? He'll come now. Put it on the right next to the prompt. There's a And then also from a privacy standpoint, are they going to be able to look in the people on the other side? Is that going to be an issue? Looking to the people that are next door? No. It's much lower than any of the guest rooms that are in the building itself. So, these are only people on the pool deck that would be enjoying this tower. Is there currently a slide on the property? Uh, there was on the former property. There was a The former property had a diving board and a pool there, but that's all been demolished, so there is nothing there today.
Okay. I thought I'd read something about it because you're placing a prior slide or something. Okay. All right. Any Anybody else have any questions for the applicant or the city? Is I I've got one. the uh is there a um uh public access on either side of on the southern side? There will be this is on the northern side. Um would anyone else like to speak to this variance? My name is Debbie Lapiierre and I'm a full-time resident. I live at 1414 Hillside Drive South. This all started like in 2021 and the city has put in a lot of work trying to come to an agreement between MIG I guess it is and the citizens of Crescent Beach. We've not been in favor of this project from the beginning, but the work that the uh the city has done in and was approved by city council in 2022 gave MIG the right to the everything was uh approved. They got the right to build a a resort building on the ocean front to a height of 165 feet. They got the right to build a parking garage across the street to a height of 90 ft. We didn't agree with it then. We still don't agree with it, but we live with it. I mean, this is something we feel like we've given all we need to give. We don't feel like that they need to encroach onto the statemandated and regulated property and that's just I mean we feel like we've given all we need to give. This isn't a concession they can make.
So So let me ask you a question while we're talking about this. So I do want to clarify number one. Number one, the staircase wouldn't encroach in any federal or state setback. This is a city setback, not a state setback. I want to clarify that. Uh according to the paperwork we were given, it encroaches possibility of encroaching on the OC. Let's see, it's called So if if you look the OCRM,
no ma'am, your OCRM is at the back of the property. It's not on the side. And they're asking for a side setback. the OCRM, which is your ocean resource management is is what your OCRM is. And basically that is at the back of the property. So that is not on the side of the property. That is at the back on the dune side back towards the ocean front. Right. Yes, ma'am. Yeah. Yeah. So that's it's not encroaching on the OCR RM line. It's encroaching on a side setback line. That would be the side to the property. Mhm. So if you're standing looking back at the beach, right, this this staircase would be on the left hand side of the property. And so they're ask they're asking for a 4ft variance there. Yes.
On that side. I just want to make sure we're talking about the same thing. I understand. Yes, ma'am. Yes, ma'am. I was going by information that was in the packet that we received. Okay. So So yeah, mentioned the OCRM encroachment. Yes, ma'am. I get it. Um, so it's not encroaching on the OCRM setback line. Um, one of the things I do want to ask is you talk about the parking garage. Uhhuh. How would you feel about them eliminating the parking garage? I don't mind the elimination of the parking garage. I mean, because it will take everything down to street level.
Okay. I was disappointed though because part of that um parking garage included retail restaurant type commercial type u businesses that had to be in put into 10% of the square footage. But if you but if you eliminate a 90 foot structure on the Ocean Boulevard, would you prefer to do that or would you rather have the retail? If I if you're able to eliminate the parking garage. Oh, I don't mind the the parking lots. Okay. I don't mind the parking lots. I do mind that they want to reduce the buffer. Okay. The landscape buffer. Okay.
So that and the way I read the information was so that we can get extra parking spaces. Okay. Well, we'll talk about that next time. I'm just asking questions. I just want to make sure we're all on the same page. Yes. The other thing too is you talk about them building having the ability to build up to 165 ft. The reason that they had to go vertical in the in the manner that they did is because like Mr. Caldwell said the OCRM line is set by NOAA, right? The National Oceanic Atmosphere Agency, right? So, and that line moved and so they have set back. So when they demolished a dilapitated hotel that needed to be replaced,
which is for reentrification of the community, which enhances tourism, which we know that our economy thrives off of tourism, all that kind of stuff, right? Exactly. So So we know this. So we we're we're trying to find a way they're trying to find a way to do something good. They did not they did not go to 165 ft. They actually took four stories off their hotel. Exactly. Yes, ma'am. But y but the overlay allows that. And I'm saying what we had to do and the city did a wonderful job of it looking forward. They looked at the future plans that was already in place
and then they came back in with a proposal that MIG could still do their project and would kind of give the full-time citizens, full-time residents, I should say. Yes, ma'am. Of the community kind of appease us in some ways. Yeah. It's got to be a win-win, right? It's got to be give and take and everything, right? I give you I got 100% correct.
So the other question I have is that through this process MIG did give 30 ft of their property to expand the beach access for the city of North Myrtle Beach which will now include pickle ball courts which Mr. Cwell can expand off of this and some additional beach access. So that restricted so again that restricted their use a little bit too. So they had to slide the the hotel over for that beach access which is on the south side of the property if I'm remember correctly. I don't have it in front of me. I just know we have seen this in front of us before. So, I just want to make sure that we're I'm recalling off of previous issues. So, they gave away 30 ft of property on the south side. So, if you're standing looking back at the beach side to the right, they gave away 30 feet to the city that's that the city can use as an enhancement for beach access and also public good.
More golf cart parking. Yeah. More golf cart parking space for the local residents. you'll be able to access um you drive your golf cart down there and park whereas now you can't. I understand that. Okay. Okay. My question though, how much public access did we have before? Very little. It was it was literally just a walkway. And was there not one at each on each side of that property? No, ma'am. So, that was one of the ones that did not carry forward based on deedings and things like that. It was just a walk. It was just a walkway. I'm just I'm going back to some of the deeds in that area, property deeds in that area in have in their deed that they have a public access. Yes, ma'am. All the way down.
Yes, ma'am. And I just want So, we're saying that 15, let's see, that would be what? 17th and then 18th. So, there was no only one public access in that entire area. There was just one on that right hand side. Yes, ma'am. All right. Yeah. But um Southside, yeah, it was on the south side. And I I agree with you. I'm I'm just so you know, I'm an original from here. I grew up here in North Myrtle Beach. Okay. So, I'm from here, born here, went to school here, left to go to college, all that good jazz. But I live here, too, like you. So, I understand where you're coming from. But also just trying to find because we again, I want to make sure you're happy as as we we do this conversation, right? And so,
we're we're just trying to to find a way to work through this. So if if if MIG gave 30 ft to the city for the enhancement of public good, things of that nature, and he's asking for literally a 4ft variance on the north side of the property, do you have an issue with that with a 4ft variance on the north side? Cuz he's given 30 ft to the south. He's asking just for a 4T for an open case open air staircase, right? Which would be for the visitors and things of that nature that are on his property. Do you have an issue with with us granting the four foot variance? No. Okay.
All right. Because I want you to I want you to be I want you to know that you're heard. That's number one. And number two, I want you to know that we're we sit up here as a board trying to find common ground for both sides of the party. And I appreciate that. And and the other residents of Cresant Beach appreciate it also. Yes, ma'am. I lived on 17th South for 10 years. Uhhuh. Y Darcy's. So yeah. Okay. So, but I just again I want to clarify that Mr. Mc Mr. McGonagle who is part of MIG transparency, we all know he's part of MIG. He's recused himself from a meeting today.
Um, is not going to be going over the OCRM setback because that's against federal law. So, we're not going to be doing that. And number two, we're asking for a 4ft variance on the north side of the property that he does have constraints that would that have set him back a little bit. So that impeding into that 4 foot granting that 4 foot variance, do you see it being detrimental or causing harm to other neighbors or the community as a whole? No, I don't. Okay. All right. What is is there anything else you would like to add? No, I just wanted uh you know to make sure that everybody knows that
there are some issue were some issues ma'am from my standpoint but also from other citizens. Absolutely, 100%. We completely understand. And I I appre I appreciate your listening. Yes, ma'am. I'll sign. Good afternoon. My name is Ann Lame and I'm one of the investors in this project, the Compass by Margaritavville. And I want to thank y'all for your time today. And I want to thank these ladies, too, for coming. And just in the spirit of what we're trying to do in this project is I've been in the hotel business my whole life. And so I have have a pretty good understanding of guests and and I try really hard to have a good understanding of hospitality. I think that's so important. not just as a business owner, but as a resident of South Carolina. And we want people to come here and go home and tell their friends and their families back home what a great experience they had. And we only get one chance, one shot at making them feel like they made a good choice because there are lots of other choices to stay um and to vacation. So, it's very important to us to make the people that live around us comfortable and and accepting and and excited about what we're what it is we're trying to do. I'm very guest focused. We we tried we we went over a million different designs of this oceanfront um outdoor amenity. And we could have pushed it closer to the o the building closer to the ocean and had more parking, but we didn't want to do that because we I know when I go on vacation, I don't want to be elbow to elbow to somebody. I want to have a nice spacious area that I feel like I can can breathe. And so all these things came
into play. It we it wasn't a a quick decision. We really did try hard to make it good for everybody. And we want it to be something that y'all can be proud of. come to our restaurants and and um there'll be a little bit of retail there. The loss of the parking garage, I think you're going to be really glad about the the retail that there was space for there wasn't large anyway and I'm I'm not sure it was the kind of it was what you're were thinking you might have lost out on, but um we'll still have some of that. Good evening. I'm Cheryl Kildday. I'm the president and CEO of Destination Northr Beach, where the local chamber of commerce and tourism organization. This is a project we've been following and have um testified before city council in support of. I think that the um the parties involved have worked to try to make sure that they're eliminating any harm for the community, the neighbors. A lot of that discussion has been vetted tonight. Thank you. Um you know, the destination master plan that our organization led as a communitywide initiative, this project is consistent with that. It's an upscale um product that we look forward to having on our beach. Amenities matter. Service matters. Fitting into the community matters. And if we can achieve that, then we would absolutely see to continue to support that. It's also consistent with where the comprehensive plan of the city, the vision of that part of um Cresant Beach and really having these commercial nodes that are walkable and um open to the community. So the, you know, the ability to offer existing space to get to, you know, improve beach access while also accommodating their guests is something that we would really like to support. So, just wanted to make a couple of comments on that as it came forward to you.

I I got it. She Mrs. Wubber had a a copy that she provided over just to make sure we check all the boxes. So, uh Mrs. Lover, I will make a motion that we pass variance BZA26-3 because the applicant has demonstrated unnecessary hardship. Specifically, there are extraordinary except exceptional conditions pertaining to this particular piece of property which are the setback of the OCR RM line established by NOAA and also the group donating 30 ft to the south side of the property to the city for the public good. These conditions do not apply to the other properties in the vicinity which they do to certain aspects minus the um donating of the land to the public good. Because of these conditions, application to ordinance to particular piece of property would effectively prohibit reason of distributization of the property.
