I am his sub. I'm new to this, not to the board, but to running the meeting, so bear with me. Julie helped me out, major, and made me a little script, so we're good. So I'm going to call to order the Zoning and Building Standards Boards of Appeals meeting on June 24th, 2026. The time is 5.30 p.m. The first order of business tonight is roll call.

0:26Speaker 4

Can we call the roll? Mr. Zollinger? Mr. Anzetta? Mr. McGinnis? Mr. Lamuel?

0:34Speaker 4

Ms. Puffinger? Here.

0:36 – 0:58Speaker 3

As you can see, there's just three of us here tonight. We have a quorum, but for the parties that are interested, if you would rather table, because in order for your variance to pass, we'd have to be unanimous in our decision. So if you'd like to table your request until the next month when we may have more members here, or we can continue. Questions?

0:59Speaker 1

Okay. If it's not unanimous, what's the alternative? People file a appeal and come to another meeting? That's a very good question.

1:10Speaker 3

Thanks a lot.

1:11 – 1:26Speaker 1

I have a question as well. So you have five people. If we decide a table, does it take five people, a majority as well? No. Okay. No. I mean, sorry, unanimous. A majority. Yeah.

1:35 – 1:52Speaker 3

THE NEXT ITEM ON THE AGENDA ARE THE MINUTES FOR CONSIDERATION. OUR LAST MEETING WAS MAY 27, 2026. THOSE MINUTES WERE PROVIDED TO US BEFORE THIS MEETING TO REVIEW. IS THERE A MOTION TO APPROVE THOSE MINUTES?

1:53Speaker 3

SECOND. THANK YOU. WE HAVE TWO VARIANCES ON THE AGENDA TONIGHT. Can you please make the first request?

2:03 – 2:20Speaker 4

Application ZBLA 26-5, Sally Liner 210 Turnberry Circle Southwest. A variance requesting a reduced rear yard setback as required by NCO 1133.05G for a new sunroom to be placed 28 feet from the rear property line.

2:22Speaker 3

Thank you. We're going to start with anyone in favor of the application, starting with the applicant. IF YOU WOULD LIKE TO STAND AT THE PODIUM AND PLEASE STATE YOUR NAME AND ADDRESS.

2:31 – 2:43Speaker 5

GOOD EVENING. I'M SALLY LUNNER AND I AM RIPA SINGH. EXPERIENCE AT 210 TURNBERRY CIRCLE.

2:50Speaker 3

DOES ANYONE HAVE ANY QUESTIONS? DO I NEED TO? Any more you want to tell us about? About why I'm requesting it?

3:00 – 3:25Speaker 5

Sure. So I am just requesting I want to improve my property and I want to create a large space, larger space that's open and hairy and light and hoping to stay in my home for the remainder of my days. And so having it in the back of my home would allow me to make it more accessible if that's more necessary at some point.

3:26 – 3:47Speaker 3

And you're asking for a variance because it's supposed to be 40 feet. Yes. And yours would be 28. Board members, any questions? Do I have a, is there anyone that wishes to speak against the application?

3:51Speaker 5

Do I have a motion? So moved.

3:54 – 4:35Speaker 1

That be accepted. As opposed. And I will second it. And just with the comment that I drove by the property and it seems like obviously backyard to backyard seems very spacious back there. I can't imagine the difference is going to make any difference to anyone. And the fact that there's no opposition today says a lot as well. I've been on HLU boards And that she had the HLA president come by, and he was in favor of it. So she's taking care of it. Very good. Just to confirm, I give a second.

4:37Speaker 3

So we have to vote.

4:38Speaker 4

I'll call the roll, yep. Ms. Puffinger?

4:45Speaker 4

Mr. Laniel?

4:46Speaker 4

Mr. Anzetta?

4:51Speaker 4

So it passes. Yep, the variance is burdened. Thank you.

4:56Speaker 3

You know, I know these things are important to you, and I don't mean to make light. I'm just a little nervous. That's okay. I'm a little nervous myself. We got through it. Okay. Can we have the second request read?

5:14 – 5:34Speaker 4

Application ZBOA 26-7, 815 East Maple Street, a variance request to add a 20-foot strip from the adjacent property, parcel 9208299. This would shift the property line to the west so that it is flush with the edge of the parking lot of parcel 9200298. Thank you.

5:34Speaker 3

So we're going to start with anyone in favor of the application. Please state your name and address.

5:43 – 7:27Speaker 2

My name is Karen Dodson. I am an attorney representing Dermaz Leasing in this matter. My address is 6545 Market Avenue North in North King. So obviously we've submitted the written request. Basically, what we're requesting this variance for is that both of these lots are required to have 150 feet or I'm sorry, yeah, 150 feet width. Currently, Dermaz's parcel has I think 116 The other has 150. The property has been treated all for at least 20 plus years as if this 20 foot strip belonged to the Durham as property. Essentially, it was under common ownership from 2000 on. And in 2001, when it was decided to sell off the adjacent parcel, they resurveyed it. Had all those surveys approved by the county, the county maps even were updated to reflect that the line was 20 feet over. But then somehow when the adjacent parcel was conveyed, the incorrect legal description was used. So instead of referencing the new survey, it referenced the original plaque and the entire parcel was inadvertently conveyed to the adjoining landowner. Nobody noticed that until this year. So really what we're asking for is to correct the record and transfer. We're in discussions with the neighbor and parcel. They're in agreement to transfer the strip to us, provided that we can get that split approved. That is essentially what we're asking for today. Does anybody have any questions?

7:28Speaker 1

So obviously that 20-foot row is parking. Yes. Are there any plans to do anything but parking? To expand the building? No.

7:39 – 7:57Speaker 2

No, it's just it came to pass because the adjacent property is getting ready to be sold again. And in so doing, they surveyed it, and the surveyors that they hired noticed the problem, even though it's been surveyed a couple times in between, and nobody noticed the problem until now. But everybody just wants to get it cleared up.

7:57Speaker 3

It even sits up higher, doesn't it, too?

7:59Speaker 2

Because when I was there, yeah.

8:01Speaker 3

So it looks like it belongs where it belongs.

8:03 – 8:23Speaker 2

It does. I mean, it's really not going to change anything as far as the character of the neighborhood. It's going to stay exactly the same as it always has. It's just that the legal ownership will be treated as if, you know, as the practical application of it has been for the last 25 years.

8:23Speaker 3

Is there anyone here to speak against the application?

8:29Speaker 3

And do we have any more questions from the board? So do we have a motion?

8:39 – 9:00Speaker 1

I move that we accept the application as proposed. And I will second. And with the comment that I think in this situation, if everyone wins, you're going to get a legal issue solved and nothing really changes. That's right. It's good for everyone.

9:00Speaker 4

So roll call? Yep. Ms. Clevenger? Yes. Mr. Lamuel?

9:04Speaker 4

Mr. Anzetta? Yes. Thank you.

9:09 – 9:24Speaker 3

Thank you. We have nothing else on the agenda tonight, so I'll make a motion. Oh, or do we? I thought you were quitting. I'm sorry. So, I'm going to make a motion to adjourn the meeting. Do we have a second?

9:24Speaker 4

You guys can just do a voice.

9:27Speaker 3

All those in favor to adjourn the meeting?
