I am the Special Magistrate for today's hearing for the North Bay Villages Code Enforcement. This hearing is conducted pursuant to Chapter 162 of the Florida statutes. Florida formal rules of evidence shall not apply, but fundamental due process shall be observed and shall govern these proceedings. I will hear testimony from the code inspector and the alleged violator that I deem competent and relevant. All witnesses and parties offering testimony must be sworn in. The village will present its evidence. Evidence first, including presentation of photographs, reports, and other documents. The alleged violator will have an opportunity to examine all documents presented at the hearing, as well as to cross-examine the alleged witnesses. At the conclusion of the presentation, I will announce a decision and issue a written order thereafter. If you are found guilty, you will be ordered to comply with the code within a certain time. If you do not do so, you may be fined up to $250 per day. for the first violation and $500 for repeat violations. If you desire to appeal my order, you may do so by filing a notice of appeal with the clerk of courts in Miami-Dade County, and you have 30 days within which to file an appeal. Case number 241101, property address 1881 Kennedy Causeway. The owner, the Bridgewater Tower Condominium Association, Inc., in violation of Code Section 8.17J1 and 2 of the North Bay Village Code of Witnesses, bills and maintenance violation. Inspector on this case, Orlando Rodriguez.
Good afternoon, Your Honor. For the record, Orlando Rodriguez, North Bay Village Club Director. This case was before you last hearing, January 22nd, 2026. Property was ordered to comply with the violations. At that point, fines of $250 per day had been running for 246 days, total $61,500. Property was ordered to return for status reported for fines to continue. As an update, The property manager, Mr. Diaz, continues to address the comments that is needed to get that permit. He is actually at the cusp of obtaining that. It's just a technicality now that's pending for him to get that permit issued. His contractor needs to re-register with the village and submit all his insurance copies and certifications. So once that's done, he'll have the permit issued. At this point, our recommendation is for the property to comply as soon as they can. Fines as of today are 274 days, total 68,500. We'd ask for the fines to continue and for Mr. Diaz to return, hopefully next hearing for mitigation.

Inspect on this case, Maria Tovar.
Good afternoon, Maria Tovar, Code Enforcement Officer. This property came before you last in January 22nd, 2026, and it was found to be in violations. 30 days were given to obtain the permit to comply with the violation. This property has been accumulated fines of $250 per day since June 26th, 2025 for 239 days for the total of $59,750. We have not heard from the owner. and all the permits application to legalize the unpermitted work are still pending since October 6th, 2026. They had gone to two different rounds of our review and the most recent one was on February 12th, 2026, but it was rejected. As I said today, they still on violations. So we are recommending for them to attend the necessary permit to comply with the violations and for the fines that have been accumulated to continue accumulating until they come into compliance and to come back at the next meeting for an update.

Case number 08051. Property address 7929 West Drive, Unit 402. Owner, Jilla Renee Oswald. In violation of Code Section 105.1 of the Florida Building Code, work performed without the required permits remodeled two bathrooms that required building, electrical, and plumbing permits. Inspect on this case, Orlando Rodriguez.
Good afternoon again. Your Honor, Orlando Rodriguez for the record for the Village Code. This case is also before you. Last hearing, January 22nd. Property is ordered to obtain their building permits to comply. At that point, fines have been running for 211 days, total of $52,750. Fines are ordered to continue and for the property to return. Last hearing, the contractor, Mr. Dennis Lopez, who's here this afternoon, was representing the owner. He indicated that he would be submitting the documents for the permits. However, we haven't seen anything yet. We did speak again this week, and he indicates that the runner he's using told him that they had submitted items, but we haven't seen anything yet. So I don't know if he got additional information. As of now, our recommendation is for them to comply as soon as they can. Fines have been running now for 239 days, $59,750. Yes. Hi, I'm here. I'm Denis Lopez. I'm working with a general contractor who will do all the permits. To be honest, I don't know what's going on between the runner and the person with the CD. So I spoke, as the inspector said, I spoke with him yesterday and I spoke with the runner. So there is some issue with the documents. So I will take it out. I will take it. I will resolve what's going on with the documents. So hopefully for me, that's going to be completely resolved the next week and we're going to submit all the documents.

At that point, fines have been running for 1,037 days, $259,250 to date. Property is ordered to return the status report. This property continues to work under certification. As we stated last hearing, they've received their exterior concrete restoration permits. So they've been diligently working on those repairs in the exterior of the building with the swings and everything. So those projects take time. But they're actively working and we're just monitoring their progress basically at this point. Our recommendation is for the fines to continue. As of today, they're at 1,065 days. They are both in submitted status currently. We do not see any other permits for any other buildings, but we're waiting for them to submit those. So our recommendation as of today is for the fines to continue. They're at 183 days to date, $45,750. We'd ask for those to continue and for property to return for a status report.

Case number 3182, property address 1681 Kennedy Causeway, owner M.G. Prosper, MBV, LLC, and 1681 North Bay Village, LLC, in violation of Code Section 105.1, of the Florida Building Code commenced demo work inside the building, demolition of walls, floors, and ceiling. Inspector on this case, Orlando Rodriguez.
Good afternoon again. Your Honor, Orlando Rodriguez, Northfield Village Code. This is a new case. On October 9th, 2023, we received a notification from the building department at the village that the property had commenced demolition work. I visited the property at that time and I spoke with the foreman in charge who granted me access into the building. I confirmed that the demolition work was in progress and they indicated that that work was being done at that time due to some water damage. No permits were on file and we proceeded to issue the $250 citation. I spoke with the property agent at that time, her name was Martha, and she indicated she would apply for the permits and pay for the citation as soon as possible. A few weeks later, on December, pardon me, October 18th, she did pay the citation approval, and she was also able to apply for four permits, one master and three sub permits. For the record, that master permit was BLDR000544. Approximately one year later, that building was sold to the new owner. And the new owners did receive a lien search. That item was documented on there. Within the last year, we had become in contact with Mr. Peter Graves, who's here this afternoon. He's been involved in resolving this issue now for the new owners. He's been working diligently with us and the building department trying to sort this out. From what we have discussed, the ultimate goal may be for the property to have the entire building demolished. So Peter's kind of navigating the best course of action to get this case in violation and compliance with our building department, kind of seeing which route is best. I can let him elaborate on that. Our recommendation is for the property to comply as soon as they can. We'd like fines of $250 per day to commence today and for the property return for a status report. Yeah, my name is Peter Graves. I'm an employee of the current owner. Orlando and Leilani have been extremely helpful in bringing me up to speed on what happened previously and what's required to get into compliance. So there's some legwork that we need to do on our end, ordering some reports and so forth that we need to do prior to applying for a new demolition permit, which would capture the unpermitted work done by the previous owner. I please ask to hold off on the ticker on the fees beginning today because there's several environmental reports and other things I need to tackle in order to get the permit that will capture this work done by the previous owner.
What's your time frame?
Yes, inspecting. So by the next hearing date, which I assume that's a month from today roughly, expecting to have the environmental survey required by the county in order for us to receive a demolition permit. depending on what's contained in that report, we will or will not be able to then immediately apply for a total demolition permit of the building. We already know who the demolition contractor will be, and we'll be getting demolition plans from them and an architect. So I plead to please give us, at least until the next meeting, on turning on our ticker.
As far as us with honor, this is his first time here with our timeline.

Let me clarify, Your Honor. This property has actually come into a stipulation agreement with the village. They did owe some fines. However, they agreed to pay us $350 for the outstanding fines they have within 30 days. If not, it will be reported as a lien on the property, just pending your approval.

I'll see him this afternoon. But as an update, the property does continue to work on those parking garage repairs. As far as the office building, They are pending Durham approval with the asbestos report they submitted. So they're continuing to work. They've given 30 days to come into compliance. The property has been accumulated fines of $250 per day since October 23rd, 2025, 419 days, a total of $29,750. On February 5th, 2026, The building department received an email inquiring about how to reactivate the electrical permit. The instructions were given. Today, I spoke to Ms. Christiane, who has always seen the electrical violations. She said that she's working with electrical, but that she's waiting for the engineer on the building side. But as of now, no application has been submitted. It is our recommendation to obtain on the permit to repair the building, to comply with the violations, for the fines to continue to accumulate until they come to compliance and to come back at the next hearing for a report.

Fines have been running $250 per day at 127 days at that point, $31,750. The property is ordered to return for status report. We have not received any communication from this owner. He has not submitted for any permits. We are still pending for him to legalize the desk he left. He indicated he was just going to remove from the property. But our recommendation is for the property to comply as soon as they can. As of today, fines have been running for 155 days, $38,750. Case number 250823, property address 7545 East Treasure Drive, owner Caribbean Towers Condominium Association, Inc., in violation of post-section. 151.208 of the North Bay Village Code of Ordinances, failure to obtain recertification of buildings and components. Inspector on this case, Maria Tovar.
Good afternoon, Maria Tovar, Code Enforcement Officer.
This is a new case.
On August 16, 2021, the building official conducted a walkthrough of the Caribbean Tower building. Several items were identified that needed to be addressed immediately. He requested an evaluation report from a Florida professional structural engineer addressing some of the components and with a plan to be how it was going to be repaired within 15 days. And then to give another report within 30 days for the rest of the items of concern. October 2021, the building official received and reviewed the documentation submitted by the engineer and discovered that all the items in need of repair, they will need a permit in order to repair. He allowed them 60 days to comply and to correct those items. and with the letter from the engineer later after saying that the business was short-term and electrical safe for the occupancy. At that time, he formally put in a notice that the 10-year recertification was due. They didn't comply with that. So he gave it another December 22nd. He sent the final notice of giving 90 days to complete her certifications. On August 25th, the property was still not in compliance. And so we referred to our department for the enforcement. A civil infraction notice was sent with 30 days to comply. But they're still in violation, so that's why we're here today. So we are recommending for them to attend the necessary permit to get their recertifications and for the fines of $250 per day to begin accumulating today and to come back for the report in 30 days.

As soon as they can, fines of $250 per day had been running at that point for 64 days, $16,000 in total. They were asked to return today for the fines to continue. The property has begun the process to request the consent agreement with Durham. The last activity that I've seen under Durham portal for this case was dated December 16th of last year, where it shows the item is still under review. I do not have any other updates at this time. Inspector on this case, Orlando Rodriguez.
Good afternoon again. Your Honor, Orlando Rodriguez for the record. This is a new case. September 8, 2025, during a routine patrol, we observed the property was installing an aluminum roof on top of their rooftop. I did verify with the building department they did not have a permit for this work. So at that point, we did issue a $250 citation that was posted to certified mail. Review of the records confirmed the citation does remain unpaid, and we have yet to receive a permit application. However, as of late, I have been in touch with Mr. Ryan, who's here this afternoon, one of the property owners, and he acknowledged it, and he says they've been working on it. However, he hasn't applied for a permit quite yet, but he sent me a text actually a couple of minutes before the hearing, indicating that his architect fell a little behind, but they're still working on that plan to go ahead and submit the permit. So I can let him elaborate on that. But our recommendation right now is for the property to comply as soon as they can. We'd ask for the fines of $250 per day to begin today and for the property to return as needed for a status report. And we have Mr. Ryan here, his bachelor's.

Good afternoon, Your Honor. My name is Ryan Whidbey. I'm the owner and resident of the property, and I would like to respectfully object. If I could, I've been in contact with our contractor who did the work. I've since contracted with an architect to create the appropriate drawings. They're requesting 180 days for full compliance, but also told me yesterday that The application should be ready or the drawing should be ready for submission by this weekend. So I think we're moving in the right direction to make progress on this. And they've just requested an extension to make sure that the drawings are complete and that we have time to go through the permitting process with the city.

Case number 250827, property address 1801 South Treasure Drive, owner North Bay Villas Condominium Association, Inc., in violation of Code Section 151.20A of the North Bay Villas Code of Ordinances, valid to attain recertification of buildings and components. Inspector on this case, Maria Tovar.
Good afternoon, Maria Tovar, Code Enforcement Office. This is a new case. On July 28, 2021, during a walkthrough of the building inspector, he found certain items that were identified that needed to be repaired, like exposed rebar at the ground floor, piping supporting the ceiling and the ground. They were not stable. They had different wires that was with the AC cable that was loose at the roof. He requested an evaluation from a Florida professional engineer. The report should address at least how they were going to fix some of the components and to give the recommendation in 15 days. December 22nd, a letter was sent to Norbury Bay Villa condominium to let them know that they would do for the 10-year recertification, based on what they found. And they got 90 days to submit a complete report. On April 23, the building official reviewed the recommendation provided by the engineer in the 10-year that based on the repair, they need a lot of permits to be able to to fix what they needed. So they gave it 60 days to attend the permit and to repair. And upon that completion of the operation that they needed to do, another report was supposed to be extended to them, letting them know that they were sheltered in an electrical safe to continue the occupancy. All those 2025 the property was still in the same condition and it was saying to the cold apartment. So for enforcement. I see many question orders with think with 30 days to comply. But as of today they feel the same condition and that's why we're here today. So we are recommending We are recommending to attend the necessary permit to attend their certifications for the $250 that remains accumulating today and then to come back at the next year for a report if needed.

Yes, Your Honor. My name is Carlos Martin. I'm general counsel for the North Bay Villas Condominium Association. Good afternoon. I'm here on behalf of the association. We don't dispute the factual allegations. What you haven't heard is because obviously the inspector is not involved in the internals of this condominium is the attempts by the association to obtain funding necessary for what is a massive structural concrete project. The association had to take votes of members, had to seek financing, and as of January last month was able to obtain a $7.7 million loan from Popular Association Lending, specifically targeted towards structural work, roofing work, parking work, and the 40-year recertification of the building. The association has now begun roofing work, has begun parking area work, and its engineers in the process of creating the permit application project, permit applications, excuse me, for the structural concrete work, the windows, and everything else that has to do with the 40-year recertification. This project, the engineer has advised us, is going to take approximately 18 months for the structural work to be performed. We have the money in place. We are in the process of doing the work now and getting the permits approved. What we would ask is that you hold fines at this time and bring us back for progress reports on a quarterly basis every three, four months, because this is not something that's going to be resolved within a 30 or 60 day period. We can provide whatever the city needs in terms of our financing that we've obtained, in terms of our permit applications, whatever you need, we can provide.
So what's your timeframe?
18 months.
And so are you asking to hold the fines for 18 months?
I'm asking to hold the fines for four months until the next progress, or three to four months, whatever your honor decides, for a progress report to show that we've been moving the ball towards the completion line. At which point, if we haven't, issue us the fine for sure. But if we are showing progress and the inspector, Ms. Tobar, feels that we are in the process of progressing towards an ultimate completion, that you continue on each quarterly hearing until the work is done to hold the fines so that we are complying, but at the same time, you have the ability to issue us that fine if we're not moving forward.
Three or four months is a big ask. Village, what say you? What is your position?
I mean, I know they do have, they started to do the work already, but I mean, we will impose on whatever decision you make.
I mean, if Your Honor feels more comfortable with a 60-day recurring hearing to show that we're progressing the project, I have no objection to that.

On October 14th, 2025, I did attend a board meeting at the property. I met all the board members and some residents in attendance. That's kind of like an outreach session to take any questions regarding their certification and violations and how the due process works on these items. The building representatives have visited our building department on several occasions. However, they have not yet advanced in submitting a report. Our recommendation now is for the property to comply as soon as they can. We'd ask for fines of $250 per day to commence today and for the property to return to the next hearing as needed.

Hello, Your Honor. Bear with me. This is kind of a long history here. This is a new case, but the owner is not here. And he also had a previous case on the agenda. He wasn't here for that. But I just want to make sure the record is clear on these items.

So this is all three of those are new cases on the evening of November 15th, 2025. North Bay Village Officer Landren responded to an illegal Airbnb rental at the property. The renters had many vehicles blocking the streets, and they had approximately 18 people staying in the home. He immediately notified my department for additional enforcement and follow-up with the property owner. The tenants confirmed that the rental was in short term, and they were actually leaving the following day. On November 17th, we did issue the property two citations for operating that short-term rental without our short-term rental license or business tax receipt. I was able to locate the advertisement for this property on Airbnb, and I reached out to the host of the ad at that time. Her name was Roxy, and I informed her that the rentals of that property were prohibited due to her not having a license. I went ahead and also contacted the property owner, Silvio, and informed him of the same. However, just a few days later, November 22nd, Officer Landren responded to the property again because they encountered a loud party with a new group of tenants who rented the home on a short-term basis. The officer counted approximately 30 people at the property. So on November 24th, 2026, we proceeded to issue them now another set of citations for having no Airbnb license with the city, no business tax receipt. And also that day, since it was the last party, they did get a noise violation. I contacted the host of the property again, Roxy and the owner. And actually, Roxy spoke with me off the platform, and she actually came to Village Hall to meet me in person November 25th, the following day. We did meet here at the lobby. I informed her of the regulations, that property was not able to get a license, so they have to rent for over a month at a time to be in compliance with her code. She indicated that she understood and she would pay the fines and that she wouldn't be renting the property short-term basis again. And then however, a few days later, November 29th, we responded to yet another illegal rental of the property. This time, the property had approximately 50 vehicles blocking the road and on the property with loud music. The officer did speak with the renter and he indicated that he rented that home to promote his clothing line. And he was having an event there that evening. Um, the host of the, that rental Roxy did arrive at the property that evening and met with the officers and actually kicked them out of the home and showed the officer proof of the Airbnb cancellation. Uh, the officers stood by for at least two hours until they cleared out the home, uh, and left, you know, without incident. Um, however, the do since. occurred. It was irreversible. We went ahead and issued another three citations the following morning on December 1st. Once again, I did contact the owner, Silvio, to let him know this was the third time we wanted to stop these nuisance violations. And the owner mentioned that next weekend was Art Basel and that he was going to rent the house again. And he mentioned that he didn't care if we cited him because he would be making $19,000 on that rental and that quote, the numbers made sense. So at that time we strongly, I strongly suggested to him that he terminate the rental, uh, because we had two weekends back to back where the quality of life was affected on that street. And, um, And eventually, I got him to agree to get on a conference call with myself and the deputy chief of police here for the village. Deputy chief made it clear to him that we would not allow for him to continue to cause quality of life issues and that we would take any and all lawful actions necessary to enforce him not continuing to have these violations. So ultimately, the owner, Mr. Seville, did decide to terminate that rental and cooperate with the village. Since then, he has had a long-term tenant in there, a gentleman that's on the lease with an option to buy. We haven't had any issues, thankfully, since then. However, he has just failed to pay for all these citations. So all we're recommending on this, Your Honor, is for him to please cease and desist operating as a short-term rental. and committing noise violations, we'd ask for the property to pay the outstanding citations. They owe us $2,975 within 30 days. If not, we'll report a lien on the property for that full amount.
