So again, for the record, Mario Garcia with offices at 600 Brickell Avenue, representing the African Harbor Island Development Company. Mr. Pinder is going to start with the staff presentation.
John. It's very hot.
Craig Pinder, Village Planner, North Bay Village. And the first item on the agenda is the use exception for the sales center with $79.46, $8,000 each drive. Give me one second. Here we go. All right. As stated, the application requested for you today is pursuant to Section 8.11.B.4 to allow a temporary sales center and marketing office on the property. It is proposed as a single story structure with 14 parking spaces. It will include new paving and landscaping to enhance the site and provide buffering against the adjacent residential properties. The sales center will operate during standard business hours. It will be a low intensity project and a short term use under the temporary approval. The project is located at the north end, the northernmost point of East Drive, and it will be located specifically on the 7946 parcel, which is highlighted here on the aerial on the left. The property itself is approximately 4.12 acres and the temporary sales structure will be located around the center of the site. To provide a little bit of a background, During the last year in the Village Commission in September 16 of 2025, a 364-unit luxury multifamily condominium development was approved. The property was resumed from RM70 to 8000 East Special Area Plan. The use exception request will support the marketing and sales activity associated with the approved site plan. On the screen now are the proposed architectural elevations. So we're looking at the east elevation and the north elevation. The east elevation is facing East Tribe and the north elevation is facing the 8000 site. On the screen now are the west elevation and the south elevation. The west elevation is facing Jerusalem Harbor and the south elevation is facing the residential property to the south. On the screen now is the proposed site plan. As you can see, the sales center is located within the site with the parking spaces. There is an ingress and egress point and landscaping buffering the southern portion of the site along as well as the eastern property line and to the north. For a visual, here is the landscape plan along with some samples of the vegetation that will be planted. The proposal before you complies with the Unified Land Development Code. The structure is modest in scale compared to the development surrounding it. It complies with the standards of the RM70 zoning district. The use will not introduce operational characteristics beyond what's typically experienced for residential properties that are currently under construction. and it will not substantially affect the character of the surrounding area. The Planning and Zoning Division recommends approval to allow the Sales Center Marketing Office as subject to the conditions contained within the staff report. With that said, any questions, or I'll have the applicant make their presentation.
Thank you very much, Mr. Pinder. As I mentioned earlier, I'm here this evening representing Harbor Island Development Company, which is a subsidiary of the Related Group of Florida. And I'm accompanied today by representatives of Related, as well as our architects from Arquitectonica and our landscape architects from Wittgen Design. This board has been with this project from the very beginning. You previously reviewed code text amendments, the special area plan and the site plan, all of which were also subsequently approved by the Village Commission. Tonight, we have another exciting step in this process, which is the approval of the sales center so that the project's condo sales may commence. Your codes, one criteria for sales centers is that they not adversely impact neighboring properties. We feel that we have accomplished that goal with a one story structure, which is very limited in scale, but still elegant and representative of the luxury project, which will ultimately be built on this site, along with certain public amenities, including public park, extension of the island walk, and also a kayak launch that will be available to the public. With that said, I'll ask Kemlong Castillo from Architectonica to present some renderings of the sales center.
good evening board members uh my name is ken castillo i'm with architect tonica i've been working on the project um called the main project a little bit of the sales center too uh and i'm just going to take you guys through a very brief presentation just so that you understand the location of where we're proposing it and i guess the kind of materials and the sort of character of the sales center itself uh so you know as staff mentioned It will be located inside of our property line, inside of the proposed. We found a very good area. If you look at the main project, it's North Tower and East Tower and basically a square proportion for the parking. And then there's a peninsula sort of for the parking, which is like 60 feet in dimension. That was the perfect place for us to locate the sales center and be able to, you know, get started with the main structures and all those things. So over here, it sort of shows a little bit more accurately where on the site that we're envisioning the sales center. And then again, just showing a rendered plan here so that we see all of the major elements. We have the parking that is provided. I think we're over by one just because of the square footage. We have the sales center and we have a wraparound terrace, a 10 foot terrace, which is something that we're offering to our residents in the future. Our entry, we mean to grab people right as they drive in. So they make that visual connection to the main entrance. And then over to the right, we have this sort of open lawn that we're gonna, you know, we're gonna activate for future events and things like that. It's still TBD, but we have the space for it there. Conceptually, what we've done is we've taken a piece of the building and we turned it into a sales center. It's especially evident with the brows that you see that we're using at the entrance. These are the moments that sort of give character to the actual tower itself. So we figured, let's take one of those elements, let's bring it down to scale. And also we got to figure out how to build it. So, you know. We're double dipping there. So as we resolve this geometry, you know, we'll get a good understanding of what we're doing on the tower. And then these images are sort of showing, you know, where we're looking to potentially put a sculpture. Again, that visual connection to the entrance, you know, the steps, you know, they're a visual indicator. So is the ramp next to it. And then further views over here towards the water side. What we're doing, what you're seeing is bits and pieces of the building that we're going to propose. So what you're seeing towards the right hand of the image, that's actually going to be the garage cladding. It's like a really scaled down version of what we're proposing for the podium, just making an appearance here. And yeah, like I mentioned, it was a short presentation, so that's it.

Thank you, Ken. Mr. Chair, members of the board, your staff is recommending approval of the sales center with certain conditions of approval. Those proposed conditions of approval are acceptable to us. We would ask that you follow that recommendation and vote to recommend approval of this use exception for the sales center. With that said, we have the whole team here to respond to any questions which you might have, and I'll reserve a little time for rebuttal if necessary. Thank you very much.

Just a few standard questions.
On sales center, I know that's a pretty common standard stuff and you're building something that big, you need to put in a sales center. But, you know, the typical thing like safety of the structure, I don't know, it's a temporary structure. So does it need to meet the same requirements in terms of wind resistance? And, you know, if we were going into hurricane season, no. So I'd like to know if that's being addressed. Yes. Let me just give you all my points. Maybe you're going to just show me a safe time. So that's one. Insurance, how are you going to be insuring anything that happens in that property? Security. Will you have security during the off hours, closed hours? Make sure nobody goes in there or does something. I don't know. Is there a patrol of the property while it's there? And also, I don't know if it's temporary. If it's temporary, is it required to be ADA compliant? Do you have a ramp? Do you have... parking for disabled parking, et cetera. So those are just my questions.
I'll go in reverse. As far as the ADA ramp, yeah, we do provide it and we have our ADA space directly adjacent to the ADA ramp. So the striping over here and then the ramp happens right behind the vegetation. That's how we meet our ADA. And yes, we do have to be ADA compliant. As far as security, I do have to speak with my client to talk about programming. We haven't had those conversations yet.
I just spoke with him and there will be CCTV, so closed circuit television monitoring. So in case anything happens, it can be responded to.
And then, as far as the integrity, the structural integrity of the building, you know we are partnering with a with a company that does these prefabricated walls. We do have a structural engineer, which you know does sign these drawings, to make sure that we are meeting you know everything that we have to meet structurally.

Okay, this is where I make the disclosure that I did meet with Ms. Graham-Penn. I believe the architect of the project, George Garcia, and the gentleman sitting here, I'm sorry, your name escapes me now. Agustin. Agustin, Agustin. So yes, we did have a meeting in which just reviewed the setbacks, heights, and they just wanted to make me aware of the project and what's involved. So that's pretty much all that the conversation was related to.
That goes for me as well. We had a Zoom call on Thursday, I think, Friday, Thursday, whatever, last week. Same thing. That's it. Okay.
Excuse me, board member and chair. The site on 7913 West Drive is a site... Thank you. Good evening again, board members and chair. This item before you again is the site plan modification application and tentative plat. And I will be pretty brief with my presentation so that the applicant can present their project as well. So just some basic project information. The owner-applicant requires a cell ad. The site acreage is approximately 1.04 acres or approximately 45,371 square feet. Some background about the site and its previous approvals. In 2022, a rare and side setback variances were granted by the village to mitigate the property's lesser depth and lack of waterfront access. and I'll show that later on or point it out later on in the site plan when it comes up in the presentation. The following approvals were also granted to the previous property owners, a parking variance by resolution 2023-162, a site plan by resolution 2023-163, and a development agreement by resolution 2023-165. The previous site plan approval included 22 TDRs and a bonus height of 89 feet pursuant to Section 8.13 and 8.12. And the property was also previously granted a use exception request for a construction trailer and staging for another multifamily development, and that was 7918 West Drive. With the site plan modification, the project maintains the same number of approved residential units, which is 94. It provides a comparable pedestal slash tower design with integrated structured parking. It utilizes the previously granted site and rare setback variances. And the building is placed similarly on site where the tower is positioned more towards the northern part of the site to limit the amount of visual impact on the residents of the 360 condominium. The site plan is on your screen and toward the bottom of your screen here, we'll see the first setback variance that was granted with the previous approval, which was zero feet along this property line that is abutting the green space. And similarly for this interior side setback, which is this little portion that is a north property line, it's also zero feet. and they're just maintaining that with the previous approval. All other setbacks comply with the RM70 zoning district requirements. As previously mentioned, 22 TDR units were provided, so a total of 94 units. The proposed number of units and density still results in 91 units per acre. And the proposed unit breakdown includes 21-bedroom units, 29 two-bedrooms, 35 three-bedrooms, and 10 four-bedroom units. As far as grain space, a total of 13,292 square feet of landscape grain space is provided, where 9,074 square feet would be required. So the applicant is exceeding. And within the front yard, a total of 3,215 square feet is required. And the applicant is exceeding this as well and providing 4,028 square feet of grain space. On your screen to the right is the proposed west elevation. And with this building, it is going to be increased in height from the previous approval. So we have a proposal of 26 stories, a total of 298 feet, eight inches. The previous approval was around 239 feet. A 40 foot building height bonus is also being requested pursuant to Section 8.12 that deals with the bonus height for the RM70, where it can have a maximum of 240 feet. The parking garage and amenities is still contained within the pedestal. A total of 201 parking spaces is going to be provided, 14 of which are proposed to be compact, as we heard in the title, with the 8%. of the request for the compact parking spaces and valet services will be provided in perpetuity due to the request for the compact parking spaces however cell parking will also be available as well on your screen are the remainder of the elevations so starting from the left side is the east elevation moving to the right the south elevation and then the north elevation So the project complies with the requirements of the RM70 high density multiple family residential zoning district, complies with the setbacks, the lot area, the height, the green space requirements, the parking, et cetera. It also complies with the comprehensive plan and the North Bay Village 100 master plan. Staff also recommends approval for the site plan application subject to the conditions contained within the staff report. And I'll just mention the tentative plaque really briefly since it's really, really, really simple. The reason for the tentative plaque is really to remove the area highlighted in red that is currently platted as a 10 foot easement. and relocated under an instrument. So the applicant will provide more information on that, but that's really the reason for the plaque. The previous project was approved showing the development on top of that easement. So the applicant is really cleaning up something that should have been cleaned up. And I'm just showing it here on the site by modification. The broken lines in red is the easement to be relocated. And staff also recommends approval of the tentative plan subject to the conditions outlined in the staff report. With that, that concludes my presentation. I'll hand it over to the applicant.

Any conditions that feel that are key conditions that need to be met?
Yes, I'm sorry, my screen just went crazy. Okay, let me go to these. So some conditions of approval dealing with landscaping. Number, item C here, the landscape and lighting photometric plan. We are requesting the applicant to submit a photometric lighting plan prepared by a registered architect or engineer. Demonstrating that lighting is provided in all areas in the front of the development where trees are planted and that lighting levels and placement are appropriate and compliant. Exterior lighting shall be the cutoff type shielded and directed away from adjacent properties and streets. We are requiring screening for all loading spaces, service areas, outdoor storage, electrical, plumbing, mechanical, and communication equipment. impertinent enclosures shall be concealed from view from any frontage or sidewalk by screening. Visibility triangles is important. No objects, trees, or vehicles above two and a half feet shall be allowed within any site triangle. The building is compliant with the green building program, but we still provided a condition of approval for that. An applicant has proposed to achieve 46 points, and we added it as a condition for the applicant to achieve those 46 points. Moving along. for the green infrastructure and the maintenance plan. We are requiring the applicant to submit a comprehensive maintenance plan for all proposed low impact development and green infrastructure features to ensure proper operation and compliance. There are conditions related to electric vehicle charging stations, lighting and energy compliance as well. Moving on to civil engineering. We are requiring the applicant to submit final civil engineering grading, drainage, and utility plans. The applicant shall provide a signed and sealed drainage report prepared by the engineer of record, indicating the method of control of stormwater and groundwater, including the method of drainage, existing water elevations, recurring high water elevations, proposed design water elevations, drainage structures, canals, ditches, and other pertinent information. As far as parking goes, I believe most of these are general, but one requires the applicant to revise the floor plans and parking table to reflect the requirement of 788 stalls. We are requesting an auto turn exhibit for the loading area on the south side of the ground floor, demonstrating that the largest vehicle design can navigate all site turns at slow speeds. But the minimum one foot physical clearance between the maximum swept path envelope. And that's really because it gets a little tight on that ground floor. So we want to make sure it works.
I think that's good. Just three things. Shade study. I know they did one of those. Okay. So that's also part of condition. They conduct the shade study, traffic study. I heard that they were asked to update or they had an old traffic study and they need to redo it or update it somehow.
That's correct.
Oh, and one concern that I heard from a resident was wind. I don't think creating a wind tunnel situation is going to be an issue there because of how open it is. But can you address that? Are they required to do a wind tunnel study of any sort? How the structure is going to affect when there's winds, how it's going to wrap around or create any sort of... wind condition that might be exacerbated by the tower and neighboring properties?
Right. There currently isn't a condition of approval dealing with the wind. The applicant definitely can speak toward that, but I will state for the traffic study, we do have that condition. Update the traffic assessment at the time of building permit application to confirm compliance with the concurrency requirements.

okay that that's brilliant that's it for me thank you we had we were so scintillating then we started talking about conditions evening everyone graham penn 200 south biscayne boulevard uh here on behalf of of the new property owner elad mbv llc um we'll meet tonight from ownership we've got matt jeffries and augustine salas as well as our architect robert perez from garcia strongberg Elad has begun in the last couple of years doing a significant amount of investing in South Florida, starting with the beautiful Lena project up in Boca Raton. This site and another site within the village are next, as well as a significant investment in Miami Beach. But they are, as you'll see in this, as you've seen in the submittal and you'll see in this presentation, devoting a significant amount of energy to ensuring that we can bring incredibly high class development to the village. Not to take a detour into the conditions, but as Mr. Pinder ably explained, We have three pages of conditions that are all related to that need to be met before we get a master building permit. That includes updating the traffic study, for example. The shadow study is in the submittal and is part of the set. And we are committing, of course, as Mr. Pinder noted, to 46 points under the green building framework of the village. So we're very excited about that part of the project too. So I'm going to take you through the history briefly, talk about the kind of unique nature of this property. And Craig touched on this a little bit. And then I'm going to turn it over to Robert to take you through the design. So as you know, we're asking for your positive recommendation on the site plan modification as well as a tentative plot approval. So I'm going to start with reminding us of the exciting history of this property. start of the 1960s. It was developed in the 60s as a parking lot and served as a parking lot for a very long time. In 2001, 2002, the aforementioned, I'm used to having a traveling mic, the aforementioned The aforementioned strip of land that's along the water that's 40 feet deep was deeded over to 360 and is now part of 360's property. That is the genesis, as Mr. Pinder explained, of the variances that we needed back and obtained back in 2022. I'll touch on that briefly again. So from 2010 to 2022, the parcel was basically, I mean, to today, the parcel has basically been empty. It has temporarily been used, again, as Mr. Pinder explained, as a location for construction for the 7918 property, but has otherwise been empty. So we've got a property that has been a parking lot since the 60s and or an open lot. So we're very excited to finally be bringing a very high quality development to this property. So aforementioned previous approvals, 2022, 2023, the former owner of the property came in, obtained a series of approvals, which are still valid today. Relevant to that, of course, was the aforementioned variance that would allow the building to be located immediately abutting the 40 foot strip that got removed from the property to account for the 360 development. The reason that was necessary is that properties on West Drive are 140 feet deep. So this property got reduced down to 100 feet deep, because that 40 feet went to 360. And at 100 feet deep, with the setbacks that would have been required, the property was undevelopable. And the village recognized that. This board recognized it. The commission recognized it. And that's why there's a variance of those two setbacks for the orientation of the building. And the orientation of the building, the location of the building, has not varied in any way from the original approval. And that's important because what we did in the original entitlement was we decided to orient the building in a way that pushed it to the north. And that took, as Mr. Pinder explained, a lot of the impact away from 360 because we used our entire southern portion for 84 feet for the view corridor. So we're out of the way as much as we can with the neighboring property from the 360 buildings to our southeast. So that again remains identical in this project, right? The plan that we have in front of you tonight differs only really in improvements. Let me show you this briefly. Just as a point of information, this is the design from the 2023 plan. This is the architecture. And I want to focus on a couple of things. Again, when you look at the architecture tonight, number one, I think you'll see, and it's really apparent, that this new design is significantly more elegant, significantly a better fit for, in our opinion, for the village. It also avoids what the previous design had, which was a lot of blank wells. We had a blank wall in the east, basically. We had essentially a blank wall in the south that's gone. So same kind of footprint for the, well, same exact footprint for the building, much superior architecture. Sorry about that. I do need an associate. I appreciate that, Madam Mayor. So let me talk a little bit about the improvements that are, and Craig touched on this a little bit, the improvements to the design and the orientation that we've done and this team has put forward. Again, we retain the approved setbacks. We retain the exact same density. We're not increasing the density in any way. We retain the same view corridors. The architecture, again, as Robert will show you, is massively improved. But functionality, let's talk about it. Parking is 201 parking spaces. That is basically right up to the line of the recommended ratio now, close to two per unit. We have 14 compact spaces out of 201. Those along with every other parking space in the building will be valet accessible. as required by the code. You don't have that other plane in front of you right now, but that plane also had exterior loading spaces. We've internalized all the loading. So a big point of what we've done with the revision is that this new design, as you'll see, it is a much greater, a much improved experience for the street, for the pedestrian. You're not having trucks out there. Everything's internalized and away from us, and it functions better. As Mr. Pinder noted, of course, we also have a commitment to 46 green building points, which is far and exceeds what's required under the terms of your code. So before I get Robert up here, I'll touch on the tea plant. This is going to be slightly boring, but under Dade County regulations, if there's a easement that is depicted on the plot, The only way to adjust that easement, move that easement, is to modify the plot. So what we propose to do, as Mr. Pinder noted, is we're going to move forward with a T-plat that wipes out that old stormwater easement, which is still being used. We're just going to relocate the structures. And so that we'll have a clean parcel and we will replace the, the planet easement with a, what we call an instrument, which is just a easement document, right? That will be recorded in the public records. That will give us the flexibility to build the building in the way that is necessary. while retaining the stormwater facilities that the village needs and that were recorded in that original plot. So that's a technical application, but we have to go through under Dade County regulations, we got to go through a tentative plan and then we have to come back for a final plan. I don't think you guys see both, but Maybe you will, but maybe back from front of you for the plot. But that's it. So it's basically a technical exercise that's required by the county's regulations. So with that, let me turn it over, Robert, to take you through the design. And I'll be back. We'll wrap it up and we'll open ourselves up for any questions.
Good evening, board members. Good evening, chair. Thank you for having me. My name is Robert Perez. I'm with Garcia Stromberg. We're Architect of Record out of West Palm Beach. I think Mr. Pinder and Graham did a good job at the technical aspects of the building. I won't bore you with more of that. I'll just kind of walk through you conceptually with some of the design aspects of it. So as Graham mentioned before, we were just looking to improve on the architecture that was previously done. As any architect would do, they would want to make something better. In our case, we kind of looked at the beautiful city that we're in, the surroundings. So I think you're gifted here by being 360 degrees of views with ocean, water, clouds, sky, vegetation at the ground level. We wanted to bring a lot of that into the building. So we wanted the architecture to mimic that. So let me show you.
I'll start off with a rendering. So our client, the Elatic Group, they are
synonymous with building luxury, like real high-quality projects. We've done that, as Graham mentioned, in Boca Raton with the Alina project, a very upscale project that brought a lot of value to the environment, to the city that it's in. So we want to do the same thing here. And with the architecture, like I said, blending in those natural elements in terms of forms, in terms of shapes, in terms of materials, we wanted the building to really stand for what, you know, like I mentioned before about what we have in our surroundings. So the footprint, as Grant mentioned, is exactly the same, going vertical with the 26 stories. We have a podium of about six floors at the base, all parking. We wanted to screen that with what appears to be like a wood-like element, but it's just a horizontal sliding, some type of a metal structure that will just kind of make that parking kind of go away, so to speak. And then above that is your first level of amenities. So that is a pure amenities level. We wanted to make sure the building had a lot of amenities for the buyers. We want something attractive, something that people may not see in other projects in the area. So we have a full floor of amenities with pool, indoor, outdoor spaces, gym, spa, saunas. We're working with our real estate marketing team to figure out for us also what are things that people want in the area so we can introduce that. And then above that is our level eight would be our first residential floor. Now, when you get to about level 20.
I'll show you the elevation.
So when you get to about level 20, we have a triple height second amenity space, which will have also a pool in there as well, which slightly cantilevers over the edge of the building. So that'll produce like a really eye-catching experience. And that's also flanked by more double height indoor amenity spaces. So you can imagine gatherings, parties, things like that. I feel that's something that the residents will really, really appreciate. And that's flanked on the east, sorry, the north and the south with more residences all the way up to level 26 with a penthouse level with a couple units. The average unit size is about 2,700 square feet. So something that's a little bit slightly larger than what the area has. And that's kind of what we were looking for is that we were doing the comparisons and seeing like what are the typical room sizes and features that a lot of the units have in the in the area, we want it to just go slightly better than that. So we feel that our target point will achieve that.
Let's go back to the site plan.
I just want to touch on a couple of key features here. So just to kind of go back to a lot of things on the site, with the previous design was very parking oriented on the ground floor. We wanted to change that a little bit, bring the parking up, mostly started on the second floor, but still have the same features where all your basics were, you know, your back of house spaces, your loading zones and all that. We wanted to achieve all that, so that's all met there. And the site being very constricted and very thin, we had to use one-way ramps to go up on one side and down on the other. And then that gave us the ability to open up the ground floor to be not necessarily pedestrian friendly, but more owner friendly, where the previous design was just very constricted and didn't have much of a lobby. So we opened that up quite a bit and added some amenity spaces down there. um and then the whole front of the building landscaping using native elements artwork so we're hitting all those marks that the city wants us to see wants to see uh water features uh upgraded um the landscape islands artwork on each side and all the buffering that's needed for the various mechanical MEP equipment that would be along the front. And then, as Graham mentioned, the setbacks of the 84 feet on the left side that you see gives us the opportunity to have a nice walk-through garden type experience for the owners. um and then from a pedestrian standpoint you know you'll see the uh again going back to the natural materials uh that you'll see that that wood sliding will come down to the base level um tie into the elevated uh ramp there and a series of plantings there so as you're walking by we want a really nice pedestrian experience with that we'll take any questions
So with that, that's our presentation. We would ask for your recommendation of approval subject to the incredibly lengthy list of conditions, as explained by Mr. Pinder. We're here for questions, and I'd like to reserve time for a rebuttal if it becomes necessary. Thank you so much.
Did you go over... pretty much touched on in your presentation to emphasize on the setbacks, please, that you have on the green spaces and on the east part. Sure.
Let me attempt to explain. Okay, so the setback on the east is zero because that's what that variance was, right? The variance allowed us to go right up to the 40-foot wide strip, 15 feet on the north, which is code. 84 feet on the south, which is the 25% view corridor, which lets us get out of the way of 360 as much as we can, and 25 feet, which is the required on the west. So those are the setbacks. As Robert explained, and as I noted earlier, that's the constraint of the site is that just because of the 40-foot strip that got removed, you are constrained with your other setbacks.
On the north side, the second. Just get closer to the left.

The building walls go in slightly so that we have a little bit balcony space. So we're still respecting the setback. And when we had the original talks about how to shape the building, we were asked to make sure that we're no more than, I believe it's four to five feet off of that setback for the actual balcony space. So the building walls kind of come in a little bit. And... On the south side, yeah. Yeah, so Augusta was just mentioning we're close to about 100 feet from the property line up to the actual building wall.
That's what my question was. In the south, yeah. So the podium says it's six stories. Correct. Correct. So do we know what the height of those six stories are or is?
So at our podium, we're at about level seven, which is the top of that, about 68 feet.
So 68 and above, then you have 100, roughly about 100 feet. Correct.
That would be that building face there, ascensionward.
Okay. Do we know, do you have a render or do you? Have you looked at how that impacts the property that's next door to the 360 property?
In terms of the shadow studies?
The shadow studies and also from the point, from that 100-foot point, does that in any way clear the 360?
We do have one other, which is a wrapping with a Christmas present, apparently.
Yeah, again, I think you'll see it from the shadow. So the whole idea is that the face of the building is beyond the Western face.

So if you're asking if the face of the building will clear the front of 360, no, it doesn't get that far back in. But we're pretty close in terms of it being right around here.
Yeah, I mean, I guess if we turn it, it's harder to see it this way. If you look at any of these, this is the edge of the building. That's the western-facing portion of 360. So basically where 360 starts to angle, that's basically where our building face is. We're a little bit north of that angle. But the whole western-facing portion of 360, we're not impacting at all.
You're not right in front of it. and the distance as you uh you may know let's just be correct 360a because 360c is is it is being impacted the 360c of the townhouses the ones although that's not that big of an issue because most of their view is is a north view but just to be 100 correct so 360c is is being impacted so for the just just for a bit of information the the face of what is that 360a
yeah which is a b and c yeah a is a big is the big time yeah the big one that's about a that's 81 feet from or the air box from our property line and then we're 25 feet in so basically when if you measure it completely east west from that for that side of the building our our tower is a hundred and something feet away from from the 360 building from the from the not the townhouses the a building yeah the a building okay thank you
The height of the roof is shows from the from the last residence. It shows 10 feet there. Is there any plans to extend that any higher?
From the are you asking about like mechanical spaces? Yes. Yeah, the mechanical, do we have the, does the elevation show the mechanical?
We have screen. It would be hidden behind what's shown there. So it'd be hidden behind this element here. Okay.
And the roof plan, do we have the roof? Because that's, you can show where it is. It's very, it's pretty far north.

The next, you have the generator on the ground floor. It's the islands, the flood zone. Is that also going to remain there? Usually the new buildings, they put them on the roofs.
That's not, well, I don't know about generator, but you do have to follow any kind of flood zone. So usually it's like two feet above the base flood elevation. So anything that's life-saving related would be elevated on the ground floor. So right now, our rate is like at seven, and we're starting at 10 feet. We're already starting at 10 feet higher. But then anything that still needs to be elevated, we'll put it on a pad just to enhance that support.
Okay. And it's sound-annuated, the room, right?
Yeah. Again, this is one of the good things that the electric does, that we get all kinds of consultants, whether it's waterproofing, acousticians, we'll soundproof the rooms. We want to make sure that the experience is good for everybody, whether it's an pedestrian or a resident. So we take a lot of
okay and the last question is um i read in your documents that you're reducing the the delivery area from large trucks to smaller trucks will will that allow the garbage trucks to get to to pull in yeah it's different from the garbage truck so yeah robert you're gonna have to get on the mic eventually
So we accounted for two different types of vehicles. The delivery trucks, the ask is that when they come into here, we technically can get both trucks in, or excuse me, we can technically get the two loading trucks in with a little bit of modification to the structure, again, because the site's so thin. But the delivery trucks would come into here. The garbage truck, with the way the building works, would need to come only out to this space out here. So it's two different types of services. So the heights and the widths in here, we did do turning movements, the vehicle movements. It all works inside for delivery trucks, too. And then the the trash trucks, a separate turning movement that we did to come out here, collect and then back out.
OK, because I didn't see the garbage trucks mentioned. And sometimes I see these buildings where the truck parks out into the road and they bring the dumpsters out to it.

On this side, we're proposing, because the setback is basically zero, we're proposing like a green metal screening there to screen the parking versus the slatted deep elements that undulate around the building. I mean, it does connect down to this level. So technically it could be.
The eternal question. Our development agreement as recorded and as will remain requires us that in the event that there's an agreement for 360 to open the Baywalk, we have to connect it. So there's two ways we can do it. We can connect on the north Or we can connect through from the sidewalk through. Because that hasn't happened yet, we're not showing it in the plan, but we are obligated in the terms of that agreement to do that connection. So if the preference ends up being in the north, that's an easy connection. And on the south, we can run it from the sidewalk.
Got it. I mean, look, first of all, the people walking on the sidewalk right now, I mean, really, I mean, I know there's been some discussion, but I mean, look, first of all, to get it open sooner than later, I mean, you're going to have people getting off and walking in front of 360 and getting hit by everybody driving out of 360 right now. So, you know, I know 360 doesn't, you know, probably really care as much that they're running people over, but to open that up, it would be a safety thing. You know, I'm just putting my... litigation attorney had on that not passed the bar yet but i know a little bit um and then the second thing is i mentioned to graham and the architect that i think and it would be a benefit to the city is that we figure out something with the asphalt parking spaces in front whether pavers or something to beautify it so it doesn't i mean we're selling million dollar condos And then we have this, you know, asphalt that's not too appealing. So I think something needs to be addressed where, you know, the developer, I think, should obviously pay for it, but it should be, you know, definitely fixed.
Yeah. And for the record, I will say that if that's the recommendation of this board to the commission, we have no objection to that. I think that's a great idea.
And frankly, all developers going forward should have to pick up the tab and fix the parking lot. I mean, I know there's a few buildings that are going to be stragglers and left behind that maybe there's some funds that are allocated for them too, but I think that might've been missed in some of the other previous approved projects, but fixing the street and the asphalt is, you know, the pavers would, you know, definitely help the island, aesthetically. Good evening, everyone. for 18 years and I also serve on the master board at 360. I'm speaking tonight because I really do care about our community. I know some of my issues, I sent an email as well last night. I know some of those things have already been addressed by George earlier in the conversation. And I'm not against development, really. I do think that development is really, really needed. And it's not necessarily particularly about this project, right? I just want to talk about general. But I'm really, really concerned of what's coming here. Northview Village is a very small, fragile island right in the middle of the bay, in the middle of Biscayne Bay. We know how fragile Biscayne Bay is. We know how fragile our island is. And yet, We're seeking an overwhelming number of large scale developments happening all at once. There's a tower after tower project after project without it seems to me at least a real consideration of the combined impact of all of these projects. We're not just approving one building here. but we are actually reshaping the entire identity of our community. We have two bridges in and out. I know traffic has already been addressed and I'm glad that you're actually looking into a much more detailed study because it's the cumulative impact. We're being told that each project just has a nominal traffic impact, but anyone who lives here knows that that's not the reality. The cumulative effect is going to be really overwhelming. And beyond traffic, it's about the quality of our life. The shadow study that I have seen, and correct me if I'm wrong, it ends at 3 p.m., right? I have a north-facing condo, and I look at the C building that George was mentioning. I believe it was George because I was on the phone. But our days don't end at 3 p.m., especially not in the summer, right? So the sun sets up after 8.30 p.m. So what's happening? Are we really comfortable in approving a building that could leave all our neighboring homes in shade for most of the day? And let me tell you one thing. Facing north in the winter, it's pretty cold. And if there's shade there, I'm happy when the sun is shining, at least a little bit. There is also no wind study. And I know you guys addressed that earlier. I really do. want to ask for a wind study because there's wind tunnels, especially there's going to be very, very little space between this building and our building. And the wind is already blowing off Trula and I put Trula and I can see it every day. So please do a wind study. And I have to ask really, you know, if we're granting all these multiple deviations from the rules, what is North Bay Village as a community really getting out of it? Right now, I feel like we're giving up a lot. and we're receiving very little. I worry that we're losing what makes this place special. It's a livable and balanced community, and replacing it with something that serves investors more than residents is not the right thing. I say this with a lot of respect, but also with urgency. Please slow down. Look at the bigger picture, because once this is built, or any of these are built, we really can't undo it. Thank you.

um you know i can't speak for them and how they want to do the moves but we've planned for uh the dry vials to be wide enough and tall enough to meet all the clearances so that they could use the internal movements of the site if they needed to to pull in and back into the yeah so in this case if it was me you know coming through here and then pull forward toward the street and then back in pull forward they could stop here just collect trash and then So the widths, the radiuses all meet the turning movements for that vehicle that size. So there's going to have to be some cooperation with the building management, obviously, to make all that happen with sites like this that are constricted. But the infrastructure is there on the site in order for them to meet.
Just to not to gild the lily, we do also have a condition 7G that requires that prior to building permit that we clarify the details of the proposed operation and collect and transfer the dumpster. So that will be further worked on prior to building permit. And vis-a-vis traffic, that's 7J, we are required to coordinate with D county traffic engineering in the village. on the signal timing which is again that everyone understands the signal at 79th and harbor island drive is something that everyone needs to work on collectively so there are a series of requirements for this project moving forward that require all these additional details to be worked out during prior to the issuance of a building permit and we've agreed to all of them

My only concern is maybe you have discussed it before, but my worry is the traffic coming down East Drive, coming down West Drive, funneling out of one-way traffic, going out onto 79th Street Causeway is going to be a disaster for anyone who's living on this island. Mayor Mrakas, i'm sure you've discussed it before, but can you imagine for new buildings all 26 stories or more. Mayor Mrakas, All trying to funnel down to side streets East drive and West drive and then trying to get out of or back into from 79th street causeway I think it's going to be a disaster, thank you, Sir.

I mean, we've been up here, we've made most, this isn't related to the project just in general, but the number of units is the number of units. We're not really adding any number of units really to the island. I mean, all these sites could have been developed with the same number of units. We're basically just approving design and height, whether you like design and height or not, but the number of units is the number of units that could have been built anywhere. Second of all, the traffic that's there, There hasn't been one new building built since Moda. I mean, so the traffic is the traffic. Now, going forward, I don't know. I don't have an answer, but I do know that all these units are two plus million dollars. Usually people are going to pay two plus million dollars, pay $40,000 in taxes and another $2,000 a month in maintenance fees are probably not going to work from nine to five. They're going to work or don't have to work. And maybe their nanny or their kids driving them to country day might be the only traffic, but that's it. So the traffic that's here is here. And the fact that we have this great community, we have no publics. I mean, we just got a UPS store that's doing phenomenal because every time I go there, we go by. We have no drugstore. We really have no amenities. I mean, Shuckers closed, unfortunately. I do love the music of Palm Tree Club, but not everybody enjoys that. So what do we have? We either have to go to the beach or we have to go to Miami. So we're going to actually have some amenities and some new things. And not only that, most of us are probably going to be dead by the time this stuff gets built because it's going to take 20 years. So, I mean, I know we all have tunnel vision into what we're seeing today, but it's going to take a long time. This project won't be built or completed for probably at least five years. So, I mean, unless I'm wrong on some of these numbers, I mean, those are the facts. So I don't know what else to say, but somebody else wants to make a motion or second, then let's go.
