Vessels in Newport Harbor Subject to Removal and Sale or Destruction

Newport Beach Municipal Code- Title 17, authorizes code enforcement staff to abate and remove vessels that are derelict, sunken, abandoned and subject to impound, or determined to be marine debris. The City follows the procedures contained in California Harbors and Navigation code for vessel removal, (and in certain circumstances, sale or destruction) based on numerous factors, including the condition of the vessel, where the vessel was found, and the estimated value of the vessel. This report will update the Harbor Commission and the public on the different categories and processes the Harbor Department implements upon discovering a vessel in one of the above referenced categories. RECOMMENDATION: 1. Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and 2. Ad Hoc Committee Updates

Several ad hoc committees have been established to address short term projects outside of the Harbor Commission objectives. This is the time the ad hoc committees will provide an update on their projects. RECOMMENDATION: 1. Find this action exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly; and 2. Each ad hoc committee studying their respective Objective within the Commission’s 2026 Objectives, will provide a progress update. RECOMMENDATION: 1. Harbormaster Update - May 2026 Activities

This report summarizes Harbor Department activities for May 2026, organized around the department's mission to keep Newport Harbor clean, safe, and well-enjoyed. Key highlights include continued trash rover operations with CERT volunteer support, enforcement actions addressing illegal charter operations and unpermitted commercial activity, and multiple vessel assists, including a side-tow of a vessel experiencing steering failure. The department issued Notices of Violation for noise violations and unauthorized public dock use by commercial charter operators and filed a Criminal Complaint - resulting in a bench warrant - against a repeat illegal charter operator. The Harbor Department assumed early management responsibility for the Balboa Yacht Basin on June 1, 2026, generating approximately $35,000 in immediate savings and projecting more than $175,000 in annual operational savings in the future. Public contacts reached 168 in May, the highest monthly total recorded in 2026 to date. RECOMMENDATION: 1.
