Get off, man. We are live. We're live.

0:07 – 0:32Speaker 4

What is today? Today is Monday, August 3rd, 2026, 530 PM. This is the Newberg Plan Commission. We will call to order. First thing we will do is a roll call from right to left, left to right. David Wills. He said, oh, you said, okay. Rick Hornbeck, plan commissioner.

0:35Speaker 2

Stacey Krieger. Riley Jones.

0:38Speaker 5

Chris Cook.

0:38 – 0:54Speaker 4

Okay, next we have, everybody should have received a copy of the minutes of the packet. If everybody's had a chance to read that, if there are any comments, corrections. If not, I will entertain a motion to accept those.

0:56 – 1:14Speaker 4

Second. All those in favor? Aye. Aye. Motions adapted? All right, new business. We have a minor subdivision, McCormick, Platt. Do you want to, who wants to open discussion about this?

1:14 – 1:42Speaker 1

Sure. So this comes to the Planning Commission just because the town does not have a process for lot line adjustments. We only do minor subdivisions per the code. The purpose of this minor subdivision, is to correct a longstanding issue with a building that was built over the property line. So it's more or less just moving that property line backward to accommodate the shed.

1:48 – 2:02Speaker 4

OK. And it's my understanding if this is all legal and according to state standards, then we basically must approve that as an organization. Is that right?

2:03Speaker 4

Does anybody have any questions or concerns about this as planning?

2:10Speaker 6

What's the difference in

2:17Speaker 2

How far do you mean?

2:18Speaker 6

No, no. Is this a new subdivision?

2:22Speaker 1

No. So it's just moving that property line.

2:24 – 2:38Speaker 6

So what's the difference? See the property line, new property line, because the shed's built over the right. So it's just that cross-hatched small addition.

2:40 – 2:51Speaker 4

I think there was a good line in the email that stated we don't have a good process to move a property line, so the minor subdivision is, this is the tool, so that's what we're doing.

2:53Speaker 2

Is that something that we should correct in the future and have a process?

2:59 – 3:15Speaker 1

I think so. I think so. We make things a lot easier administratively and also for you guys. I think Warwick County does that. I think a lot of municipalities do it.

3:15 – 3:26Speaker 5

It may not happen very often, but it will happen again just because of the age. As properties change, ownership, people will always question, where's my lot line?

3:26Speaker 6

So was there a sale of that strip?

3:32 – 3:47Speaker 1

A sale, no. So I think it was a mutual agreement between property owners just to move the lot line back to that garage or shed, more like a shed that was built on that property.

3:47Speaker 5

Are you asking what provoked this to take place?

3:52 – 4:13Speaker 6

No. One property is smaller than it started out with. So someone has given up some property. That's fine with me for them to do it, but I just want to make sure that this is done with the consent of the property owner that is losing a small sliver of property at the far back of it.

4:14Speaker 1

Yes, they will have to come in and sign and notarize this form, basically agreeing to it.

4:21Speaker 6

So what's coming to us to say, is it okay with us that they make that alteration? Yes. But we're not saying that alteration has been agreed upon. Got it.

4:34Speaker 1

But yeah, all parties will come in and sign this and it will be notarized.

4:41Speaker 2

But you think it's already been worked out between the property owners?

4:43Speaker 1

I'm 99% sure it has been.

4:46Speaker 5

Did you say the McCormick, Alice McCormick that owns that property, did you say her father passed away? Is that what you said?

4:55 – 5:25Speaker 1

So I've been talking back and forth with them for I think it was a couple months back and I'm not sure exactly what happened. I think it was kind of a gentleman's agreement where they had like this shed that was built on the property line and then her father or her grandpa either moved out and then The McCarty's wanted their property, but they wanted to push it back. I mean, I don't know all the workings of it. I don't know what happened behind the scenes. I just know that that was told to me.

5:26Speaker 4

They wanted it legal. That's understandable.

5:30Speaker 5

The McCarty's did. Or is it the McCormick's that are asking for this to be done?

5:37 – 6:01Speaker 1

from what i understand this went this was dealt with legally behind the scenes i don't know the extent of it um i think the surveyor mentioned that it it was figured out in court or like a settlement happened or something like that so we just don't we don't know so we really do not know what so i would make a

6:03 – 6:15Speaker 6

The plan commission has no objection to the alteration of the shape of lot number one as outlined in this plat.

6:17Speaker 4

I will second that motion. All those in favor? Aye. Opposed? I hear none. The motion is passed.

6:30 – 6:42Speaker 6

does not imply that that has to be done, or it is done, or that there's a legal agreement, or that we force one person to agree to this and not another. We just say it's okay if they want to do it. Yeah.

6:44Speaker 2

And if they don't, that's between them.

6:46Speaker 6

Right, because there's nothing we can do. Okay. And the lot lines would then convert to their original .

6:56Speaker 4

Sounds great. Okay, moving on. Old business. Do you have any old business?

7:07Speaker 1

No, it's just a placeholder.

7:09Speaker 5

I've been here a couple times this year.

7:14Speaker 4

Okay. Miscellaneous business announcements. Next plan commission meeting September 7th.

7:19Speaker 5

Actually, it's the 8th.

7:21Speaker 1

The 8th. Good catch. Thank you. Oh, because the 7th is Labor Day.

7:28Speaker 5

Yeah, okay. And I only saw that on my calendar when I was looking at something else this morning. Holidays get us.

7:35Speaker 4

HWC updates?

7:37 – 8:01Speaker 1

Yes, so we met with HWC last Friday about the... housing assessment um they're completing a housing assessment for us we kind of just walk through some basics i think they're going to have something for the next plane commission meeting yeah yeah they should have something to present at the next meeting on the 8th there's going to be a survey that they're going to get to me this week that we're going to send out

8:03 – 8:45Speaker 3

we talked about the structure of the survey. This is just for that housing, uh, report that we have to do the thousand one, um, the, uh, that the state's making us fill out by January 1st. And, uh, They were actually supposed to get it to me today, but I haven't seen it yet. So I'd imagine I'll follow up with them tomorrow. But it's going to mirror what they send out. We're going to also post it on our website and our social media. And I think they were refining some of the questions. And I told them just sometime this week, but I thought I would see it today, and I did not. Because I'd hoped to have something to show you all.

8:47 – 9:16Speaker 6

um but they will be on our next agenda anything else so the information we received at the last meeting was just for our information no action required here at this time anyway not yet okay thank you all right is there are there new any further questions concerns if not i will

9:17 – 9:36Speaker 4

Take a motion for adjournment. Move to adjourn. Sorry. I'll second. All in favor? Aye. Opposed, nay. Meeting is adjourned.

9:37Speaker 5

I was looking at these nuisance violations letters, and I was like, that's why.

9:42Speaker 6

David has a question.
