Hello, everyone. I haven't met most people here, but I'm Lucas Adler with Commonwealth Engineers. I'm a project engineer on the treatment plant job. So before you, I have the change order proposal, change order number two. This change order proposal is essentially all the pluses and minuses that we've tracked to date. So if you flip to the memo page, or the summary page, it's a summary of everything that's gone on. A lot of these changes, are come as a result of things we couldn't account for during design, things we came upon in the field. In addition, we've been working with to kind of trim costs and they propose other changes to kind of, make their process more efficient. There's also been some duplicatives in there. So like that wetwall coating that you see for the negative $57,000. We already require a standard coating and the specs that we had on this job had an additional H2S protective coating. We looked at it with the paint manufacturers and actually Thinamint's the one that proposed it to us. So all these changes in deducts that you see here have made construction more efficient for them, but without cutting any cost or any quality to you guys as well. So if you want, I am more than happy to run through them more in detail. Figured not. This is a cost saving measure. So we'd be saving $113,000. $113,145.00. And that has nothing to do with the timeline? Correct.

Correct. This is just additions and subtractions to the change order?

Yes. So I will anticipate another change order coming here shortly. We recently received a schedule update or proposal from Phenomen on their time extension. So we've reviewed it. We've noted our concerns, but they have They have elected to move forward with a sit-down meeting. So we were planning a sit-down meeting with representatives of the town, us, and Dean Amin to negotiate a contract extension. Just to kind of give you guys an overview of where we are on the project, they are actually past substantial completion at this point. So what that means for you guys is they proposed a change or a payout for this previous month. We don't withhold, we don't apply liquidated damages, even though liquidated damages can be applied in the future. What we do is proactively withhold those payments. So in my next recommendation to payment that will be processed along with this change order too, it basically recommends no payment at this time until the contract is resolved. So then once that contract gets resolved, we'll release payment to them at that time and proceed on our way. I don't know how much Al has filled you guys in with previous discussions. When we get to this phase in the contract and they go over their time extension, they don't want liquidated damages applied to them for multiple reasons. So it's this is our opportunity to kind of sit down talk through them and i know there's some additional work that we've been talking about with jim and kyle that would make their lives easier out there that theta would be willing to do at reduced costs in order to get that extra time and not have those damages applied so at this next change order this will this change order doesn't address it but this upcoming change order will address any additional cost change or savings that come out of this meeting as well as the additive time. But I'm more than happy to answer. Is that meeting scheduled yet? It is not. So we actually just got, I just got sign-off from them today that they approved of our evaluation of their schedule, had no concerns, even though we had noted concerns on their timeline, and they would like to proceed with that meeting. So that meeting is yet to be set.

Will we have a conversation with you all so that we are aware of your concerns?

I mean, I'm more than happy to share that memo that will outline the concerns. So we can do that we could potentially push it off until the next progress meeting because that would put it when's the next town council meeting? And I would like to ask for permission to do our parade that we do every year before the Oktoberfest on September 12th. Close the road for less than an hour so we don't get in trouble with anybody. And that, yes. And so it doesn't last that long anyway. And then after that, then the Oktoberfest will start. So I don't really have a lot to say about it other than please can we have the parade? September 12th. It's Saturday. Grade starts at 11. We'll line up at the high school starting about 9.30. And then it comes down, Bittner, or yeah, Bittner to Maine, and then back to the high school and gym.

So what we're talking about today is a letter being sent out for residents about the increase in the sewer rates. We've known that's coming. We've known that is coming, but we wanted to send a letter out to everybody letting them know, give advanced centers as much communication as we can, in addition to adding it to their next bill. So everybody's got these letters in front of them.

Does anybody have any concerns with this for discussions that we need to take? I'm going to put this on town letterhead and delete the word residential. So they'll just say, dear senior customers,

I did read both drafts of this, and I do like Bill's original draft. The other one was just way too wordy. That's my personal opinion.

I appreciate Bill taking on that task today, and I'd say we get it sent out along with the ordinance attached. Any concerns?

So we could say between 1,200 of presidential letters and 20 commercial with less than five users or whatever.

Just 1 quick item. I've been working with Jim on a couple of parcels that. Are interested in being annexed into the town. So I've been working with Jim on building out that timeline and. meeting all the notice requirements and such. So that will be something to look forward to here in the future once we get more information from that property owner.

These are south of us. This is with Arbor Homes.

I'm back. Yes. I listened to the, or I watched the council meeting last time, and Zach brought up the architectural review committee. And what I, my interpretation of that committee would be, not necessarily the homes but the facade of the businesses and the signage and landscaping and that kind of thing not not the homes so i don't know maybe yet uh counselor uh hartley um mentioned that with the requirements of hb uh 101-001 it may uh make some of the

intended uses of that committee null and void the intention behind that bill was to create more affordable homes and in doing so kind of lessening easing requirements on builders. So I'm kind of examining that, what that requires the town to do, what we can and can't require builders. Some of those arc objectives were to beautify, I understand, but sometimes those get in the way of arguably creating affordable housing. So kind of examining a balance there that we can take.

So can you distinguish whether that applies to homes or businesses or HB? I think what Terry's asking is if we do, if we put the architectural committee, can we apply that towards businesses or is it just residential or is there a separation?

My belief was that the architectural review committee would apply to throughout not only homes but to businesses as well.

But the House bill?

The House bill applies only to residential.

Speaking of, how's the Speedway thing going?

I've been in communication with their attorney. The office here has provided me with all the documentation that we have. I have not heard from them since we've provided that documentation. I think Jim has worn that one out two years ago.

Yeah, they're surely, you know, you couldn't see getting in and out of McDonald's. So it took. Months to get them to cut down the shrubs and stuff.

Absolutely it's a signage requirements under the, um. Under the zoning ordinance, um. The problem is them acknowledging that they're in violation and. I know talk to him and, um. ask him to clean it up and I don't know if we've issued a fine letter, but, um, I think so.

Sure. Nothing gets your attention like they're getting in her wallet. Yes.

Kind of speaking on the architectural part. You know, I told you last meeting that I went to Morrisville to look at the arrival homes for Arbor, and I wasn't satisfied, and I don't think the council would be as well. And, you know, I didn't get into an architectural. I mean, they went from 320 homes to 250 on 50-foot lots, so they'll work with us, you know, and I think, I don't think we have to hit them with the architectural. I think they're going to work with us, so. That being said, we're working through the annexation process and the timeline and hopefully that kind of coincides with getting a development plan here so planning can look at it. So it's moving along. The other thing I had, and Jenny had brought this up, and we talked about it probably at the last Council several years ago. Certified letters are starting to eat us up. I think they're $11 a pop now for Grassland. So I'd like to look at our ordinance and see if we could do these through certified mailing, I think they call it, or registered certificate of mailing. Thank you. That's what I spelled and that's what I didn't say. And then registered mail is another option. I think with the certified mail, $11 a pop, we send those out, and then we wait that 14 days, and sometimes the grass is mowed, sometimes not. We send out that second letter. It's getting expensive, so we have to look at another alternative.

We have the problem with certified letters, but a lot of times people just won't sign it.

Oh, we get a lot of them back. Yeah, all the time.

Or if it's a certificate.

And I'm not sure where we ran into the issue last time we discussed. Do you remember that, Bill?

I don't, Bill. But, you know, when certified mail was three bucks, it really wasn't an issue. But now it is.

Extremely expensive. Is there any problem with adding all three? Well, I think the way it's- We safeguard ourselves if one starts to become more expensive than the other. So I think we talked about three, right? Yeah.

Zach, how would that read in our ordinance?

The state also said we don't have to do a certifier. They said first class mail. The state's Indiana code is first class mail. So there are suggestions and ideas of what to do or

Are we at any point where all the letters that you keep sending out finding these people?

Recruiting that dollar amount, I think that'd be harder to do.

It's hard. I mean, every once in a while we will have to go back in and mow a property and then cost him $200 or $300. That solves it pretty quick. Very seldom do we have to, but we have done that in the past. Do you have any rights that we can record a lien? We do. Once we mow it, we do the lien and we get paid.

Any abatement action taken by the town is... I'm talking about...

It's not just mowing.

Mowing is a cheap cost. We're not mowing it. They get his bill for sending the list. You know what I mean? I think that's what starts to change.

The thing is, you have to mow a cost in all these letters. And not all of them lead up to doing a lead. In the six years I've been here, I've had two mowing leads. And you can charge them a significant amount of money when you do delete because it all adds up. But all these other people you're sending all these letters to, you don't recoup that at an $11 a month. It's just too much.

Yeah, I think we're all at Grants. We're hoping to do something cheaper and easier for you guys. Just let us know what that is and we'll make that a point.

Thanks, Jim. Steve? Well, I'm sure you're all aware that something weird happened yesterday. The sun came out. It was able to dry our pavement enough so that our contractors that had their equipment mobilized for two or three weeks were able to get out today and finish up our paving. So, The paving part is done. We have the crack sealer. We're in town before them. They called me today and they're going to, they forgot about the roundabout. So they're going to meet me tomorrow and do the approach legs to the roundabout and get the roundabout cracked sealed tomorrow. And then we'll be done with .26 community crossing project. In time to apply for in the 1st of September 2027, this community project. So.

Steve, do we have any issues that are in causes any headaches? What's that? Did the ring cause us any headaches?

Oh, of course.

I mean, do we have failures on culverts or do we have flooding issues? Oh, as far as federal money? Well, not just federal, just general headaches. Did we have any major issues?

No, not really. NUPAP did not. Like areas that typically we do have trouble with, like 600 West and Steinmeier Road, typically in a bad rain, water is flowing across that road. It did not. The roundabout on the northwest corner. We have trouble there. We didn't have trouble there this year. I went around when I got a thing saying, you know, if you had any damage, you know, roads or anything like that, or start applying for money now. I went around, but no, we just.

Yeah, it's amazing.

Our worst rains, I mean, at the south end of the creek will come across the road, and it didn't really get much up into that yard that abuts it. So, I was surprised.

We had a lot of rain here, but we didn't have what everybody else had.

Did you get much on the eastern end of the county?

Yeah, I ran 30 bridges in the past two days, checking our scour-critical bridges. We did a good job in the county as well.

We're going to charge them an advertising fee for being at that crime location with all the people stopping. Tell them next time you have five minutes a day.

I can ask. I let them mobilize there because it's easy. I know it is. I'm teasing.

Every time I stop there. Yeah. We should be doing these things. Put a billboard up here or something. Everybody's stopping here, you know.

With their equipment mobilized there for three weeks. And they had their guys come up from North Vernon a couple days on, you know.

Their town hall entirely flooded. Town hall fired, or police department, they can't even repair it. And today they've got a new space in a school somewhere that they're going to set up as a temporary town hall. They've got furniture, no sound and things going, but on Friday, with your permission, I am hoping to take Jim and Brian home. to help the court treasurer set up an office and potentially, you know, also help whomever else there needs to set up, you know, command center facilities. We have gotten a bunch of office supplies donated that we're taking and I would like that there's a as well as Jen and Brian, I'm asking for permission to keep them paid, but for them not to actually work in town hall here, but instead go with me to Cambridge City and try to help out.

This is our task force.

If I was going to send anybody. Quick question, is there anything else they could use that we're not using? I'm talking about, like, we've got stuff in that back office that, you know, we talk in every once in a while. But really what I'm thinking about is if there's a chair that's not filling a butt around here, I want you guys to, like, when we say okay to this, I want to make sure we make it as wide to say.

You wouldn't let me take something. until we really get a better idea of what else they need. We were going to go and get some filing cabinets. Steve Craney from the auction house, the auction that just happened at the old Deer Creek had graciously agreed to give me some filing cabinets to take out. But for now, it seems like that is not necessary. However, I did think about in the shank room, we have all these wooden chairs that sit stacked up against the wall that we've not used in the past six years that I've been here. Should I find over there that they could use them, it would be my suggestion that we consider them surplus and take them out there. But I don't know what their space looks like. They may not have one.

Maybe too soon for that stuff.

But yes, can we can we maybe suggest that we give her permission to allocate?

We've got community support on our budget, but still about it. So Smith here today, can we allocate maybe up to $1,000 at her discretion to be able to support them if needed?

Yeah, so if it's like if you buy lunch for that group that you're helping out and from the town and then additionally like setting that threshold gives you the The goodwill and the feeling of like, okay, I'm going to take this chair as well, and I don't need to call counsel. You're talking about a stack of things on that desk that I've paid for myself. You know what I mean? So I think what Ethan's suggesting is that way you feel comfortable. Not to set a limit to say don't go over this. It's to set a limit so that you guys feel confident to say we can do this without it.

And if we're there, we find that they don't have a printer that I might need.

So it's taking me a little while to get in here because I've been pulled in 18 different directions the last two months but our community community today that we had with the scrap steel Just like last year, and I'd like to continue to this going forward, the amount of money that I am able to capture off that, give it back to the New Powell Canine Foundation. So here's my check of $200, which is what we got with two trailers. I think next year I'll try to have three trailers out here because we had so much. We had an overflowing amount. So hopefully we can continue that going forward each year. It helps the town. I love the animals. And as a matter of fact, your canine raider was used at our park one day when we had an issue out there, and the dog's doing good stuff, I'll just say.

I appreciate all the work that you guys put in to make that event for us, but that's one small thing that you guys all do to make our lives easier and to let us help serve the town. So thank you guys very much for all of that. and we've got football season starting so Go Dragons the band is playing I think this Friday there's like 17 different groups that are going to be there I don't know every time I talk to somebody about it there's another junior high that's getting announced and then all these other things so if you don't have an extremely exciting Friday you could have one just head down that way and go watch

be there at that so um that's my shameless plug and that's all i have thank you how big's your trailer i'll start with everything that's been said and unfortunately last somewhat fortunately because i was fishing i missed the last meeting which meant i missed the opportunity to congratulate officer waggoner for successfully completing the police academy. And I certainly want to congratulate him for that. I welcome him to his capacity as an officer with the police department, which is fantastic. Contrary to the insinuations, otherwise many fish were caught in Canada. And, and beat it to death. Pelso Stadium, probably the oldest one in Perth, had all the champions. Class 5A Dragons versus somebody from Illinois. So come on out and you'll see what SMAP community is all about.
