City of Nagash planning and zoning commission meeting. Uh we have a thin turnout today. So I'm going to dispense with most of the preliminary stuff about how the meeting will be uh conducted as we as the two appearers here are very familiar with it. Uh no other comments acting madame director. No comments. I did want to state that on the agenda item three, we can go ahead and approve those minutes. Okay. With that correction we talked about. Yes, sir. All right. Roman numeral two. Uh, Miss Brenda, roll call. Miss Williams. Charles Whitehead III here. Bobby Claybornne. Michael D. Lewis here. Miss Anita Dubois

1:11 – 1:510

here. Mr. Walter Johnson here. Alexa Bernard Kai here. Sadie Sawyer, Isaac Bo Lewis. Yeah. Ricky McAllister. All right. By my count, we have a quorum present. Yes. Yes. All right. Roman number three, approval of the minutes. We can go ahead and uh it's showed on your agenda is being deferred, but uh they have been completed. There will be one uh I'll need a motion to correct the spelling of Miss Dubo's name, but if there's Let's uh if there are any other corrections or not, let's incorporate them into the same motion. Are there any other corrections to my name as well? Alexa.

1:49 – 2:340

All right. I didn't I didn't didn't look at it that close. Okay. Uh let's uh Yeah, I see that. Like Amazon. Yeah, I understand. Uh but better. So, uh, we'll have I I'll entertain a a motion to, uh, correct the minute to accept the minutes being corrected to reflect the correct spelling of Miss Bernard's first name and, uh, Anita's uh, surname. Do I have a Do I have such a motion? Motion by Lewis, second by Duboce. All in favor say I. All oppose like sign. So, the minutes stand uh approved as corrected. Just catch me at the whatever you haven't printed out.

2:330

I'll print them up. I I'll come by in the morning and sign them.

2:37 – 3:480

All right. Uh Roman numeral. Uh also, I need to go over that all uh all of these uh meetings are recorded and can be seen on the Nacades uh city YouTube channel uh at navishla.govcontentme-vide. Roman numeral four subsection A the old business subsection A the city council delayed the application by Mr. Brian Briggs to reszone the following location of the oil mill being 6.2 2 acres between Mill Street and Union Pacific Railroad. Section 77, Township 9 North, Range 7 West, include a portion of the original track and conveyance book 195 folio 4, the records of Daggers Parish, Louisiana from B1 to B3 special exception. The reason is the operation of a restaurant with exception to sell alcohol premises uh bearing municipal address 110 mil street. Uh what uh what is the status? What what is delayed an application? [clears throat] I don't I understand tableabling an application. I understand removing it from an agenda. Uh

3:47 – 4:130

um do you know the answer to that? No, sir. I do not. Cuz I that I assume we use those words because that's what they said. That is how the motion went. Am I going to have to buy a brethren uh you know one of these or or that may be too much. I've got the cheat sheet right here. Maybe a cheat sheet. Good lord. All right. Is that all the old business? Yes, sir.

4:10 – 4:530

All right. Roman numeral 5, uh, new business, subsection A, the application by Mr. David Perkins to reszone the following, uh, location, uh, lot 7, block A of Adams Park subdivision and a portion of Adam Street, located north of the improved Asphalt Street bounded on the north by Cane River Lake from R1 to R1 special exception. The reasons to operate a short-term rental bearing municipal address 1538 Adams Avenue, council person number one, district uh council district number four. Uh the commissioners have it in the packet. Has the office received any comment? Uh

4:50 – 5:170

email comment from any of the letters that went out. We've had no one call the office and based on the ordinance, the application does meet the requirements. It's it's compliant. I would uh if the applicator's destiny would come forward while I uh enlighten notwithstanding the fact that some of our folks on the city council claim that there's

5:14 – 6:040

some kind of uh guidance in the short-term rental ordinance. I find no guidance whatsoever other than the fact that it states that these will will be allowed shall be allowed in the municipal limits. And then the vague comment that it's a special exception use that possess such unique characteristics or special form that each specific use shall be considered an individual case and subject to approval of the city commission after a public hearing. and recommendation by the planning commission. I don't see any guidance past that other than telling us it's permissible and it requires a hearing, but I see no criteria for that.

6:02 – 6:420

Miss Toten Beer, if you'd identify yourself for the record, please. Uh my name is Michelle Tenbeer. I'm with Pitter Homes and Gardens Road Realy. I'm the agent representing the uh applicant and Mr. Brad Ferguson is the agent for the selling. All right. Uh the summary of the application was that they simply want to operate a um short-term rental at this. Uh it's my understanding it's been fairly well uh renovated and I assume that they've received and understand the uh obligations on a short turn.

6:40 – 7:250

Absolutely they have. They have. They plan to move back here in about three years. Um, uh, David and Misty bought my grandparents house in 2000 after they passed away, the home that I grew up in. And, um, then he opened his own business and moved to Houston. So, they've looked at several venues in Arkansas and in other locations, but they just love Nacadish. So, the home would be used for uh for them to come back and forth and visit. Uh, his wife teaches, so she's uh, able to move around the summer. would give them more time to visit and then in the times that they're not using the property, they would like to uh have have the opportunity to operate as a short-term rental.

7:230

Have you received any comments from any neighbors or anybody else?

7:26 – 8:140

We have. Uh Mr. Perkins has visited with Buddy Hagen and his wife. Um I've talked to Melissa Clutter. Um I know Anita owns a property that backs up to the mobile home. It's a rental. Um, and so we do have a letter in the packet from uh, Buddy Hagen stating that he has no opposition. The property is the end of a deadend street. Adams is off of Williams Avenue, North Williams to the Dead End Street. Um, there are two parking spots, but Mr. Buddy Hagen's house sits on a little bit over five acres and then he owns the mobile home that is a rental next door to the property. And then Miss Anita owns a home behind the motor home.

8:10 – 8:550

Okay. Any questions for Miss Toten from commission members? [clears throat] Mr. Ferguson, would you like to speak or are you good? I'm good. All right. Seeing that there's no um no one else here to appear in opposition. We'll move straight into discussion by the commission members. Uh, Madam Secretary, please show that Miss Duboce is abstaining from discussion and voting in the record, please. Uh, what does the commission want to do or do they want to talk about it? They got a uh motion to approve. Motion by Mr. Lewis to approve. Second. Second by Mr. Johnson. All in favor say I. I.

8:52 – 9:350

All oppose like sign. Uh, so that will come up. It'll be introduced next um on the 12th on the 12th and then be voted on on the 29th. Correct. You know, uh what we normally tell people in the open comments, not supposed to talk about it. Next time is for introduction only. If somebody shows up, wants to speak because they're going to be visiting grandchildren or in the hospital or something, they let them talk. I suggest people come to the introduction in case they take it out of order, but if they don't, be quiet and show back up for a hearing like this.

9:33 – 10:160

I'll be representing my client introduction and he will be present for the vote. Okay. It would be 12 + 14 26. The 26. Yes. Okay. All right. All right. Thank you, ma'am. Thank you. Uh that is the conclusion of new business. Do we have any uh office activities? No office activities other than this is my last. All right. Well, Miss Bernard Condi, you're in the seat. So, you've got you give us the motion. I'd like to make a motion to adjurnn. Ajourn. I'll second.

10:130

Second by Duboce. All in favor say I. I. All oppose like so. The show we are
