Start free trialHarold Thomas is requesting a variance to the setbacks for a fuel station om C1 zoning for property located at 4281 Greensboro Highway (Tax Parcel 043-111A).
Staff met with the applicant and the property owner, Mr. Singh, on January 5 to discuss options for improving the River Store. The existing convenience store and fuel canopy are partially within the commercial zoning setback, and the entire property is within the 300 foot setback from residential property for a fuel station. The options discussed included a new convenience store and remodeling the existing store, which is in poor condition. The owner was concerned about lost revenue if he demolished the existing store to build a new store, and even though staff offered to allow the existing store to remain open during construction, he opted to request the variance for an addition to the existing store. He also asked for an addition to the existing canopy. At the Planning Commission meeting, Staff raised concerns about the distance between the canopy and the convenience store, which would be reduced to 5 feet with the proposed store addition. The condition of the existing store was mentioned as well as various ways the fuel canopy and pumps could be arranged. When the owner was asked directly if he would consider a new building, he stated that he would prefer it. The discussion changed completely from the proposed addition to constructing a new convenience store, which would be completely within the building envelope. Instead of a variance for the C1 zoning setback and the 300 foot fuel station setback, the variance for the C1 setback was no longer needed. The Planning Commission also discussed the similarities between this application and the application for Fairplay Grocery last year. In response to staff concerns about lighting, the applicant gave assurances that all new lighting would be directed down. The Planning Commission voted unanimously to recommend approval of a variance to the 300' setback for a fuel station for a new convenience store and canopy addition that will be outside of the C1 zoning setback with the condition that the old convenience store is to be removed within 60 days of the Certificate of Occupancy of the new store.
Morgan County Planning & Development is requesting a text amendment to Chapter 2.9 of the Morgan County Zoning Ordinance related to building permits.
This text amendment request is in response to the new permitting software employed by Planning and Development. Because all documentation is now submitted online, the wording requiring paper documents to be provided to the Planning office needs to be removed. The amendment includes clarification that permits and placards should be printed and displayed. The Planning Commission voted unanimously to recommend approval of the text amendment as presented.
