TENTATIVE TRACT MAP NO. 38955 (PEN24-0058), PLOT PLAN (PEN24-0059), AND VARIANCES (PEN24-0144, PEN24-0095) (DISTRICT 2)

Tentative Tract Map No. 38955 to subdivide 9.33 gross acres into airspaces for condominium purposes, a Plot Plan for the development of 139 attached multifamily residential units, and two (2) Variances: 1) to allow the required 50-foot rear setback to be measured from any residential structure exceeding one story on the Project Site to the property line of any parcel containing a residential structure in the adjacent residential subdivision to the north, and 2) to increase the maximum allowable height of the retaining and non-retaining walls along the north and west property lines not to exceed 12 feet in combined height within Tentative Tract Map No. 38955. Recommendation(s): That the Planning Commission: 1. ADOPT Resolution No. 2025-16: a) ADOPTING the Initial Study/Mitigated Negative Declaration prepared for Tentative Tract Map No. 38955 (PEN24-0058), Plot Plan (PEN24-0059) and Variances (PEN24-0144, PEN24-0095), on file with the Community Development Director, incorporated herein by this reference, which was completed in compliance with CEQA and the CEQA Guidelines, and reflects that the Planning Commission reviewed and considered the information contained in the Initial Study/Mitigated Negative Declaration, and exercised its independent judgment and analysis of the Proposed Project's potential environmental impacts; and b) ADOPTING the Mitigation Monitoring and Reporting Program prepared for the proposed project, which consists of Tentative Tract Map No. 38955 (PEN24-0058), Plot Plan (PEN24-0059) and Variances (PEN24-0144, PEN24-0095) pursuant to CEQA and the CEQA Guidelines. 2. ADOPT Resolution No. 2025-17: a) APPROVING Tentative Tract Map No. 38955 (PEN24-0058), Plot Plan (PEN240059) and Variances (PEN24-0144, PEN24-0095) based on the recitals, evidence contained in the Administrative Records and Findings as set forth in Resolution No. 2025-17. 3. ADOPT Resolution No. 2025-18: a) APPROVING Variances (PEN24-0144, PEN24-0095), subject to the attached conditions of approval included as Exhibit A of Resolution No. 2025-18 and the approved plans.

MUNICIPAL CODE AMENDMENT (PEN25-0149)

The Proposed Omnibus Municipal Code Amendment Includes Various Updates and Text Clean-ups for the Purpose of Complying with State Law and Clarifying and Streamlining Various Development Standards Within Title 9 (Planning and Zoning), Including Chapter 9.02 (Permits and Approvals), Chapter 9.03 (Residential Districts), Chapter 9.04 (Commercial Districts), Chapter 9.07 (Special Districts), Chapter 9.09 (Specific Use Development Standards), and Chapter 9.15 (Definitions) of the Moreno Valley Municipal Code. Recommendation(s): That the Planning Commission: 1. APPROVE Resolution No. 2025-23 Recommending that the City Council: A) Find that PEN25-0149 is exempt from the California Environmental Quality Act; and B) Introduce and Adopt Ordinance No. [next-in-order] approving PEN25-0149, based on the finding set forth in the attached Planning Commission Resolution.
