Agenda item number three, consideration and possible action on the planning and zoning regular meeting minutes of September 2nd, 2025. I make a motion to pass. Second. We have a motion and a second to approve the planning and zoning regular meeting minutes of September 2nd of 2025. All those in favor say I.
All those against say nay. Okay. Agenda item three carries. Item number four, consideration of possible action by the planning and zoning commission on the preliminary plat for Brierley, formerly known as Redbird Meadows, sections four, five, and six.
Good evening, commission. So today in front of you, you all have the preliminary plat formerly known as U Redberry Meadows preliminary plants sections 3 4 through six. I'm currently handing out a general exhibit on the proposed phasing of the development just to give youall an update as to where we stand. Tuesday, the B development has platted sections 1 through three and it's currently going through the process of planning sections 4 through six and we're working through a couple of other um fin center and proposed road. Uh so on that first page you'll see um overall development again the development which is comprised of approximately 690 homes um being a mix of 60 ft 7T and 80T blocks. The approved variances uh for this development allow for the lot width of a minimum 60 ft um with a minimum lot area of 8,400 square ft and a minimum sideyard setback of 5 ft. Sections four um are all comprised of 60 foot box. Sections five is comprised of 70 and section six is comprised of eight. Um total block count for these three. 112 for all three locks or all three sections uh total. And so what this agenda item is doing is uh requesting that y'all make a recommendation to city council to approve or deny learning class that are here in front of you as a
part of their development agreement. Uh it is also important to note that their uh minimum five yard setback or five the minimum siding lot setback uh of no less than 15 uh ft is allowed for up to 20% of their total lots. So essentially of the 698 homes 20% of those are allowed to have a 15t sideyard setback between both property uh building pads. And so there are currently two dates between sections 1 through the proposed four, five, and six are at 14%. Again, that 20% requirement is for the entire development, not for each individual section. Just wanted to note that I was reading on the plat also that there was the Montgomery monuments where the cemetery is in that neighborhood. So, they are going to square that off and make sure that that is a special area for that uh cemetery location. It says monument on there.
So, I didn't know that's what it meant. Just to confirm, the monuments are make sure you're referring to there are city of Montgomery monuments that um are tied essentially allow the flat and property to be tied to specific elevations and coordinates to allow for construction um of the plat of the section. That's typical for all those. Well, I'm I'm just wondering what are they doing? I want to make sure that where they I believe is not being touched on accident. Sure. We we've made provisions to clean that up, get it back to you, restos those closer to the ponds, correct? Yes. Well,

Is the rightway along multiplers on road intended for future utilities?
So uh to date we have installed as part of the development they were required to install or fund installation of a 12in water line and a force man along the road. We have installed the water line and force man. Both of those are well force man in the warranty. Uh we have our learning walk say next month or uh in the beginning of the park no later this month excuse me and then the water line is has been accepted by the city and it's currently in so we'll come back for that oneear warranty walk um September of next year. I did notice in this would be in area four or section four. There did look like uh lots, let's see, like four, five, and six are just some examples where they do look like they're below that 60. I'm just curious how that frontage is measured.
So the frontage is measured from the building line. So if you take that on four, five, six, they all have 57.28 ft. So if you measure that from the building line it
similar for seven that has better. Yeah. Is there a timeline for permanent flats or the final flats? So, they're currently going through construction for these three sections um that is within their phase 1B. So, they're continuing with the WSB and paving for those and I would expect flaps to be in.

Okay, that's we're currently reviewing preliminary for that now that actually I can't remember. Is there going to be an entrance off old doin plannersville road or just off of Spring Creek in Old Plannersville?
So, there are two connections to Old Plannersville Road and future ultimate connection to Spring Ranch Road. Um, as a part of the future phase, we're working through a three-party agreement with the city, priorly Johnson Development Corporation, and then the county on how that is um, one financ. So, nothing on Old Dive in Plannersville Road, but they enter into the subdivision.
Not for the subdivision. Um, if you notice on the AR corner, uh, there is a access reserve and dedication. That green space is the future site of our plan number four. There will be access for that for public works and city staff but not the subdivision directly.

Agenda item number five, consideration of possible action regarding a request for a special use permit to place a temporary construction trailer on a residential lot located at 703 Gunner Court in the Redberg Meadows development known as Bri.
Good evening, commissioners. This will be the first of three special use permit requests that you'll have in front of you uh for a placement of a temporary construction trailer on three of the uh specific blocks at Red Bird Meadows developments. This one here is 703 court. Um just so you know, they did go through an architectural review committee. I believe they're calling it their red group. They did go through the architectural review committee. They looked at it for landscaping, fencing, um their parking in general. Now, we can't because in the city can't enforce that, but it's nice that they did look at that. So, the the big plus to to them reviewing this is that what they've done is grouped all of the construction trailers instead of being throughout the development. It's all in one spot and they could all look cohesive, I guess, for construction and any light, noise, maybe even dirt that might come from the construction trailers or even vehicles that will using the trailer um can all be in one spot. That's what the special use permit is for. This first one will be a request for I think this one is
weekly for three years. I know there's one in here that's Yeah, one of them is for three years. I It's 2028. The others are to 2027. Well, no, there's two of them for 2028 and then one for 2027. the first one in case Johnson development wants them to relocate or something like that. That's what they were just planning for relocate within the subdivision subdivision just in case. I I don't know if they discussed that.
So generally the idea is as to keep everybody in the same spot kind of in their own little corner away from residents. Uh here it works out well because it's kind of a quick in and out. So traffic that's coming to drop stuff off or delivery it's right there at the front. We keep them uh there for parking there as well away from everybody else. Um and the idea given the size of this community they'd be this is the only place they'd be and then the next move would be to move them out to start building the house on that. So that's the idea there and and this point enforcement will absolutely drop the hammer on you know From your perspective, do you have a desired time frame to for rather than having a couple at two years, a couple at one, you know, rather than erratically having these? Is there

Just to have some consistency. Sure. On timing I don't know that there's a magic number. Um the developments I think we've got we got three phases where four five and six was second part of phase one as you mentioning section seven and eight is phase two and there's the future phase after that. you know, kind of looking at schedules and timelines of how things progress now. Probably they're probably building houses into probably being conservative. So, we never know exactly. Some of them go faster, some of them go slower. may hit everybody else there, but I think it's somewhere in that range of 28 probably number and at some point they're going to get to a point where they're they're finished out enough and there's not there's a handful of homes being finished that they'll they'll back up and then they're just working the last couple construction projects.
Are these all tying into utilities, power, water, sanitary with meters, independent restructur?
I um I'm not quite sure how I feel about it moving into 2028. I I understand uh your your logic of the amount of time and spread out or whatever, but that's a lot of time to give for a house to be built. And it is a special use permit, which we meet monthly. You could bring that to us before and get it approved. I mean, you know, you're going to have it on Gunner Court. You know what I'm saying, right? Uh, and we understand if you have to move it, you know, to over to Republic Road or whatever it's called in that subdivision. But, um, I would like to see that we give them to 2027. Um, and just make it uniform across the board. We can expect to hear back from you hopefully earlier. That'll make your market better for selling, you know, whether it's going to be sooner or later.
Yeah. Yeah. Yes, absolutely. I mean I mean that that that way it's uniform and everyone has a desired time frame and then it is a special use permit. You have to come to us if there's a change that needs to be taken. That's the only thing that I would suggest um in the uh request for a special use permit.
Are there two more coming after this? Is that correct? Highland Homes and just just past on this agenda. Okay. I thought I saw so there's three in this one. Just one of the drawings in weekly homes has an additional two more for Highland Homes and Construction and then Chestn Chest Homes as well. It's okay if it's not. I'm just you have um JP J Patrick and then yes Chesmer is going to be a little bit later. Okay, that's what
I like two years. I I I think two years is sufficient time frame. Makes sense to me. Would that be December 27 or what? When is the when are the trailers moving in or are they already there? They're not there yet. Okay. When are they moving in? I'm sure right after um council final approval. So I guess we're giving it to year end. and you do you will come to us if it has to move out of Gunner to a different culde-sac. It would have to. Yes, for sure. the the intent is that they stay there and then we'll come back up on progress time stay in the same place where we're at. Okay,

Throughout its use. Activities associated with the trailer must comply with the city noise ordinance. I I want to say this out loud. Um these are three separate special use permits and if anything changes individually, they have to come back to the planning and zoning. I just want to say that out loud. Um, I'm I uh make a motion to approve the request for a special use permit to place a temporary construction trailer on a residential lot located at 17 Gunner Court in the Redberg Meadow development known as Briley. The exception with the recommendations of um what they have in there to keep up the area. Um the only thing is is it will expire the year end December 31st, 2027.
