You do have a quorum.
All right. The first item is election of officers. I just want to say before we start that I've been chair for two years. It's been an honor. It's time for me to step aside that somebody else take the chair. I will not be accepting a nomination, so please nominate somebody else if you could. With that, I'll open the floor to nominations for president or chair.
Well, I'll make the first nomination for John Schmitz.
Okay. First and a second for John Smith. Does John accept that? Glad you showed up. Okay. I think technically I have to open it three times, right? So are there any other nominations? Any other nominations? And any other nominations? That's the third time. All right. So, John, are you good with that?
Yes.
Okay. With the nomination of John and seconded, we'll vote on that. All in favor, say aye.
Aye.
All opposed, nay. Motion carried. Then the next item would be the vice chair.
Yeah, I'll do that if you want me to.
I'll second. Any other nominations? Any other nominations? Any other nominations? All right. We have a motion and a second to navigate myself as vice chair then. Any further discussion? All in favor, say aye. Aye. All opposed, nay. Motion carried. John, you get to switch chairs with me.
Right now? Right now. Perfect. Let's do it. Congrats. Item number four, a declaration of conflicts of interest with any of items on the agenda today, eight and nine specifically.
None?
Hearing none, we shall move on to item number five, approval of the agenda. Looking for a motion to approve. Move to approve. Second. We have a motion and a second. All in favor say aye. Aye. Item six, approval of previous minutes from June 8th, 2026. Looking for a motion to approve.
Move to approve.
Second. We have a motion and a second. All in favor say aye. Aye. I need a motion to set the date for scheduling the next meeting July 27, 26. Set the date. Second. We have a motion and a second. All in favor say aye. Aye. okay the real business item number eight variance permit from brandon wagihawk brandon has applied for a variance permit for a front yard setback of four versus 35 to convert an existing garage into an entry mudroom and build a new attached garage this is located at 1509 westview drive legally described as lot 8 skyline estates in the northwest quarter of section 14 Township 103, North Range 60 West of the 5th PM, Davidson County, South Dakota. The property is zoned UD Urban Development District.
I think that's you. Members, if my computer decides to load here, this is in the ETJ. I believe it's in your packet if you want to take a look. Really not a whole lot to say here, self-explanatory. I'm asking for a three foot offset. Yeah, with that, we'll open it up to questions.
So in the photograph, the aerial photograph, this particular one here, the red boundary is the property line, correct?
I do have it up on the screen now. Yeah, so that shows the boundary. You can see they want three feet off. These aren't always exact, but it would be three feet off the boundary of the driveway, as it's shown now. This is considered a private road that's in the county, so it's maintained by the people that live along there, just off Shannon, as you can see.
How close is the web property to the street? Looks like they're right up against it, too.
Yeah, they are very close. I would say probably, yeah, a couple feet, less than five.
Think this will ever get annexed into the city?
Doubtful. Yeah, not in my lifetime, I wouldn't say. Okay. Then we don't care. Well, I should mention the letters were sent out to the neighbors for the requirements. There was one back in approval.
Do we know where that property owner resides?
That was Sand.
816. Sand owns the farmland in Crips.
Adjacent to. So no one within the Nobody within or that lives on the road responded.
Has this been to the county yet?
This does not go to the county. This is the variance for city zoning, which is in the ETJ.
Well, I think with the private road, that makes a totally different situation. Webb's right up against it, so it's not the only one. Right. I'll make a motion to approve it.
Second.
We have a motion and a second. Any comments, suggestions, or otherwise? OK, hearing none, all in favor say aye. Aye. Item 9, Platt, Grumwick Construction LLC, a Platt of Lots 1 through 10 and Lot A of Legacy Court Edition in the southwest quarter of Section 16, Township 103 North, Range 60 West of the 5th PM, City of Mitchell-Davison County, South Dakota.
Yep, this is located on the west side of Commerce Street, as shown on your screen. Here is the Platt. Currently, the plan is for that. They have it listed as lot A. That will stay as a private road. So I have an HOA set up, however that works. So all of that will remain private. There is an easement on the west side of the property for the drainage and detention pond that's in that location. And with that, I can answer any questions you have.
Any questions? Any of these non-conforming to the zoning?
They are all conforming. Mark has checked that and everything would be good to go. Move to approve.
We have a motion. Second. We have a second. All in favor say aye. Aye. Other business, item number 10, is there any other business to come before the committee? Hearing none, we'll move on to item number 11, public input. If you need to address the board on an item that was not on the agenda excluding personal items, please come forward to the podium and state your name and your concern. Presentations are limited to three minutes. Items will be considered, but no action will be taken at this time. Any input from the public? Hearing none, I need a motion to adjourn.
