It is um a little after the 5:30 hour. So, I will call the November 18th, 2025 council meeting to order and I'll ask the clerk to call the role. Dr. Lee here. Mrs. Walden here. Mr. Reynolds here. Mr. Chambers here.
We do have a quorum present and can continue with the meeting. If you will please stand and join me in the prayer and the pledge of gracious God, we thank you on tonight for allowing us to be here to continue to do the business of this city. We thank you that each mind tonight represented here that we be on one accord and that as we move into the holiday season, we be mindful of those less fortunate than we are. Father, I thank you that as we come upon each decision making process on this agenda tonight, that you be with us as we make decisions to continue to moves the city of Milligville forward.

So, at this time, um, I'm I will turn the meeting over to Mr. Griffith regarding the presentation on the Millisville Housing Authority, uh, TERA.
Uh, thank you, mayor. Um you all have passed I believe it's two resolutions uh dealing with um what is commonly referred to as TERA or proving the we reissuance of of um tax exempt revenue bonds for the purposes of improvement of uh housing authority uh properties. It's my understanding the last one that you all passed that bond was not able to be used and because of that um there is additional monies remaining in um the Milligville Housing Authority bond package that needs to be um reallocated to uh Fairview Terrace um and apartments in Henry County. Uh we have on the phone with us tonight Allison Dyer. Allison is with Holland and Knight. She's a partner with Holland and Knight LLP. Um she spoke with you on the last um TERA and um she is on the phone tonight uh to answer your questions, give you a quick summary to remind you of what um reissuing of these tax exempt bonds is all about in terms of housing authorities um and then to answer your question. Allison, can you hear us?
I can. Can you hear me? We sure can. Thank you. We appreciate you being here tonight. Um and I'm just going to turn things over to you to uh give Mayor and council a summary of what we're looking at tonight and then I know you'll be happy to field their questions.
Yes. Thank you. And um I appreciate you all um putting up with me joining by telephone. I'm in in Washington DC for other meetings today. Um we were before you earlier this year for the same request. The resolution before you is a um a resolution approving the housing authority having properly held a public hearing with respect to what we call a reissuance of some outstanding tax exempt bonds that they have. Um what is a reissuance? It's basically refinancing. It's like when we redo our own mortgages. Um they're making some changes to the terms of the loan, none of which uh Milligville or the housing authority are obligated on. We are simply the conduit issuer that facilitates the issuance of these bonds. Um but the uh Internal Revenue Code requires that certain hearings be held. The hearing was held. Notice was properly given and um the resolution before you today just states that you approve that the housing authority has properly held that hearing. I'm happy to answer any further questions you might have.
Anyone have any questions for Allison? So, Mr. Jordan, when I spoke with Miss Kerry, she said she wasn't familiar with this being brought forth.
Uh, yes, ma'am. I mean, it's kind of an ongoing saga. Uh but really from the city standpoint, we have no exposure or no liability or obligation, but for some reason because of the way this all began here locally, you're still your approval is still required. uh acknowledging that these hearings have been held and that's that's about as good as I can explain it. It's very difficult to understand in some ways. I think Allison would probably agree with that.
Yeah. I mean, look, the IRS doesn't do any of us any favors, but that's this is a a hearing that's required by the IRS. That that's all. And it's it's really kind of a check the box That's right. type situation. Okay. I think the important part is to understand that the city of Milligville would not have any financial liability. Absolutely not. In this regard and that's as you all know being the number cruncher I am, that's what's important to me from from the city manager perspective. Okay.
Anyone else have any questions, concerns? Well, Allison, we have some very important work to deal with, but I know you probably want a rest from what you have been doing in Washington DC today. All right. Moving along. You all have all received a copy of the October 28th, 2025 council meeting minutes. Are there any corrections that need to be made?

Moving on. At this time, we will move to the city manager report, and I will recognize Mr. Griffith.
Uh, thank you, mayor. I started to go up to the podium for my last official city manager report, but I need to be close to the computer where I can be showing you all some things. So, uh I'll stay uh here. I wanted to start out since we are looking at um approving the millage rate tonight to talk a little bit about uh taxes mainly our splice and t-plas taxes that are currently being collected and give you an update on where we are in terms of receiving those collections from the county. If you remember the IGAs that created both of those uh special um purpose local options sales tax, both regular splice and a T-slice. Uh one of the things that was to happen was the county was to um through an AC deposit direct deposit uh the city's share of the collections within 30 days after they received them. I shared with you all at the U planning meeting that we had in association with GMA back in June uh that the county was was falling behind, but I felt positive that they would get caught up. Um that positivity waned uh as I continued to contact the county about uh getting those collections forwarded to the city. as the IG stated they they should um Mr. Chambers and Miss Shinster and a number of others of you uh also contacted the county um and that precipitated some um forwarding of collections. Um, and what I wanted to do was let you know what those collections were tonight up to date and uh and then let you know what was uh owed to see uh what direction
the city could go in in terms of trying to collect these um additional collections that have been sent to the county. So you have on your screen um first of all a spreadsheet dealing with the regular squash. You can see that uh the first collections for it um were sent into the state uh on April 30th, 2024. Uh the first amount column that you see is the total amount uh of collections that were collected and sent to um the county. In the regular splice, the percentage um that was to be forwarded to uh the city based on uh the projects that were put forth um was um 26.36% uh of the total collections. So when you look at the city share column that you have on the spreadsheet in front of you, that equates to 26.36% of the total talk total amount that is in the amount um column. Uh, I would ask you to look down at the bottom of the spreadsheet that you can see on your screen and you can see thus far from April 30th, 2024 uh through um that should be April October 31, 2025, not 2015, excuse me. Um total collections have been $16,551,23789. um of that um amount uh based on the 26.36%
figure um the city share to date based on what has been forwarded to uh the county by the department of revenue uh is $4,362,96.31. Um what we have received from the county thus far um and was received in the last 30 days is the total that you see there that's $1,821,887.50 leaving a balance still owed to the city by the county of $2,541,181. um splashed and t-splashed accounts uh by state law are eligible to earn interest. Um we do not uh necessarily shop an interest rate for that. So uh the the two accounts that these are in is a relatively low interest rate about a half percent. Um but based on um the amounts that we should have been receiving, uh I tried to do an estimate on what um interest we might have lost to date had we had the amounts uh in our bank account. And you can see on the splice uh collections uh that would be a little over $20,000 of interest that we have lost in the last uh close to 24 months. Well about uh about 18 months. um to give you the same information on the T-slos. Uh if you remember the T-slos was the percentage was more than um it was on the um regular splice. The city share for the T-slos was 35%.
And what you have on the screen in front of you is the same thing as the SPLS spreadsheet. The amount column shows the total amount that has been forwarded to the county by the department of revenue based on their collections. And then the city share would be 35% uh of each one of those amounts that you see in the amount column. the way the summary works out on that. Well, let me back up and say you can see that uh 14,593,23356 of Teslas collections have been forwarded to the county by the state department of revenue. Based on the 35% share, the city share to date should equal 5,17,631.75. Uh we have received to date 2,239,984.39 but you can see a balance owed to the county of 2 million8 excuse me from the county to the city of 2,867,647.36. Same thing with the estimated interest that I did on the regular splice and it appears to be um almost $21,500 u to this point. Um I pull the October numbers today. Um, so technically, if we were following the IGA, um, we may not have the October figure or amounts by now because we're still within the 30-day window of the time that the county would have received those collections from uh, Department of Revenue. But I I wanted to show you what they were just to give you some idea about what you so that you could see what collections were being collected or
what amounts were being collected and what amounts were being uh forwarded to um the county. Um, this obviously is a violation of the IGA, both IGAS. Um, and u, I was, as I said, confident um, up until about two months ago that they would get this, um, updated and get it to where it needed to be. Um, that confidence went away about two months ago based on a response that I got from the county finance director. Um, and, uh, you see where we are. uh we basically have received the collections that we were to see receive through December 31st, 2024. So we have not received any collections at all for any of the months of um of 2025. I know that um Mr. Jordan and I have been talking about this. You all some of you have been talking to Mr. Jordan about it and I think we will uh continue to have conversations about it maybe even before this meeting is out. So, I just want to give you the figures there and let you know what they were. Um, let you know what has uh been done uh thus far. Um, I would just call attention to for you and for those uh in the public that are listening. Um we completed about uh one and three4 million dollars of road resurfacing um up uh until the last well for about the last three months. Um none of that has come from Tesplot money. We had Elmeig money that we'd banked for three years plus supplemental elig. Um, but we could certainly be paving a whole lot more roads a lot more quickly uh if we could get our funds from um from the county. So, I share those numbers with
you. I'll be happy to answer any questions that anybody has uh about them, but I wanted to make sure that you all knew exactly what the numbers were um based for future discussion, not only possibly tonight, but in the months to come. Uh, I will be, uh, forwarding this spreadsheet to, uh, I already have forward it to our accounting manager. Uh, I will be forwarding it to whoever the interim city manager is. Um, and making sure that they know how to access the department of revenue website to be able to see what those collections are. Uh, so that they can keep you all updated as well. But any questions on that? Has anybody reported um reported this that they have not been giving us the money um monthly as it was supposed to be done?
Reported to whom? To the people that issue the money to the county. Uh no, ma'am. I don't think so. I have not. I I don't uh I have not spoken with anybody from the Department of Revenue, Mr. Jordan. I I don't think you're aware of anybody that has either. Um so, no, ma'am. Mr. Jordan, can you or I want to notify of Mr. Griffy? We can. Now, you know, uh, the city manager sent a letter to the chairman of the Bowman County Board of Commissioners, Mr. Strickland, on October 27th of 2025. I have that.
Right. And I do not know whether we have received any response to that letter. Um, so it's probably incumbent upon us to uh get some response from the county as to what their position is relative to paying this money that they they owe. uh and then of course I'll be discussing with you uh if they fail or refuse to do so what steps we can take to uh collect that money and um uh I would know that anybody has you you have not received have you I don't know if anybody
they haven't given a date or anything that they need artificially yes unofficially. I I don't unofficially yes when is it the end of the year by the end of the year that that they they would be caught up now I don't know do we have that you know to what what extent I said unofficially ma'am okay that basically a conversation um but I think that is what supposedly they're working toward Now, that's a tall order.
Yeah. Because the question is whether they've got the money or not, right? What have they done with the money? And so, it's going to be incumbent on us to discuss that and for mayor and counsel to give some direction as to how they want um my office to proceed. uh to either get a answer as to when we're getting the money or if we have to proceed through the legal system to get it to get our money and you know we lose interest too. Understand and we'll discuss all that. That's
there are some parameters that we may be able to work under to to recover that interest as well. and the cost of pursuing the right collection.
Any other splash or t-plas questions before I move forward the rest of my report? All right. Uh you all have heard a number of different times, especially from one particular developer um about the need for um parking spaces that meet the requirements of the ordinance for loft development downtown. One of those requirements is that u parking spaces that are leased for loft developments be included in the in the um central business um commercial district. Um, and based on that, I think it it's time to consider the possibility of extending that district. Not only because of that, but we've got some other properties um that are currently just on the edge of of that district that uh we have been contacted about about being redeveloped. But those properties don't have any on-site parking. And if if the property is in the central business district, then the street parking can be considered the parking for their business. Um and uh I think it's just a good time for us to look at the possibility of of expanding that. Um that can be done through a text amendment that planning and zoning will consider. Uh so I'm recommending ordinance uh 02504-07. The reason that's a 04 ordinance is if you remember, we had an ordinance we were looking at back in April that would do this same thing that we pulled from the agenda. So since we had already assigned that ordinance number to the expansion of the central business district, um Courtney and I went back and picked up that same ordinance number. Um, in your packet was a Google map that I uh created that will show you the additions
to um to the central business district. Um, so what I have on on your screen now um the yellow areas are what is the current um central business district. the green areas three blocks to the north and then one block to the south uh would be potential district expansion. Um when I looked at what those areas might need to be, uh I looked at the current mix that was there in terms of residential and commercial. Uh quite frankly, I looked at the potential for some areas there that might serve as as expanded parking area for loft development. Um and uh I also uh looked at the potential for um businesses expanding into those areas. Um, one one building that um we have been contacted uh by developer about um actually is on the north side of Ford El Griffin Junior Street. So, we need to try to extend that block to Montgomery in order to be able to redevelop that building. That particular block also could provide some additional parking. the uh block that is between uh North Jefferson and Montgomery and Elbert and uh Macintosh uh would be an area that might uh have some of the development of the hotel that was shared with you all a couple of months ago. So I think it would be advantageous to include that in the central business um district as well. Um, and then on the south side, there are some areas there that might be developed into parking spaces for loss.
Um, and uh, so I wanted to make sure included uh, that area as well. This will be a first read for this since this is a text amendment and the ordinance change. Um you can see on your uh information that it will go to planning and zoning on December 1st uh for them to consider it and should they approve it then it will come back to you on January 13th um uh for you all to approve or not approve. But I think this takes care of some issues that we have. Uh my initial thought was to expand it the same to the same footprint as the historic preservation district. backed off of that a little bit for a couple of reasons, but I think this is a good compromise um for those u for between those two. So, uh you have that there. If you have any additional questions about it when it comes up for after the first read, I'll be happy to answer them for you then. Um, ordinance uh 02511-18 is a ordinance that um amends the budget uh the 25 26 fiscal year annual operating budget. It's purely simply taking um water treatment operators from the water treatment plant and uh transferring them to the wastewater treatment plant. there's no there's no money difference in the two. The positions are just being transferred. Um and then deleting the fog administrator because that job is currently being done by the pre-treatment uh coordinator and um that fog administrator position would then become a lab coordinator position at the wastewater treatment plant. Once again, the same pay scale. moving those positions to the wastewater treatment plant will enable us to start moving towards having that plant manned 247
like the water treatment plant is. Currently, state does not require that. And if you all remember when I brought to you um the request to upgrade the SCADA system, I said that that would keep us from having to man that wastewater treatment plant for a few more years. Rob shares with me that he's he's pretty confident that the state's probably going to come back in the next 12 to 18 months and say the wastewater treatment plant has to be man 247. So this is planning for that and as I said there's no difference in money just transferring from uh one department to another. Um, mayor, in the information that uh uh Courtney shared with you, I think she has it uh listed as a first read. I would request that the agenda be amended so that maybe that could be passed tonight since it's just simply transferring positions from one department to another. Uh, but I will leave that up to to you all. Resolution R211-49. Uh, Mr. Jordan and I have been working on uh trying to get a deed of correction on a piece of property that was sold during um a tax foreclosure sale. Um this this deed of correction has been completed. Um but we realized that that um the person who signed the deed was obviously no longer working at the city. the person who did the last tax sale unfortunately is ill and is not here. And in the course of Mr. Jordan and I having that conversation, he um uh thought it would be good a good idea for us to or for you all to name a city marshall and deputy marshals. And I talked through it. I thought it might be a good idea to to name those people
based on current job titles within the city. Um and that's what we have done here in this resolution. Um the um city marshall would be the the lead um code enforcement officer or the senior code enforcement officer and the deputy marshalss would be the city clerk and the city manager uh as necessary. Um, I one of the reasons I went with the code enforcement officer was because I think this position will become even more important as we start to take code enforcement issues to municipal court because that's that's the way the ordinance says that's done. Um, and since the code enforcement officer will already be working on those, I think it just makes sense for him to be the city marshall. Mr. Jordan, you got anything to add to that?
No, I agree. I think that's uh the code uh requires us to have a marshall. uh we can have some deputy marshalss. I think that all makes uh perfect sense uh and really came to light when we had this issue uh with a corrective deed on a tax sale uh that's been ongoing for quite a while because we've gotten some different opinions from the interested parties, opinions from their lawyers as to what needed to be done. But now they I think have settled on that they can we can accomplish this with a deed of correction uh which our folks are are putting together the folks that handle our tax sales because that was in essence their their error uh as such. So, uh, we'll get that deed of correction, but we need somebody that is authorized by law to sign that deed of correction, and that's either going to be the, uh, the marshall uh, or one of the deputy marshals. So, it's it's just pretty much housekeeping, but we need we need it done uh, for future. And I I agree with uh the city manager that having it by title uh they still have to they still have to take an oath. Uh there's an oath provided. Uh but having it by title uh eliminates the need to make that appointment every time we have turnover or have have an issue. All right. A couple more resolutions just to bring your attention to. Uh resolution R2511-52. Uh that is a storm water drainage
easement that um came about because of uh the bridge expansion that's occurring on South Wayne Street. um the bridge expansion really didn't cause the need for the easement, but um when um the drainage um infrastructure on um the city right of way uh was excavated around it caused it to collapse uh just simply because of the age of it and um there was not much need in replacing that when we knew that that uh that was running across the back of what we know was Southside Equipment's property um was ultimately going to collapse as well. So, while everything was dug up, uh we were not able to find an easement for uh that initial drainage infrastructure that was there. So, we had one surveyed out in this resolution is you all accepting the permanent easement uh of where that storm water drainage will be and the property owner will be assisting in the cost of replacing that uh in the easement that goes across their property. You all received an amended agenda um this afternoon and I wanted to ask Courtney to I typically would not amend an agenda that quickly um but uh they're they're there they're there two things that I think are extremely important um and uh we wanted to get them on the agenda for you all to have the opportunity to vote for them. Uh the first one is resolution R2511-53 which is a resolution to award the contract to FSC Scarbor LLC for our CDBG project. If you remember our CDBG project is the water system uh improvements for Milligville Estates. Uh we received that CD uh that CDBG um
grant about probably 18 months ago now. We've been working on the engineering on it. We've been working on easements for it. Uh, and we're finally to the point that um we have a a contract to award based on um the bidding process that that Jackie um took it through as per our our purchasing policy. Res resolution R211-54 is actually a resolution to an award a contract to that same company. Uh this will be a contract to um to replace the water line on Montgomery Street from Clark to Jackson Street to take an 8 inch line that is currently there out of service. Um and also to run a new uh 10-in line down North Wayne from Montgomery Street to Hall Street. Um both of those areas are areas that that we have had issues in the past. And um we have done the engineering on it. Uh if you remember, we actually u bid out the Montgomery Street project and didn't get any biders on it. So Jackie suggested that we put these two projects together and that that caused us to get some bids on it. Um, I shared with you all when we had uh the water man break on South Wayne Street last week that uh we are working on getting some preliminary figures from the engineering firm on what it will cost to run a new 8 inch line down South Wayne Street from Green to Franklin Street to try to take care of some of the issues that we're having there. Uh once we get those numbers, we might possibly um if I can sweet talk Jackie into it, uh making that a change order on this particular contract since it will technically be an
emergency repair and and have this same contractor do that as well. So, um I believe you'll see dirt being turned up and new pipes being installed by no later than spring. And I'm excited about uh about that and want to get those resolutions on the agenda for tonight. How will they lay the new lines? I'm sorry. How will they lay the new lines?
Uh it'll it'll just t typical laying of lines. They'll they'll they'll dig it up. Uh put the new line down, connect the new services that need to be there. Um, as a matter of fact, in the um in the project for um the North Wayne Street um and uh Montgomery Street bid, initially the con the service line connections were not there. We went back in and did a change order to that be. Everybody had the opportunity to bid on that. Um but um it it'll be pretty straightforward as you would expect installation of water lines would be. I mean, there there's there's really no way to to trench it or to um to try to be clean with it. It's just something that has to happen. But um in these installations, no one will be without water while the new lines are being installed because the current services will stay intact,
right? Um until the new ones are swapped over. Okay. Um the one on North Wayne Street got a little expensive because we're having to bore under the railroad. If you all remember, you all approved uh authorizing the mayor to sign an agreement with the railroad in order to do that some some months back. Um, and uh, the one on Montgomery Street is actually pretty expensive because uh, it really adds to the cost of a project when you have to take another main out of service, especially when it's on a DOT right away because not only will that main be taken out of service, but because it's on DOT right away, it has to be completely filled with concrete.
Um, so that increases the cost a good bit to take that out of service. um just part of what DOT requires on their on their road um subsurfaces. So um I'd like to take just another minute if I could for a point of personal preference, personal privilege rather. Um well, let me back up and just say let me remind you about the employee appreciation lunchon on Friday. Service awards will begin on 11:30 and and lunch will should um start around 12 at Magnolia Ballroom. um provided no one has any issues with it, we will let the staff go home that afternoon after the lunchon is over with as an appreciation for um their hard work. So, with that said, let me see if I can get through this. In June of 2019, you all appointed me the interim city manager. Service delivery was very deep and we managed to get that hashed out between the governmental entities. March 2020 brought in COVID and all the challenges and changes associated with that. Some of which are not back to pre-COVID days even now and probably never will get back to pre-COVID days. Things and people changed um and difficulties have continued even past that. But I think we have weathered it well in the city in spite of the rocky start. You all made me the permanent city manager June of 2020 and we have accomplished many things of which I'm proud of. I won't spend this entire meeting re viewing those, but we've done things
together like updated 10-year-old salary scale. We have spent over $4 million in storm water infrastructure improvements. Um replaced the playground equipment at Central City Park that was so old that Walter played on it. Um at a cost of about 600,000. We became a city of civility and we renewed our city of ethics designation. Um, we purchased a building to utilize and ultimately turn into fire station number three for expansion of our fire department. We upgraded SCADA at a cost of over $975,000. And I can I can give you at least five examples where that has kept us from having a major water failure um since it's been installed. Completion of service line inventory that was mandated by the feds at the cost of $700,000. IT upgrades totaling more than $150,000 uh including uh a new IT company physical plant facilities repair and improvements in excess of half a million dollars. uh resolution 2511 53 and 54 which I just shared with you that will ultimately equate to about a million and a half to $2 million of water infrastructure improvements and soon to begin a $5 million a $50 million um refurbishment of our water treatment plan and and capital improvement plans for um for delivery infrastructure. I shared with you all the night that um I told you all about my retirement date this information and I want to share it again. I'm appreciative of the more than 11 years you've allowed me to work with
the city versus city planner and the city manager. It has been an honor and a privilege to serve you and the people of this my hometown for that entire time but especially over the last six and one half years as city manager. My tenure year has tenure here has been rewarding and I'm incredibly proud of the projects completed, the strengthening of our municipal services and the fostering of a collaborative en environment among our dedicated staff. Millersville is truly a special place, a place that I love and this decision has not been made lightly. I want to express my deepest gratitude to you for the trust, guidance, and support you've given me. I also want to extend profound thanks to the department heads and the entire team of city employees. Everyone's professionalism, hard work, and dedication are what truly make Milligville thrive. I want to say to the public, we ain't mad at each other up here. That's not the reason I'm retiring. Uh, it's just that I'm ready to slow down a little bit. Um, I'm appreciative of you're giving me the chance to manage this city over the last six and a half years. Uh it's the hardest job I've ever had, but in some regards it's the most rewarding that I've ever had. Uh we have worked together, laughed together, fought together, grieved together. Uh and I will forever be thankful for working with you and and for this city. I thought about something that I could leave you all with. Um, and if you've ever had the opportunity to talk with anyone who has been or was currently in the Georgia General Assembly, they all seem to have the same lapel pin that they wear all the time. So, I asked Johnny Grant, who served as our district 25 senator at one point in time, what what what was the meaning of that? And he shared with me that they
get a new pen from some entity every bannual meeting. but that uh the uh at the time the secretary of the senate uh when he was there had um commissioned a pin for the state senate that current senators and all previous senators uh received in war. So I decided that's what I wanted to do with the Milligville city council. So, uh, as my personal gift to you all, uh, I have commissioned, uh, a lapel pin.
