Um but the fact that it was this afternoon when this item was supposed to be here and my email started getting flooded by you know residents the this yes the the um I have some concerns and some questions that I you know I want to deal with it and I think we talked about it madam manager during our briefing um but you know to to have folks you know emailing us yes we understand it's a it's a it's a program that's needed there's also a sector of the community that's really needed the program that's not getting the services that they needed. So, I would appreciate between now and whatever that they coming back, we could have that conversation on how to service all of North Miami, not only those people who could send emails because we do have quite a few of of residents who will love the service um and who is not accessing the service because of language area. And we had those conversation before we get into this um agreement with them that this is a community where you have to do your outreach veracy to make sure that we are touching the residents who really needed the service. So I'm looking forward to have those discussion with them and please tell the residents we get it. Please do not email us. If you have a concern, you could come here, but just and you, you know, it's orchestrated because it's almost the same thing saying about the item and when you have other residents who have serious concern who does not even have a computer or could send an email, that's a that's an issue and I want to talk to the vendor about that. Thank you so much. Um, yes, please.

20:07 – 20:46Speaker 1

Tab R.

Thank you so very much. Public hearing is open on tab R. Seeing none coming. Public hearing is closed. May I? We have a explanation of what the pro what this will do. Any I was ready to um presentation. Um are you asking for just Yeah. Oh, okay. Sure. Um madam manager just explained um the Yeah.

28:37 – 29:08Speaker 1

So, this is a request of Councilman Charles to formalize and codify procedures for city recognitions, including proclamations, certificates, and keys to the city. Awesome. What? Let's go in. I didn't know this was included. The Which tab is this, Councilman? It's your Can you explain? Yeah. No, no. Quickly. Uh sir, it is basically um

29:06 – 30:12Speaker 1

I was saying uh in the past three years that I've been here um we just don't have really a process or procedure in place for our key to the city proclamation and um certificate. Uh it is res residents are you know asking questions especially um for some um key to the city that um uh was awarded to uh um some um not I'll say not people but was awarded to uh people with not such a good standing moral standing and everything and then and then the question arise and also Um it is a way for us to be on one um line when it comes to um key to the city because sometime you go to an event that we giving the key to the city. There's not even one of us um up here to um give to the uh the key to the city uh the key to the city. And um

30:10 – 30:51Speaker 1

wait wait wait no proclamation. You mean the key is proclamation? Yeah. Proclamation is one. There was a case that we um gave a key to the city at um at FI. I think the event was held at FI to one of those artists and a lot a lot there was a a lot of complaints about it and everything. So we just basically um shaping it give it a form for us to um to follow and there was even um cases that when it come to proclamation we just issue them proclamation and then we just put the signature signature everybody in it. So there is nothing to follow. That's basically that's basically it. Um that's the [music] reason.

30:48 – 31:31Speaker 1

No, I support that 100%. Cool. Yeah, that that one that I think that was an unfortunate um situation and we don't want to go into the detail and you're right about that one, but it it all came from internal um how that you know the whole thing happened and you're right. So, we good. Um public hearing is open on the item. Um and I'm glad this is we are formalizing it. Public hearing is closed. I have a question. Go ahead. Sorry. I have a question on the certificate of recognitions or the certificate of achievements. Um what is that? On page three of five um under C um number C.

31:28 – 32:10Speaker 1

Um it says that um a council person is limited to one per calendar year um as a certificate of appreciation. you know, would that have [clears throat] we've done those and it's it's just to thank an organization or individuals for maybe something that they do in the community without doing the process of a a proclamation. Um, I think those since they're individual certificates of recognition and achievements and it usually only has one council person's um as a sponsor and only that person council person's name on it that it should not be restricted to just one. Yes, maybe we could

32:08 – 32:32Speaker 1

as opposed to a proclamation when we're all signing it that has a different magnitude. I I I [snorts] agree with you as well, but also I I I think I understand where the sentiment of the and I and I like the suggestion of maybe increasing it to whatever. I didn't even know we had [music] um the certificate of um appreciation.

32:29 – 32:54Speaker 1

I usually just thought it was um you know proclamation or etc etc. So, if it's a certificate, even if it's only you, believe it or not, there's things that I don't even know um you you you give to someone, they call me and thank me or do something because I'm like, "Oh, okay. Well, you're welcome." So, yeah, I I do think um you know, I I I like the the resolution, Councilman in the

32:52 – 33:34Speaker 1

Yeah. Yeah. We can we can always we can always fix that. Um, Councilman Burns, um, I would just leave I wouldn't put a number that the person No, as far as certificate goes that um, you might have an organization and there might be three people on that organization that you want to recognize. Okay. And so that's three and then you don't go. So yeah, you don't go overboard, but um, uh, I I think that that is uh, uh, would be reasonable. Now the proclamations I agree very limited on the proclamations and I know there's been a question about the signatures. Um how will this make the signature stand? Will they be wet or automatic?

33:32 – 34:06Speaker 1

So I guess that was what I was going to bring up a couple a couple of points. Um the first one is that the way that it reads right now I know you all to some extent have [clears throat] like stamps and we get them from some of your staff. Yes. If you don't want that, no don't any more of that then that would take that out and that means individually you have to be present to sign yes any of the proclamations. So in the absence then there won't be there. Can I can I say in the legislation in our absence if we're not here I think if I would say with written permission

34:04 – 34:46Speaker 1

that's what I'm saying I would say so and then say okay signature with written permission so to make sure we would get it a confirmation that way it's a little bit easier in terms of getting them because a lot of times the proclamations come to us last minute so if that happens and we're waiting for wet signatures we may not be able to have them for events. Yes. So I was going to talk about putting that in as I so that would be on B1 that the digital just the digital not electronic because I don't you know the digital signature the stamp is allowed with written permission and I've written well even if I send an email

34:44 – 35:19Speaker 1

just with permission I don't think we need to be specific on the just with permission because they could text me they could whatever any of us that's written yes no I know but I'm And if they if you somewhere they just talk to you it's fine also you know they don't have to tell you send me a text or email me whichever whichever mayor I I would feel more comfortable with written permission that's fine then we a lot of times like you said that some of us as long as we okay meaning that if I if if vice mayor said okay my aid could you know whatever I think that's okay if that's what we want we okay with that we just have to

35:18 – 36:02Speaker 1

anything the other thing I just wanted to point out and maybe for the C1 which is the certificates of recognition. I'm reading it as limited to one recipient per event per calendar year. Right. Take that out. Oh, no, no, no. No, no. What she said, so it's one person per event. It's not one the way you you you stay. It's not one per calendar year. So every time you do an event, if you want to give somebody, you can give them a certificate of recognition. So it's not stopping you to one per year. And if this is an organization with four or five, it's one organization. I don't think we we saying you know like one organization there's five people you want to give. I think they say one that organization that's it for that year. Okay. I'm fine with that.

36:00 – 36:39Speaker 1

Yeah. Yeah. It's one Yeah. per event per year. So if you do 12 events you you can give out 12 certificates of recognition. Okay. Okay. That makes sense. We normally also have been given the uh how will the proclamations for the officer of the month 12 times. So u that that isn't going to interfere the this new policy won't interfere with but that's still per event and it's a different person so it's fine. But not only that though, I think there has to be something in there with the exception of if it's internal like we do proclamations for different we [clears throat] boards boards

36:37 – 37:16Speaker 1

something that that occurred a couple weeks ago when when I wrote that the the member it was specifically ex the external that was coming in and it was getting to the point where you we had some actors that would go to each of us not thinking that we would know because they know whatever the cases of sunshine whatever and they'll X us for five, X this one for six. By the time you get it, one person is getting 20 and I was in another and somebody called me from from Haiti. They said, "Man, we just got something from you." I said, "You did?" [laughter] And when they I said, "Oh." And and I'm like, "You know what? That is very dangerous for all of us."

37:14 – 37:59Speaker 1

Um because you know, you don't know if where your name is would be or your signature, what whatever the case is. And you know, so okay, this is good. Um Councilman, thank you so much. Um, and what has the policy been when we're um I know I've gone to some view not viewings or funerals um for funerals and stuff and we present. Is that a statistic? Yeah, I don't think Yeah, that's different. Yeah. Sympathy. Sympathy resolution. Sympathy resolution. I don't think we touched those. Um Kevin, I think they're already done. You know, [laughter] move forward. They're not in there. Seconds. All right. Um, Councilwoman Esme Irving, the sympathy is not in there, right? Part of this one. No, it's not in here. Okay.

37:58 – 38:35Speaker 1

I have a motion made by Councilman Charles to approve the item at Tab R. Motion was seconded by Councilwoman May Irvin. Councilwoman Mr. Mayor, how do you vote? Yes. Councilman Charles, how do you vote? Yes. Mayor Desme, how do you vote? Yes. Councilman Burns, how do you vote? Yes. Vice Mayor Timothy, how do you vote? Yes. Motion carries with a 50-0 vote. Thank you. Thank you so very much. And we did open public hearing on this item. Yes. Okay, we may have to change the public hearing process where we possibly do it if we could explore maybe at the beginning and then like mo most cities um you know do it. Um, tab S.

38:34 – 39:00Speaker 1

Tab S. A proposed first reading ordinance of the mayor and city council of the city of North Miami, Florida, amending chapter 2 of the North Miami code of ordinances entitled administration by repealing article 3, division 4 entitled community relations board, thereby abolishing the community relations board providing for repeal, conflict, severability, codification, and foreign effective date tab S.

38:56 – 39:40Speaker 1

Thank you so very much. Um public hearing is open on tab S. Okay, seeing none coming. Public hearing is closed. Um madame manager, I I know we all been explain unless any of any members up here would like further um explanation to the resolution or the ordinance. Actually second it. I have a motion made by councilwoman as the mayor to approve the item at tab S. The motion was seconded by Mayor Desameé. Councilman Burns, how do you vote? Yes. Mayor Desome, how do you vote? Yes. Vice Mayor Timothy, how do you vote? Yes. Councilwoman as the mayor, how do you vote?

39:40 – 39:55Speaker 1

Yes. Councilman Charles, how do you vote? Yes. Motion carries with a 5-0 vote. Thank you. Thank you. Quasi, now I do not have any any cards. Did they submit anything to you, Madam Clerk? Not yet.

39:53 – 40:38Speaker 1

Okay. Thank you. Please be advised that the following items on the agenda tabs T and U are quasi judicial in nature. If you wish to speak in favor of, object to, or comment on an item, please complete a public speaker card indicating the agenda item number on which you would like to comment. You must be sworn before addressing the city council and you may be subject to cross-examination. If you refuse to submit to cross-examination, the city council will not consider your comments in its final deliberation. Please also disclose any expparte communications you may have had with any members of the city council. City council members must do the same. Thank you. So just a reminder there are I would love to demo public speaker cards but they were so beautiful they stole them.

40:36 – 41:21Speaker 1

They did. So you might find them in the front of chambers. So tab T, a proposed quasi judicial resolution of the mayor and city council of the city of North Miami, Florida, approving the vacation, abandonment, and sale of a portion of a city-owned alleyway located east of 12255 Northeast 16th Avenue and north of Northeast 122nd Street. Further authorizing the city manager to negotiate the sale of said section of public land and [snorts] to take all necessary steps to effectuate same, providing for an effective date and for other purposes. Tab T. Thank you. Thank you so very much. Um, is anyone here? Do we swear them in now? Um, madame clerk, would we?

41:18 – 41:45Speaker 1

If you'll be speaking on tabs T or you, please stand and raise your right hand as I administer the oath. Do you swear or affirm that the testimony that you are about to give in today's proceedings are the truth, the whole truth, and nothing but the truth? If so, say aloud, I do. I do. Thank you. There's four people. Okay. Thank you. Um, Debbie, hi. Happy New Year.

41:42 – 43:40Speaker 1

Happy New Year. Uh, good evening, mayor and council. For the record, Debbie Love, Community Planning and Development through the city manager. Um, as, uh, the title reads, this is a an abandonment of a segment of an alleyway. Bear with me just a moment, please. We have to do this a little differently. This is 145 lineal feet of a platted 15 foot wide alleyway. Uh the highlighted red area is the portion of the alleyway that is the the applicant is seeking to be abandoned. It's uh located east of 12255 Northeast 16th Avenue. Uh the adjacent properties to the west um is the 12255 and then to the east that's an adjacent parking lot. They are both owned by the same [clears throat] owners uh 1590 Northeast Holding LLC and they are the applicant requesting the abandonment. And as you all know, uh, the approved abandonment goes half goes to each property. And since this is owned by the single ownership, they will be responsible in in its entirety of um unifying the properties assuming that you all approve the abandonment. the adjacent property owner seeks to utilize the uh that segment of the alleyway to create a more economically viable parcel uh and to enable cohesive site planning. They are they went before planning commission at the beginning of the year. Planning commission unanimously recommends approval to

43:37 – 44:21Speaker 1

Cynthy Council. There were no objections received to this um abandonment request by the public. We did uh as required by our charter and our LDRs requested and uh commissioned two appraisals of the property. They came in at 250 and 245 from the two um uh appraisers. And the charter requires that the purchase price be no less than 90% of the highest appraised value and the city manager would be responsible to negotiate that sale with the applicant.

44:20 – 45:03Speaker 1

I'll take a moment, one second before you go. I I have spoken to the applicant um and they profered which we agree with is a $240 $240,000 price which is about 97% of the value of the from the from the lowest appraisal. Madam, would you say that number again for me please? Madam 240. Is your mic on? Your mic is it on mine? Yes, it's on. Okay. She said 240. Um Miss Love, let me ask you. So, was was there three appraisals that was done with with that one? It was two appraisals. One at 250 and one at 245. Okay. And you say 245. No, I said 240. Okay.

45:00 – 45:44Speaker 1

Um because originally the number was 245 and 240, but 250 and 245 and that the 240 came to an agreement at 97% of the lowest appraisal. Okay. But why are we not at 100? That that was you can go you we can go to 100. I'm saying if we selling it which you know I don't mind but we should get as much as so that would put us at 250 at the highest. No I'm not saying 250 but I don't want us if it's coming at 240 and we reducing it for them. I you know I don't mind at 245. I don't think we need to leave anything on the [clears throat] table um where we are. Yeah.

45:41 – 46:20Speaker 1

Anybody else have any you Mr. mayor at the 245. I'm sure the applicant um knows he's getting a good deal. Oh, yeah. They getting So, uh um I would also agree with you on the 245. Anybody? Um I'm just going to disclose exparte communication. I did miss the applicant. Um and I'm okay with the 240. I know um I met with the the applicant. Um we talked about what beautifification projects that we can do um around the area especially with the development that they're coming that they're bringing forth. So that's just but what I'm what we saying is no no you you say you want to go to the

46:19 – 46:38Speaker 1

I know I'm I was saying what you're saying I agree with um and thank you for reminding us because I totally forgot about it. I did have um expert day um communication with um I guess with the consultant of the application of the applicant. Um you council

46:37 – 47:16Speaker 1

I I met with the applicant and their lobbyist and maybe their attorney and but I want to keep it I want to keep it focused just on this piece of property. Uh not what they're going to come before us for the property across that'll be a whole different set of community standards or or benefits. Okay. Um, but this one again, we're vacating a particular city alley and we've done this more and more now where we're trying to get closer to the 100 and I think if we're taking the the 245 um I think it's a nice little compromise. It's only $5,000 difference um to go into the city coffers. Thank you.

47:14 – 47:57Speaker 1

What is our What is our um It says that we have to accept no less than 90%. Correct. Or Yeah. No less than 90%. And so 90 of 90% will have a square where well generally we were combining them and then putting it by 90%. So you would take 250 plus 245 um add that together divide that by two and then 90% of that. So that's closer to about 225. Yeah. No. So, so we're actually So, cuz normally it would be just be the 90% is what we take and I know when we've aband so we didn't so we we were from the last time we got into the process of like we were leaving 10% on the table most of the time and so

47:56 – 48:40Speaker 1

which seemed that the consensus was not to leave 10% on the table but having seen that we've gotten to that that pattern we went you just kind of negotiated in between. Yeah. even though we're moving towards, you know, not leaving that much on the table in terms of the monies whenever we're negotiating. Yeah. Which is which is fine because normally historically I I used to vote against these items because I hate giving anything that's public onto the but over the years I've gotten to the middle on that. So that's why I don't want to leave any any dime on the table because you know you're going to hear from the residents. They probably don't know it but once they you know at least we could do that. Um, councilwoman um, parte communication with

48:39 – 49:15Speaker 1

Yes, I had exparte communication with the applicant and his representative. Thank you, Councilman. Uh, yes, I, you know, it's been a year a year ago, 2025, but I remember um talking to uh the other applicant about um Yes. And that's the problem a lot of these times. Um, and we got to be careful because we don't want to get in trouble. We may have a conversation and we forgotten because one person representing 10 people and you don't know what they talked to you about but okay. Thank you so very much. Um, thank you Miss Love. Is she still Is she done yet? She's done. We do have some conditions.

49:13 – 50:04Speaker 1

Oh, okay. Go ahead. for the abandonment that after the payment in full is received and the city will issue a deed, they will have to provide easements as required by um public works and or the uh different utility companies who have utilities within that easement within that alleyway and within 45 days of approval they have to unify the property. So, it's a quick pay us, issue the city deed, now go and unify the properties and get it recorded. And with that, um, again, that's the steps involved in and to close this out and we try to move on them expeditiously. That's the end of my presentation. The applicant is here if you have any other questions.

50:01 – 50:23Speaker 1

No. Um, no. We try. You got questions? Question. Yeah. Oh, god. Okay. Just real quick. Okay. for the applicant or from um the lawyers here. Oh, hey, good evening, Ethan W. Good, good. Happy New Year. Uh on behalf of the applicant. No, we I said happy new year. Happy New Year. Thank you,

50:22 – 51:06Speaker 1

Ethan. I know it's not part of the city's sale, but um you had made a comment and the applicant had made a comment at the planning commission that because of the concerns of the retail center that faces 123rd Street that you all were going to uh uh reach a mutual agreement between the two parties. It's a private between you both, but just want to have it on the record that the city is aware of it that you're going to allow that shopping center access through your uh parking garage or however you all figure it out. Is that correct still? That's correct. And we have that a settlement agreement and an easement already executed between the parties. So, we're here tonight with the support of our neighbor that came to the planning commission.

51:04 – 51:48Speaker 1

Okay. And um and and your applicant wouldn't shouldn't have a problem with uh paying us the 245, should they? No. No, they condition question. Um Ethan, while you're here, this is um the entrance to the whatever we call the Grand Mololis, correct? No, the truth is the other one. Okay, you talk about the the 116. Okay, the faces 123rd Street. They were concerned about that alleyway in their truck, but they have come up with a an agreement that everybody's happy with. Okay. Thank you so very much. Thank you. Thank you, Ethan. So move second. I would move it with the

51:46 – 52:29Speaker 1

245 price tag that the applicants attorney has agreed to. I'll second it. I have a motion made by Councilman Burns to approve the item at tab T with $245,000 being the sale price. The motion was seconded by Councilman Charles. Um, wait, wait, wait. I made the motion. Okay. He corrected the amount, but So, you accept? I mean, I don't mind. He with the two. Correct. No, no, no, no. I had to remade it. You went and corrected mine. So, I kept my motion as it is with the amendment

52:27 – 52:58Speaker 1

that we which you heard, madam clerk, the amendment that we talked about. Motion made by mayor. Seconded by Charles. Vice Mayor Timothy, how do you vote? Yes. Councilman Charles, how do you vote? Yes. Councilwoman Estee Irvin, how do you vote? Yes. Mayor Desme, how do you vote? Yes. Councilman Burns, how do you vote? Yes. Motion carries with a 5-0 vote. Thank you all very much. Have a great night. Thank you so much. Um Tab Oh, wow. This is great. At exactly 7:59,

52:57 – 53:54Speaker 1

don't jinx it. Keep it going. Keep it going. Tabu. A proposed quasi judicial resolution of the mayor and city council of the city of North Miami, Florida, approving an application for a site plan in substantially the attached form for a proposed development consisting of an 11story 18 unit residential building on two parcels of real property located at 1998 Northeast 135th Street identified with Miami Date County Folio number 06-229-00008-0060 and 06-229-008- 0061 and totaling approximately 0.34 acres in accordance with article 2 division 7 section 2-701 and article 3 division 2 sections 3-204 through 3-206 and article 3 division 3 section 3-302 of the city of North Miami code of ordinances chapter 29 entitled land development regulations providing for an effective date and all other purposes tab you

53:52Speaker 1

tab you and we have a whole presentation

53:54 – 55:52Speaker 1

once again for the record Debbie love community planning and development. Um this site plan approval uh is the um it began with a conditional use permit and it is now coming before you for final site plan approval. It is located at 1998 uh northeast 135th. The property consists actually of two lots uh about 15,000 square ft. Uh one parcel contains a duplex and one parcel is uh developed with some parking as you can see on the uh slide in front [music] of you. It's zoned R six, which is highdensity residential, and it allows 110 feet in height and 25 dwelling units per acre with an additional 25 dwelling units per acre through the conditional use permit, which would allow up to 34 units and 10 stories of project. Again, you all approved this project um in its uh con conceptual form back in October and uh you allocated nine additional floating units because they have eight currently um as of right and so you all allocated nine additional units. So the project actually is an 11story 18 unit luxury condominium development. The project consists of five five bedrooms. The all the units are five bedrooms about 3,300 square ft each. It has an integrated parking garage with 38 spaces which is 10 more than the code actually requires them to have. They're going to be certified green build. um Florida native vegetation. The lot coverage is well below the max 80%. So they do have a

55:48 – 56:54Speaker 1

excess an excess of open space. They have an additional landscape buffering and permeable paving along 135th Street frontage and that will definitely improve the storm water absorption and help with the urban heat island effect. The DRC approved this um in um just recent just in in August actually. I think that date is incorrect. My apologies. Um consistent with uh the conditions of installing and maintaining a 10-ft wide sidewalk along the 135th frontage. All the utilities must be underground. As you know, we all that's one of our requirements and they have to plan apply for a building permit within 18 months of site plan approval. And with that, that's the end of my presentation. The applicant is here with a brief presentation and they are here to answer any additional questions you may have. Thank you.

56:54 – 58:04Speaker 1

Good evening, Mr. Mayor, Madame Vice Mayor, members of the council. Rachel Striderfeld's law offices at 7275 uh Northwest First Court. We just moved. Sorry for that. Um it's my privilege to be back here on behalf of the applicant, the Shelton Miami, Inc. Um, as Debbie stated, we did have approval of our conditional use permit back at the end of October and the application, uh, the project rather has not changed at all. Um, we went through a more diligent, detailed review with DRC on our site plan. Uh, we meet your comprehensive plan, future land use element. We meet the underlying requirements of the R six zoning district. We meet the city's sustainable building development standards and of course thankfully we have that conditional use permit that allows us 18 units. Our esteemed uh world worldrenowned architect Kobe Karp is here to walk you through the project. Kobe.

58:10 – 58:54Speaker 1

Sorry. Um my name is Kobe Karp. Number one, it's a pleasure to be here in front of you. Happy New Year. Um, since Miss Debbie Lav and your staff has been so helpful to us and she has made such a good presentation. I presented to you last time. It's an honor to be here. This project is a very unique project and we're very proud um to work with your staff on this project and uh looking forward for it. If you have any questions, suggestions, I'm here u for any questions. Thank you. Thank you so much, Mr. Karp. Um, public hearing. Well, no. Um,

58:50 – 59:03Speaker 1

I didn't get any cards, so we we um we done with that. Council members, this is in what district is this? District one or two? Okay. Um, Councilman,

59:02 – 1:00:14Speaker 1

um, I want to say that I I've met with the uh the attorney and the uh the applicant um because we held uh two two or three community meetings and the community uh um was able to have uh their say and um overwhelming uh was supportive of the of the project and I think they made the uh the point when they received their conditional use permit. Um nothing has changed since then. looking forward to it. Um, I understand that be to get the 10-ft sidewalks and the uh uh additional parking for service vehicles so they're not in the roadway. Um, I had asked that uh two of those black olive trees be removed and you're going to overenhance the the landscaping and that nothing has uh come out of that. um because I know we're trying to be uh stricter on removing those trees, but on those particular two um that uh it was necessary to be able to recreate your particular project. Um I'm still supportive of that, but uh the community is looking forward to it and uh hope you move forward as fast as possible.

1:00:13 – 1:00:58Speaker 1

Thank you. Thank you so much, Councilman. Any any comments? C um vice mayor? Oh, nothing. No, I haven't met with the applicant since the last meeting. Okay. Um, and I've I I've traded um text, but we haven't met. I think we met um I think the same time around. You um vice mayor. Thank you so very much. Um Madame Clerk, um do we is it has it has it been moved or move approval? Second. Second. Okay. I'm sorry. [snorts] I have a motion made by Councilman Burns to approve the item at Tabu. The motion was seconded by Councilman Charles. Councilman Charles, how do you vote? Yes. Councilman Burns, how do you vote?

1:00:58 – 1:01:42Speaker 1

Yes. Vice Mayor Timothy, how do you vote? Yes. Mayor Desme, how do you vote? Yes. And Councilwoman Esté Irvin is not present. [music] No. So will we. She's gone. Thank you so much. Congrats. Thank you, Mr. Mc. Thank you, Mr. Hu. Happy New Year to you. happy and healthy. Thank you, madame mayor. Thank you all. Have a wonderful evening. Same to you, ma'am. Thank you so much. Discussion item one was removed um regarding the So, we are moving the because of date days, right, madam manager? Um um the moving of the election. No, of the 10th of the Well, yes. You know what I'm saying? You already moved the election. Mayor moving of election.

1:01:41 – 1:02:25Speaker 1

We already got enough going on in this country. I'm not trying to cancel February. [laughter] That's not what I I misspoke. And thank you, Councilman, to correct the record. Moving of our next council meeting. No, no. Cancelling cancelling the February 10th meeting. We would not be able at the beginning of the month, but they went um we will uh a majority of the council will be at that date. Absolutely. Yes. Thank you so much. And I don't think we need a um a vote for that, Madam um attorney. Do we? Yeah. But you're not rescheduling the date. There's perfect notifying you that there is no forum. Thank you so much. Um, citizen forum.

1:02:23 – 1:03:06Speaker 1

I see Bill here. This the favorite part of the of the night. Bill, are we good? Amen. Mike, we good. We good. Okay, perfect. Um, all right. Council citizen is closed. Um, council report. Vice Mayor. Oh, council report. Me. Um, happy new year everyone. I know it's our first meeting back. Um this upcoming Thursday, we'll be at the library with our with our property appraisals office um in Miami Dade County. For any folks who has questions regarding their homestead exemption um any questions regarding applying for them, they'll be there to assist on site. So that's this Thursday from 5 to 7. And I think that's it for me.

1:03:04 – 1:03:31Speaker 1

Yes. Um in fact, somebody came yesterday. Well, no, today and I sent them the information. So, you know, a lot of homeowners are calling. So, great job. Thank you. Thank you. And council councilman. Um, just a couple things. I want to thank the city manager and the public works director and the workers um that responded quickly last night to a uh

1:03:27 – 1:05:14Speaker 1

uh large water break on Alamanda. Um, but I have a question, Madame Manager. We believe we know who damaged it and um that we follow up to make them um liable for that damage that they may or may not have uh reported to us in a time timely manner. I'll just leave it like that, but that we follow up that um they are held accountable for that. And also, um, I have a question, um, through the manager, through the the building department, um, having three homes under construction directly across the street from me at one time, um, uh, the music blaring throughout the course of the day and the blocking of traffic. So, I know we have some standards that the building department um, requires of the developers to maintain. Um they need to realize these are single family neighborhoods throughout the whole city that um they're just running rough shot there. Nobody's policing the overparking. We had a meeting with the developers uh five six months ago to have a meeting of the minds that they need to behave themselves when they're in the uh the neighborhoods. It's [clears throat] not like they're doing a commercial project somewhere on a highway that uh they're leaving industrial size um large trucks and tractors and so forth out on the swailes, not up on their uh construction site um and they're uh littering the neighborhood. So, if the building department or code enforcement can keep a little um pressure on them to remind them to behave themselves and enforce any code that we have as far as uh uh construction equipment left outside of the job site would be helpful.

1:05:12 – 1:05:30Speaker 1

Okay. Please leave the addresses of the places. That's it, sir. Um and that's about it for right now. Yes. Awesome. Thank you so much, Councilman. Oh, thank you, uh, Mayor. Happy new year to you and uh to all my colleagues in here

1:05:28 – 1:06:34Speaker 1

and happy new year to uh to our staff and uh all our resident um district 4. I just want to say thank you and um I would like to extend my sincere thanks to our parks and department and staff uh farm share the office of state representative wireless police uh for their collaboration on uh our district 4 food distribution this past Saturday. Um together we're able to provide um about 500 household with fresh produce and dry goods supporting families throughout our community. Um to that uh I see something and I had a conversation with uh the manager about it. Um I think the system that we have in here for registration is outdated. We need to uh find another way that is more efficient for us to uh do registration when we have food distribution. It take more time to register uh the the the residents than to serve them.

1:06:33 – 1:07:12Speaker 1

Councilman, I'm already on them. Uh I'm already [laughter] on it. City manager already has a a built-in app that's getting ready to roll out. Thank you very much, Vice Mayor. So, we need we need something that is more efficient and again um thinking to that Mhm. Go ahead. No, no, no, no. Once you done, I want to add I like that. No, the engineer actually Yeah. No, the engineer actually built it where they'll have it in your like you can once you verify where you're from, it'll tell you what district you are. It can be in your Apple wallet or, you know, Google Play digital print like over and over. Use it over and over. Yeah, we're working on it now. I remember we we had I

1:07:10 – 1:07:47Speaker 1

No, no, I'm glad he mentioned it because it was at back to school. The event was from like 12 to whatever time it was like from 5 to 7. The the the registration was still going and the event was over. Yeah, it was there was Yeah. Yeah. We we I'm I'm glad that we we are doing this type of work. There was one app that we're trying to bring in to replace the Nomi app and that. So, please as long as we make sure it respond to all of our residents and that usually be the challenge part. So, that's good. Yes. And and also um what I'm seeing is that a lot of u people were double dipping. Oh yeah, you

1:07:44 – 1:08:23Speaker 1

so they go on and back again and again without even thinking about it like you stop somebody else from u getting some food. So I think with a with a new system that if we scan the eye or whatever it is that you can see that that has been scanned already and then you get the food so we not going to serve you. So something something of that nature. Okay. No, I know. I know. We in a digital age. No, it's a good idea, [laughter] but those people council ment when when designing the app so that you know we know they'll tell you somebody took my ID from my president. You know, it's good.

1:08:21Speaker 1

And uh another note, I also want to thank um city administration, especially uh madam manager.

1:08:28 – 1:09:52Speaker 1

I remember two weeks when uh when we had our first work tour over to Pepper Park. Well, what a lot of residents are complaining about is a hangout at the parks very late at night um 2 in the morning, 3 in the morning, you still have hangout um there. And then we had that conversation and um quick u she went on and then we got [music] gates installed on all those parks. Pepper Park um Suniss Sassool uh Griffin Community Center is just in district 4. So, I just want to say thank you to that because in here in the city of North Miami, we always look at safety of our resident, safety of our facilities. So, I just want to commend you for that and say, um, thank you. And again, um, resident, we're going to have a great year. Um, our code district 4, I just want to say our code department, they doing what they're supposed to do. Police is doing what they're supposed to do. Um, I know we need change and we want it now. Understand that it's not going to happen overnight. It's not going to happen overnight and there is no way that everything that needs to be fixed will be fixed overnight. So, we just ask a little bit of patient and understand that they are working. They are working. Uh, we're doing better and better every day. So, uh, lastly, I would like to wish a very happy birthday.

1:09:51 – 1:10:35Speaker 1

No, no, no, no, no. I cannot take that. No, no, no, no, no, no. It's on my one of my madam manager. She's mine. Oh, no, no, no. Okay. I made her come to work. I I take that back. [laughter] But um to um uh leave it there and u madam manager will um take uh the lead on that. So I'll just leave it and uh thank you and thank you um welcome back. So uh Mr. Mayor, thank you. Yeah, believe it or not, um we thought that the meeting was going to last forever and then we on time. Thank you very much. And I just want to say um hello to uh father who's here.

1:10:32 – 1:11:11Speaker 1

Uh and stay thank you very much father. Oh, appreciate you. That's why either ended at 8:15. That's why vice mayor that's why the meeting went so smooth and quick. We had the Lord was in here throughout the entire bill. Now what you trying to do? You trying to speak when we allow you to speak? Oh, it is Father Fraser's birthday in Holy Family. We We call it Listen, you got 15 seconds, Bill. What do you We can't accept no gift. What is that? No, no, no. Is it over $50? We can't accept it, Bill. Oh, everybody here. No, but for what purpose? Wait, wait, wait, wait. For what purpose, though?

1:11:09 – 1:11:29Speaker 1

Is it for for the the for the centennial? For what purpose? It's Well, I'll tell you. Mhm. Um, no, no, no. It's 15 seconds. Just tell us. Well, it's William Prevetel, 12,000, uh, 11930 North Bay Shore Drive.

1:11:27 – 1:11:59Speaker 1

Uh, thank you for continuing Citizens Forum for me. I just I thought it had not happened. Um, I've been spending some time in S. You don't want to go outside necessarily these days and uh I I was watching TV and I noticed that our vice president uh I don't like to get too involved in politics, but our vice president was warning that hey, there are a lot of rapes and murders going on. A lot of rapists and a lot of murders happening. And I figured, oh my goodness, he he probably knows. He goes between New York and Washington and

1:11:57 – 1:12:41Speaker 1

Mr. Bill why we have the whistles. That's what I want to know. That's I'm getting to that's right and he's saying that there's this and I thought right and then again there's nobody been held accountable with these thousand plus rapes that took place in the Epstein files really only one woman is partially held accountable. I thought this is a problem. This is a problem for our community and that our community should have an initial stockpile of rape whistles. No no no no. I'm glad. Okay. Stop. Stop. Bill. Okay. Thank you so much. But we cannot accept that. They are rape prevention. Listen, Bill, Bill, Bill, I I get it. I appreciate it. If you didn't say anything, it would have been good, but we cannot accept that. You mean you're pro rape? [snorts] Bill, Bill, Bill,

1:12:39 – 1:13:23Speaker 1

that's not I'm going to have to put you out. Listen, listen, my friend. We've been good. Listen. And you are not even supposed to be speaking. So, I'm saying to you as a government, we don't we cannot get involved. I thought you were giving us this for the for our um centennial. Um if I was giving out mugs or something else, that would be fine. No, no, no. We're in into our No, no, no. Listen. You go up to DC and deal with them up here. Don't bring that down here. These are purely for rape. They don't work for anything else. Go up to DC. Listen, that's fine. Thank you, Bill. Thank you. We appreciate you. Um, my report, I don't have much. Um, but the event that the vice mayor is Sorry, sorry, sir. We We still in an official meeting. You could do whatever. Yeah, leave it whatever you want to do. But yet,

1:13:22Speaker 1

I can't tell you what to do. You could do whatever you want. Whatever you want to do, Bill.

1:13:26 – 1:14:28Speaker 1

You got it, sir. Thank you. So, um again, Coun um Vice Mayor Tim Timothy's hosting along with um Commissioner Malen Bastian and our um property appraiser um Mr. Regalado on um Honorable um Regalado on Thursday at the North Miami Library. Please please come out. It's there's um folks who wants the benefits about um all the different things that they could get in in terms of their homes um property appraisal anything um this is the information this is the time to to come and learn more and especially for seniors they do have um additional discount other than um the one that you are currently getting on your property um taxes. Also the city is turning 100. We're already We're like two weeks away. Less than two weeks. On the 5th. Um, right. The 20. [music] Yeah. So, the 5th of February, we're going to have is it the carnival or carnival or something?

1:14:26Speaker 1

Carnivals around the world. It'll be right here.

1:14:30 – 1:15:25Speaker 1

Okay. Okay. Right here. So, we're inviting everyone to the carnival around the world. So, Bill, maybe that's a good idea. You come then you give. There you go. All right. Thank you so very much. Now, city madame clerk report. Just want to record tab U as being four a four zero vote. All right. Uh from my report uh to start February 13th, the city clerk's office is having the mobile DMV. So for anyone who needs to renew their license, get any permits, or get their ID done, you can come and do that at that event. It'll take place at the North Miami Public Library. I'd like to wish a very special happy birthday to Miss Anna in the front and how many people are on your list so I don't because

1:15:22 – 1:15:34Speaker 1

Okay, perfect. So, uh, Roberto from my office and of course Geette who is in the room with us. Happy birthday. And

1:15:35 – 1:17:33Speaker 1

I think it would I wouldn't be me if I didn't mention the fact that there's a lot of fear and uncertainty right now, especially around the deadline that's coming up next week. And I think a lot of families and neighbors who are aware that their neighbors are in this state of confusion, but also concerned for the rest of their lives are are coming out and and trying to seek help. And I understand that it's in a lot of ways very limiting. But I think on the whole, North Miami has always been a place that has come together and really tried to to help each other rise. And I think that that's the posture that we really have to take right now. I think it's okay for us to want to and to actually support respect for laws, but I also think that it's okay for us to also stand against cruelty. And I think that it's also important for us to be able to talk about the things that are of real concern to us without also making people targets. So in this time, I think it's really important that we find it in ourselves to have compassion for each other, grace for each other, and maybe taking time to really reflect on those things that unite us because a lot of us have some shared experiences. is either we were translators for our parents when we were kids. You know, folks who work multiple jobs to make ends meet, kids who are home alone not knowing if their parent is coming back and then 3 4 days pass, a mom is finding out that her kid was picked up and detained somewhere far from her. So I think that there's a lot happening and I think that if we can

1:17:31 – 1:17:51Speaker 1

be just a little bit more compassionate and focus on the humanity of it all, we can overcome this time. So that's all I have to say. Thank you so much. I'm sorry. Thank you, Madam Attorney.

1:17:48 – 1:18:29Speaker 1

Yes, mayor. Um, and city council members, I wanted to give you an update on the Bell House Apartments litigation regarding the outstanding loan obligation, which has not been repaid back to the city. Um, the city did enter into a settlement agreement with them whereby we gave them until December 31st to repay their loan obligation and they have not done so. So, I did want to report with to you that we we still have that amount outstanding and we will be working with outside counsel to proceed aggressively in the litigation at this point. Oh, awesome. Because I believe our statute of uh limits is uh quickly approaching. Correct.

1:18:27 – 1:18:49Speaker 1

Okay. And then um it could come back to cause us a lot of problems if we don't collect that money. Correct. Okay. Thank you. Thank you, Madame Clerk. I'm sorry. I must have madame clerk on my mind of evening. Madame city manager, your report.

1:18:47 – 1:19:18Speaker 1

Um I have one report. They um as we're getting ready to go to day days, um there is an item that might have some uh impact to to North Miami in terms of what u Miami date has requested and has requested for appropriations. Um if that's the case, we may need to um assume one additional lobbyist because we would have two lobbyists that have conflicts

1:19:15 – 1:19:57Speaker 1

um based on their representations of those who have interest separate to us. So being that it's a very short time uh time frame between now and then. At that point, if there is one, I would try to speak to each of you guys individually and look to have someone for a short term if we need to to go to Tallahassee. um if we're conflicted out. Ye Yes. But [clears throat] in in and I know we lost two of our council members. I think we need to for you to poll and and figure out and see strategically. And I think that's something that we got to be strategic um about it and and what how we're going to respond. Yeah.

1:19:54 – 1:20:37Speaker 1

As a city. And I don't know if this is maybe the the timing is kind of weird because we have the meeting before the next meeting and we need to figure out what we doing before we get there. So I I think madame manager my suggestion would be start with the you know district commissioner and work your way up um and figure out what's the feeling because we got to be strategic about that request and I don't even think we need to mention the request now you know in terms of our strategy if if that's the way we're going and I and I'll be fully in support if if majority of us um decided to do that I I'll certainly be in support of you getting someone that could

1:20:36 – 1:21:01Speaker 1

you know not the two that we have currently. I think that's part of the the the package. Um, etc., etc. But so, Commissioner, I would defer that you we we discussed this privately, you know, in terms of what we're doing and how we're moving forward. But the manager has uh the discretion already to yes, spend an X amount of dollars to protect our interest. But what I'm saying is we need to figure out if

1:20:59 – 1:22:33Speaker 1

strategically if that's where the board needs to go cuz, you know, we got to be factual and wherever we go, I'm I'm I'm in supportive. I told them because legally right now what what are our the the ordinances and city code and everything else already has taken a position um um for the last 20 years about this particular item and um and never has the city has never wavered on it. I mean so so we won't but um I don't know if anything would have jumped out that would have caused that to change that. Um and [clears throat] and one of the things is uh speaking with um people involved with it is that um one entity never even bothered to come and have a conversation with us um because it's a conversation that's been taking place for 15 years. But to do a sneak around other than our county commissioner calling us and and giving us a heads up which was very well appreciated and and then city staff being on top. I I honestly think that we have already gone said enough because I did not know who how we got there. But I think we we strategically we got to handle it and I think you have the full support of us and and I think we'll be okay um commissioner to to you know for the city to represent the best interest of the residents of the city is probably that route. just find out from us and where we need to go and then we'll decide and you'll hire somebody and if need be and then we'll we'll we'll fight.

1:22:30 – 1:23:15Speaker 1

Um secondly, um in celebration of the centennial, if you guys all saw your centennial pin, very new pins for the centennial. Um and I'm just going to put another thing out for our centennial celebration February 5th. And of course, my favorite, which is Katya's birthday, who was insistent that she'd be at work today and who worked all day. Happy birthday. Happy birthday, Katya. Happy birthday. Thank you for your work and thank you for being here. And uh thank you for celebrating with us. I hope we make like the second worst birthday, but not the worst. That was Don't for nothing, John. We We had a private celebration. See, that's why this year not no good. Yeah. Just

1:23:14 – 1:23:36Speaker 1

Yeah. We didn't get just want to disclose that. Um Ka I cannot say happy birthday to you. Yeah. Yeah. Yeah. I was about to get to everybody [laughter] and I'm George. That's a good one. Motion to adjourn. Thank you so much. Have a good night and I'll see you all on the 24th. The time is now 8:28
