Yes, good evening board 932026 is the authorize the purchase of a snowplow for the road department. This past winter we definitely reviewed our winter weather operations and we found a way that we can improve efficiencies and we're going to wait till the next budget year to purchase a snowplow for the street supervisors truck that will open up an additional vehicle so that way due to breakdowns or whatever we can maintain services. We did find funds within our budget that we could repurpose and accommodate this request without waiting till next year. Happy to answer any questions regarding the purchase of a snowplow questions. Thank you. And resolution 94 is resolution authorized township administrator to purchase a truck for the road department. One of our vehicles was in a accident and it was total loss. And this is to purchase a replacement vehicle. I have multiple quotes in the packet and would be happy to answer any questions regarding this replacement vehicle. Thank you.

Yes, good evening, Board. Resolutions 95 and 96 are both related to a nuisance property located at 7823 Washington Park Drive. If you recall, a couple months ago, this property was declared a nuisance. We did go out. We cleaned up the property. We've had continuous conversations with the property owner. It has, again, become a mess. They've put new things on the property. Things have sort of come out of the garage onto the driveway. During the cleanup, we also noted that the car that was sort of had junk piled on it, we were able to determine it is inoperable, it's unregistered, certainly constitutes a nuisance as well. So 95 is to, once again, go back out to the property, clean it up, and assess the costs of doing so back to the private property owner. The 96 is declaring the inoperable vehicle a nuisance as well, ordering its removal, and again, assessing the costs back. want to make sure I'm kind of filling you guys in on some of the other background discussions we are talking with the Court of Common Pleas as well just trying to find out what can be done we don't want to have to keep doing this I mean unfortunately is going back one of the property owners property tax rule and they will have to pay it at some point but it's not a cost we want to keep having to incur so the hope is we can find another method for compliance uh it is owner occupied um is a sort of a family thing uh we're kind of learning so again trying to find other ways to ensure long-term compliance without having to keep doing this but i want to be sure for the neighbor and neighborhoods that we're getting it taken care of and it's not kind of an ongoing problem so 95 and 96 would remove all the junk and then secondly remove the junk vehicle from the property
All right, any questions? I know you said last time that that was like the extreme and you said you're working towards other things. Is there like anything else to do to stop coming up or is that what you're like looking into right now?
Yeah, trying to figure out what support, if any, we can get from the courts that may be a little bit more of a fine or again, something to force compliance, maybe more than just the costs assessed back to the property tax. So we're trying to see what support we can get from the courts. uh so we we've tried both routes i think we're going to try both routes one sort of civil one as sort of a criminal just to see what sort of action we can take without getting too much into the final strategy but we will be kind of updating those postings here soon working with our law director resolution 97 this item comes after again a few months ago we entered into our new agreement with miami valley lighting for all of our residential subdivisions in the townships crane's run hapland subdivision heritage lehigh miami village all of the districts terry lynn a couple of the others so For the last 10 years, we had sort of flat rates that were tied directly to the original contract. Under the new contract, though, that we entered into, there are a couple of catch-up years where they are raising a percentage on the electric rates to catch up. Again, they had sort of 10 flat years, and they are way behind, and we as the township were sort of getting behind. So ultimately we pay Miami Valley Lighting and then we collect the assessments to make sure that the township is made whole through general fund for the lighting districts. So before we were able to sort of have one resolution that carried us for 10 years, we're now gonna have to bring back a resolution every year to reassess and recalculate all these new costs. You're provided with the chart for the assessments that are going on to the individual parcels. On average, it's about a five percent increase, which is what we anticipated from Miami Valley Lighting. Some of them were less than that. Some of them didn't increase because they got upgraded under the last contract. There's a lot of factors. But anyway, we'll be seeing this more often as we recalculate and work with Miami Valley Lighting to assess these costs back. Any questions on these ones?

Resolution 98-2026, this is another lighting district resolution, this time related to the Austin Crossing development. Last meeting, we authorized the release of bid requests for a contractor to install lighting at the Austin Crossing development. We did receive a bid for this from Light Source AL. They're the same lighting district that provides the lighting over at Austin Landing. I did find them to be the lowest and best submission meeting all of our district requirements and specifications and certainly would recommend that we authorize acceptance of this bid and authorization for the Township Administrator to enter into an agreement with Austin Landing to provide lighting similarly they will install the lighting we will get a cost from them and then we will assess that back to the property owners in this case commercial property owners within the austin crossing development questions okay on the resolution 99 2026 this is a resolution to authorize the submittal of an ohio public works commission application for the resurfacing of newmark drive and gander creek drive so talking with john schweiker public works director we were trying to review what projects would potentially apply for the opwc program it's a great sort of local level application that can get funding back for public works projects Some of the things that do qualify are what we were asking for here, pavement resurfacing and some capital improvements, curb repair and some other things on Newmark and Gander. We feel that we may get some extra points on this application. We do have some economic development projects moving along, some residential development. We have some new office relocations. So we think this will score well, but we are hoping to get functionally a 90% coverage of paving for both Newmark and Gander, which are in need. So talking with public works director, we think in 2028, when the funds would release, our existing paving schedule could absorb some of these costs, so our 10% match. So again, anytime we can find basically 90% coverage to do something we need to do anyway. We want to take a shot at it. So this will at least let us apply. And then the next steps, if we are awarded, would be determined exactly how much we are awarded, if it's not the full 90%. And then we could discuss an actual agreement to do that and discuss the local funding match. But we at least should apply and see if we can get coverage. Any questions? Thank you, Board.

good evening board yes resolution 100 is an authorization to approve a transfer of funds from the deferred benefits police fund number 133 59 over back to the police fund to for a payout for a retiring employee and excuse me resolution 101-2026 is kind of an omnibus of the result of our budget discussions mid-year and needing to kick off some capital projects as well as absorb some of the price increases that came along from our health insurance so the packet included a cover memo detailing out what was in there so happy to answer any questions okay any questions mr snyder you have resolution 102 2026.
evening board resolution 102 2026 is a resolution to extend the tolling agreement through a third addendum this tolling agreement was originally approved under resolution 72 2024 and again extended through resolutions 43 and 99 2025 so If there are any questions with this, again our legal counsel has reviewed this tolling agreement. The other party has agreed to an extension through March 2nd of 2027.
okay thank you so now we come to the public comments portion of the meeting um the residents of miami township are invited to share their thoughts with the board please know that this time has been set aside for the board to listen to you your comments are valued and will be taken into careful consideration the board will not engage in dialogue at this time and presentations are limited to five minutes each So I think many of you, several of you may be here to make comments.

Carol Pappas, 2316 Vienna Parkway. You want everything. That's good. That's good enough. All right. I I'm not one to complain, but I live on the corner of Vienna Parkway and Rose Cliff. Now we have Rivendell traffic coming here. Vienna Parkway into here. Sometimes I have trouble backing out of my park my driveway and I am made to have that some of these people are going especially on the in a parkway when we moved here almost 16 years ago we were told that would probably never open well guess what it did. And then we never thought the field for Rivendell would ever be developed. And guess what? It did. So we have a lot of traffic. And I never see a policeman around there. And someone told me that they were told by someone who knew what they were talking about that police won't be giving tickets because apparently the fines have to be paid to Miamisburg. Is that true?
No, I don't think that's true.
Well, I hope it's not true. Because I've always supported police levies. In fact, once I even helped promote it with other houses. Right.
But I certainly are paid to the Miamisburg Municipal Court, I believe. But that doesn't mean that Miami Township doesn't see any benefit.
Because I wouldn't I wouldn't vote for a police levy if I thought all the money was going to Miamisburg. right and our prosecutor is in miamisburg so there's a and sometimes i'm sitting in my tv room which i i view vienna parkway and about 9 30 at night there's a chartreuse colored car that comes down from the northern end of rose cliff i cannot believe how loud i don't think he has a muffler i don't know i can't believe how fast he goes it's amazing what time is that that's around 9 30 at night but what can we do to get more enforcement of our speed limits
Right? Well, that's an ongoing discussion that we won't get into here. But I will ask Chris to address the is there a survey that's going out currently?
We are preparing a neighborhood survey to review several different topics, including traffic and safety.
And how will that be distributed to the residents?
That'll be distributed through a mailing. And then there'll be an online link that the survey can be filled out as well. So every household gets one of those every household in the Vienna neighborhood. Yes.
Okay. And what month should we expect that?
I would say that will be going out in the next couple of weeks, likely. Okay.
I'm quite certain I noticed it more because I was in the very first driveway off of Vienna Parkway. One day last week, I was backing out and I had looked know towards vienna parkway no problem look toward rivendell no problem i started backing out and just at that point somebody came up so fast on vienna parkway and started to turn and then saw me he did turn part of the way but i could have been plastered and you would be losing quite a prize if you lost me yeah what what time of day was that that was midday okay yeah all right so thank you we'll take that into consideration i'm sorry i'm just pleading for some more absolutely i understand yeah i support police i have a brother who was a policeman for 35 years so i'm not anti-police i'm promoting them but
Right. I know. We're very proud to have our own police department. Yes.

evening. My name is Lynn Jensen. I live at 6986 Rosecliff place. I just like to echo Carol's comments and just say that I feel like there's not enough support for the speed that the speeders that are happening on Rosecliff and Vienna Parkway. So we would just like to really appreciate some traffic. I know there's fancy term for it. But just when they slow things down, just whatever we can do, we'd really appreciate it. Thank you.

and Scott Swanson if you'd like to approach the board from the podium good afternoon Scott Swanson 6959 Rosecliff Place and we too live just off of Vienna Parkway I am typically walking there three to four times a day sometimes more walking the dog and get to see the traffic up and down Vienna Parkway It is not uncommon to see 125% of the posted speed or velocity on that. More often than not, you'll see 150%. Chief, I'll ask you, would you ever put 125% of chamber pressure in your service firearm? Probably not. Anybody here run 125 to 150% of the red line RPM on their car? No. Why do we tolerate those speeds on the Anna Parkway? All right, we need to consider measures to rapidly reduce the velocity for the vehicles. Speed tables is an actual well designed engineering platform that would limit the velocity and or additional stop signs up long Vienna Parkway in both directions.

do we have another speaker tonight all right do we have any yet hello everyone my name is dale nye and this is my lovely wife claudia and uh uh... thirty four twelve old lantern court and uh... forgive us uh... alex uh... you know we we sent you an email today about a week ago you know that we had a conversation and i was encouraged by it and i told my wife what we talked about and she had some questions which seemed pretty legitimate to me and one of those questions were Or should we attend the township meeting tonight? And so hopefully we made the right choice. And because all we want to do is just express the concern.
Yeah, absolutely. I think I got a response out a little bit.
But yeah, definitely stated.
We love when residents come and let us know what's going on.
So thank you for your hard work. Appreciate you being here. We can get to some resolution. Thank you. So our concern is Cornerstone Research Group, also known as CRG, at 8821 Washington Church Road. And the complaint is a persistent and disruptive humming siren noise in the back of the building by the dock doors that face Old Lantern Court, that adjacent property line. We submitted an online complaint on May 21st with Isaiah, your coworker. On July 9th through July 14th, sent daily noise videos to Isaiah. On July 2nd, Isaiah and Zach came out to take a reading and where they took the reading from was approximately two football fields away from where the noise was generated from. Our back door is about 225 yards away from that compressor or whatever's creating that loud noise. And, of course, Alex and I spoke on the 11th. And a detailed description of the complaint reads, as outdoor temperatures increase, the HVAC air handling system operating on the CRG property emits a persistent high-pitched siren-like noise. The noise grows louder throughout the day and is most severe during the late afternoon to evening hours, though it is present 24 hours a day, seven days a week, including holidays, Memorial Day, July 4th. It's always there. This condition has made it impossible for us to reasonably enjoy our property. We are unable to sit outside to use our backyard. We cannot open rear-facing windows or our sliding glass door. Because the the the noise just permeates throughout the entire House at night we must run our own air conditioning solely to drown out the noise the impact is continuous and significantly interferes with the normal residential use of our home on April 7th. We contacted CRG directly and provided Jeff King, the Vice President of Security, with multiple videos documenting the noise, along with information from AI regarding the likely source of the issue and potential corrective action Mr. King responded that CRG believes it is compliant based on light industrial zoning. However, our understanding is that CRG property is zoned special purpose planned unit development subject to zoning case 45823. That's my lovely wife doing her due diligence. And it's approved conditions. One of the specific conditions imposed by the Miami Township Board of Trustees for this development states, no noise should be generated from any operation conducted on the premises, either continuous or intermittent. This condition was clearly intended to protect the adjacent residential properties that directly abut to the CRG site. The ongoing noise generated by the HVAC system appears to be in direct conflict with this condition of approval. We respectfully request that Miami Township Code enforcement investigate the noise and take appropriate enforcement action to bring the property into compliance and eliminate the ongoing disturbance, which I trust that Alex is in the process of doing, in all fairness. we invite you to our home anytime at 3412 old lantern court just take a look for yourself we brought examples just on the phone that we could play for you now if you would like. You let us know and we will play a couple of videos to give you a sense of how the noise is. Alex is familiar with these videos because we send them to him on a regular basis. we um we just want to thank all of you uh for the attention to this matter and for your role in enforcing township zoning conditions designed to protect residential neighborhoods such as ours we appreciate your assistance and look forward to a resolution and we have our you know names address phone numbers and emails we make copies here should any of you like one um And we also have, I think, five other people on that on that property line that set seven people that are right on that line and right near the, you know, on the line of sight to that to that generator.
Right. So I'm sure Alex is going to forward some of this communication to me. Right. So I can hear the videos. They've sent those to you. The idea.

I'm happy to give a quick update too, if that's okay. Mr. Colt. Oh, yeah. Quick update. Yeah. So, Claudia, I do apologize with the email. For some reason, there was like a blank thing going on, but... so i got it i think we figured it out i got the response out but i'm happy to report here too we had a good conversation with uh sort of the different side of the coin from some of the previous conversations we've had at crg we actually got down to their grounds management uh sort of their chief operations folks we had a site visit we stood out there with them we said guys that's a problem we can all hear that that needs to be fixed so We had a good, very frank conversation since Mr. White, Joel White, has been back. He left for a few days, but he's back. He has called their HVAC equipment manufacturer. He is trying to get them as soon as possible to come inspect the equipment, one, to see if there's something deficient. I think this has not been an issue previously. It's the same old equipment that's been there for 40 years. It seems like it's a new issue. So is the equipment faulty? If so, can we fix it? If not, in either way, what screening mechanisms, what kind of sound dampening, are there better, you know, something to do to muffle that noise, knowing that it is an issue? And they've acknowledged that. They're trying to get folks out on site. uh we are working with them at this point i think we have a shared understanding that it needs to be fixed so we are hoping that you know this positive communication can get there we're certainly prepared to use more i guess strict enforcement action you know as we need to but we feel positive about the conversation we're going to try to give them a little bit of time to get this worked out i know it's frustrating But we are going to stay on top of them, I assure you. Whether it's me or Isaiah, please give us a call if something changes, especially. But we'll try to stay up with you as we learn more, too.
based on my interaction with you thus far i i i absolutely you know believe and have confidence in what you're saying so we are we are very grateful my only concern is if we don't have anything in writing that you know i know it's a little quick to cite them but you know we're going to go into the winter months their hvacs is all going to be shut down then we're going to come into february march april when it starts warming up again, and then that stuff starts going, and then we're out in another season of enjoying our home and our backyard and our space that we are paying a lot of tax money for. So, I mean, that's kind of why I'm asking, you know, what's in writing, because they've already told us. We tried to go to them and be nice neighbors, and they've already told us that they don't think there's a problem.
they have been notified that it is a violation they are certainly aware that it is in violation at this point so the next steps and iterations certainly would be citation or other kind of you know enforcement filings uh things like that with either a court system but

uh now it's time for department head comments so uh police chief adam uh police chief nielsen thank you board yeah i just wanted to talk about we've uh had a very busy august at the police department so far national night out was a couple weeks ago was it was another big hit thousands of people came through the event i think we had a record in terms of vendors and partners that were there just to show their support meet and greet with the community we had a couple neighborhood block parties which have kind of dwindled over the past few years so it's good to see them trending back up so that was a great night to get all of our staff public's work was there and I know just just a lot of township staff was there so that was huge and then last week obviously runway fest there was a lot of people involved in that I don't want to steal thunder on that one But I'll just say from the PD side of things, it was safe. We didn't have any accidents. We didn't make any arrests. Things were flowing, shuttles and traffic. We didn't have any folks trying to walk across the roadway or anything like that. So as far as I can tell, that was great on the safety side. I know some have already seen it, but we put a lot of time and energy into a police department video just to highlight the quality of people we have there, some of the equipment and technology, trying to build some energy around hiring and recruiting and things like that. It came out phenomenally. We had a lot of township help, public works and PD staff and things like that. So that went very well and I hope it'll pay off for us. lastly and i know some of the folks have left but um you know we take we take traffic excuse me traffic safety seriously in the township and um you know we get a lot of calls up there i've talked to to a lot of residents on the north end of the township vienna parkway and other places um we certainly are not telling folks that we're not going to write tickets that's not on the table but we're not going to take a zero tolerance stance either we want our police officers to use their common sense and use their judgment but we are aware and we take it seriously so expect to see us around there thank you for for the time and it's always good to see folks stopping by meetings so thank you board thank you

Sure going to be hard to follow all those comments, but just want to say Runway Fest was fantastic as far as public works involvement, you know, some coordination behind the scenes, getting tables up there. But overall, it's been a while since Runway Fest. I know a lot of staff have put a lot of hard work in, Mr. Snyder. It was good to see, you know, elected officials out there, but seeing the community come out and take a look at aircraft and see the different vendors and inflatables for the kids and good band and then to cap it off of the fireworks it was just a fantastic time and i really hope that this becomes an annual thing moving forward great to see different jurisdictions working together but runway fest is definitely something that we need to continue in the future so i couldn't be happier to attend it absolutely thank you

Well, just briefly again, I want to thank all of the staff as well as our partners at the City of Dayton and the Department of Aviation with the airport in helping put Runway Fest back on for the first time in five years. I think our last event was in 2019. It was a big undertaking to do this with a lot of new folks that weren't around when it was previously put on. But I think it went very well for a first time back. And again, we're certainly hoping to make a few changes and bring it back even better next year. We'll be having some follow-up discussions with the whole team in the next few days to debrief from the event, but it looked like everyone was having a great time out there. Also want to note and call out Mr. Mel King, who will be celebrating 30 years of service with Miami Township and helping to keep all of our facilities running and functional over the last 30 years and also helping out a lot in the winter and with a lot of other tasks throughout the year as our facilities manager. So we'll all be helping to celebrate his 30 years tomorrow, I believe. So that's it.
