Good evening, trustees. I have before you resolution 046-2026 which authorizes the township administrator to enter in a contract with McGrath human resource group for a formal wage and benefit study. This will entail a review of current job descriptions, wage ranges and benefits to provide updated data to the township and ensure we are taking the necessary steps to retain and attract talent to our organization. I have included the information in the packet with details outlining the services to provide it and the timeline for completing this project. Do you have any additional questions? Any questions? Yes, board. Um, and you should have all of these, but starting with 47, this is a resolution to update the job title. We have it as assistant police chief. We would like to update that to uh deputy police chief. Um this is just more of like an industry standard and best practice. That assistant police chief is more um tied to bigger police departments and more to the fire service. So we're just trying to modernize what uh we're doing at the police department. Um and I just wanted to throw in that we're not going to be changing job titles every couple weeks. So this is one that we're going to uh set it and kind of forget it and leave it. So happy to answer any uh further questions.
Questions? Okay. Um 48 is to authorize the township administrator to accept grant funds for our bodywn uh camera program. Uh last year we we started the grant process with Motorola Solutions. They're they're who services us now hardware and software wise with our very important body camera program. Um we need to update hardware and software both. um we've got servers and some things going on hardware-wise that um we're not 100% comfortable with the backup should we have a critical failure, should we have floods, hurricanes, things like that. Um so this grant um I think helps us to uh use our budget properly, helps us to offset tax tax payer funds um and it's going to really help us modernize and keep that very important critical piece of equipment up to date.
Great. Any questions? Okay. Um, and then 49, this is a uh replacement uh vehicle purchase authorization. We've been looking at our whole fleet. We've been looking at our marked cruisers. We uh have investigations cars uh that some of the unmarked cars. We're at a point now that we've got several vehicles that are at or very near end of life. Some of those also that are not quite at end of life, they need a lot of expensive repairs. again trying to be good stewards of our taxpayer funds and our budgets. Um we're going to start to go through as as best we can and this will let us buy a new vehicle and we'll take an existing vehicle and we can move that down the line and then further down we can take one that needs a new engine or some of these other things and just kind of scrap that. So we're just trying to get ahead of some of the fleet and vehicle issues before um we have to start a car pool program or something like that. So happy to answer any further questions on that purchase.
Sounds good. Uh I think someday we need to talk about what that fleet looks like in more detail. I know we went to a years ago we went to a I think uh each officer has a car and we need to review whether or not that works for us. Yes, sir. We're going to look at that uh here in the spring which I guess we're there now. So in the next 30, 60, 90 days, we should have an answer for you on that. Okay, sounds good. Any questions? All right. Yes. Good evening, board. Uh, this resolution 050 would allow the township administrator to go into an agreement with people first staffing. This would help the parks department as they now have a full-time employee on a three-month leave for medical reasons. Uh this has been checked by our law director and uh we think that's our best way to fill that position. Uh if you have any questions, I'd entertain. None for me, but thanks for joining us tonight. Yes. Thank you. Good evening, board. Uh first resolution before you tonight uh is a resolution dealing with the nuisance property here in the township that we've been dealing with for a little while now. More detailed history was provided in your packets from our community development officer. Uh but over on Washington Park, uh this property owner has been uh piling up trash, debris, um things that they say that they're flipping, but uh in general is is a lot of junk and debris. Um we've been uh working with them again over the last several months trying to identify a path to get this cleaned up uh without having to declare a nuisance. Uh that did not work. We moved to a civil citation program, filed these civil citations with Miamiburg court. Uh unfortunately they've just continued to pay these citations and that's not leading to results. Uh so uh typically citations end up hedging activity and people don't want to pay the fines and they clean up their things. This has not happened. So, uh, to try to give some relief to these neighbors, we are requesting that we declare this property a nuisance. We'll do a couple things. Uh, we will notify the property owner, uh, that they have been declared a nuisance property, and it will give them officially 7 days, uh, to clean up the property. If they do not do that, then we can contract services to go out and clean up the mess, uh, which those fees would be assessed back on their property as a lean. Um, so again, this is sort of our last case scenario. We we don't like having to get to this point, but some of our other uh methods have not been working. Unfortunately,
it's owner occupied. I assume
it is owner occupied. Um there are again potentially some familial things going on in the background that have kind of led to confusion and conflict and really who is the person being charged versus maybe causing the issue. Um but nonetheless, uh neighbors are of course dealing with this regularly. Uh these pictures only show kind of a small snapshot of what's going on. The backyard is um pretty bad as well and actually the property is on a corner so you could really kind of see straight into the backyard. Um it's a bit of a mess out there. So again, we think unfortunately we've gotten to the point where a nuisance removal is probably uh the best mechanism to actually get some results out here. If you have any questions on this one. Okay. Um, another uh resolution we have would allow our township administrator to accept funds through the community development block grant program with McGomery County. Uh, this year McGomery County announced an accelerated program uh before or between funding cycles. Occasionally they have some excess funds either from uh projects that were canceled and funds got sent back or you know other circumstances. But they had excess funds. They announced to all uh eligible jurisdictions within the county, which there are, I think, 26 of us, uh that they had some funds available. We were given about a two-eek notice to put applications together. So, it was pretty quick. Uh but thanks to public works department and the planners in my department, Max McConnell, Zach Burlesen, and Junior and Rex over in public works, uh we worked really quickly to get applications submitted um before bringing this to the board again on such a tight timeline. Uh but we did receive notice that both projects we submitted were funded in full. Uh so zero matching dollars are required for these grants to deploy. Um CDBG funds typically are deployed in neighborhoods that are either low income or in cases where ADA improvements are being made.
So uh both of these projects qualified in the Huber South neighborhood installing ADA compliant curb ramps, seven intersections, 16 new curb ramps. Uh so that uh generally just helps create a better transition from the road to the sidewalk as well as installing uh all the other ADA pertinances. Uh and then last uh uh last but not least over in layer park we have uh ADA compliant dugouts that we are planning on installing around the baseball diamond as well as pathways and ADA picnic tables uh within the park. So again, about $120,000 awarded through this program with no match required. So we are very excited to get this. So um approval of this resolution would allow administrator Snyder to agree to all the terms to deploy these funds. Any questions on this one?

Yep. Uh and then the last resolution for you tonight, uh a resolution, uh to allow the township administrator to execute a development services agreement with Woodard Development. A little bit of history, uh this piece of land located to the south of Austin Boulevard, west of I75, east of Wood Road. Uh the township has owned this piece of land since 1991. It was originally acquired with the intent of installing a fire station or a public works uh service department on this piece of property. Uh since then we have developed both of those down further on Wood Road. Uh so when those were built 2010 2011 uh some of the this is a little bit before my time but looking into the history some of the conversations then shifted toward how do we potentially market this site. It's one of the, in my opinion, sort of gyms along I75, one of the last large pieces of undeveloped land really between here and uh downtown Dayton. Um so we started looking at marketing the site, putting together economic feasibility studies, a couple of RFPs, requests for proposals, looking at kind of how could this land come together over the years. So, uh, we have a history of trying to figure out how to develop this land, but I think it's one that we've been pretty protective over and want something very special to our community and to our region to develop here. Um, so with that being said, um, over the last couple of months, our staff and and board of trustees, we've had some initial discussions with Woodard Development. Woodard Development is a developer who I feel is uh, very reputable in the Dayton area. have been a part of a lot of special projects uh and talking with them uh believe that they have a uh vision for this property that matches what staff and the trustees have discussed over the years in terms of long range planning. So uh this development services agreement would be the first step in trying to uh figure out exactly how this piece of land could develop to be that special uh mixeduse
development we've all talked about over the years. So this agreement would do a couple things. Uh first it would empower Woodard Development to uh go and put together a master development uh proposal. So that would do a couple of things. Uh start to identify what land uses they feel would best fit uh public infrastructure needs, development timetable, an economic feasibility study. Um but largely speaking, we anticipate this to include uh very high-end multif family apartments, uh hotels, premium casual, fast casual restaurants, and other retail and service uses. Um but again with the topography and the lake and the location on 75 uh really focusing towards the highest possible quality development that we could find. Uh in exchange for that uh we would be agreeing to a land purchase option with the developer uh in which they would have exclusive option to purchase the property as specific development phases are ready to commence. Uh so the comfort that comes out of that for us is working specifically with Woodard. Uh the way that we have uh set this agreement up is that the township still ultimately fully controls all of the zoning on this property. So every phase of the master development still has to come back for zoning approval to be able to enact this development plan. Um so I will say working with Woodard this has been a very unique uh process in which it's been made abundantly clear we don't want to do anything that you as the township don't want to develop. Uh so we feel that this agreement has created uh a way for the township and Woodard to incrementally step forward together to find out what this development could or should be. Um, we've also agreed at a high level to reviewing uh certain other potential incentives either through our TIF districts uh through operation in the joint economic development district or creating a new community authority uh to help fund portions of this project. Um the next steps after this development services agreement again over the next
couple of months Wood will be putting together a master development plan for our review. We would discuss zoning, all of those things, discuss the actual p purchase option and likely a subsequent development agreement that would outline any details on incentives or purchase price or the other things the the fine details, but uh this is that first step to give Woodard some comfort to go out and spend real resources to put a plan together. Great. Uh overall it's 40ish something acres. Uh several of that is in the pond though. Uh so developable it's closer to 23 acres um with um you know sort of a split there. There's the north pond. So we can kind of develop that top piece but then the western parcel is the larger development parcel. Uh it's a regional basin. Um, so we're actually through one of our Jeds, we're doing a regional study on that basin, but there is a lot of area that is tributary to that pond. So, Mr. McCord, uh, you have resolution 54, 2022.
Yes, sir. U, it's an amended appropriations resolution uh, based on a couple of pieces of legislation that are before you all tonight. Specifically, resolution 50 and resolution 52. the uh supplemental workforce were unanticipated when we put the budget together for you all at the beginning of the year. And the um CDBG CDBG grant program is a reimbursement based program. So we will have to spend the money to get the money back later in the year. So we need to amend the appropriation so we can get those projects moving should it be approved.

If you do, please do come up and state your name and your address for the record. Approach the mic. Good evening, township trustees. My name is Todd Duplain. I'm with Woodard Development. The address is 505 South Jefferson, Dayton, Ohio. I'll be very brief. Uh certainly entertain questions, but I don't want to uh misuse your time. Uh Alex said it very appropriately. Our we understand as it relates to this piece of property that's still up on the screen, this is your front door and we're going to take this very seriously. Um, our vision is very much aligned with yours. Uh, as Alex said, we do not have any interest in going into communities and trying to push a development that's not aligned with what the township wants. So, again, I want to stress that we are going to come in here, we're going to work handinand glove with your staff, with you all to make sure what we come up with over the next several months is aligned with what you want. We think we can do that. This is probably one of the most exciting projects that we hopefully will be a part of in the next for our company's history, which is about 12 years. So, super excited about this. We think we can do a great job. We're very experienced in this kind of mixeduse suburban development. And I can assure you that the development agreement in front of you has a lot of controls for the township to determine timing, uses, design, users, etc. I'll leave it at that. Thank you.

This particular request involves a reasonzoning for an adult use cannabis dispensary. Given that this represents a relatively new and significant land use for our community, it is vital that we have the benefit of a full three member board to deliberate on the specific impacts and standards involved. Continuing this to the next meeting ensures that all trustees can participate in a thorough discussion of whether this land use should be permitted under this case. Yes, board. Thank you. Uh legal requirements for this case have been met. I do have a zoning commission recommendation. Uh but first, I will go into the staff report. Uh request tonight is for a final development plan within the Dayton Christian School plan development. Uh this case was submitted by Chris Beish of MSP. Uh on behalf of Dayton Christian School, uh Chris Beish is here tonight. if you have any specific questions over some of the engineering or site plans. But again, I will get into a high level overview of the project. Uh property location, I'm sure everyone is familiar with where Dayton Christian is located at the corner of Washington Church Road and Spring Valley Road on the east side of the township. Uh Dayton Christian is submitting a development schedule uh hopefully to be completed uh still yet this fall uh with their football stadium. Uh public health, safety, and morals. One of the items we review as part of all of our zoning requests. Uh this item had a this this request had several items that we reviewed uh in great detail. Uh sports stadium is an atypical use certainly in our community. Uh anytime we look at one of these, there's potentially a higher impact uh generated. Uh with that being said, the property was originally zoned for some of these uh secondary uses beyond a school like a stadium or baseball field or other things. So, we've known it's been coming, but uh still ensuring that some of the impacts are mitigated was a significant uh piece of conversation with Dayton Christian. We'll get into more of these items in detail. Traffic control and access. Uh reviewing some of the traffic counts. Uh there will be certainly short bursts of of new traffic generated from evening football games on property, but uh still feel that it is within expectation and ability to be controlled by these roadways. uh certainly feel that it will be less than uh morning and afternoon traffic generated by schools um but again will be sort of more concentrated traffic public service burden fire
district public works neither group has identified any concerns uh arrangement compatibility of structures uh we'll take a look here in a moment but uh the stadium is located uh about 56 feet away from Washington church road uh the stadium is certainly close located directly between the existing school in Washington church but otherwise meet setback requirements that we have set. So here's a site plan again showing the uh location of the stadium so the school and then to the east is Washington church and the stadium will be located directly between the two. Uh the first phase is building the home uh bleachers which is located on the west side again closer to the school and then in a future phase building the visitor bleachers which would be on the east side closer to uh Washington church road. Uh we have some initial designs from them. Uh certainly feel that when that modification comes there will be no concerns about design. very nice uh brick looking bleachers that they've faced to look very high level design. So otherwise we have no no design concerns with the current homeside bleachers or some of the other fencing. So again here's some details. We've kind of covered most of these uh landscape plan. Again, one item that we spent a lot of time working with the uh school to discuss. Currently, there are very few per trees along Washington Church Road or really at the corner of Spring Valley Pike, but uh trees both act as an aesthetic improvement, but also for sound and light buffering. So, we wanted to be sure that there was a lot of thought put into the landscape plan as we worked through this. So, uh you can see here uh our requirement per our code was 64 trees to be installed. Uh the school has proposed 113 trees. Um so doubling essentially their minimum
tree requirement. They've taken this to heart and done everything they can to create a really nice uh tree buffer um along our roadways. Here's the second piece of the plan. Again, rounding out down towards Spring Valley. Uh again, a really nice landscape plan put together that will work with existing site trees to create continuous uh screening along both of the major roadways. It would be a huge improvement again both aesthetically but also um for neighbors but and also really for attendees at the school. Uh you know having some buffers between the roadways and formalized trees uh does a lot for the players and uh visitors to the school as well. Uh the lighting plan uh was another of the areas that we spent quite a bit of time discussing. Um, stadium lighting is something that is again very atypical in our normal zoning code for a retail building. We're talking about 25 foot light poles in a parking lot. Uh, that's functionally impossible for a stadium. You have to elevate the lights to a point where uh you're not creating shadows and you can evenly light an entire field. So again, we're talking about significantly higher poles in this area. Uh, one area where we spent some time discussing was on that eastern property line. Uh originally they had proposed two 80 foot poles, but because of that height, the amount of spillover light that was heading over even toward the east side of Washington Church was creating foot candle levels that were way beyond what we were comfortable with spilling over into the neighboring property. So they dropped the poles by 10 feet and they were able to decrease the light levels while creating an even spread by doing that. So we think it was again a very thoughtful improvement to make sure that we are limiting the light as much as possible to within this property. So again pole height uh configuration is one of the areas where we are um sort of diverging from what is typical again for an atypical use but uh considerations that were provided. Again creating a
uniform illumination across the playing surface is very important. Um, lowering heights would create shadows, uneven visibility, uh, potentially leaving the field unsafe for night games. Um, and again, adding the fifth pole, uh, was a a great design choice to help lower the lighting levels. The illumination levels themselves, uh, certainly for a football field are far above what we would typically approve in the township. um 67 foot candles where again 10 is about what we look for for most security concerns. Um staff working with the uh develop the design team has reviewed and 67 foot candles on the field is very typical for what a football field would be. Um so again while it is divergent we feel that the limited use of a football field certainly to Friday nights uh to be stopped by 11 pm uh really helps reduce that nuisance level to neighboring properties. These are not lights that will be on 247 like lighting a parking lot or something like that. So um again despite the higher onfield intensity this plan does adhere to our one foot candle maximum at all property lines. So, they've worked very hard to uh screen and direct these lights to be uh very controlled and pointed exactly where they uh they are intending to light. Uh the other item, one that we review frequently is our uh color temperature. So, our normal standards for our street lights and uh typical properties, we review 30,000 Kelvin as our maximum color temperature. This is a warmer white color. Uh reviewing some of the standards for football fields, uh a 5700 Kelvin is the typical number. So this is a much cooler white than what we would typically allow, but there are many studies that show for depth perception
for color reading, fasttracking movement. This higher Kelvin color temperature is really important to simulate uh sort of a natural daylight or some of these again more crisp differentiation. Um we still feel that again due to the limited uh use of these lights this is something that we are are overall comfortable with uh in this limited use. Noise and volume control. Again this was another area where we spent a lot of time working with the uh the school trying to figure out how to reduce the impact especially from a PA system and certain things like crowd noise or band. I think there will there'd be some difficulty exactly regulating a decibel level, but this is one thing that certainly the school has some more control over. Um, so again, trying to review the original submitt to where we are now. Dayton Christian has opted for a more modern system, much smaller speakers that are spread evenly throughout the stadium rather than the large speaker stacks that are more traditional for a football stand. Uh so again, they're able to lower the volume levels significantly by having them spread out throughout the stands uh embedded and directly pointed at uh the visitors rather than up on giant light poles kind of booming through the neighborhood. So we thought it was a very creative approach uh and felt that they were taking it to heart how to reduce this noise. Uh they've also again developing uh with an audio professional they actually engaged a group to come in and make recommendations on speakers to lower sort of the bass that lower frequency that typically spills uh and to have active sound level monitoring built into the system so they can make sure that they're meeting all their standards. Uh so the recommendation from the zoning commission uh was uh recommended approval with stipulations and a 4 to zero vote. Uh the two things they sort of reinforced uh are things we've
already talked about. The first, no noise from any electric PA system or any other sound amplification device operated on site shall exceed the decibel levels prescribed in township uh zoning noise ordinance uh measured from the western boundary of Washington Church Roadway and the northern boundary of the Spring Valley Pike ride ofway. Uh, and two, the largest screening trees should be concentrated around the stadium, specifically near lighting poles and speakers to mitigate sound or light bleed. The applicant work with staff to identify types and species of vegetation and best practices to achieve this aim. Again, in the interim from zoning commission to now, our staff has worked very closely with the applicant to uh develop this site plan. We think it was uh again very thoughtfully done with the intention of mitigating some of these noise and light levels. Uh that is all I have for my report. Greening tree line is a safe and typical distance from the road. Yes. I'm not sure what that is, but yeah, typically we actually require that the trees be uh planted for street trees within 15 ft. Uh so we want them a little bit closer to the roadway. Uh there is sort of a natural uh drainage channel there along Washington Church. They're on the other side of that from the road. So we're we're happy with where they're located. Okay. So that stipulation electronic PA system, not the old one. Uh so that that would be that would be for their new installation for the PA system that they have to meet all of our uh current standards. Okay.

I do. Thank you. Um at the end of March, we had the opportunity to have our yearly police department awards uh ceremony. Um, I call it yearly because it'll be yearly from here forward. It's the first one we've done about five or six years. Um, but it just gave me a chance to uh uh recognize the hard and the quality work that has gone on over there and uh throughout the township over the last year. Um, it was about a two-hour event. So, we had some food graciously hosted by uh Crossroads Church across the road. Um, had a great time. Like I said, it was a two-hour ceremony. I won't go through every name every award, but just some stats for you real quick. We gave 12 separate awards. So, Medal of Valor, multiple life saving awards, employee of the year, things like that. So, 12 of those um to 17 different police department employees that have a total of, uh 210 years of service to the township. So, uh pretty good night. Had a blast doing it. Um and, uh we're going to do that every year. So, I just wanted to recognize all those folks again. Um and then at the end of this month, so April 25th is a Saturday, um we're going to be down at Wald Park. We're we're Starting off just like a community public event. We're calling it Bash with the Blue. We're going to have our K9 down there. We're going to be demonstrating drones. We're going to be answering questions. Familyfriendly, kid friendly. We're going to have some popcorn and cotton candy, things like that. So, um, we're going to be down there noon to 3, Wal Park, April 25th. Um, it's going to be a great time. So, that's it.

Um, for the public, I do want to highlight again some of the work that you saw tonight regarding these grants that were obtained. I do want to commend public works, our community development department, and the police department for bringing in over $200,000 worth of grant funds this past month. These funds allow us to invest in capital improvements and equipment beyond what would be possible under our ordinary revenues and without taking on additional debt. Uh your efforts create value for residents and taxpayers by bringing these state and federal dollars back to our community. These projects also highlight the value of long-term planning like our parks master plan that enables the community to benefit from grant programs to meet our broader infrastructure goals. And I'd like to thank the board for their support again of these planning efforts. So, thank you very much everyone.
