Thank you. We have two presentations tonight. Chief Nielsen, you have the swearing in of uh one new sergeant and Chief Johnson will be providing us with an update on the Miami B Valley Fire District. Yes, thank you board. Um very privileged and honored here to recognize Sergeant Bobby Johnson. Uh Bobby started uh prior to here started with the Germantown Police Department. Um he was a road officer, did some task force work there. He's uh been been with us for approximately seven years now. Um and he's just done a great job for us working the road here, obviously officer in charge status multiple times. Um but what he's been doing for the past few years is he's been working uh major case investigations. So, we're talking property crimes and persons crimes, really working closely with the public, getting property back to uh victims and solving their crimes. Um, we did a sergeant uh process some time back. Um, and I've been talking a bit about his competency and things like that, which we like to see from our sergeants obviously, but what what uh really shown through with Bobby, and I think we can see that here with the room full. Um, I can vouch for this group of folks that they aren't here to see uh me speak or to hear hear this, but they're here for this this this man here. So, um, I think that's a testament. The full room, the job that he does, the way that he treats people, um, and the way that he serves the township, proud to have him. He's officially a sergeant as of last week.

good evening. I appreciate you all having me back again. Uh I can't remember when I was here last but uh I definitely remember the last time there was a lot of doom and gloom. Our apparatus was not in good shape and cost had risen and cost haven't gone down but uh and the delivery times on apparatus was uh was put us in a scary predicament. But I'm here to report that uh we are in a much better position tonight. So um looking forward to to uh informing you all on that. Uh, first and foremost, as a department, we uh secured ourselves once again as the second busiest department in Montgomery County behind only Dayton. I hope I'm never here to tell you that we're busier than Dayton because uh something's gone drastically wrong. But uh last year, the Miami Valley Fire District ended the year topping the 11,000 run mark uh for the year. We finished with a total of 11,014 runs last year. And just to give you a little bit of uh perspective, when I left Warren County, I was left as the busiest department in Warren County with around 4,000 runs. So I come up here and we just topped 11,000 runs. So that uh kind of tells you what what the men and women of the district are out doing every day and night. So uh busy department doing a great job. But uh talking about our vehicles, uh this past year we were able to complete our overhaul of our five ALS frontline medic units. Now, uh, currently our front five frontline medic units, the oldest one is a 2022 and everything's 2022 or newer, and our frontline uh, first line reserve is a 2019. Uh, when I came here in 23, the 19 was our newest and best medic unit. So, now it's our frontline reserve unit. And all of our medic units now, including the frontline reserve, have been standardized into the Ford F550s. So, they're all similar in in makeup, and that really helps with our maintenance and and stocking supply and different things like that for our medic units. Last year, we were able to take

two uh deliveries of two new fire engines for 51s and 55s. Uh both stations are in the township. One's up the north station and one's the south station. Uh two new engines were were taken in delivery and then we we're still waiting on the third new engine that's due in this year. It was ordered in early 23 and we're expecting it now in November of 26. So we're still on that two to threeyear delivery time frame, but at the end of this year then we'll we were expecting that third new engine to come in. Uh last year we were awarded the federal AFG grant totaling almost $400,000 for the purchase of extractors and dryers for each station for gear extractors and dryers and a new brush truck. So we're currently working towards getting that brush truck ordered. I think they're telling us it's a two-year delivery on a brush truck, believe it or not. And the new uh extractors, which is a fancy washing machine for for fire gear, and dryers will be placed in each of the new each of the stations. So, each station will have its own. And that was at a cost of it was a 9010 split. So, it cost us around about $38,000 out of the $400,000 that the project cost. The rest came from the federal government. Uh we recently signed a contract to replace the 2016 ladder truck, the big big ladder truck you see riding around town. Uh we actually have a team leaving in the morning for Bali, Minnesota to do the pre-build on the new truck. Uh and we're talking 24 to 30 months on delivery on that once once they start production. So, um, and then along those same lines, in October of last year, in an effort to try and control our maintenance cost and up our preventative maintenance on our vehicles, we were able to hire an in-house mechanic. Uh, we were able to steal a mechanic from Dayton Garage. Um, and he's setting up shop at the at station 51 now. So, uh, we got big plans for him. He's a great addition and he's really hit the ground running. So, we're looking forward to

that and seeing what uh what how that can bring our maintenance costs down and our preventive maintenance and hopefully never get us in the position where we were before with our trucks and apparatus. Uh switching kind of to a focus on our employee health and wellness. Last year, we brought in Pinpoint Behavioral Health to perform what they call a checkup from the neck up phys or mental assessment on all of our employees. and uh it was a ra resounding success and we're going to continue that process this year is kind of leaning towards the me mental wellness of our employees. And to add to that, this year we in conjunction with the union we uh we're we've signed a contract with Grail Incorporated to do a voluntary blood cancer screening on all all voluntary employees and the at the district's expense. Uh it's a real good test that will test for multiple types of cancer with one blood test and uh really excited about that and trying to because cancer is the leading cause of death in firefighters. So we're hoping to catch things early before symptoms start. Uh so we're really looking forward to doing that and every every employee that's eligible and wants to do it this year will be will be eligible to do it and then in years after we will square the parameters down a little bit to it won't be the 20somes won't necessarily need the test every year as you get older and the parameters that will include that. So, the cost will decrease every year, but uh we're hoping to catch these things early and and not have such a a fatal result from from cancer and the firefighters. Uh Station 51 on Wood Road has been staffed. I know that was a contentious part of the levy a few years ago. Uh station 51 has been reopened a few years ago and it's been opened non-stop. It has not been blacked out a single time since it reopened. and now it's staffed every day with at least three firefighters every day.

Uh the district was able to purchase the uh fiveacre lot across the street from Meyers down on Spring Pike for a potential replacement of station 55 down on Joe Marine. Um so we were able to there wasn't a lot down there. We we searched and searched and we we really lucked out into getting that piece of property right there next to the Walgreens. Uh, and we're working with KZF Design out of Cincinnati right now and we're determining the needs. They've got a questionnaire that our guys are working on right now where they will determine the size that we need of the station. We're looking to just replace the station that's generally there right now. It's not going to be any kind of administration or anything like that. We're just looking to replace the station that we have up there that's over 70 years old now. Uh, so we're looking to to decide what size of station we need and they're working on that right now. And at the end of that, then it would be an estimated cost to build the station at that point also. So, we're we're in the midst of that right now. Um, EMS50, our paramedic chase car that we put in service has been a resounding success. uh providing additional help on EMS calls. But the big thing about it is it's able to we're by sending a SUV to EMS calls, we're able to keep the engines and ladder truck, what we call our heavies, off the road, thus improving their their maintenance reliability and and and lowering the cost to maintain those vehicles. Uh it's been a success. We're doing really well with it. We are seeing a drop in in our maintenance cost just by using that vehicle. Our in-house podcast, Dose of the District, is uh been a rousing success. Uh we've done, I think, six podcasts now and uh they're put on YouTube and they are very wellreceived and we're expanding that all the time. I'm thinking about using that that facility to do my Friday instead of doing a Friday email, I'm going to do a Friday, not a podcast, but just a taping and using using the the equipment that

they've got up there. And we've uh been discussing a lot my chief's meetings and different things like that how that's more attractive to the to the younger generation than the emails because I hear a lot of well I don't read emails so so we're going to looking at this to uh maybe get a little more engagement with our with our younger members. Um and the district uh next month we'll be redoing our mission vision and core values along with the new strategic plan. Uh the planning team for Fifth Third Bank corporate down in Cincinnati have agreed they will be facilitating the two-day event and they will end up putting the uh finishing touches on the book and they'll return a new strategic plan for the district for a one, three, and fiveyear plan for the district uh later this year. It'll be turned in. And the best part about this, this is done at no charge to the district or or anybody. They it's a community service that Fit Third provides. They do one fire department a year and we were able to get in through some people I knew and we were able to get them up here and we're really excited to get this going. So, it's been a been a goal of mine for since I've been here to get our strategic plan up and running. So, um, and finally, on a good note, uh, two of our members last year, Lieutenant Jared Aysman and firefighter Ben Robertson were awarded the Montgomery County Firefighters of the Year for their actions down on saving a saving a man from a fire down on Old Main and Mamesburg back in October. Uh, so there's a banquet in a couple, it was supposed to be the night of the storm. We just found out it's been moved to the 28th, but they will be awarded the firefighters of the year for the Montgomery County. So, uh, good note on that and, uh, just an evidence of what what the district is doing. So, uh, other than that, that's all I have. If you have any questions, I'd be glad to entertain them.

Any questions? So, regarding the SUV that replaced the replace the uh, fire truck, heavy equipment runs. Uh, how is that configured? What's the capabilities of that? It's a it's an SUV. It's it's equipped with a senior paramedic and it's equipped with ALS equipment. We're upgrading it all the time. But the idea is instead of if you have a serious call, a heart attack, you know, a shooting, things like that. Sometimes the fire trucks will still go, but what we were seeing was we were sending fire trucks for extra manpower and because we only put two people on our ambulance. So if those two people are required in the back, we need somebody to drive different things like that. What this does is this puts that third person there and it keeping the heavy trucks off the road. That's all it's doing is just keeping you from having to respond with a fire truck.

Yeah, I like the idea. Yeah, it's uh it's very successful. A lot of places are doing it and now we're we're looking at a moot new medical director, a very aggressive medical director and he's got a lot of good ideas and some of the things that are coming to this area. One is community parame medicine. Uh another another thing is uh carrying whole blood which is a new to the EMS. Huber Heights is doing it right now. They're looking for they would like um jurisdictions around strategically placed around Montgomery County. They're looking for five. Dayton, Huber Heights, and then they're looking for each corner. So, they're obviously looking at us to carry whole blood. But it wouldn't just be for us. If say Germantown or somebody else needed it, they could call us and we could send that car with the whole blood and different specialized supplies and different things like that without taking our medic unit out of service or anything like that. we would just we could send it and that it's kind of a regional asset. So there it gives us a lot of opportunities for things like that. The the uh u things we carry for smoke inhilation and things like that very expensive. We carry one in our battalion. We carry we would carry one in that vehicle as well. So we could send that elsewhere as well without taking our battalion out of service or taking one of our fire trucks or something out of service. We could just send that car because that's all they need is different things like that. So, it's a lot of opportunities, a lot of lot of potential that we could do with this thing and and without sending a heavy truck and sending three or four guys having to take it. We could send one person. It's a lot of lot of potential for for upgrades.

Well, like I said, when we get this I think we'll get this. It's a bubble diagram. It's not a not a design or anything like that. It's just it would be need to be this size. This is how it would sit on your property type of thing. And then we would have to go back and actually bid out for the design to for the company to I would you know KZF is who I used down south. U I worked with them before but they would obviously we would have to go to bid because that is the expensive part of it. But once they did this, this station I don't think would would take a long time. But, you know, it's just going to be the cost and getting the approval and moving forward. But I would say we could start by the middle to the end of the of the summer and then it would probably be a year, nine months to a year to build it. So hopefully by the middle, if everything goes according approved and we want to do it, we decide to move forward with it, the board decides they want to do it, then we would be looking at probably the middle of next year. we would move in.

Yes, sir, I do. Sorry, I was uh I was having a problem with the microphone. Um, this is a resolution to uh let us uh compensate our newest uh canine handler for care and custody of that dog. Although he works 40 hours a week, um he'll be uh bringing that dog to and from uh home and work. Um he's already had to do some vet checkups and things like that. So, we think this is a uh fair and a market-based way to compensate him for this time. All right. And this has been done before and it's done in other departments, right?

Yes. Good evening, board. The uh first resolution is 28. It's a resolution to award a bid for the solid waste collection and disposal services. Uh Miami Township conducted a competitive bid process for the 2026 uh solid waste and disposal uh collection contract. After reviewing all the proposals, staff determined that Rumpky of Ohio submitted the lowest and best bid. The contract is scheduled to begin July 1st, 2026. The law director verified that all processes and procedures were followed correctly and legally compliant. Why Rumpky was selected uh the lowest rates for all three base contract years. They offered fixed pricing for both optional renewal years and determined by staff as the lowest and best with the most control features for the benefit of the residents. I'd like to go over a little bit of the pricing option. Uh the first year was $17.89. Second year is $18.83 and the third year is $1982. Keep in mind that this is the monthly cost. The option years, if we so choose, $2086 for the first option and $21.95 for the second option. Resident benefits under this contract. Weekly trash recycling and yard waste collection. A free 95gallon recycling cart for each household. They do have flexible cart options. Uh you can use your personal carts uh or you can rent one and uh you can also place bags there. Weekly pickup of up to three bulky items at no additional cost. Uh co-mingled yard waste. It could be within the carts or it could be on the ground as long as it's properly bundled. And there's educational opportunities as well. So, we believe this is a strong and competitive proposal for our community with pricing that remains comparable and in some cases reflects smaller increases than what we have seen in surrounding communities. Okay. Resolution 29 is an agreement with Montgomery County uh for sign maintenance. So, as you know, we have started an initiative on branding and we replaced majority of our street signs throughout the township that have our logo, color palette. Um, this is to for an agreement so that way we can continue placement of these signs in Montgomery County right away still within the township. Of course, the objective is when you come in the township, you know, you're in the township. Uh I will explain that the county engineer at this time was not uh in agreement for signs up on mass and then intersections. So these would be at the corner intersection on the ground level. Um happy to answer any questions regarding this resolution.

And final res resolution that board resolution 30 is to authorize uh purchase of parks equipment. uh been working with the finance director for many years on building this uh budgetary process on uh on the mowers and mowing equipment within the parks. Uh this was capital uh that we planned for in 2026 uh using the Ohio public contracts through the state of Ohio. It is the replacement of two zeroturn I can't speak tonight. I'm sorry. Yes. Good evening, board. Uh, resolution 31 uh would authorize execution of an agreement uh rather two agreements uh for right-of-way acquisition services for the Kings Ridge Drive uh transportation project we've been working on for several years. Uh we're through our phase two engineered drawings. We have rightway plans that have been prepared and it's now time to bring a consultant in to actually appraise and acquire those pieces of rideway necessary for the project. Um for the most part the project is contained within the existing rideway. However, there are temporary pieces of rightway for construction purposes basically along the entire corridor that we'll need to acquire uh for construction purposes. So um under state statute, there are two contracts required to be awarded. first for a primary appraiser uh and someone to do the negotiation and closing and then we also have to have an appraisal reviewer second group who checks those appraisals to ensure that they agree and are are fair market rate. Um the two proposals we received uh we received several proposals but through a quality based selection process have recommended two MS consultants for the primary contract Martin and Wood for the secondary. Uh both proposals are well within budget and staff recommends uh proceeding with these proposals. If there are any questions, be happy to discuss.

Okay. Uh resolution 32. Again, this resolution authorize execution of the phase 2 addendum to the Austin Crossing project management financing agreement. Uh last year the township and the T entered into a project management financing agreement PMFA uh to start the process of acquiring all the ground necessary for the Austin Crossing uh public roadway project. We've been reviewing the last couple meetings uh the sort of individual final development plans as well as the the prelim primary roadway. Um but it's a as we discussed very complicated process. There's a lot of property owners involved. uh ODOT had land that's now in control of the T uh sort of being our proxy by through the township. Uh so with the developer RG properties uh there is a land transaction necessary to uh make ground developable by the developer and they are giving land back for public rideway purposes. Uh so this agreement is what will help facilitate all the work necessary to execute and finish that process. So um at this time recommend moving forward with this phase 2 addendum. Uh again we're doing this in concert with a larger development agreement and individual final development plan. So there's a lot of pieces but uh this is what will formally authorize the TD to start moving forward um making that uh authorization for uh the transaction to occur. There any questions?

Yes, board. Legal requirements for this hearing have been met and I do have a recommendation. First, I will go into my staff report zoning case 411-12, final development plan for the wind supply uh project expansion. Uh we heard this case last month at the resoning level. Uh and these wind supply guys move fast, so we are already back with the final development plan. Uh they did done a great job working with us through all of our Austin Crossing development standards. So, we'll go into a couple of them. Uh project timeline. Uh they anticipate construction uh here in short order this spring uh and then about a year year and a half maybe two years for construction. Uh working with uh public works, police, uh fire department. There are no negative impacts anticipated as part of this expansion. Uh traffic control access uh the largest piece here uh to review. Uh a traffic impact study uh for this site has already previously um been approved by Montgomery County. uh specifically the proposed ingress and egress that they are tapping into. Uh so working with the county engineer again this has already been planned for some level of industrial type activity. So this is nothing new. Um but sort of taking a step back we've had conversation with wind supply and also our county t and county engineer about uh reviewing the buyer banner intersection in the future for some type of improvements. It's a busy intersection that I think is only getting busier. So uh while we feel it can certainly accommodate the uh level of traffic that Wind Supply is proposing, we are looking forward to see uh what potential solutions might exist. Uh same thing public service burden. Uh nothing new anticipated here. Uh then getting into the actual proposal. Uh they're proposing uh a pretty large expansion to their facility. Uh doubling the site functionally as well as relocating their existing outdoor pipe

storage yard. Here's the existing site. Again, buyers on the west side, I75 on the east side, and here's a look at the expansion. This sort of turns the drawing for visibility. Uh, north being on the left side of the screen. Um they're expanding the building to the north, uh using the natural sort of curvature of the site and the interstate to stagger the building in uh and then bringing the pipeard to the north and then tying an existing access road that wraps around the building up to the north and connecting into that stub road at buyers that I mentioned. A couple of uh uh qualitative or quantitative items here. uh wind supply has met all the standards of the wind supply plan development. Uh the only item that uh really is worth noting is the uh parking discrepancy. Uh per our general code 214 parking spaces is what would be required uh versus the 101 that wind supply is proposing. Uh given that much of their building is just storage. Uh they are very comfortable with that 101 for their number of employees they have or visitors. Uh we certainly don't think that they should add more parking for no reason. So we're we're very comfortable with their explanation they've provided uh in that parking gap. Uh here's a quick look uh elevation uh from I75. I'll show you a on the ground picture in a minute so you can kind of compare uh the look. But the expansion is the the piece off to the right side of the image. That would be the north. Uh their intention is to continue the existing design of the building. Uh here's the dock side and I'll show another image of this from from the street view. Um but then this is the I75 side. Again, the intention is to continue their existing building on. Uh you can sort of see on that bottom image where that shadow comes in, there's a bit of a building staggering. I think

will create a really nice uh view coming down I75. Uh they're proposing a sign. Again, this is uh compliant with sign standards. Uh lighting plan. They've provided a lighting plan that uh that meets all standards of the Austin Center District. I have no concerns there. Here's a lighting table confirming everything is below the maximum six foot candles throughout the entirety of their site. Uh landscape plan. Uh the zoning commission had recommended uh some additional landscaping be installed as well as requesting a better look at the existing landscaping on site. Uh for building expansion, typically 50% of required landscaping is required um they in this case have exceeded that. They're adding 97 new trees, most of them primarily along buyer road uh and then several along the building um to match what uh the planning clusters they have out there today. I'll show you that in a minute as well. Um, but given some of the extreme topography of the site, we feel that they've, uh, very carefully placed all the trees that they can, uh, you'll see in a moment, the site as you hit off buyers, just drops off very quickly. So, there's really not a lot of room to plant between uh, where they're showing on buyers in the building. And then the same thing on the other side, it immediately goes to a slope down into the ditch between their building and I75 again. So, they have uh some some existing trees that are very wellkept, well-maintained. We'll take a look at, but again, are adding 97 trees to the site. I think it'll be a great look along Buyers Road. And then here's a look from I75. Again, we feel that uh the the tree plantings that they've already put out there are very nice on their building. It creates a really nice facade from I75. Uh we anticipate the same thing will happen with the the tree plings they're proposing. Uh but in addition to that, uh here's the actual view as you're

coming down, uh where their building will be. Uh you'll you kind of see that tree stand. That's where the building will be located. A lot of those trees are in ODOT rightway, so they're not going away. So while we're obviously trying to screen the building, you're not going to see a lot of it. The pipeard will be really hidden by most of those trees that are not going away. So we feel comfortable with their landscape plan they've put together. And then here's a view from Buyer Road. So there'll be trees down the entirety of this strip. But as you can tell, uh if you were looking at the aerial image, it just looks like lawn and then you hit where the trucks are parked. When you're actually looking at the street view because of that grade, you can't see any of the trucks parked out there or the truck docks. So again, we feel that their trees kept up closer to the road will probably still have the most screening benefit, but you really can't see the truck dock anyway. And then here's their sort of existing tree stand. Again, very uh wellplanted entryway, but you can kind of see the grading drop down there into the truck bay. Uh zoning commission recommended approval and a 4 to zero vote. Uh the only uh recommendation being that uh an updated landscape plan come back uh meeting some of the intentions for frontage trees as well as removing all non-native invasive vegetation. Uh the applicant was very comfortable with this recommendation, came back with a well done revised site plan. uh staff believes is fully meeting the spirit and intent. So, um once we get a couple of things buttoned up, I think we're hopefully on our way to construction. Public health, safety, morals, and welfare. uh there's no significant impact anticipated working with our uh reviewing partners. Uh traffic control and access again the largest item here being that uh approval of the internal roadway is a prerequisite for development of this site. Public service burden um similar with all new development. Fire and police now have additional coverage expectations but otherwise uh no undue burden and then arrangement compatibility of the structure. So you're taking a look here. Uh Chick-fil-A is the first site as you turn into the development. Uh you turn in, come around, and then see the the traditional Chick-fil-A drive-through lane that sort of wraps around the entirety of the outside of the site.

Uh again numerically uh the site is is very well put together. Size setbacks uh building height impervious surface everything uh meeting Austin Crossing development standards and our code. Uh designers put together a really nice uh looking building. This would be a good uh first look as you come into the development. Uh just a very uh high-end design for a Chick-fil-A. Entirely made of brick. uh done a good job in incorporating glass uh base treatment uh putting on a facade that will help screen some of the uh roof mechanicals. Uh that was one of the very few items that uh came out of discussion was ensuring that roof mechanicals will be screened from the ground level. Uh the applicant has put together a sighteline survey to show from all neighboring roadways. Uh the facade will hide all of those mechanicals. uh something we try to do just to uh improve the quality of design. Uh they put together a sign package that meets all of our sign standards. I believe they had to pull maybe one of the uh wall signs off of the plans and they've done that. So they have met all sign requirements. Uh the lighting plan is one area uh that the zoning commission recommended uh a a modification to the plan. Uh currently uh the applicant is proposing a higher level of light uh than what would typically be permitted under our zoning code. Uh a zoning code typically allows for six-foot candles. Uh it's a level of brightness that is consistent across all sites. However, for gas stations, uh drive-throughs, uh banks with some security concerns, our code is allowed to go up to uh 10 foot candles. uh that is a sort of extension or uh excessive lighting, additional lighting beyond what is typically required. Come back to this image in a minute. Um the

applicant's current proposal uh averages higher than that uh with reaching the highest brightness points of like 35 foot candles. Again, significantly higher than what we would otherwise permit. Um, using some of these numbers, it's hard to really get a grasp on what that means or how bright that is. So, we wanted to give some context. Uh, one site that we knew we had approved under our our new lighting standards was the Speedway, the corner of Austin and Buyers, uh, down by Austin Landing. Uh, we feel that is a a pretty bright canopy when you're under uh, you can certainly see everything you need to on the uh, registers or at your vehicle. Uh, again, went down to just double check and measured that yes, they're at that 9.8 a foot candles. Um, again, I would encourage anyone to to take a look at it. It feels very bright. So, uh, the the proposed level of brightness under the canopy feels excessive, particularly relevant to, uh, the Austin Commons, uh, building, multif family residential building, directly across the street from one of the canopies, as well as the other side being directly adjacent to State Route 741. Um although the lights sort of taper off once you get outside of the canopy, it still is a very bright point that uh we have concerns of visibility for our drivers and for uh residents immediately adjacent to that. Particularly given that uh again we have not heard or or received any concerns about the level of brightness at something like a gas station which again we we tend to want to be bright. So, uh, the applicant, I think, has, uh, prepared some some studies they'll likely discuss as part of their applicant comments, but again, from the staff level, wanted to express our concerns with with greatly exceeding our standards, um, that we want to be sure are not unduly impacting our drivers or residents. Uh, landscape plan, they put together a fantastic landscape plan. Uh, really met the spirit and intent of frontage trees. Uh, they have a very difficult site.

They actually have three public road frontages being the first site in. So they have 741 and then they have the two new roadways within the development. So they have trees uh basically surrounding their entire site internal to their site and then they have a bush uh a shrub canopy line coming around the drive-thru to help screen cars that would otherwise be facing 741. So uh they've put together a fantastic plan on the landscape side. Here's a look at some of the trees. Again, good native species. So, there's a couple of recommendations. Uh, first being, uh, that the approval of this plan is contingent on approval of the roadway. Again, that has now been approved by the trustees. Second, applicant must provide updated sighting plan includes a safe, well-marked pedestrian connection. They have done that. Um, there is a path that it's hard to show here. get my mouse over here. Yeah. So, the crosswalk comes down, hits the sidewalk, and then connects with a crosswalk up to the front uh walk here. So, anybody internal to the development cross and have off off streetet connections through the site. Uh there's also a bike path that comes down through the front of the property uh to connect folks over to Austin Landing. So, uh internal to the site, it will help pedestrian connections move very well. Uh applicant must provide updated building elevations showing ground mounted roof mounted mechanicals. They have done this. We think they'll be well screened. Applicant must provide updated signage plan which reduces the number of wall signs. I think that was the only item that exceeded our code. They have done this. Applicant must provide update landscape plan meeting all requirements zoning resolution Austin Crossing development standards. Uh again we think it's a it's a great landscape plan. Uh certainly meeting all of our standards. Applicant must provide an updated lighting plan

Um, we've we've worked to with Chick-fil-A and with their lighting designer um to get those down to what we think is the minimum acceptable, which is the uh illumination engineering society's recommendation of 10 to 30 foot candles average. I know this the this city's requirement is 10 foot candles max um at any point, but we feel that that is just not bright enough or light enough. Uh we have employees, you know, I don't know if you've been to a Chick-fil-A um restaurant through the drive-thru, but we have probably six or seven employees in that drive-through lane working, taking orders, both two lanes. So they have, you know, two or three people in advance um taking orders and then people on the other end where the meal delivery is is being um delivered. So, we're real concerned with making sure it's visible that the vehicles, you

So the because the the our canopy the one that they gave the example um for the gas station those those lights sit up higher. Our canopy is a has a we have a crossbar clearance requirement saying that any vehicle over

Yes, board. Legal requirements for the hearing have been met. I do have recommendation zoning commission. Uh the specific project location, this is the former ODOT out parcel located to the west of the uh former Walker Toyota, now South Dayton uh Toyota dealership at Lions and State Route 741. Uh in 2022, uh the property owner requested uh after purchasing the ODOT out parcel uh requested a reszone to uh basically match the uh the car dealership zoning. So allowing for uh some use for auto sales or sort of accessory type land use for the primary dealership. Uh since then, the property has changed hands. The new property owner uh is now prepared to come forward and and use one of the buildings formally on the ODOT out parcel. Uh but prior to doing that there were a couple of requirements. Uh they had to uh prepare an access management plan uh in response to comments from McGomery County Engineer. Uh they had to uh meet the county engineers requirements uh prior to commencement of any permitted land use in the development. Uh and then uh lastly a final development plan itself must be approved prior to com commencement of any permitted land use. Uh so again taking a look uh the parcels were entirely separately managed from an access standpoint. So uh the county engineer at the time reviewed the site and said uh we need to do some work on Lion's Road to improve the access. The two points are uh too close to one another and are too close to State Route 741. Uh so we need to revise access uh to the site. Uh so take a look at the site plan. Uh the applicant is proposing uh demolition of two of the structures on the site. This the as you drive sort of west on lines, you can see they're kind of the older barns located on the property. They're not in great shape. So they'll

Uh the other important piece here and I'll highlight uh so discussing with the applicant we went back and forth uh on ways to uh better manage the access to the site working with McGomery County Engineer as well. Uh one of the original proposals was to consolidate both of the drives into one single point. Um that was the original proposal, original recommendation of the county. Uh after reviewing a little bit more with them, reviewing the traffic manual, uh the revised recommendation was instead to allow this access point to remain as a full access point to the ODOT lot and converting the existing access point uh for Toyota into a ride in ride out with a designated pork chop. Uh the reason being for uh leaving this existing point as there is already a dedicated left turn lane on Lion's Road to allow access into this point. Uh if we were to fully consolidate it or even push it further to the east, uh there would be uh not much room really for a dedicated uh left turn lane into the site. Uh so instead leaving this as a write in ride out will also allow the applicant to uh managing their shipping routes, bring trucks in uh eastbound on lines and into the site where they've already been managing all

So, uh, we feel that this is a a great solution to, um, take out this full access turn movement where currently drivers are using, uh, a through lane to wait and turn left in across several lanes of traffic. Um, and drivers are trying to turn left out of here where vehicles are coming up and onto lines very quickly from State Route 741. So, uh definitely believe this is a uh a huge improvement to site access uh and certainly feel that uh you know reuse and and some clean up of that uh garage building is a a big benefit. Here's a quick look. They're doing some cleanup work on the uh kind of brick facade down by the main entryway, but otherwise it's really just kind of garage doors that run the length of that. So, they're going to do some painting and cleaning up of those garage doors as well, but we think it'll be a good reuse of that building. Uh here's some data. Again, this is some of the background work we put into uh the traffic manual from the county on determining where sort of the no access zone should be uh versus further up the road where full access could be given that there is dedicated left turn movement. So the only recommendation that came out of the zoning commission case was that a revised site plan be prepared showing the addition of a traffic island at the site entrance of Lions which limits ride in ride out only. And secondly, this is prior to issuance of a zoning certificate that an access easement be recorded. Uh that would give cross access between the two sites. Should the developer sell in the future, somebody if they wanted to get out left on Lions could still use that full access point uh across the two sites.
