Ticket Appeal - Regular Meeting
The meeting primarily addressed ticket appeals, with many cases resolved through settlement agreements where violators agreed to pay fines. Two cases proceeded to trial, one resulting in an upheld violation and the other dismissed due to an incorrect notice. Numerous other tickets were upheld due to the alleged violators failing to appear.

reliable will be accepted. Understand that. And everybody has the right to call and examine witnesses. So if you have witnesses with you, they can speak as well if that's what you want. It's my responsibility to find the facts of the case, right? So I'm looking at whether the violation did occur and if the person named is responsible for that violation. In order to uphold the code enforcement inspector's decision, I must find by the preponderance of the evidence that that violation occurred. And what I will be, my order will give the amount of the civil penalty and the administrative cost if I put on administrative costs. And that means we're here having a hearing so there can be an administrative cost attached to the penalty. You're also warned that failure to comply with this violation by the date in which you're supposed to comply with it may result in an automatic referral to the Code Enforcement Board, and that may be the imposition of fines per day. So if you don't take care of it timely, you'll find that every day you'll have a fine attached to it. The alleged violator, you may seek to overturn my order by going to Miami-Dade Circuit Court Appellate Division within 30 days of receiving the order. So the way this works is after the code enforcement inspectors put on their case, you will put on your defense. So everyone will come to this podium. The city will use this podium. We will start with the Pledge of Allegiance. So I'm going to ask everyone to please stand for the Pledge of Allegiance.
Please remain standing to be sworn in for those who will be testifying today.
Please raise your right hand. Do you solemnly swear or affirm the testimony you are about to give today is the truth, the whole truth, and nothing but the truth? Thank you. Have a seat. Quietly and safely.
Interpreters, right?
Uh-huh.
Interpreters? You're gonna swear to me. No, they're not here today.
Okay, so.
I'll call the first case when you're ready. Okay, we're going to start calling cases. Understand that the cases that are called first will be the agreements, the settlements, and then the full trials will be called.

I don't want to hear that. Okay.
Sir, you want to settle or not? Because you have a right to a hearing.
Yeah, we agreed already.
Okay, $200, so ordered. Thank you, sir. Two copies are here. Sign both. Leave one with the city and you take one.
This case was previously called. It's page 83, case number 147252, property address 4222 Northeast 1st Avenue.
Hi, how are you? Good morning. Good morning. Your name, please?
David Kassir.
City? You have an agreement with the city, sir, that the violation did occur? Thank you. You're legally responsible, it's been affirmed, and you've agreed to pay $250, is that correct?

So ordered, sir. Please come sign. Thank you. And that's all the settled cases I have. Okay, quiet please. We're going to move forward with the hearings now. So remember, I'm looking for if the violation occurred and the person named is legally responsible. One more settlement, sorry.
Page 94, case 147452, property address 2200 Tigertail Avenue.
Hi, good morning. Morning. Your name, please.
Ernesto Runhill.
Sir, you have an agreement with the city that the violation did occur. You're legally responsible and it's been affirmed. You've agreed to pay $250. Is that correct?
Yes.
So ordered.
So come sign.
There are two copies.
Come sign both.
And that's the last settlement, is that correct? Madam Clerk, is that the last settlement? Yes. Okay, I know there are some people who were here to be witnesses on a case where the parties did not show up. That ticket will be upheld as a matter of law. We do have some trial cases before we announce it's upheld as a matter of law. If you'd want to stay through that and then go, that's fine, but I know you're here for that, so I just wanted to let you know that We have two trial tickets we're going to go through first. That'll probably take, I don't know, no more than a half hour. And then they'll go through the cycle of the ticket appeals that fail to appear, which are automatically upheld for them to pay, and it's a violation. Okay? Just to let you know. So the cases that are set for trial, we have page 37, which is 3720 Kumquat Avenue. If you wanted to, as I said before, if you wanted to see your case, I could show it to you. And I also have 4530 Northwest 17th Avenue. 4530 17th Avenue. Those are the two trial cases. I have no other cases at this time. If you are here for another case, not those people who are here as the witnesses for the Xi Jinping case, you have not checked in. We don't know why you're here. You need to speak to the clerk over there. So the inspectors I need at this time only are Inspector Mills and Inspector Perkins.
All other cases are gone for today, except we have one more person, so just give a minute.
No, they're late. If these people leave, I mean, we're upholding the ticket. Do you want to do that now for 2101 since we have witnesses here?
That's fine.
All right, so that's page... What are we doing? Page 8. 2101 Southwest 22nd Street, case number 00143664, which is Inspector Purnell. For MVH 2103, it is a noise ticket. Nobody has appeared. We'd ask that the ticket be upheld for failure to appear.
I don't have any papers.
You just say, yes.
I want to sign off on it.
No, you don't have to sign off on it.
Okay, you don't need me to sign off on it. It's an FTA.
It is 946. We were set for 9 o'clock.
Okay, so no one has shown up for the ticket that was just called. There is no witness, no property owner here. I'm upholding the ticket.
And we're going to release the witnesses for the city. Thank you very much, Madam Magistrate. Sir, this is not the time for that. We only have one ticket on for today. If they don't appeal the tickets, this is what we have here today. So, ma'am, your property is set for an appeal. Are you on Kumquat? Okay.
Has everyone had the opportunity to speak with the city, look at your ticket, make an informed decision?
The first case we're gonna call will be page 37. It's going to be 3720 Kumquat Avenue, 00145306. You ready to move forward?
Yes, I'm ready.
Okay, I don't know if you want to ask name and...
I don't have an order.
Right, what's for trial?
I still have to sign off and fill it out. Thank you.
I usually bring the order over after I admit the evidence, but...
So just for the record, the city's going to put on their case, but what's your name, please?
Clara Garcia.
Thank you, ma'am. Go ahead with the city, and then I'll hear from you.
Okay. Inspector, did you put... Please state your name for the record.
Inspector Mills, City of Miami Solid Waste Coal Division. Okay.
Did you put together pages 1 through 28 for today's hearing, which we can see up on the screen? Yes, I did. All right. You cited the property for a violation of 22-6 of the city code, which is the trash was placed out on another, not only at an unauthorized time, but it was dumped across the street. Is that correct?
Correct.
And what we're talking about are boxes... with addresses on them, is that correct? Correct. Okay. And you sent both the ticket citation as well as the summons for today was mailed certified mail as well as posted at the property, is that correct? That's correct. All right. And these are copies of what was mailed and posted. We have the appeal here. The explanation and the reason for the appeal is bulky waste was removed within an hour of the notice. And these are the documents, the property appraiser showing the owner, the deed showing the owner. We're on page 17. This is the address, correct? 3720 Kumquat Avenue?
Correct.
All right. And then this is the box with the address on it, correct? That's correct. All right. That shows a posting. This is the area where it's found, is that correct?
Yes.
And was that across the street? Directly across the street, no.
All right.
So it's not even on their own property where they're required to put items, correct? And in fact, all of this is dumped in front of a no dumping sign, which the city has placed up.
Yes. Okay.
And that's a copy of your posting and that's the property. This is the posting for today. And we have that at this time, the city would seek to admit pages one through 28 into evidence.
So admit it.
Inspector, did you have any conversations with the owner or any resident of the property?
No, only the daughter, I think, on the day that I was doing the posting for court. The daughter came up to my car to ask me what was that, and I explained that that was their court paper. Okay.
We have nothing further.
Thank you.
Thank you. Ma'am, I'd love to hear from you, please.
Okay. The same moment that the inspector was there, one of my daughters was pulling out, and she noticed, asked her, and she called me with her in the property. I said to her, please, do not place the ticket. I'm going to send my husband right now because he was two blocks away to remove the box because today every neighbor has been dumping. You see many other objects were there. I said to her, please, I'm going to go in five minutes. I have the proof. In less than 10 minutes, the box was removed. I said to her, please, I'm going now to remove the box. She said, no, I can't. And that is why I think I bring this for your consideration. Still, there is no sign. Still, in this place, the neighbors are dumping a lot of stuff daily. You must put again the signs.
I see a sign that says no dumping. I see a pile of trash with a box with the address 3220 Kumquat Avenue. 3720. 3720. I'm sorry, I do numbers that way. 3720 Kumquat. Sorry about that. That's what I see. Removing the violation after it's occurred does not mean the violation didn't occur. The officer's job is to find violations if they occur and cite the person for them. That's what happened. You received the ticket because there was a violation. You sound like you were Oh my goodness, we should not have done that, but that's not a defense. So I haven't heard a defense to the violation. I'm looking at a clear violation. Even if it was down the street, around the corner, with your address on it, you're one of the people that will get a violation. I don't know who else, and you talked about neighbors. That has nothing to do with this case. So I'm going to uphold the violation did occur. Your legally response point has been affirmed. The amount of the penalty is $5.25 plus an additional $50 court cost. That's the case so ordered. Thank you, ma'am. There are two copies of the order. I need you to come sign the bottom. You're going to take one of each and you're going to leave one for the city and you'll take one. There's also a document explaining payment. You can take that document so you can understand the payment, so you can do it timely.
All right, our next case is 4530 Northwest 17th Avenue. Did you want to see the file or not? Okay.
Come on over.
Inspector Perkins.
What page?
This is going to be page 85, 4530 Northwest 17th Avenue. 00145512, if you wanna see, you can come over here, I'll at least explain it to you. So this is for the garbage and the roll off. We'll get to, this is just all the notices, obviously. That's your appeal.
This is the lot.
Give you, that's all I need to know. Okay, thank you. Page 85, the initial notice, the address was incorrect. Violation is reversed. Bad notice.
I'm gonna, right now.
You can go over there. I need your name on the record, sir. Good morning. So what's your name, please?
Andres Rico.
So I have the address 4530 Northwest 17th Avenue. And I have here that the violation is reversed. There was a problem with the notice, so it's dismissed. So ordered. Okay?
Thank you.
I need you to come sign off, sir. and take a copy and leave a copy.
All right, we're ready for upheld, not, you know, the fair to appear.
Okay, page eight, case number 143664, property address 2101 Southwest 22nd Street. No show. Upheld. Page 14, case number 132950, property address 5915 Northwest 12th Avenue. No show. Upheld. Page 21, case number 130947, property address 8100 Northeast 1st Avenue. Did they get proper notice? Yes.

The guy who runs the church came back again without a power of attorney or without the owner again, knowing he was supposed to bring them. We're not resetting it a third time. So he said he was going to pay it. So it is a no-show because the owner did not appear and the owner was the party noticed.
Upheld.
Okay, next case, page 39. Case number 143209, property address 2644 Northwest 22nd Court. No show.

Adjourned.
Yes, we are adjourned.
Thank you, Madam Magistrate, and Happy New Year.
Thank you. Same to you. Thank you so much.
you you . . Thank you.
I've seen names here like Burdines, Toomey, Jackson, Tuttle, very well-known names in our community and they are the foundation of Miami. So it's important to know where we come from so that we can know where we're going. And it's important for us as a city to keep investing in this cemetery, upgrading it, and really celebrating, exalting it to a much bigger, greater level so that it can have its proper status within our city.
We're here today to groundbreak on a new maintenance building for our historic cemetery, a project that we're managing directly. This is a very important site for us. It's historic. It's very important for us to not only maintain it, but within the future, enhance the site.
This is one of the ground zero sites for us where historic preservation is concerned. We're committed to all the enhancements and improvements that we want to see at this cemetery.
I've been volunteering for about 38 years. This cemetery started in 1897. The property was owned by the Brickell family. This is really ground zero for who's buried here in Miami.
Words can't even explain how thankful I am. I finally got a place where my kids can actually play in the backyard, and I get to watch them outside of the window, and I'm just very thankful.
Thankful! The house is a three bedroom, two bath. It's approximately 1,400 square feet, brand new, all state-of-the-art stuff inside, impact windows, impact doors, the air conditioner is energy efficient, the house is very nice.
We're really excited about providing assistance for another home buyer. This is in a very desirable area of Miami and it goes along with our intent to try to diversify neighborhoods and provide affordable housing opportunities throughout Miami and this is a classic example of that.
I am so excited for yet another first-time homeowner taking the keys to her new home. She is now a stakeholder in our community. She's creating generational wealth for her family. This is our 16th first-time home buyer celebration. We have eight more to go. Real affordable housing through homeownership.
for us to come here. What process do we need to be able to repair everything in the area? We need, first of all, alphabets. If everything is done, we need light work. If it is not done, we put alphabets in it. We need a machine to cut it and put alphabets in it. How long does it take to repair the hole in the back? It can take, depending on how big it is, it can take 3 to 4 minutes. The best way to remove it You have to wait for them to report it. They have to wait for 311.
La vida no se detiene y tu acceso a la información del gobierno local tampoco debería serlo. El servicio telefónico del 311 es tu conexión con todo lo que necesitas para obtener información sobre los servicios que brinda la ciudad de Miami.
When a storm is on the horizon, turn to 311 for assistance. From FEMA information to evacuation centers, 311. Stay safe and informed.

As technology advances, scammers have figured out multiple ways to use it against us. Scammers target consumers searching for company contact information online by purchasing fraudulent ads that look legitimate. When individuals click these ads or call the displayed numbers, they are unknowingly connected with scammers and share personal information. Victims often only realize they have been scammed weeks later. To protect yourself from online search scams, follow these tips. 1. Always use the phone number on your FPL bill instead of searching for contact information online. 2. Check the URL for misspellings or extra characters. 3. Look for the padlock icon, which indicates a secure connection.
It happens more than you would think because scams are getting more elaborate. It can be difficult to tell what is a scam. These scammers know how to confuse you and take your information.
Scammers are aggressively targeting utility company customers across Florida using sophisticated tactics to pocket quick cash. And it can happen to anyone.
At Florida Power & Light Company, we don't ever want one of our customers to become a victim of a scam. That's why it's so important that you follow these tips to best protect yourself.
If you receive a suspicious call and they say it is FPL asking you to pay something, hang up. Even if the caller ID displays FPL's phone number and name.
FPL will never call you and demand something immediately. An FPL employee will never call you and make you feel pressured to provide personal information.
FPL will never demand immediate payment through an app like Zelle or Venmo, a prepaid card or wire transfer to avoid service disconnection. FPL will never ask for personal information, such as account numbers or your social security number. FPL will never ask for personal information unless you call them, in which case we will ask questions to confirm you are the account holder.
