2:27Speaker 6

So a couple of housekeeping matters. Mr. Williams has asked for an excused absence, so if we can get a motion. Motion. Second.

2:36Speaker 7

All in favor?

2:37 – 3:10Speaker 6

Aye. Second. There's a copy of the nuisance abatement report for 2025. I understand there's a typographical error. I have corrected it already in my draft. By the time I sent it this morning, I picked it up. Other than that, take a look at it. It explains what we did last year. And again, there wasn't much of anything special. But again, I did reinforce the importance of appointing members to this board. There's two vacancies, so hopefully we can fill those two vacancies.

3:11Speaker 7

I did review it. Thank you very much. It was very well written.

3:16Speaker 6

We'll go on for nuisance abatement.

3:23 – 5:10Speaker 8

okay good uh good evening everyone we're going to call the nuisance abatement calendar it's four cases should be fairly quick two motions to terminate and withdraw and two status updates first case uh appeared on page five and six property one four five eight northwest 69th terrace owner is clearview capital corporation just uh members of the board this was a property that we dealt with dealt with in the past We jurisdictioned out last year on a prior nuisance order. There was a new one that hearing was held in April 2025. The property has consistently been non-compliant. The prior owner was deceased. There was a new owner, but nothing was apparent on the property appraiser website. However, in the interim between The December and the January nuisance abatement, there is a new owner of Clearview Capital Corporation. I have a report from the neighborhood resource officers that the property is clear of all debris. It's boarded up at the present time. There are no individuals at the property. There's no information or ongoing narcotic activity this order does terminate pursuant to the code in april of 2026 naturally however due to the uh update from the neighborhood resource officers the fact that the property is free and clear of activity persons it's all boarded up there's no one there at the present time despite the prior non-compliance at this time the based on the wishes of the police department, the city is going to motion to terminate the order as it relates to this property.

5:11Speaker 7

Okay, so just so I understand, that's 1458 Northwest 69th Terrace?

5:17Speaker 7

And there was an order continuing the status, right? Yes. Okay, so today you're just going to move for termination? Yes. Do we have a motion?

5:27Speaker 6

Move to terminate order.

5:30Speaker 7

All in favor?

5:31 – 6:29Speaker 8

Aye. The second property, appearing on page seven through 104, it's 7001 Northwest 15th Avenue, apartments 19 and 21, calling out the owner for the Saha Buildings Corp. This was a hearing we had back in May of last year. It was found guilty. There's been multiple status conferences on this matter. Last December nuisance board meeting, there was a $500 fine issued for noncompliance. The update from last time, there's too many owners and they've been non-compliant. There's continued problems. Relating to the, excuse me, January update now, still no compliance, no contact within the orders. They're just non-compliant with all the conditions of the order. So based on that, the city is going to motion to fine the property $500.

6:31 – 7:01Speaker 7

reset this matter for february 25th of 2026 we do have jurisdiction until may of 2026 and this is 7001 northwest 15th avenue apartment 18 us apartment 19 and 21 yes sir okay and are these each one of these apartments i guess they're individually owned like they have their own folio number that's why it's not the entire building the no the the building has one folio number it's one

7:02Speaker 8

It's one owner that owns multiple units within the complex.

7:06Speaker 7

But you can have different owners own different units?

7:10 – 7:21Speaker 8

Yes, I believe the, in this case, the corporation owns the entire complex. Right. So if there's another, I mean, as far as it relates to this one, the corporation owns.

7:21Speaker 7

I'm just wondering, at one point, is this leanable that the city could, you know, bring them to the table to, I don't know.

7:28Speaker 8

As far as noncompliance with the order?

7:31Speaker 7

Right, I mean, there's some kind of monetary fine running with it, right?

7:34 – 7:47Speaker 8

Right, right, and those are liens issued against the property. I mean, the other avenue pursuant to the code is there's contempt proceedings, but that would require permission from the board and brought within a circuit court.

7:48 – 7:59Speaker 8

It's separate and apart from what we're doing today, but as far as what we can do today is find the property and liens on the property. Right, it keeps running. And we get jurisdictioned out.

8:00Speaker 7

In this case, it would be So what, the next step would be injunctive relief with the circuit court?

8:11Speaker 7

I mean, if it's just a nuisance. And I'm just asking, this is educational for me. I mean, I'm just wondering. It just goes on for years and years. At what point does it get knocked down?

8:19Speaker 8

Well, that's not for the nuisance board. Right. You know, code enforcement can go in there and inspect the property. Right.

8:28Speaker 7

But I'm just saying for this board, we have, you know, $250,000 in fines at some point, is it lienable?

8:39Speaker 8

It doesn't convert to a lien? I don't know the answer to that.

8:44Speaker 3

These aren't per diem liens. This is nuisance abatement, so it isn't a per diem lien. It's a one-time lien every time. Yes, it is a lien against the property.

8:55Speaker 7

I'm just saying at some point somebody runs a title search and says, we've got to deal with this.

8:59Speaker 3

They're going to see that there's an open case, and the maximum you can do is the $500.

9:04Speaker 7

Okay, so there's some kind of notice that a subsequent taker would say, this is open and we've got to resolve it.

9:10Speaker 3

We have a problem. Correct.

9:12Speaker 7

Okay, that's all.

9:13Speaker 8

And they'll see if, you know, in, what, May of 2026, if we bring a new complaint, they'll see it's a second open case or second pending case.

9:23Speaker 7

Trying to understand it. So you're seeking a motion to continue?

9:28Speaker 8

Requesting a $500 fine and set it for status in February 25th, 2026.

9:36Speaker 7

Do we have a motion?

9:37Speaker 5

February? It says here January 28th. I'm sorry. What is today? What is it? Yeah, it's today.

9:45Speaker 4

What's today?

9:46Speaker 5

The order says today's date, January 20th, 2026. The defendant shall provide a status on January 20th, 2026 at 5 p.m. on the board.

9:54Speaker 8

Which page are you on?

9:56Speaker 6

I'm sorry? Which page are you on?

9:58Speaker 5

Yeah, he's here providing the status.

10:01Speaker 8

Yeah, I thought I said reset to February. Oh, okay.

10:04Speaker 5

Yeah, reset to February. Yes, one month. I second.

10:10Speaker 7

All in favor?

10:11 – 12:35Speaker 8

Aye. The third case is appearing on page 105 and 106. This is a set for hearing. Property is 1505 Northwest 68th Street. owner anthony's comfort in inc the owners were here last time they are represented by an attorney i have word from the neighborhood resource officers that prior to this complaint well since the complaint was filed and prior to this hearing the property has been in compliance with all the requests that we would normally issue within the order and the request is to please close out the case so based on that information and i can i can provide the board summary of the factual allegations, but based on that, the city is going to motion to withdraw the complaint at this time. This is a property that was engaged in four CI purchases for cocaine, and there was a search warrant that revealed firearms and lots of rounds of ammunition. However, that property has since been in control. The owners are Compliant the owners are in communication with officers and they were prior to this even being heard before the board So based on that city is going to motion to withdraw the complaint Do we have a motion to grant the city's motion to withdraw the complaint so moved? second second all in favor final case is appearing on page 107 through 144 property addresses 17 to 1 Northwest 55 Street owner Danny Felton This is a property, this is set for status as a hearing back in April of 2025. Jurisdiction terminates in April of 2026. There was a $500 fine issued at the December nuisance abatement due to noncompliance. Essentially, the owners or the individuals in charge of the property have not been in any communication with the officers. There's been no compliance with any conditions of the order. It still remains the same today. There's noncompliance, no contact. And at this point, the city and the police department would request a $500 fine and reset for status February 25th of 2026.

12:36Speaker 7

We have a motion for the $500 fine and the reset.

12:39Speaker 5

I move as stated. Second.

12:42Speaker 7

All in favor? Aye.

12:45 – 12:56Speaker 6

And just a point of clarification, the first case that you terminated, do you need an order on that first case? Which case? On the termination, the first case you terminated.

12:57 – 13:18Speaker 8

I'm sorry, what was the question? Do you need an order on? No, I don't need an order. Unless the property reaches out to me, then I'll reach out to you. All right, thank you. I think we just got, sir, what's your name? Are you here? Can you come? Okay, is that your company?

13:21Speaker 8

Do you own Saha Building Corp?

13:23 – 13:34Speaker 4

No, I'm the manager. Okay, do you have a... Power of attorney, last time I was here, I provided the power of attorney to you guys. Do we have that? I was here for both hearings as well.

14:00Speaker 7

While he's looking at that, what's going on with the property? It's not ready. It's not cleaned up, the property?

14:08Speaker 4

Did you talk to the neighborhood resource police officer?

14:28 – 14:45Speaker 7

What's his name or her name? You spoke with Officer Robinson? Yes, he knows me. Okay.

14:47Speaker 7

Yes, Robinson. That's not the NRO, though.

14:50Speaker 8

You have his phone number?

14:57Speaker 5

Should we ask for his name for the record so we can have it? Yeah, we can.

15:01Speaker 7

I thought he said it when he came up here. What's your name for the record?

15:08Speaker 4

Scott. S-C-O-T-T.

15:16Speaker 7

I mean, ultimately, you've got to come back next month for another hearing.

15:19Speaker 3

We do not have the power of attorney. You need to bring one every time that you're here. We don't have your power of attorney. We need to bring it with you every time you come.

15:29Speaker 4

Okay, I was not aware of that. But I've dealt with the attorney as well on numerous occasions, even through email as well.

15:38Speaker 8

You've emailed me?

15:39 – 15:58Speaker 4

Yes, we had correspondence, I believe, as well. You was out of the office. I've dealt with your secretary as well. What's your email? It should have came from Superior Capital. And as well, you've texted me.

16:03Speaker 8

We just got to get the green light, so... Yeah, I mean, I've spoken with you back in June of 2025, so... It's been some time.

16:12Speaker 7

Get in contact with the NRO so the NRO can tell them if everything's cleaned up and good to go. When you come to the next hearing, then, you know, there'll be some notes in there.

16:20 – 16:50Speaker 8

If I can make a recommendation... Yes, sir. Due to the fact that I don't have officer... It's Robbins, not Robinson, here to testify. I'll give him the benefit of the doubt for this time because we don't have him here. I know there was a prior ruling. Let me talk to him after because it's the last case. I'll meet with you right here. And we'll come back with the status next time. We just reset it for status, no fine today. And we'll just reset it for the same date, February. We have until May, so...

16:52 – 17:42Speaker 7

Okay, so do you want us to... I guess motion... Motion to modify the previous motion. It's going to be reset, but withdraw the... Yes, sir. The fine. Yeah. Okay. Regarding case number NAB 24-06, as it relates to property 7001 Northwest 15th Avenue, apartment 18 and 21, Miami, Florida... the owner of Saha Buildings Corp owners, based on the city's request, do we have a motion to modify the previous motion to cancel the $500 fine and reset the matter for hearing on February 26th?

17:43Speaker 5

I move as stated.

17:44Speaker 7

Do we have a second? Second. All in favor? Aye. Aye.

17:49Speaker 8

That concludes the calendar. Sir, just give me two minutes, I'll come talk to you. Thank you.

18:02Speaker 4

Motion to adjourn noise abatement.

18:05Speaker 7

We have a second?

18:07Speaker 7

Second. All in favor? Aye.
