6:02 – 6:14•Phillip Scott

Okay, I have seven o'clock, so we'll call this session of Mansfield City Council Caucus meeting to order. Are there any committee reports slash public announcements?

8:29•Phillip Scott

NEW SPEAKER ANYONE ELSE HAVE ANY COMMITTEE REPORTS SLASH PUBLIC ANNOUNCEMENTS? Okay. Fair.

8:38 – 11:23•Jodie Perry

All right. Before I do the next beautification awards, I wanted to make a couple quick announcements. First, some of you are aware because you participated, but the CIC has been steadily working behind the scenes, putting together a plan for on addressing the entryways, and most specifically Main Street, both North and South Main Street, outside of the downtown area. So we did a walkthrough two weeks ago, I believe it was. We had department heads there, we had business community leaders there, and Councilwomen Mount and Meyer were able to join us. So we're continuing to work on that, and I'll

12:17 – 13:13•Jodie Perry

And our second honoree this month is the M1 Church. We have Pastor Mark Lehman is joining us. I think we've got some photos there as well. There we go. They have done a lot of rebranding and outside work on the outside of the church. They're over on McPherson Street. Their property is always really well kept, and that is certainly an area that we want to continue to encourage people to invest in their properties and keep it up. I should say we can give you a stake if you want to stake these in the ground, but we did it without the stake to start. Anything you would like to say?

21:47•Phillip Scott

Thank you. Very good. Then we shall proceed with legislation. And starting for caucus, we'll start at 26-145, Mrs. Meyer.

22:02 – 22:28•Cheryl Meier

Thank you, sir. 26-145 will be authorizing direct reports to accept and appropriate a grant in the amount of $10,000 from TransCanada Energy Corporation to be used for the purchase of rescue equipment. I understand from Chief Crow that this will be used to purchase confined space rescue equipment, i.e. breathing tanks and respirators.

22:31 – 22:42•Phillip Scott

game is there any questions discussion on 26-145 OK, moving on to Bill 26-146, Mr. Miranda.

22:43 – 23:11•Mike Miranda

Thank you, Mr. President. This is accepting the specialized grant docket in the amount of $220,000 from the Ohio Department of Mental Health and Addiction Services through the Richland County Board of Mental Health to be used for personnel cost and other supporting services associated with four Mansfield Court specialty dockets the Domestic Violence Court, Drug Court, Mental Health Court, and Veterans Court, and declaring an emergency.

23:12 – 23:25•Phillip Scott

Is there any discussion on Bill 26-146? Okay. Okay. Seeing none, moving on to 26-147. Ms. Robertson?

23:25 – 23:37•Shari Robertson

Thank you, Mr. President. Bill 26-147 is authorizing a claim to William Bettner. It's claim number 90-060226 in the amount of $80.47. Okay. Any discussion on 26-147? Mr. Falkett?

23:46 – 24:11•David Falquette

Thank you, Mr. President. We did receive a letter tonight from the law director's office about this claim, saying that under the certain circumstances, the city didn't have any liability. So I guess the only question would be, Ms. Robertson, if you felt that we should hold the course and award the $80 or if you had changed your mind because of that letter.

24:11 – 24:47•Shari Robertson

So to answer, and thank you, Mr. Falquette, for that clarification and mentioning that. So part of this one, we discussed it last week. We talked about the fact that it had been reported, but what we learned later in the follow-up with the law director was actually Mr. Bittner that reported it. So hence, that's why we don't have the liability of it to have that. And even if it had been reported, we would have had three days to correct that. So... Yeah, I would, do we still move it on and then let everyone at council vote or?

24:49•David Falquette

But I was asking for your recommendation.

24:52 – 25:09•Shari Robertson

Yeah, it would be my recommendation that based on what we just learned tonight with the law director that we would deny that claim. And that would be keeping in, following our current practice of anything that we are not liable for as a city and the taxpayers that we shouldn't be paying for, regardless of what that amount may be.

25:11•Phillip Scott

Very good. Very good. Any other discussion on 26-147? And lastly, 26-148, Ms. Robertson.

25:25 – 25:49•Shari Robertson

Thank you, Mr. President. Bill 26-148 is authorizing the payment of approved claim 11-062926 to Rozelle Boleski at Deja Foods in the amount of $300. And this was the one last council meeting during committee that we talked about. It was the plug from the snowplow that got stuck in the drain and it backflowed into the business.

25:51 – 26:04•Phillip Scott

Any questions, discussion on 148? Okay. That is all the legislation. Is there anything further to come before caucus this evening?

26:08 – 26:25•Phillip Scott

Been regularly moved and seconded. We close the caucus session. All in favor, signify by saying aye. Opposed, same. Okay. We are closed. With that, I'd like to call this session on Mansfield City Council meeting to order. Please stand for the pledge and remain standing for the prayer.

26:49 – 27:08•David Falquette

Heavenly Father, we ask you to be with us tonight, guide us in our thoughts and processes, look over our city, look over our citizens, and keep our safety service people safe as they perform their duties and protect us. We ask this in your name. Amen. Amen.

27:12•Phillip Scott

Okay. We'll ask the clerk to now call the roll.

27:34 – 28:02•Phillip Scott

Here. Unless there is an objection, the reading of the journal and the correspondence will be dispensed with. Hearing no objection, they will be dispensed with. I don't know, do we have anybody that came for public comment that wishes to address? If you want to come up to the microphone, state your name and address, and we allow three minutes.

30:50 – 31:19•Phillip Scott

I believe Ms. Hess was the only one that signed up, but is there anyone else? Okay. Thank you. Okay. Any committee reports again? Okay. Mayor, any of the directors? Okay. Very good. We shall proceed with the legislation. And we have no late bills. So, Ms. Daly, the suspension of the rules.

31:22 – 31:45•Antoinette Daley

Suspension of the rules. Thank you, Mr. President. Sorry. Suspension of the rules. I move with respect to all bills that come before council this evening that the rule requiring reading on three different days be suspended and that each bill be read one time by title only. Second. Second.

31:46 – 32:11•Phillip Scott

Been regularly moved and seconded. There was suspension of rules. Council shall cast their vote on the motion. Motion passes eight to zero. Okay, so moving on to legislation. First piece is 26-126. Mr. Diaz. Thank you, Mr. President.

32:20•Phillip Scott

Been a regular move in the second. The clerk shall read Bill 26-126.

32:39•Phillip Scott

Is there any discussion on Bill 26-126? Ms. Robertson?

32:43 – 34:38•Shari Robertson

Thank you, Mr. President. Mr. Lyle reached out to me and spoke to me about what he gave to us in reference to this. I don't know if any other council members had a chance to check what he had written and compared it to the plan. We had a great discussion. He had some concerns about the possibility of us building T-hangers and maybe not having areas to store planes while he's being built. Legitimate concerns, obviously hail storms or things like that would do great damage to those types of vehicles. So I know that I'm assumed that if we would happen to go down that path in the future, that we w

34:40•Shari Robertson

So I just, I just want to put that out there and express his concerns. So,

34:48 – 35:35•Crystal Davis-Weese

Yeah, I also wanted to add to that. I did get a chance to look at that and also served on the committee. So I did like that it said it was subject to subsequent updates on there because I think it's an important piece to look at. I love the portion that he brought in because we should consider people who have been there for a substantial amount of time. and look at perhaps like a position in grandfathering them. And because, yes, we do want to any form of development, we're going to increase prices to a level. But at the same time, we still should be courteous of people who have invested lots

35:39 – 36:04•Cheryl Meier

I guess my question is maybe for the mayor. I'm sorry, excuse me. It states that the subsequent updates will be upon the approval of the Economic Development Department and the mayor's administration. So what if any of these quote-unquote updates would come before us? Or would we have an opportunity to weigh in on anything?

36:05 – 39:25•Jodie Perry

I think the way that Barrett has it set up is that it doesn't necessarily have to come back through council, but what he and I have talked about is when there are updates that he'll track those changes with footnotes so that it's very easy for you to pick out what is changing. Now, if something really substantial was going to come through, I probably would bring that through council, even though by this legislation we're not required to. I did want to add that how we're going to handle the hangars is definitely not anything set in stone at this point. The rents that they're paying are extremel

39:28•Phillip Scott

Any other further questions or discussion on Bill 26-126?

41:33 – 41:44•Crystal Davis-Weese

So then my question is, is how many current planes do we have that are out of compliance? Like how many are, do we have a number based on that? We should start.

41:44 – 42:02•Jodie Perry

There are some, um, I can't give you an exact number off the top of my head. They do an inspection every year on all of them. It's getting better, but it is not 100%. Is that fair to say? Okay.

42:58•Phillip Scott

Any other questions, comments? Okay. Seeing none, Mr. Diaz?

43:15 – 43:28•Phillip Scott

It's been regularly moved and seconded. Council shall cast their vote. Final passage of Bill 26-126. Bill passes 8-0. Bill 26-145. Mrs. Meyer.

43:36•Cheryl Meier

Thank you, sir. I move that Bill 26-145 be read and placed upon the floor for discussion.

43:41•Phillip Scott

Second. And rarely moved and seconded. The clerk shall read Bill 26-145.

44:01•Phillip Scott

Is there any discussion on Bill 26-145? Hearing none, Mrs. Meyer.

44:09•Cheryl Meier

Thank you, sir. I move that Bill 26-145 be placed upon the floor for final passage.

44:14 – 44:32•Phillip Scott

Second. Been regulated and seconded. Council shall cast their vote for final passage of Bill 26-145. Bill passes 8-0. Bill 26-146, Mr. Miranda.

44:33•Mike Miranda

Thank you, Mr. President. I move that Bill 26-146 be read and placed upon the floor for further discussion.

44:41•Phillip Scott

And regularly moved and seconded, the clerk shall read Bill 26-146.

45:13•Phillip Scott

Is there any further discussion on Bill 26-146? OK, seeing none, Mr. Miranda.

45:22•Mike Miranda

Thank you, Mr. President. I move that Bill 26-146 be placed on the floor for final passage.

45:30 – 45:50•Phillip Scott

Second. Move to second. Council shall cast their vote for final passage of Bill 26-146. Bill passes 8-0. Bill 26-147, Ms. Robertson.

45:50•Shari Robertson

Thank you, Mr. President. I move in respect to Bill 26-147 to be placed upon the floor for discussion.

45:58•Phillip Scott

Been regularly moved and seconded. Clerk shall read Bill 26-147.

46:17•Phillip Scott

Is there any discussion on Bill 26-147? Okay, hearing none. Ms. Daly?

46:26 – 46:54•Antoinette Daley

So my question is, when the damage occurred... Mr. Bettner's vehicle, and he reported it. The city is not liable for that claim, even though there was a damage before. And the fact that he reported it means that there was a problem. There was an issue. So I still don't understand that.

48:42•Phillip Scott

Thank you. Okay. Any other further questions, discussion on Bill 26-147? Okay, hearing none, Ms. Robertson.

48:52•Shari Robertson

Thank you, Mr. President. I move in reference to Bill 26-147 that it be placed upon the floor for final consideration.

49:00 – 49:35•Phillip Scott

Second. In regular movement, seconded. Council cast their vote on Bill 26-147. The bill is defeated seven to one. Seven nos, one yes. Okay, moving on to Bill 26-148. Ms. Robertson.

49:36•Shari Robertson

Thank you, Mr. President. I move in reference to Bill 26-148 that it be read and placed upon the floor for discussion.

49:44•Phillip Scott

Been regularly moved and seconded. The clerk shall read Bill 26-148.

50:05•Phillip Scott

Is there any discussion on Bill 26-148? Hearing none, Ms. Robertson?

50:14•Shari Robertson

Thank you, Mr. President. I move, in respect to Bill 26-148, it be placed upon the floor for final passage.

50:23 – 50:36•Phillip Scott

Second. Been regularly moved and seconded. Council cast their vote for final passage on Bill 26-148. Mr. Diaz?

51:06•Shari Robertson

It's on the original claim as 54 Park Avenue West that we had. I'm not sure what happened when it got moved up.

51:29 – 51:41•Shari Robertson

Mr. Diaz, do you want to make the amendment, or would you like me? Mr. President, in respect to Bill 26-148, make the amendment that we change the address to 54 Park Avenue wet.

51:44 – 53:04•Phillip Scott

OK, we have a motion on the floor to amend Bill 26-148 to change from 54 Park Avenue East to 54 Park Avenue West. So the clerk is getting the motion ready to be displayed on the screen. Council should have the motion before you to vote. And the motion passes 8-0 to amend the motion to 54 Park Avenue West. Okay. So with that, Bill 26-148 has been amended. Ms. Robertson.

53:04•Shari Robertson

Thank you, Mr. President. I move in respect to Bill 26-148 that be placed upon the floor for final passage.

53:13 – 54:01•Phillip Scott

REGULAR MOVEMENT SECONDED THAT COUNCIL SHALL CAST THEIR VOTE FOR FINAL PASSAGE OF BILL 26-148. OKAY. HANG ON A MINUTE. Council has the motion or the bill before him. Okay, it passes eight to zero. Is there anything else further that concludes legislation, Ms. Davis-Weiss?

54:03 – 54:41•Crystal Davis-Weese

I just wanted to take the time to address you. um as an educator i just want to thank you it sometimes does only take one voice and you speaking on behalf of your community your english teacher should be proud um so even when people are in like disagreement with me it's okay and it's one of the things that i want you to know but it takes people like you to stand up as an educator i often fuss when i see 400 facebook posts but not one person shows up to council to tell us what real issues are in their area. So for that, I thank you. Continue to use your voice. Appreciate that.

54:43 – 54:54•Phillip Scott

Is there anything else to come before council this evening? Very none. Been regularly moved and seconded for adjournment. All in favor, signify by saying aye.
