All right. All right. Thank you so much, everyone. I really appreciate your patience. I apologize for all those technical difficulties. I'm going to go ahead and call to order the Morgan Hill County Commission meeting. Jenna, if you can go ahead and please start the roll call attendance.

0:55 – 1:23•Mohammad Habib

okay and if i could please have commissioner lake uh you may either pledge allegiance and be that before uh proceeding to the declaration oh yes thank you with chairing tonight's meeting agenda was duly noticed and posted in accordance with government code section 54954.2 okay i'll ask everyone to stand and face the flag for the play congratulations

1:46 – 2:39•Mohammad Habib

Okay, we are going to go ahead and start the public comment. This is where members of the public are entitled to address the Planning Commission concerning any identity within the Morgan Hill Planning Commission subject matter. Public comments are limited to no more than three minutes. Except for certain specific exceptions, the Commission is prohibited from discussing or taking action on any items not appearing on the posted agenda. So just for some clarification, we're opening public comment for items that are not currently on agenda. So items that are not related to the Morgan Health Devco

3:18 – 3:44•Mohammad Habib

Thank you so much. Once again, we will have an opportunity for those who are wanting to talk about today's item in a public hearing section of today's agenda. Thank you, Jenna. We're going to go ahead and move to the orders of the day. So first we'll start with the minutes approval for July 14. All the emotions. All the emotion. So we have a motion and a second general to all of us. Yes. There are heavy. I mission is weak. I will learn

4:17 – 5:06•Mohammad Habib

So now we're going to go ahead and move on to the public hearing. This is most likely what we have many comments that were submitted to the Commission for, as well as those doing this in person and online. So first, we are going to open the public hearing. This is for the request of a tentative subdivision map for 320 residential lots on a 69.4 acre site located on the northwest quadrant of Hill Road and Deer Avenue. And what I'll do is I will go ahead and hand it off to city staff for a presentation and then we'll follow that by opening and closing public hearing period. and going to back to

5:14 – 5:28•Mohammad Habib

Yes. So what I was going to wait for is after the presentation, before it comes back to Commission discussion to bring that guidance for the Commission in regards to the item that we have with the discussion.

14:01 – 14:17•Mohammad Habib

So maybe what I'll do is I'll have a clarification after the questions. And so that way the public can also hear before we open for public comment and then the Commission can also hear. But right now I'm presenting clarifying questions for city staff.

18:23 – 18:52•Mohammad Habib

Further clarifying questions. Further clarifying questions specifically for today's presentation. Okay, I would like to bring it back to city staff. I know I had a discussion earlier around maybe defining the scope for the planning commission. I think it's a good time for also the public to give you some context around what it is that we have in front of us for today's planning commission meeting. Just for some clarification that, you know, Commissioner Downey also wanted.

20:04 – 20:26•Mohammad Habib

Thank you. So maybe just a point of clarification to you. So as I'm understanding it, you know, things related to whether the housing belongs here, density, environmental impact before, it's a natural benefit. Those are off of today's resolution for what the planning commission is going to be saying.

20:48•Mohammad Habib

And so, maybe for clarification is my also commissioner that was public he helped me explain or refresh our memories on what it is not this.

21:27 – 21:39•Mohammad Habib

Okay. So as I'm understanding, you've had the Google, um, have now the map based off that Google. And so that's, I think it's like where the laws are going to be, where the streets are going to be, uh, where the parks, trails, et cetera.

22:21•Mohammad Habib

And maybe another quarterback question, too, is as I'm understanding the departments, there is a blue 60 day or 90 day 10 month he explained that time increase.

23:16 – 23:37•Mohammad Habib

So essentially, as we're understanding the commission, our bold release either approve or deny the item that would lie before continuance essentially would mean that we're going to be in three days past that deadline. And if we then feel it's either approved or denied before that deadline, that automatically will go into approval.

23:43•Mohammad Habib

So really either the denial or approval will need to be made.

23:47 – 24:02•Joseph Mueller

Okay. May I? Yes. Just one thing. Attending that is approved by the planning commission. Okay. So we're going to deny it or approve. Okay. It would not go to city council.

24:07 – 24:20•Mohammad Habib

And if it does get appealed, that's still not within the time limit? Or does that extend that time limit?

24:36•Mohammad Habib

Any other clarifying questions on the presentation before we open to public comment?

24:42 – 24:59•Joseph Mueller

Yes. Given all the interest, before we go to public comment, we need to understand how many speakers we have. So that if we have an enlarged number of speakers, then we want to consider shortening the time to three minutes of whatever ended on the note.

25:15 – 25:33•Mohammad Habib

Yeah, so I would like to preferably give the public as much time as we can, so we'll give you guys 15 minutes. And for any of the public that is joining or folks on Zoom, would you like to please make that announcement on how they can go ahead and partake in public comments?

25:55•Mohammad Habib

Thank you, Janet. Now I'd like to officially open the public hearing. And if you'd please start with the items that we have for this speaker.

26:48 – 26:59•Mohammad Habib

Thank you. Chair is Lindblom? Glenda. Glenda. So just for clarification, the applicant does have 10 minutes. So Jenna will go ahead and start that. Thank you. Thank you.

29:53•Mohammad Habib

I just wanted to add that if there's any questions in the commission, what are my questions?

1:05:10•Mohammad Habib

Thank you very much, Rocky Garcia. I just had two minor comments.

1:06:16 – 1:06:28•Mohammad Habib

Do you have anything else you're looking to know? And I said any questions from the Commission specifically at this time for the applicant because once you close mobile will not permit for any questions.

1:06:35•Mohammad Habib

As far as for right now, we're currently in the applicant comment period. We will address comments that we have from the Republican, and we'll make sure to pass those and say so.

1:08:48 – 1:09:23•Mohammad Habib

Great. Thank you. Thank you. Any other questions before we close, public comment? Okay, so we'll officially go ahead and close the public comment, bringing back to the Commission. Before we do so, there were several questions that didn't come up during the public comment that I've noted, and so if city staff may take a brief moment to answer some of those questions as there were several that have come up consistently. So one was the closure. Do you know roughly a timeline on how long certain road closures may be?

1:12:03 – 1:12:36•Joseph Mueller

Can I follow up a little bit? First of all, you talked about these are in all likelihood will be fairly short in in closure time we're as sure as you can make them right correct we're not talking about many months in typical no okay how long in advance would we know so that we can inform the neighborhood as we're going through the construction of a large project like this of when things are going to happen uh that's a special related

1:13:09 – 1:13:37•Joseph Mueller

notices as we get closer to the construction i would surely i think the neighbor would would love to have warnings farther in advance that this is coming up so that they have times to react i mean doing it in the summer whatever while school is in session and things like that help but two weeks notice that that really might go down for a while it seems a little short

1:13:49 – 1:14:07•Joseph Mueller

Can you also set up like an email notification where people can sign up for these updates so that we're not talking about necessarily 200 or 300 feet? It can be a much larger radius that are very interested in this, and that would be a way for them to get the information.

1:14:28•Joseph Mueller

Project level emails like we do during the time of days. Not to my knowledge, no.

1:15:03•Joseph Mueller

Okay. There will also be a phasing map, right? Yes. You have the phases of the project that are being built?

1:15:22 – 1:15:49•Joseph Mueller

I know tracking is not part of this, but I'm sorry. I know tracking is not really something that we can turn down to any map form, right? But why was there not an access onto Hill directly?

1:16:38 – 1:17:08•Joseph Mueller

Right. So there's traffic safety concerns at arterial speeds that set a minimum distance between intersections, especially if there are stops or traffic signals so that everything can move. By interjecting a street too soon, you actually can cause more congestion than you would get if you didn't put it.

1:17:28 – 1:19:08•Joseph Mueller

And another complication you're going to have is because you have several people and some laws that tell you linkage can be near that creek. That's correct. And they have to be factored into the plant. And I know the public is asking a lot. I hate to say it this way, but it's sort of a weird thing. We haven't gotten to that level of detail at this stage of the program. Right. To know a lot of the details that you're talking about here, as was stated by the city attorney, right? This is a high level still, right? The details come in the next steps. And for the people who have been here for all

1:19:11 – 1:20:01•Mohammad Habib

So I guess maybe a follow-up question. I think this also came up several times. See, you know, Kauffman brought it up. Ryan also talked about this a little bit in public. Liz brought it up. Francis brought it up. And so it was really around traffic, right? And then the entire discussion around traffic, anywhere from the data being from 2019 to the traffic being so much working costs. access issues, especially during the evacuations. You know, I think Jeremy mentioned that too, when in situations where you have an active call or an emergency. Can you talk a little bit more about, or city staff

1:22:41 – 1:22:52•Mohammad Habib

Some of those that provide the public comment is close to the same street. Some of you appreciate that and has this as a number is going to bring back to the Commission. Thank you.

1:23:30•Mohammad Habib

Um, and it was for a kind of clarification. Is it possible you can point this out? So we're not clear on what it says.

1:24:33•Mohammad Habib

Do you have any follow-up on your questions?

1:28:10 – 1:28:28•Mohammad Habib

Okay, and just a clarification, in the instance of a denial, and in the instance, for example, it's significant enough for not to be able to make the change to the tentative map, the denial would allow the opportunity to make the changes based on that, or how would the denial work?

1:28:57•Mohammad Habib

Yeah, we're going to think this is the times.

1:29:24 – 1:30:22•Joseph Mueller

so i mean from our standpoint those are the three things we look at for our example that's the three things we have to look at right i mean is it consistent with the general plan yes the density is within the allowed density right second is it in substantial compliance with the pd I think it's been pretty well documented that it is in compliance with that. And I haven't heard any objection from anyone that says it's in defiance or not compatible with the city's map, the city map ordinance or the state of California's policy. And we've tried to spend a few minutes here answering as many of the

1:30:50•Joseph Mueller

Well, my action is me to take make a motion with getting into those questions you want answered in the discussion phase of the motion.

1:32:37 – 1:32:54•Mohammad Habib

So we will go around. I think there was one other one. I think this had brought this up from the public. This was around affordable housing. So if you can see the rest of that one, that was from not meeting the 15% minimum requirement.

1:35:13 – 1:35:25•Mohammad Habib

Sure. And then just to confirm that with that was already improved back in training for for the whole field where they don't have to build that they didn't put money. But everyone has some question. Okay, I'm going to ask john just in

1:35:32 – 1:35:44•Joseph Mueller

A minute or less. Can you sort of let the neighborhood know why the city would take a 100% fee out? Well, that is a large sum of money.

1:37:57 – 1:38:17•Mohammad Habib

I also didn't have any additional items on my comments list, so I'll go ahead and maybe bring it back to the Commission. Share any comments before we go on. I'll make a quick comment. You know, first of all, thank you everybody for coming down.

1:41:58 – 1:42:11•Mohammad Habib

On the result of your review side, this is a point of order and public comment is from a close. However, when this into further information, we see that you have that information under these air.

1:43:48 – 1:44:02•Joseph Mueller

I believe in the conditions there is a condition that asks for that rather not be redesigned from this plan to minimize the impact on that particular block.

1:44:34 – 1:44:56•Mohammad Habib

um and uh commissioner if i may just follow up on that because i know uh one of the public comments joshua mentioned something in relation to that and that was the other three conditions i believe he had mentioned are those conditions currently in the conditions report that we have or didn't all make it um i'm not remembering specifically so we've done more about communication which the city intends during the design review permit

1:47:56 – 1:48:42•Mohammad Habib

I just have a couple of questions before we go ahead and just do that. The one I have, this kind of brings me back because this is one of the situations that we're obviously seeing a lot more now than ever, which is wildfires, evacuation, etc. It was already addressed a little bit by city staff. But I think I'm just going back to the initial fire marshal review process. Are they looking at typical circumstances or are they really looking at instances where Again, after God once in a lifetime evacuation processes, etc. He knows what we're having to know the details of what fire marshal looks ou

1:49:50 – 1:50:17•Mohammad Habib

Maybe one final question is tied to some of those comments in that you also talked about it a little bit briefly with the Barrett access and you shared a little bit about some of the difficulties with having access by a Barrett. Is it impossible or is it just really difficult and complex? Are you referring to the Hill or Barrett? I'm sorry, did I say, I believe it was Barrett, was the...

1:51:01 – 1:51:14•Mohammad Habib

Is that too complex to make a change at this time, given the route. As you're sharing earlier, we cannot make significant changes about if you wanted to explore.

1:52:10 – 1:53:14•Mohammad Habib

I actually was coming in specifically for CNF that was proposed for the general final status and connections. And that goes into it requiring subdivisions to provide multiple connections to the surrounding community. And so as I'm trying to make that determination, it is to see whether or not we really explored all of those possible connections, even though with that general plan insight on, yeah, if it's possible versus a really complex, complex was obviously will need safety measures to control and maybe traffic light, et cetera, that will just again, make it really complex with other agenci

1:53:52 – 1:54:03•Joseph Mueller

I'll make a motion to approve the resolution approving the Kennedy map. Sorry.

1:54:03•Mohammad Habib

Okay, we have a motion by Mr. Mueller and a second by Commissioner Padano. We'll go ahead and open it up.

1:54:10 – 1:55:40•Joseph Mueller

Can I make just one comment on the discussion board? One of the speakers had requested that there be a forum that had the city, the applicant, and the neighborhood having a discussion. In the old days, before the state got into writing really new, detailed, and complex rules, that might have been possible. But in today's regulation environment, that public meeting would account for one of the meetings that we are held to and might be very difficult to fit into the streamline that. That's just the fact of the rules that the city has to operate under. Just like there's a rule that says we have a

1:55:43 – 1:56:33•Mohammad Habib

To answer this question. I'll maybe just add, as of right now, just based off of that discussion, I'm still a little bit held on the outside connections for the general plan consistency that we're looking for. And I know we have a really tight timeline as well for either approving it, not doing anything in the approval room automatically without having those conditions in place. And so I was your own side of the comments you've received so far that I really touched on the opposite connections component of general consistency that we're looking for. And so for myself, I think at this time, I'm

1:57:02 – 1:57:36•Joseph Mueller

I was going to say there is another Public hearing time is coming up. When we can't get into a lot more detail of the design review and design permit stake, that will get planned into mission immediately. And I want to thank you all for hanging in there tonight on our 35 or 40 minute delay. All of them, we appreciate everybody's comments, right? We always want to hear from you, right? And we always hear, sometimes you can do things, but sometimes we can't.

1:57:39 – 1:57:55•Mohammad Habib

And with that said, once again, there is going to be one more public hearing that comes before the commission, and that will be the design of these. Thank you all for your comments. And we are going to go ahead and move on to the director's report slash announcements.

1:58:29•Mohammad Habib

If I can ask the public to order things, if you can please sign with me if you are moving out. That's going to be so it's not just back.

1:59:57•Mohammad Habib

The other questions you should be seeing then we'll go ahead and turn things back to you.
