10:18 – 10:39•Kate Brophy McGee

Welcome. We are at the Wednesday, July 15th, 2026 formal meeting of the Maricopa County Board of Supervisors. Thank you to everyone who came. Thank you so much for your patience. Madam Clerk, would you start by calling the roll, please?

10:58 – 11:15•Kate Brophy McGee

Thank you. All members are in attendance, either one online and the rest in person. We will now proceed to the invocation and Pledge of Allegiance. And Supervisor Gallardo, would you please introduce your guests who will lead us in the invocation and pledge?

11:15 – 11:33•Steve Gallardo

Thank you, Madam Chair. We have one of our own that is going to start us off today. And if it's OK with you, I'd like to say a few words after she gives our invocation and pledge. So Yasmine Romero is here. Oh, she's already at the podium. Absolutely.

12:59 – 14:10•Steve Gallardo

Thank you, Madam Chair and Yasmine. Thank you so much for starting us off today. Appreciate it. Madam Chair, as we all know, the offices kind of rotate and find a special person to come and lead us off in our daily work at our board meetings. And Yasmine, she has been with us for the last two years, two years, two years. ASU student. I didn't know this. She enjoys pickleball. Is that true? Is that true? I didn't know this. Okay. We learn stuff. And she definitely enjoys volunteering her time when she's not here at the county. She's been with the clerk's office for a couple years now, as she sa

14:12 – 14:43•Kate Brophy McGee

Thank you, Mr. Gallardo. Well, I've only been here a year and a half, but I don't ever recall running into Yasmeen or seeing her where she didn't have a beautiful smile on her face, so thank you. Now we will proceed to our pet showcase. And in place of our wonderful Kim, we have wonderful May to introduce us to today's beautiful star.

15:51•Kate Brophy McGee

Thank you very much. Take a good look. He's going to be flying off the shelves. Good luck, Mama. It's wonderful.

16:39 – 16:57•Kate Brophy McGee

Thank you for keeping us on track. Golden continued until which date? August 19th. Thank you very much. We will now proceed to Child Support Awareness Proclamation. Madam Clerk, would you please read it?

18:23•Kate Brophy McGee

Thank you, Madam Clerk. The board will now consider item five. Madam Vice Chair, is there a motion, please?

18:33•Debbie Lesko

Thank you, Madam Chair. I move that we approve item number five.

18:37 – 18:56•Kate Brophy McGee

Thank you. Is there a second, please? It's been moved and seconded. There being no discussion, all those in favor will say aye. Aye. Aye. Are there any opposed? Motion passes unanimously. And Madam Chair, if it's okay for the sayer.

18:56 – 21:03•Steve Gallardo

Mr. Gallardo, please. Thank you, Madam Chair. Juanita, thank you so much for reading that out. We get these proclamations or resolutions once in a while to kind of spread the news and kind of continue to bring awareness around certain issues and child support is one of those issues that is just so important. We have so many young people out there that just lack the basic needs sometimes and I'm a strong believer that and We all deal with our schools and so on. I'm a strong believer that if you take on the challenges that many of these kids face off school campus, you're going to see them flour

21:03 – 23:38•Kate Brophy McGee

And thank you, Supervisor Gallardo, for championing this issue. You're absolutely right in so many of those respects. Let us move on to the business portion of our meeting, starting with planning and zoning hearings. First, I would like to remind our wonderful audience of the rules of decorum. It is the intent of these members of the Board of Supervisors to follow orderly procedures for conducting business and we have adopted the following rules to do so. The chair of the Board of Supervisors has the authority to maintain order and professional standards during open meetings and may enforce th

23:41•Kate Brophy McGee

I'll get there. Yes. Thank you, Madam Chair. 6 and 7 and 9 through 17. Yes. To clarify.

23:48•Debbie Lesko

Thank you, Madam Chair. I move that we approve items 6 and 7 and 9 through 17. Thank you. Is there a second? Second.

23:56 – 25:02•Kate Brophy McGee

It's been moved and seconded. All those in favor will say aye. Aye. Those opposed? Motion passes unanimously. We will now consider, for separate consideration, item number eight, carefree commercial. With that, I would ask Mr. Gerard and Mr. Ellsworth to please come forward and present. This item is in my district and We have done, it was I think shortly after I got on the board, and we've done a ton of work on this arena and on this area. And I cannot thank Planning and Zoning and your folks for your enormous help in articulating a policy that incorporates desert hills and the carefree corrid

26:34 – 27:03•Kate Brophy McGee

Thank you, Mr. Ellsworth. Madam Clerk, we have how many speakers signed up? Okay, while the public participation is preparing, may I ask, is it Bill Lawley to come forward on behalf of the developer of this property? And as part of that, would you please speak to the adjacent properties that they have also been developing? Thank you, sir.

27:41 – 28:00•Kate Brophy McGee

And so it's really just a phase two of something that's already underway Thank you very much to board members have questions for either staff or mr. Lawley Hearing none will proceed to stand by in case we need you To public participation madam clerk I

28:31 – 28:47•Kate Brophy McGee

Thank you for taking the time to come all the way down to our meeting. Ms. Schenk, before we get started, if you would state your name for the record. Two minute participation, stating your concerns.

30:58•Kate Brophy McGee

Thank you for your summary. For my information, did you attend the public meeting that was held or not?

31:24•Kate Brophy McGee

I'm not going to question your priorities. I just wanted to know if you knew about it. So thank you. Yes.

31:56•Kate Brophy McGee

Ms. Parrish, if you would state your name for the record so we get it right. Sure.

34:09 – 34:20•Kate Brophy McGee

Thank you very much. Madam Clerk, does that include speakers? Madam Chair, yes. No other speakers. Mr. Lawley, would you please come forward and address the concerns?

38:28 – 40:21•Kate Brophy McGee

Thank you, Mr. Lawley. Any questions from my fellow board members? No. Thank you. I have no questions, sir. I've worked on this whole area since I took office because it was becoming... a haven for RV and boat storages. That was not the mix that is demanded along a scenic corridor, which is kind of paradoxically a commercial node. So you have to figure out what commercial development looks like on a very, very busy highway, which would not be receptive to building a house. I remanded this back when it came to us first. It had a 9-0, as I recall, commission vote against. I worked with my two D3

40:22•Debbie Lesko

Yes, thank you, Madam Chair. I move that we approve item number eight. Second.

40:26•Kate Brophy McGee

It's been moved and seconded. Hearing no further discussion, all those in favor will say aye. Aye. Any opposed? Motion passes unanimously.

40:39 – 40:57•Kate Brophy McGee

Moving on to planning and zoning hearings. Regular agenda item 18, true leave, dispensary, happy valley. Are there any speaker forms, Madam Clerk, for item 18? I think, Miss Vice Chair, this is in your district.

41:08•Kate Brophy McGee

Okay, so anybody else? So what we'll do is introduce the item. I'm gonna turn it over to Vice Chair since this is in your district.

41:23 – 41:39•Debbie Lesko

Madam Chair, would you like to hear from the applicant first or the speakers first? What was your preference? Okay, thank you. Madam Chair, I would like to hear from the staff first, give an explanation of the item, and then the applicant, and then the speaker.

43:54•Debbie Lesko

Do members have questions of the staff? Okay, then I'd like to hear from the applicant. You have five minutes.

49:37 – 49:52•Debbie Lesko

Thank you, sir. And now, Madam Clerk, you said how many speakers do we have? Madam Chair and Vice Chair, one speaker in favor. Thank you. If you could call the speaker forward, and I'm going to give the speaker the same time, five minutes.

50:02•Kate Brophy McGee

Thank you, and do please state your name for the record.

51:15•Debbie Lesko

Do any members have questions of the staff?

51:20 – 51:48•Mark Stewart

Madam Chair. Yes, Mr. Stewart. Thank you. Yeah, we've dealt with a couple of when I was on council in Chandler with a couple of dispensaries. And I think the biggest question I've got is how many parking spots are there this particular location? I understand the Fridays and after work are pretty busy times. Are there any concerns about parking and transportation, not transportation, but the ability for people to leave safely, etc. ?

52:06 – 52:25•Mark Stewart

Okay. And one follow up question, Madam Chair, is there any stipulation in the zoning? And I guess maybe this would come in a pad or that smell situation. So if they were found to be non compliant with the odor, what would be the recourse for the board or or for them to correct that?

52:50 – 55:56•Debbie Lesko

Madam Chair, I would like to talk a little bit about this case since it is in my supervisor district. And I have received feedback from constituents in my office and from the Peoria Mayor and the Peoria Mayor Pro Tem. And when this property was rezoned in 2023, the board approved a specific set of development standards and a specific list of permitted uses at that time. Those conditions weren't accidental. They reflected the proposal that was before the board at that time in 2023. Today we're being asked to change those conditions. I believe that the surrounding property owners and the communi

55:57•Kate Brophy McGee

Members, do you have any questions? Mr. Stewart?

56:04•Kate Brophy McGee

Okay. I'm not seeing any questions here on the dais. Madam Vice Chair?

56:12 – 56:32•Debbie Lesko

Yes. Thank you, Madam Chair. I move that we deny item number 18 in accordance with the Commission's recommendation. This vote will not remove the site's existing commercial zoning. A yes vote will deny item 18. So it's one of those where you vote yes to say no.

56:33 – 57:10•Kate Brophy McGee

Thank you for explaining. Is there a second? Okay, hearing no further discussion, we will proceed to a vote. All those in favor of denial will say aye. Those opposed to denying will say nay. I think, yes. Okay, motion passes unanimously. The zoning modification is denied. Moving right along. Item number 19, 67th Avenue, Rezone. Madam Clerk, are there speaker forms?

57:18 – 57:32•Kate Brophy McGee

Okay. Two seconds, I'm sorry. Lost my page. Supervisor Gallardo, this is in your district. Would you like to proceed with a staff presentation?

57:33•Steve Gallardo

I've already spoken to the applicant. I have to speak to the staff as well, but go ahead.

58:08•Kate Brophy McGee

You've got whatever I have. Thank you, Darren.

59:07•Steve Gallardo

Okay. I wasn't familiar that there were speakers that allowed to hear.

59:10•Kate Brophy McGee

If we could proceed with public participation then.

1:04:12•Kate Brophy McGee

Thank you. Mr. Gallardo? I understand that the applicant and owner and their representatives are here. Is that correct?

1:04:24 – 1:04:52•Steve Gallardo

Yes, they are here. I've had discussions with Paul in regards to this. Madam Chair, if it's OK, I'm ready to make a motion. I appreciate the public's comments. And we duly noted on how we move forward. But this is a project that the entire PNZ commission supports, staff supports. I'm very familiar with this area.

1:04:56 – 1:05:13•Steve Gallardo

So I'm very familiar with this area and I understand what we have in front of us. So Madam Chair, I'm ready to make a motion that we approve item 19 on our planning and zoning agenda.

1:05:15 – 1:06:08•Kate Brophy McGee

I guess that was a motion and now it's a second. Hearing no further discussion, we will proceed to a vote. think I vote means I this time yeah this is yeah this is easy thank you all those in favor will say aye aye those opposed nay the motion is approved and the item advances now we go to statutory hearings for clerk of the board related to liquor license applications, bingo license application, and a de-annexation from the city of Avondale to Maricopa County. And also, transportation has a road file in there. Madam Clerk, are there any speaker forms received for items 20 through 23A?

1:06:21 – 1:06:35•Kate Brophy McGee

Thank you. Mr. Crawley, would you please come forward? So that's, he wants to speak on both items. If we limit participation to two minutes, he can do two minutes on one and two minutes on the other?

1:09:48 – 1:10:03•Kate Brophy McGee

Thank you, Mr. Crowley. Mr. Gutierrez, I think both these items fall under your jurisdiction. Can you address those questions, sir? Oh, and Mr. Smith. Welcome.

1:11:46•Kate Brophy McGee

Thank you. Do you want to speak to 23A, please.

1:13:24•Kate Brophy McGee

Thank you, Mr. Gutierrez. Questions? Vice Chair.

1:13:28 – 1:14:02•Debbie Lesko

Thank you, Madam Chair. Mr. Crowley, is very passionate about buses, bus stops. And so he brought up a good question that I wanna know. Like in that case of, not the Chandler one, because Chandler's gonna take it over, right? But the other one where the county is taking over the road. Let's say in the future there's, you know, bunch of people living there and they had a bus route who did who decides to put in the bus stop is it us is it the city who how does that work it.

1:14:51 – 1:15:30•Kate Brophy McGee

Thank you. Are there any other questions from board members? Hearing none. I don't think that was a question. The board will now consider item 24. I think I'm on the wrong page. The board will now consider. I'm getting there. I'm trying to figure out what that noise is. Smoke alarm is what it sounds like to me. But the board will now consider items 20, 21, 22, and 23A. Madam Vice Chair.

1:15:31•Debbie Lesko

Thank you, Madam Chair. I move that we approve items 20 through 23A.

1:15:35 – 1:16:05•Kate Brophy McGee

Thank you. Is there a second? Second. It's been moved and seconded. Hearing no further discussion, we will proceed to a vote. All those in favor will say aye. All those opposed? Aye. Motion passes unanimously. We now move to the consent agenda items 24 through 99. Reminder that 91 has been pulled and continued. Madam Clerk, do you need a separate motion for that? Oh, and thank you, Mr. Gutierrez and Mr. Smith.

1:16:16 – 1:16:31•Kate Brophy McGee

I want to get crossways with the clerk. Let's consider item 91 separately. Do board members have any other items besides 91, which is a continuance, they wish to have pulled?

1:16:36 – 1:16:52•Mark Stewart

I'd like a little bit of background on item number 27, and then I'd like a very brief presentation on number 80, and then I'd like to make a comment about item number 27. I'm sorry, number 28, if I can, please. Thank you. Or is it 82 now?

1:16:55•Kate Brophy McGee

Mr. Stewart, is your request to pull items 27, 28, and 80 for separate consideration? No, my...

1:17:06 – 1:17:31•Mark Stewart

What I want to know is a little bit of background on how reappointments to the GPAC are handled and how that process works. You might be able to share that since you're the desk that decides that. And then I'd like to make a comment about 28, just to thank our member for being a part of that board. And then on number 80, I'd like some background on that presentation. But I don't necessarily need a poll.

1:17:32•Debbie Lesko

Madam Chair, can someone please tell us what that noise is? We're working on it. That's me.

1:17:37•Mark Stewart

So my carbon monoxide detector is going off, so my apologies.

1:17:43•Debbie Lesko

The problem is solved. Okay. Yes. Get some air. We don't want you to get passed out.

1:17:53•Mark Stewart

I think I'll be fine. We'll get the doors open.

1:17:56•Kate Brophy McGee

Mr. Stewart, does that constitute an emergency for you?

1:18:00•Mark Stewart

It does not, but thank you. And it's number 82, not 80. The numbers that I've got are different. So item number 82.

1:18:10 – 1:18:41•Kate Brophy McGee

You want to have some discussion about 27, 28, and 82. And the way we go about doing that, sir, 28 you said you wanted to comment after the vote. So we will vote 27 and 82. Yes, ma'am. for separate discussion, questions, information. So, nice chair, I hope you figured out the numbers. She's getting there.

1:18:42•Debbie Lesko

Madam Chair, I move that we approve items 24 through 81, 83 through 90, and 92 through 99.

1:18:55•Kate Brophy McGee

I think we need to pull 27. Oh, I messed up.

1:19:03•Kate Brophy McGee

28. Oh, we need to pull 28. So let's try again to get the sequence.

1:19:08 – 1:19:32•Debbie Lesko

All right. Let's try it again. So we need 24 through 27. Then we need 29 through 81. Then we need 83 through 90, and then 92 through 99. I move that we approve those.

1:19:32•Kate Brophy McGee

And to go back, what was item 27 that you wish to do something with, Mr. Stewart?

1:19:40•Mark Stewart

That's the GPAC appointments, Madam Chair. Greater Phoenix Economic Council.

1:19:48 – 1:20:00•Kate Brophy McGee

Then we need to revise it. And 28 is what you wish to comment on afterwards. Well, thank you. So can you withdraw your motion and try again?

1:20:04 – 1:20:35•Debbie Lesko

I think I did it right. I move that we approve items 24 through 27, 29 through 81, 83 through 90, and 92 through 99. Because, Madam Chair, that leaves out 28, and it leaves out 82, and it leaves out 91.

1:20:36•Kate Brophy McGee

Yes, but I think 28 he's going to comment on after. We can take the vote, and he can comment.

1:20:41•Mark Stewart

But, Brooke, can you help me? That's correct. The motions...

1:20:45•Kate Brophy McGee

But then 27 is not pulled and there will be no discussion according to the rules of consent.

1:20:54•Mark Stewart

So we're not going to discuss number 27? Not unless you pull it. I'd like to ask that to be pulled then.

1:21:19•Mark Stewart

So then it is number 28. I've just got different information.

1:21:27 – 1:21:58•Kate Brophy McGee

Hooray. Got it. Okay, so there is a motion on the floor, and I will not state it again, but hopefully you got it. Okay. Got it. Is there a second, please? It's been moved and seconded. We will proceed to vote. All those in favor will say aye. Those opposed, nay. Motion passes unanimously. Mr. Stewart, you wanted to comment on 28?

1:22:02 – 1:22:16•Mark Stewart

Yes, ma'am. Can you give me some background on how those selections are made? And I've noticed in the past that that tends to be a, in many things that we do, there's a revolving sort of process where, you know, one supervisor's.

1:22:19 – 1:22:50•Kate Brophy McGee

I am so sorry. Didn't we just approve 28? Say that real fast, eight times. So we need, there was an item on consent that you wish to comment and thank your appointee. Why don't we try that? And please name, if we can number the item, that would be very helpful.

1:22:57 – 1:23:11•Mark Stewart

All right, on number 28, I want to thank Chrissy Rodriguez for volunteering her service and her time again as her reappointment to the Community Development Advisory Committee was just approved, and we want to thank her for her continued service. Thank you, Madam Chair.

1:23:12 – 1:23:26•Kate Brophy McGee

Thank you, Mr. Stewart. We will proceed then to item 28, and you wanted to comment on the process related to GPAC appointments. Madam County Manager?

1:23:36•Mark Stewart

Yes, ma'am. Can you tell me how the process works for appointment?

1:24:05 – 1:24:26•Mark Stewart

So the chair makes the discussion. I've noticed in the past that there's not much turnover in this particular role. So we don't have the opportunity for new ideas, new energy, those kind of things serving on this board. Maybe the chair can provide some background on why we're continuing to keep the same people on the board versus turnover.

1:24:28•Kate Brophy McGee

I think that was a question for me, Mr. Stewart. Yes, ma'am. It is at the discretion of the chair.

1:24:34 – 1:25:33•Mark Stewart

So you just decided, because I don't remember us talking about that, but thank you for helping me understand that. I hope it's helpful. Thank you. Is there any plan in the future to have any turnover on that board? As you know, I was invited to be part of the group that went to dc the lobby on behalf of the county in the past and you denied that travel on my part to be able to attend that as a business owner somebody that's helped with economic development in chandler which is basically the uh soon it is now and hopefully will continue to be with intel the heartbeat of semiconductor industry w

1:25:36 – 1:26:11•Kate Brophy McGee

Mr. Stewart, we've had this discussion previously. I represent the majority of the City of Phoenix, not all of it, but most of it. It is at the discretion of the chair. I am aware of the Washington DC trip that effort came following your discontinuance from the G Peck board and as such the travel was not authorized and I know that is a very Painful for you, but it's no no, it's not painful.

1:26:11•Mark Stewart

Just trying to understand the rationale behind it Well respectfully

1:26:18•Kate Brophy McGee

That's old history. What I'd like to do is move forward with a motion on this item.

1:26:27•Debbie Lesko

Madam Chair, I move that we approve item number 28.

1:26:30•Thomas Galvin

Madam Chair, I second. I'd like to make a comment to explain my vote.

1:26:34 – 1:26:45•Kate Brophy McGee

Please. Given the discussion nature, let's just do a roll call. Madam Clerk, starting with District 1, please.

1:26:48 – 1:28:11•Thomas Galvin

yes supervisor galvin hi and madam chair like to explain my vote please uh madam chair thank you for explaining that question in case anyone else was curious or interested in this topic um yes the chair does make a decision on this but obviously it's up to the discretion of the entire board on how to vote i do know that the five members that we are reappointing to this gpeg board are prominent members of the community from across section of our business community and represent the county in wonderful ways and have been supportive of the board and the county and its endeavors. I know one thing

1:28:19 – 1:28:30•Kate Brophy McGee

Aye. Motion passes unanimously. Proceeding on to item number 82. Mr. Stewart.

1:28:32•Mark Stewart

Thank you. Can I get a brief presentation on this? Understand a little bit deeper on what it is?

1:28:41 – 1:28:58•Kate Brophy McGee

Thank you. Ms. Flanagan, would you please come forward? Please state your name so people in the audience know who you are. This is your wheelhouse, and I would appreciate a brief overview.

1:30:21•Kate Brophy McGee

Thank you, Ms. Flanagan. Mr. Stewart, do you have questions?

1:30:25 – 1:30:47•Mark Stewart

Marcy, this is extremely important, as you know, to the entire board as well as the community. I just want to thank you for the work that you're doing on this. It's an important initiative by the county in conjunction with our partners. And I just wanted to make sure your team got some recognition, but also make sure the community is aware. Thank you, Madam Chair.

1:30:48•Kate Brophy McGee

Thank you. Thank you, Ms. Flanagan. Mr. Stewart, would you like to move on item 82?

1:30:57•Mark Stewart

Madam Chair, I'd like to move that we approve item number 82.

1:31:07•Kate Brophy McGee

It's been moved and seconded. Any further discussion?

1:31:14 – 1:31:28•Kate Brophy McGee

Aye. Those opposed, nay. Motion passes unanimously. We are on to what I think is our last one, 91, which has been pulled and continued to August 19. Madam Vice Chair.

1:31:28•Debbie Lesko

Madam Chair, I move that we continue item number 91 to what date? August 19. August 19.

1:31:38 – 1:32:27•Kate Brophy McGee

Thank you. It's been moved. Is there a second, please? Second. It's been moved and seconded. Hearing no discussion, we'll proceed to vote. All those in favor will say aye. Aye. Those opposed? A motion passes unanimously. It has been continued. We now move on to the Board of Supervisors regular agenda under real estate no-build easement agreement with the City of Avondale. Please note that this item requires a unanimous roll call vote. Madam Clerk, are there any speaker forums? Madam Chair, none for this item. Thank you. The board will now consider item 100. Madam Vice Chair?

1:32:28•Debbie Lesko

Thank you, Madam Chair. I move that we approve item number 100.

1:32:34•Kate Brophy McGee

It's been moved and multiply seconded. Madam Clerk, roll call vote.

1:32:52 – 1:33:11•Kate Brophy McGee

Thank you. The motion passes unanimously. We will move to the Board of Supervisors regular agenda, transportation contract and grant of easement with the United States Department of the Interior Bureau of Reclamation. This item requires a unanimous roll call vote. Madam Clerk, do we have any speaker forms?

1:33:23•Kate Brophy McGee

Mr. Arnold, would you please come forward? Welcome, and please state your name for the record.

1:34:28•Kate Brophy McGee

Thank you, Mr. Arnold. Mr. Gutierrez, is this you?

1:34:40 – 1:34:54•Kate Brophy McGee

Mr. Smith, we have three questions from public participation. Can you have a seat and let's hear also then from the next individual assuming questions. Madam Clerk. Thank you, Mr. Arnold.

1:35:33•Kate Brophy McGee

Thank you for your questions. Mr. Smith, do you have all of those?

1:36:00•Kate Brophy McGee

They have a- Oh, respectfully, I wanted you to go to 101.

1:36:17 – 1:36:40•Kate Brophy McGee

We've already taken action on that, and Brooke, I don't think we can go back and reopen it. Can we answer the questions? Madam Chair, that's at your discretion if you'd like additional discretion. Okay, since we got the numbering, a bunch of us have the numbering wrong. Please come forward and, Mr. Smith, can you handle that, please?

1:37:33•Kate Brophy McGee

Thank you. And you said it was built on a landfill?

1:37:42 – 1:37:57•Kate Brophy McGee

Thank you. Any questions from board members? Thank you to our public participants. I think we need to vote on item 101.

1:37:58•Debbie Lesko

Madam Chair, I move that we approve item 101.

1:38:02•Kate Brophy McGee

Thank you. Is there a second? Second. This item requires a unanimous roll call vote. Thank you, Mr. Smith. Madam Clerk.

1:38:23 – 1:39:19•Kate Brophy McGee

Aye. Creaking right straight along, we are on the Board of Supervisors addendum, Competition impracticable and county attorney initiative declaratory judgment action. Item 104, settlement in Maricopa County versus Howard and Kekebush, 105 through 109. Nine, initiating litigation regarding health code and zoning violations. And item 110, Maricopa County resolution prohibiting personal profit off non-public information. Do you want to pull item 110? So we'll take that off for separate consideration. Are there any speaker forms? Madam Clerk.

1:39:28•Kate Brophy McGee

Mr. Hoff, would you please come forward? State your name for the record.

1:40:07•Kate Brophy McGee

So now we're back on 101. Okay, we have already taken a vote on that issue, but we will hear your comments, sir.

1:41:11 – 1:41:28•Kate Brophy McGee

Thank you, Mr. Smith. And while Mr. Smith is getting settled, could you double check the numbering on the remaining speaker forms so we quit encountering this?

1:42:15 – 1:42:43•Kate Brophy McGee

So we are back on item 102 and Don't go too far away, but you are excused for the moment. I hope that answered your question, Mr. Hoff. Item 102 through 109, the board will now consider those items. Item 110 will be considered separately at the request of Supervisor Galvin. Madam Vice Chair, do you have a motion?

1:42:43•Debbie Lesko

Thank you, Madam Chair. I move that we approve items number 102 through 109. Thank you. Is there a second? Second. Second.

1:42:51 – 1:43:10•Kate Brophy McGee

It's been moved and seconded. All those in favor will say aye. Any opposed? Motion passes unanimously. We are now on item 110, Maricopa County Resolution prohibiting personal profit off non-public information. Mr. Galvin.

1:43:10•Thomas Galvin

Madam Chair, if I may, I would like to ask the county manager to give us a brief overview and then I have some comments as well for the motivations behind this agenda item. Thank you.

1:44:18 – 1:44:35•Thomas Galvin

Thank you. And Madam Chair, I just have one question for the county manager. As I understand it, Jennifer, this resolution would apply to all employees that report up to the county manager through the Board of Supervisors, but do not apply to employees of the other county elected offices, correct?

1:44:46 – 1:46:37•Thomas Galvin

Okay, thank you. Madam Chair, if I may. Please. I want to talk about the motivations for this, and I really want to extend my thanks to you for your leadership. You have shown leadership on a wide variety of issues this year as chair. You know, we heard today about your leadership on GPAC as well. But when it comes to this resolution of prohibiting personal profit from non-public information, It is very important for me and I know that it's important for this entire board for our constituents and our residents to know that everything we do here in Maricopa County is above board and frankly not

1:46:37•Kate Brophy McGee

Thank you. Are there any questions or comments from board members? Madam chair, Mr. Stuart.

1:46:46 – 1:47:09•Mark Stewart

Thank you. Um, as this is a, I think this is a brilliant idea. I mean, I wish we could fire this up to Congress or to Nancy Pelosi's office. But, um, do you think did, did MCA go through this and are we good to go? Has it already been vetted? We didn't talk about this in an executive session on Monday, and it's kind of the first introduction that I've got to this, so I just have a couple questions. Thank you.

1:47:19 – 1:47:30•Mark Stewart

Okay, fantastic. And why can't it be extended across the county? Is it because those are duly elected positions and it's just easier to do that? through each individual office. I'm just kind of curious.

1:48:54•Mark Stewart

Okay, thank you. And does it roll up through the board? Like we're responsible for this too as well?

1:49:22•Kate Brophy McGee

So could you help me understand the question again please Mr. Stewart? I'm glad you got your carbon monoxide alarm fixed.

1:49:32•Mark Stewart

Do you, does this roll through the board? Are we responsible for this resolution as well?

1:49:38•Kate Brophy McGee

with our district and with our board offices, correct?

1:49:51•Kate Brophy McGee

Please state your name for the record and answer the question.

1:50:21 – 1:50:47•Thomas Galvin

Mr. Calvin. Madam Chair, to that point, I don't think there's any question here. It says all Maricopa County employees and board staff are all Maricopa County employees. They have access to a lot of sensitive information. So I believe this is written to cover everyone. Including us. Including board members as well. And I don't have a specific disagreement with that.

1:50:47 – 1:51:01•Mark Stewart

Thank you. And then one final question. What is the punishment for if a board member or any staff is found to be guilty of speculating on CalSheet or whatever that may be?

1:51:49 – 1:52:03•Mark Stewart

Thank you. And then my final question, Madam Chair. Is this in response to anything that's happened or is this a proactive measure on Supervisor Galvin's part? Again, I want to reiterate, I am, I'm a fan of this, but I'm just kind of curious with some of the details.

1:52:39 – 1:53:31•Thomas Galvin

Mr. Galvin. Madam Chair, to that point, it's a very good question. This is a proactive measure. This is a policy that I have seen out in the private sector, adopted by a lot of companies. I do believe that this Board of Supervisors is a professional board. in terms that we want to conduct our business like a business. This is something that companies would be doing out in the private sector. So I think it's always good for us to be proactive. Always good for us to be thinking ahead. Basically think about what can come around the corner. You never want to have a situation where something happen

1:53:36•Kate Brophy McGee

Mr. Galvin, this is your agenda item. Would you please move the item forward?

1:53:43•Thomas Galvin

Yes, thank you. With gratitude to staff who worked on this and Madam Chair who put this on the agenda so quickly, I move passage of this item.

1:53:55 – 1:54:24•Kate Brophy McGee

Thank you. It's been moved and seconded. Any further discussion or comments before we proceed to a vote? Hearing none, all those in favor will say aye. Aye. Those opposed? Motion passes unanimously. We will recess as a Board of Supervisors and convene as the Improvement District. Madam Clerk, do we have any speaker forms for Item 111, Amendment to Australia Dells I, Water Improvement District?

1:54:28•Kate Brophy McGee

Thank you. We will proceed to vote on this item. Madam Vice Chair?

1:54:36•Debbie Lesko

Madam Chair, I move that we approve item number 111.

1:54:43 – 1:55:31•Kate Brophy McGee

Hearing no further discussion, all those in favor will say aye. Aye. Any opposed? Motion carries unanimously. We will now adjourn as the Improvement District and convene as the Flood Control District Board of Directors for consideration of items 112 and 113. 1, 14, 15, 16, 17, and 18. Madam Clerk, do we have any speaker forms for those items? Madam Chair, I do not have any speaker forms on these items. The board will now consider items 112 through 118 for the flood control district. All those in favor? Madam Vice Chair, would you please introduce a motion?

1:55:31•Debbie Lesko

Thank you. Madam Chair, I move that we approve items number 112 through 118.

1:55:37 – 1:56:07•Kate Brophy McGee

Thank you. It's been moved. Is there a second? Okay. Hearing no further discussion, we'll proceed to a vote. All those in favor will say aye. Those opposed? Motion passes unanimously. We will adjourn as the Flood Control District Board of Directors and convene as the Library District Board of Directors for items 119 through 124. Madam Clerk, do we have any speaker forms for the Library District items?

1:56:48•Kate Brophy McGee

Hang on a second. It's the numbering again.

1:57:15 – 1:57:33•Kate Brophy McGee

identifying the items do you first of all do those who have signed up wish to speak to the library district okay why don't we have you come and speak and then we'll figure out which items they pertain to and thank you for your understanding and patience

1:58:54•Kate Brophy McGee

Thank you. If the other two speakers were compiling your questions, I will address them.

1:59:13•Kate Brophy McGee

There's not an agenda item for that. You've asked the general questions related to library district policies. Please state your name for the record.

2:03:30•Kate Brophy McGee

What I'd like to ask before we hear from staff is how many speakers do we have? I thought you said three. Is it four?

2:04:11 – 2:04:27•Kate Brophy McGee

So going to the public, just very quickly, I believe we have more speakers on library subjects, correct? Yes. Okay, so let's get all the questions on the table. Who are our next two speakers?

2:04:51 – 2:05:48•Kate Brophy McGee

Okay, so while our next speaker is coming up, is it Noah, James? Yes, Madam Chair. I wanted to reiterate, because we've had the numerating issue in the past. The board meets on Monday in executive session, and from that executive session, they produce what are called addendum items, executive session items that require public action of the board, and it goes on these agendas. So what I would request that everyone do... Is we have a draft agenda that's published on Friday, and then please check 24 hours You know you identify your item your number, please check and make sure That you've got the

2:11:16•Kate Brophy McGee

Thank you. Please state your name for the record.

2:13:52•Kate Brophy McGee

Thank you. That concludes the speaking portion of these agenda items. Madam County Manager, turning it over to you.

2:15:11•Kate Brophy McGee

Do board members have any further questions? Mr. Gallardo.

2:15:15 – 2:15:32•Steve Gallardo

Yeah, Madam Chair, Jen, and I just, clarification, and I think you touched on it, but I just want to make sure we're clear. For instance, the town of Gilbert, if they wanted to, they can go and construct their own library and pay for it, correct?

2:15:38•Kate Brophy McGee

Thank you. Any other comments? Oh, Mr. Stewart.

2:15:43 – 2:16:02•Mark Stewart

Yes, thank you. I think one of the questions was, and I'm kind of curious, when was the last time library policy was reviewed comprehensively, similar to what we just did, thanks to Supervisor Galvin, with the zoning, planning and zoning ordinances? When was the last time that was done for the library, Madam Chair?

2:16:34•Mark Stewart

Just when was the policy reviewed? And you have to excuse me. I'm a little under the weather, so my little scat.

2:16:41 – 2:16:52•Kate Brophy McGee

I'm glad you're feeling better than yesterday. Madam County Manager, do we have specific dates or will that need to be something staff researches?

2:17:02 – 2:17:17•Kate Brophy McGee

Thank you. Any other questions or comments from board members? Hearing none, we will proceed to a vote on library district items 119 through 124. Madam Vice Chair.

2:17:18•Debbie Lesko

Madam Chair, I move that we approve items number 119 through 124. Thank you.

2:17:22 – 2:17:56•Kate Brophy McGee

Is there a second? Second. It's been moved and seconded. We will now proceed to a vote. All those in favor will say aye. Aye. Any opposed? Motion passes unanimously. We're on to the final items of our agenda today. We adjourn as the Library District Board of Directors and reconvene as the Board of Supervisors starting item 125, public comment. Madam Clerk, do we have individuals and also could you speak to the email commentary we've received?

2:18:26•Kate Brophy McGee

Thank you. Ms. Barker, you're up to bat. Please state your name for the record.

2:22:37•Kate Brophy McGee

Thank you. Please state your name for the record.

2:26:41•Kate Brophy McGee

It depends. We're in public participation. Items are not agendized.

2:26:45•Thomas Galvin

I do not want to directly address the speaker, but I just want to let him know that my staff is standing here in the back and he can go talk to them about his issue. We'd be happy to see if we can help. Thank you. Thank you.

2:44:31 – 2:44:47•Kate Brophy McGee

Thank you. Madam Clerk. Joe Hoff. Caitlin Contreras. Excuse me. Madam Clerk.

2:47:10•Kate Brophy McGee

Welcome. Please state your name for the record.

2:49:02 – 2:49:16•Kate Brophy McGee

Thank you. That concludes the public comment portion of the agenda. We will move on to Supervisor's Summary of Current Events. Asking Madam County Manager first if she has any comments.

2:50:12•Kate Brophy McGee

so much for flying under the radar. But she did pretty good up till now. Supervisor Stewart, comments?

2:50:22 – 2:50:37•Mark Stewart

None for me today other than I want to congratulate Tom on his move and I couldn't agree with County Manager Moore. He's a tremendous asset to the county and he will be sorely missed and we wish him the very best in his future endeavors. Thanks, Tom.

2:50:43 – 2:51:39•Steve Gallardo

Thank you, Madam Chair. I wasn't going to say anything as well. But now that we're saying our thoughts with Tom, a lot of these issues, particularly when it comes to planning and zoning, It gets complicated. It gets difficult sometimes. So we rely on our experts here at the county to kind of help navigate us. We're trying to look at our neighborhood concerns, and we want to do the right thing. but i just want to say thank you you've been a tremendous asset for district 5 and helping us on so many different projects and and just understanding it you know it's you know it's for someone who comes

2:51:42 – 2:52:18•Thomas Galvin

Tom, we're going to miss you. Thank you so much, not just for your service to the county, but your considerable career. And I had the good fortune of interacting with you before I joined the county. and became a supervisor in all respects that I have dealt with you. You've been nothing but above board and professional. I also know that it's really hard in leadership positions in government. There's a lot of decisions you have to make, but a lot of times you have elected officials looking over your shoulder. But you've been fantastic. You've been a great public servant in the true sense of the

2:52:23 – 2:55:01•Debbie Lesko

Thank you, Madam Chair. I'm just so grateful that Recorder Heap and the Board of Supervisors reached an agreement, a settlement agreement, so that we can run the elections smoothly, efficiently, and fairly. This has been a long process for over a year and a half, and Justin Heap signed the settlement, and we are moving forward. I also want to say congratulations to you, Tom, and thank you for all your help in the cases. Most of the planning and zoning cases are in my district, because it's a high growth area, and you've been very helpful. So best wishes in your future. I also want to congratul

2:55:01 – 2:57:48•Kate Brophy McGee

celebration for America's 250th birthday and with that madam chair I yield back thank you mr. Ellsworth when I was on the school board the hardest time of every year was when the teachers retired first of all you couldn't believe that they were old enough to retire and second of all it's it was just such a loss very very bittersweet but happy for them just happy for them and i so i don't respond well to change in that sense but i am so so grateful that prior to assuming the role of supervisor that i had the opportunity to spend two and a half years on the planning and zoning commission startin
