All right. Good morning, everybody. I'm going to open up this Yamil County Board of Commissioners formal session at 10 a.m. on October 22nd. And I'd ask John Olson to lead us in the flag salute. Let's go, John. I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation, under God, indivisible, with liberty and justice for all. Thank you very much. Thank you. General. Okay, cool. Up next is our calendar session. Is there any changes by the commissioners?
Okay. DS public comment. If you're online, raise your virtual hand. And if you're in the room, raise your hand or fill out the card. And I do have one. So I'm going to ask Catherine Holder to come on up. Yeah, right here to the tables in the middle. And then when you get there, just give us your name and address, please. And then go ahead with your comment.
Thank you. Thank you. We'll make sure that we get your contact to the correct people.
I'm the liaison to the jail. I'll make sure and reach out to you and we can chat further.
Is there any other public comment online? If you are, raise your hand. I am seeing none other in the audience. So we will move on. Thank you very much. We are up to E, which is department updates, and we are joined by our tax and assessment team. Good morning, Derek and Patty.
So just to put your mind at ease, I did receive my tax statement in the mail. Oh, yes.
I thought we got, I got one too, same thing. Every year this comes around. Do we get some kind of employee discount or something?
Can you remind us the basis of why that went through the system?
I can tell you just as kudos to you guys. I've been through the process before, years ago, nothing lately. There might be a few coming up in the near term. I do appreciate you guys implementing the let's come to an agreement before it gets to PFAB. That's very, very helpful to the process and also I think helpful to the citizens that maybe feel like nervous taking it to PFAB and to the board. I like how you guys implemented that. And I can tell you that the ones that I have brought, most of them we have come to a decision before it even made it to PFAB. So I do appreciate that process, my piec
In terms of the appraisals, I know way back when there was just decades of appraisals that hadn't been done recently. And then you instituted the program where you can basically fly over and do that every what year, couple of years? Yeah. So how has that impacted the reduction in those that are needing to be appraised or has it?
Wouldn't now be a good time to give us an update on House Bill 3518 and just your efforts there, if there is anything that's changed since last year?
Question about the requests to the taxing districts and how that went and any anticipation should there be no legislation which would increase a state stipend. What would that look like in terms of going to the taxing districts and saying, look at this, you know, universally statewide, this is just not going to work unless.
desperately need it and without it it probably falls to a different funding mechanism that pushes that burden onto the public so is there any uh is there any leverage or any teeth to anything to uh something that could be um we could approach the taxing districts with and and is there anything that could be done in that way to say look at Either this or that.
And you're already by state standards understaffed.
So, um, Do you know, uh, are you aware of urban form?
Does it interact with what Brian has for his GIS system that's set up?
So all the cities in Yamil County are transferring to Urban Form as their basically database for planning. So if you're trying to build something, you'll go to Urban Form and click on it and try to give you as much public information as it can on on, uh, those, uh, different tax odds.
There's a, there's a push by urban form to, uh, get cities and honestly the County to, um, I think they're looking for, and Brandon was very well versed in this too, but I want to say it's about 30 grand that they're looking for to step up this platform as the primary, I guess, a way of getting information in county wide, not the county, but county wide through cities. Mostly I've watched a couple of the presentations from urban form. I think they could change their sales pitch just a little bit. Cause I watched one out in Willamina and they're trying to go for a blanket three grand per city.
I think there was some discussion because early on I'd attended some of those meetings years ago. And with the sort of the ask that the county get involved. And I remember contacting, you know, having a discussion with Ken Friday. And there was some concerns not only about the cost, but also about any of the interfaces. So I don't know how that's changed. But it was a discussion.
So, so we don't have a sticker shock when you come with us for a software, what's the ballpark that we should be?
So that's a sure thing. It was on the radar, I believe. It looks very Washington-y.
Yeah, no, we're not going to do anything like that. I'm just going to. Great idea. So it's not going to happen. Thank you. Thank you guys very much.
F is work session. There is none. G is consent agenda. I would move approval. Is there any further discussion? None. All those in favor signify by saying aye. Aye. Motion passes unanimously. Thank you. H is old business. H1 is consideration of an ordinance amending the Yamil County Zoning Ordinance Section 1006 signs declaring an emergency and setting the effective date. This is the second reading brought to us by Jody. You had plenty of warning to get there.
You're distracted by a retirement party.
Thank you. Somebody put it on the agenda. I would have read it. Would have gotten done quicker, that's for sure. Do we need to set the date then now since this is the second reading?
So I would move approval. Is there any further discussion? All those in favor, signify by saying aye. Aye. Aye. All those opposed, nay. Motion passes. Commissioner Stewart voting aye. Commissioner Johnson voting aye. And Commissioner King voting nay. And I remembered to ask for the nay this time. Last time I was like, oh. We're moving on to aye, which is other business. I want discussion of a proposal.
Do we need to make a motion to him? What does that say?
I negative 1 is Lindsay Manfred giving us a presentation.
I make a motion to amend the agenda to bring Lindsay Manfred and Dr. Manfred for the intergovernmental grant agreement with the state of Oregon.
Cool. Any further discussion? None? All those in favor signify by saying aye. Aye. Motion passes. Thank you. Go for it.
And the rural health money, the money that's gone to the state of Oregon from the federal government is what, I forget how many millions, but then those are, doled out to the counties for the non-competitive types of.
I would move approval of accepting the IGA. Okay.
Motion has been made. Any further discussion? None. All those in favor signify by saying aye.
Thank you. That brings us to I1. And this is the discussion of a proposed truancy task force roster. Did everybody get a copy of the roster on there in an email?
I didn't get it. We'll just round up to it then.
Yep. I think the main thing was direction to establish the task force. Jody has written up the bylaws for that or stipulations for it. I think the main thing that we would also need approval so that they can come back before us is how the committee was going to be set up and who was going to be on it. Some of the initial versions had way too many people on it, but they pared it down. So I'll rattle off who's going to be on. Excuse me, Chair.
Since we haven't, have we seen the bylaws? Because I haven't seen them and the roster. Can we put this off? Absolutely.
I'd much rather have, but for now, let me at least rattle off publicly what, who's proposed to be on it. Did Jeff show up today? He didn't. Okay. That actually is probably better. Anyway, just in case there was questions, I was kind of hoping to have Jeff or Courtney here. So proposed to be on the task force is going to be Jeff Clark, Superintendent, Amity School District, Courtney Ferreira, McMinnville Superintendent, Kit Johnston as the Yamaha County Commissioner Representative, Lindsay Manfren, our HHS Director, Judge Easterday. She will be representing the Yamaha County Court System. Jessi
Appreciate it. Yep. Appreciate that. Thank you very much. We're just going to move on to item I-2. It's consideration of rescinding board order 26-155 and declaring vehicles from the fleet department as surplus in accordance with YCC 2.60. I would move approval. Mark is here if we have any questions. Is there any further discussion? None. All those in favor signify by saying aye. Aye. Aye. Motion passes unanimously. Thank you. Let's see. So, Ken, you want to give us a little background on I3 and 4 real quick?
So that brings us to I-5, which is consideration of Amendment No. 2 to Agreement No. 1029202 between Yamil County and the Oregon Health Sciences University, Board Order 25-102, adding funding in the amount of $20,142 retroactive to October 1, 2026 through September 30, 2028. Move approval. Motion's been made. Any further discussion? None. None. None. All those in favor signify by saying aye. Aye. Motion passes unanimously. Thank you. That brings us to I-6, is consideration of agreement between Yamil County Health and Human Services and Lane County for food handler training and testing revenue
I would make a motion to delay agenda items I3 and I4 to the next available date. um at the discretion of the county administrator at the discretion the date will be set at the discretion of the county administrator uh motions have made any further discussion on that none all those in favor signify saying aye aye motion passes unanimously thank you moving back to i7 I7. Did we finish vote on I6, though? Okay. I7's consideration to renew the Office 365 license with technical support from Tangent in the amount of $228,555.01, effective October 30, 2026 through October 31, 2027. Is there any...
Motion's been made. Is there any further discussion on that? No. None. All those in favor signify by saying aye. Aye. Motion passes unanimously. Thanks. Thank you, Shane. Moving on to item I-8, consideration in the matter of Yamil County Council assuming the duty of representing the state's interest in civil commitment proceedings. I would move approval. Is there any further discussion? Football?
Motion's been made. Any further discussion on this? No. Jody, do you want to give a little background on it?
Okay. Appreciate it. All those in favor, signify by saying aye. Aye. I motion passes unanimously. Thank you. Item I nine is consideration of agreement between Yamo County and Pay it for merchant credit and processing retroactive to October 15 2026 through June 2020 June 24 2029 Motion's been made. Any further discussion? None. All those in favor signify by saying aye. Aye. Motion passes unanimously. Thank you. Okay. That brings us to our public hearings. And because we don't have public hearings too often, I never did mention that if you are here to give a public comment or you showed up late,
Yeah, for mainly seniors and cost-wise, making sure that we have some form of reduction for that. Or free, I think is what maybe the ask was. 50% reduction is what it was. Is there anybody else that would like to give public comment on the transit? Anybody online? Raise your virtual hand. Seeing none. Do you want to do the same for then item IB then? Or is it
Since there's no public comment, I'm going to go and close item 1A, public hearing at 1059. I'm going to open up the next public hearing, which is item J1B in its consideration of proposed transit service adjustments for Yamhill County. Is there anybody here to give public comment on that? If you're online, raise your virtual hand. Seeing none in either. With that, I will then close the public hearing at 1059. Fantastic. Okay, now what would you like, Jodi?
Any deliberation on this? I know we had talked a little bit at length last week about it. Anybody want to add anything?
Motion's been made to approve. Is there any, you want to do separately or? Okay, motion's been made for item 1A. Commissioner Stewart.
Yes, I would move approval of the Fair Policy and Community Pass Program with implementation targeted for January 1, 27, subject to operational readiness.
motion any further discussion and for me none all those in favor signify by saying aye aye motion passes, thank you.
You want to do the second motion, I would move approval of the consideration of the proposed transit service adjustments for yam hill county again January 1 2027.
operational readiness uh contingent thank you for that is there any further discussion none for me none all those in favor signify by saying aye aye motion passes unanimously thank you thanks for coming brandon thanks brandon thank you see you later hi does anybody need a break okay let's take a quick five-ish minute break
I'm going to open up this second public hearing, item J2. It's docket number at, what time is it? At 1109, this is docket number C-28-21. It's the Louvre remand number 2022-090, a request for a conditional use request to operate in nine guest room bed and breakfast facility as a home occupation at 15990 Northwest Red Shot Lane in Carlton. Applicant is Kellen Lancaster. Appellant is Friends of Yamil County. The hearing will be limited to accepting evidence and argument. uh regarding only the following issues that formed the basis of the remand so with that i'm going to call for any abstentions
campaign contributions and I have stayed at the ground before I was commissioner. And while I was a, Board president for the Salem Valley Chamber of Commerce before they opened.
Are you abstaining? No. Okay. Ask, is there any objections to jurisdiction of this board to hear the matter before it? Anybody online? No, hearing none. Okay. Does any board member need to announce and state on the record the substance of any ex parte contact or any site visits? Yes. Okay. Also, I will say that I've been on site, but it wasn't specific to this. Nothing from Commissioner Starrett. And then we're going to go with the reading of the statements by Jody required by law, or I guess Ken or Lance. Lance, you're up. Lance, go ahead.
Can you unplug that and just, is Ken's microphone okay? Yeah, it seems fine. Oh, no, he's a little bit jumpy too.
No, don't do that. Unplug that one. That's sensitive. Are you staff report? Yes.
With that, we're gonna go to the applicant's case. I'm gonna call up Mark Hoyt.
No. Just to be clear, so the operator's residence is detached from the bed and breakfast main facility, correct? No. That picture where you have... Let's go back. That's the hillside.
Yeah, right. Go back. There you go. So the picture to the left.
So that picture on the left, that is not a detached. No. That is all part of it.
Right. That's what I was... That picture makes it confusing. So that's why I asked. So thank you.
Quick question. So in Exhibit D, page 3, the bottom left for department use only. We're talking about August of 21. Under conditions and remarks shall not be used as a short-term rental, bed, breakfast, VRBO, et cetera. without first receiving land use approval. And that was, what was the year? Was that?
Yeah, I was just looking for that. OK, thank you.
Just so before I start getting into, let me get back to my list here. Hang on a second. So before I get to testimony and support of the application, I'm going to ask anybody online that's in support of the application and they're here to give comment to raise your virtual hand just for support, please. And then I will get into the list of people that are here. I'm going to call up next for support of the proposed application, Frank Foti.
Thank you. um just a quick reminder if you're here for support of the application online raise your virtual hand this will be our last warning before you get skipped over next up i'm going to call heather miller who's in the room good morning name and address please my name is heather miller i reside at 15250 northwest panther creek road in carlton oregon
Thank you. Next up, I have Agustin Enriquez. You can correct me when you get up there. Name and address, please.
I don't see any, there's no more papers for anybody in the room for support and I don't see anybody online with their hand up. So we're going to move on. And we're going to ask for the appellant's case. And I'm going to ask for Sid Friedman to come up. And I'm also going to ask that we have Eve Goldman online promoted, please.
Okay. We're promoting her now. Welcome, Eve. Can you hear us? Yes, we can. Go ahead with your name and address, please.
I have one question for Ken back to one of the statements that he made that the prior replacement dwelling never qualified as a dwelling or there was no proof. Can you touch on that a little bit?
Thank you. Any question? Go ahead. Go ahead. Just something to kind of clarify. I see the direction that you were going with your slides there, Sid. I guess one of the things that sticks out to me, a few of them jumped around from different people. And so you're trying to build this narrative that Heather isn't the onsite. um, caretaker of the property. Um, but to me, I mean, it's an employee. So employees change, I guess, explain a little bit more or confirm with me, would you would agree that a caretaker could change a month by month, year by year, depending on what they do for their job or
I mean, they said it was Heather on the record. But it is going to change, I guess is my point. So what would you want to see as evidence more than Heather coming up to the stand and saying, I am the operator and I live there?
But I mean, that's part of the record, I guess.
A couple of things. And as far as your address on a license, that's visit or call the DMV.
I was just going to say that as far as an address on a license, we know that that's not necessarily proof that anybody lives at that address because people say that all the time. But anyway, a couple of questions. And this might be a question for Ken Friday. Did Luba or are we required? for the owner to live there. We also talked about an operator. So if somebody has a concern, a business, does it necessitate that the owner actually live and operate that particular business?
What about the fact that this was under appeal and building was continued, construction continued?
Well, that was brought up as one of the issues in terms of it The construction continued while it was under appeal. Is that an issue? Is it material? No. It's not? No. Okay. Would that be a code violation?
It would require a stay from the court. Yeah. Okay. And that never happened? So the other, what was brought up was the farm campus, 22 cabins and yurts and those particular things on the same property. There was, was that something that was?
The building code, the OSSS code from R1 to R3, was there an issue with whether or not that was appropriate?
So our code, and we've had this discussion in terms of does the board or did the board ever want to address the fact that it was allowable for nine rooms, and we had talked about you know, what did we want to bring it down to five or four, but that's not the case because this exists and was built under the nine room.
Yeah, because I think we were going to, and then we never did. What about the 19 parking spaces? that would have been pretty much commensurate with the fact that there were nine rooms provided. So that would have to have been allowed.
So the definition of a motel that was brought up, what is the definition of a motel, hotel? Is that something that needs to be addressed here, or is the fact that there were nine rooms allowed, that's enough?
So if today, and this is separate, if today someone were to apply for a residence with that many bedrooms, and then we know maybe the plan would be to change into a, you know, rental, short-term rental, we would have to approve it today.
Right. We would have to, unless things change.
Is there a definition of what we would require? A caretaker room or... Anything to that effect? I mean, a lot of this argument hinges on a 149 square foot room, but as far as we care, it doesn't matter how big.
And the only other question I had was the replacement, so thank you for touching on that.
Okay, there's no further questions. We'll move on. Thanks, Eve, and thanks, Sid. My next, if you're online and you have comments in opposition, raise your virtual hand, and then we'll get to you. The next in-person is Mary Wheel. Thank you. Okay, well, I got a few more here and we'll ask maybe one more time before we get to the end. I do have one that says they only want to provide written testimony and it's Terry East and I just want to verify she doesn't want to give verbal testimony. Okay.
If you're going to give a comment, come on up. So I just need a yes or no. Okay, thank you.
Okay, hang on. We'll get to it. That brings up Catherine. Come on down. Name and address, please. Again, if you're online, raise your virtual hand. We'll get you queued up. Good morning.
Oh, thank you. Thank you, Catherine. Don't forget, if you're online, raise your virtual hand. I got one more in-house comment, and you can correct me as you come up, but it's Issa Purse. Ilsa Purse, come on down.
I haven't seen you in a while. It's been a while. I know.
If you could state your name and address for the record, please.
Thank you. So that was my last in-person. I'm going to circle back to see if Mary Wheel made it online and wants to give comment. Raise your hand if you're there. Okay. I'm not seeing any, so we're going to wrap that up. That brings us to 11, which is our public agency reports.
And that brings us to our rebuttal by the applicant.
Questions? No. None for me. None. Thank you. Staff recommendations.
Thank you. With that, I'm going to close this out at 1.31 for deliberations. Who wants to kick us off?
To clarify what I said earlier about donations from the owners of the ground, I've also received campaign contributions from both friends of Yamhill County and Thousand Friends board members. So I really don't have a dog in this fight at all. I've operated a B&B in the past. It was attached to my house. And everything describing this room was actually very similarly set up in my house. And I have a room in my house today that has a coffee station because I don't want to walk into the other room when I wake up. Um, and as far as, um, the argument of, uh, concierge or a desk, um, you know, I, I
OK, I think that's what we were looking for.
I would like to say that I have appreciated the folks from Friends, even though I have probably only agreed with you on one time. And that's OK, because your passion is wonderful. I also know that when I heard about this particular property and what was going on, I thought, boy, this is a tough one. We're looking at basically a hotel, whatever you want to call it. But I also know that this board is tasked with doing one of two things, and that is looking at the rules and the regulations and saying, does this comply with what our zoning ordinance says and with what the state requires. So as muc
I agree with Commissioner Starrett on how we need to make sure we stay focused on what's before us. There's a lot of opinions that can get in the way if you're not careful. And I mean, some of the stuff that Sid was saying, I don't hold it against him, but it As he's speaking with this slideshow and I'm thinking through just the houses that I've lived in throughout my life, I've farmed all my life and lived in a number of different farmhouses and nothing as fancy as that. But I guarantee you, I lived in a 10 by 14 room and I was tickled to be in that 10 by 14 room because prior to that, we wer
Okay, appreciate it. That being said, last time we had this conversation, we were going to have a work session to discuss what Commissioner Starrett brought up. I was here for that. We probably should... Get that on the calendar. I don't know how productive that's going to be because we're going down these roads with trying to, I don't see hopefully is this being as bad, but you never know. We start opening up a can of worms with changing definitions on things. And so I don't want to overload Jody with something either. So I'm going to leave this up to you two, but let's put it in the hopper a
And hopefully there's no definition changes. Okay. So with that.
Can I ask a question about that really quick? Yeah. Are we okay if that is after the first of the year? I know that we have a change here, but we only have so many weeks between now and the end of the year. And she's a woman.
Okay. Um, with that we're set and we are going to move on to. Okay. Announcements.
I forgot all about that part of that today. Um, let me see. I'm going to keep this brief because we have been here for a very long time. Thank you to the sheriff for, um, the invitation and the ride in the, um, parade at McMinnville 150th birthday had a great time I don't know how many times people said that we were locked up what was it we counted maybe up to six I think five six yeah so and two you have a quorum yeah and two we have a quorum so yeah uh public meetings so um but great to ride in the new car I think that uh Sam kept a big um some big plans for those um Really, the only other t
So I want to piggyback on that. The shooting in Bend highlighted a couple of things, and I think that really has to do with the overwhelming disappointment I have with our legislators on both sides of the aisle. We have seen the most restrictive gun laws increase and make it difficult for law-abiding citizens to protect, for instance, in this case. We had not only a shooter who was intent on killing people, which he did, he shot a seven-year-old wheelchair bound girl in the face. He killed a five-year-old who was planning on dressing as a bunny for Halloween, shot an 11-year-old, 25-year-old t
Thank you for that. Tuesday, I had a working conference, the work in conference that was hosted by Willamette Workforce Partnership, and it was an all day conference. I'm just going to touch on it super quick. Main key thing coming out of a lot of the different breakout sessions from presenters, the biggest one that stuck out was from Angela Wilhelm with Oregon Business and Industry. One slide sticks out. It's three steps. This is a message to the state. I think we all know it doesn't matter what side of the alley on or politics, but it's the one message that acknowledge the problem that busin
