All right, I'll go ahead and call this Tuesday, October 20th work session to order. I'm going to ask Commissioner Underwood, if she don't mind, lead us in the blessing, followed by the Pledge of Allegiance. Commissioner Gruber, please stand and let's bow our heads.
Thank you. Dear Heavenly Father, we just thank you for all that you do, God, because you know, God, we know that you are good. And God, we know that the goodness of you is something that you don't have to prove because you are good. And we just thank you and praise you for all that you do for us here in Ballin County. And Lord, be with us today as we conduct the business of this county. Help us, Lord, to make the right and best decisions. In Jesus' name we pray. Amen.
of the United States of America, and to the Republic for which it stands, one nation, under God, indivisible, with liberty and justice for all.
Thank you. All right, so right now what we are going to do is work on putting our consent agenda together, and I'm I want to welcome everybody here today to this beautiful morning and great work session that we're about to have. So, so on our consent agenda commissioners, we have our administrative items. I think on a couple of these, we can, we can go ahead and consent. There's on item CA three, there's another monetary donation. coming from the Fly High Goose Foundation. And I think they will be at their 10 o'clock meeting to talk about what they're going to be wanting to do around the same
All right, so next up, we do have somebody here that may want to speak on behalf of this. This is acceptance of a sponsorship from Rainier, Inc. for the 2026 and 2027 Christmas lights at Bicentennial Park. We have Ms. Shawn DeRome here with Ray Anear that is present. Felicia, do you want to come up and say anything?
Do y'all have anything you want to say to Mr. Rome?
I just want to say thank you. Thank you for doing that. I mean, cause we want to continue to have the Christmas light show. Yeah. It helps.
Yeah, thank you very much. You know, the more sponsors we can get in this thing, it helps us. Sure. I'm glad to see you all stepping up and doing that. Thank you so very, very much.
Well, especially thank you for having lunch with me that one time. Yeah. And we're touching base about what Ray and Nir does for our community and how we're partners. And I had no idea that something like this would ever come out of that conversation. But when I, when I started talking about Christmas lights at bicentennial park, I could see you were interested in it back then. So almost two years ago, that's crazy how we're here today. And I appreciate your confidence and y'all's interest in helping Baldwin county commission out with this project, because it does take now a lot of outside mon
or y'all take this as a consent item, okay? Yes. All right, we have our items in budget and purchasing. That is CE1 through CE14, or excuse me, CE15.
Damn good. All good. Now we got a item with the sheriff's office transfer seven vehicles to Baldwin County commission to be sold on gov deals. Okay. Commissioner group. I hadn't heard you today. All right. So we got EMA items. We've got a couple of things here. 2026, Baldwin County Multi-Jurisdictional Hazard Mitigation Plan, as well as a joint funding agreement with the U.S. Department of Interior, U.S. Geological Survey for engaging states. I'm good with those. Yeah, I'm good.
Good with these? Yeah. Okay. Highway item? Wow, two items, huh? Yes. Yeah, I'm good with those. Good with those. All right, personnel.
All right. So this is the end of our consent agenda, which is meaning we're nearing the end of our work session time. But this is also the time for our public comments section. Now, if you are here for a 10 o'clock planning and zoning case, you're more than welcome to speak during public comments, but you will have a time to speak when your case is heard at 10 o'clock for the public hearing. So is there anybody, Roxanne, is there anybody signed up to speak for the public? Is there anybody out here that wishes to speak to the commission in public comments? All right. We ain't had that in a long
I want to move back to, do we want to include any of the?
GA1 has to be, I think, voted on, right?
Commissioner Gruber, are you okay with that? Yep, I'm fine. Okay. So we will add FE1 to the consent.
And the rest we'll take care of when we open up our 10 o'clock meeting. Just remember, commissioners, hang up before we do a question. When we do this adoption, I mean, you see all the red on this when we kind of take action at 10 o'clock, so. Just make sure when whoever makes, Commissioner Gruber will make the motion, I'm sure, to adopt these meeting minutes, but you got a lot of stuff to read right there, so I'm just drawing your attention to it before we get to that point. Anybody else got a commissioner request?
Mine's not really a request. Mine's a comment. There's some things after the hurricane that hit that I want staff to see if they can help me with this. I don't see Deidre. Yeah she's off maybe Roger you can help me with this it's admin leave I had a lot of county employees reach out to me and I think it's been fixed but they said that they wasn't something that the policy was changed back in April or something that they weren't going to get the admin leave because I can't remember the reason but they said there was an issue but but then I heard that the The staff has fixed the issue and the em
It was mostly the people from highway that was calling me anyway. So I think if I asked Judge of Probate, his issue, it didn't have any. So it was mainly the highway guys. Yeah. You know, their emergency, their essential employees, they have to go in different times.
Okay. Well, good. I just feel like at this time and age where... You know, we have hurricanes down here. We know about admin leave. They shouldn't be an issue. That should be clear because we don't want these county employees worried about, you know, if they're going to get paid or not or if they're going to get leave or whatever. I just feel like this is 2026. They shouldn't be an issue.
We should be to the point. I understand what happened is you had all these guys working, everybody else at home. You get paid twice for that, and I get it.
I had two call me and thank me for letting them off. Other than that, that was a hundred.
It was a lot. I had no one call me, but they sure did thank us for letting them off on Thursday.
Well, tell Deidre thank you. Absolutely. Because we don't want that, especially right now. But thank you.
Nope. I don't have one. So senior staff.
Absolutely. Well, thank you. Well, thank you all. Good work, good teamwork. Good. County attorney's report.
So, commission, y'all have heard our attorney's advice.
I'll make a motion that we accept our attorney's recommendation to go into executive session.
And I'll second that. We've got a motion and a second to go on to executive session.
Aye. And for the record, we will return at our regular meeting at 10 o'clock and not reconvene this work session. Open up our regular meeting of the October 20th Baldwin County Commission regular meeting. Today, joining us, As a minister of pastoral care, it's a church of his presence, Randy K. Worrell. If you would, please come up and deliver our invocation today and followed by the Pledge of Allegiance by... Who did it last? Commissioner Gruden? Yeah. Commissioner McKenzie will do it the next one.
Please join me in a pledge of allegiance. I pledge allegiance.
Thank y'all, y'all can have a seat. All right, commissioners, first up on our agenda is item A, which is the adoption of minutes.
Mr. Chairman, Commissioner Graber asked me if I would read this. and make the motion. I will make a motion to approve the October 6th, 2026 regular meeting minutes with the notation that there are some corrections and we need to correct for the record the project numbers that were listed in agenda item GA as follows. Capacity improvements on County Road 64 at State Route 161, project number HW27011.
Hey, Commissioner Underwood, if you would, you said County Road 64.
Oh, you know what? I don't remember saying that, but if I did, I did. I was just sitting here going State Route 161. I'm sitting here thinking, is that wrong? But anyhow. All right, we'll start over. The capacity improvements on County Road 68 at State Route 161, project number HW27011, road extension on Hartung Road to Sherman Road and Pond, project number HW27077, intersection realignment on County Road 32 at County Road 55, Project number HW27081. So that is a motion to approve the correction to the.
Okay, y'all heard the motion. I'll second. We got a motion and a second to everything that you just heard. All those in favor, signify by saying aye. Aye. All right, so now we need a motion on the October 6th, excuse me, October 7th emergency special meeting, meeting.
Mr. Chairman, I make a motion that we approve the minutes from the October 6th, 2026 regular meeting.
We got a motion and a second to adopt the minutes for October 7th, 2026, the emergency special meeting for the hurricane that I still can't pronounce. So all those in favor say aye. Aye. Okay.
We never said it, so we didn't get used to it. All right. Road and bridge division meeting adoption minutes for July 14th, 26.
Chairman, I'll make a motion. We adopt the minutes from the July 14th, 2026 road and bridge meeting.
Got a motion and a second. All those in favor say aye. Aye. Aye. Commissioner Gruber, I will turn the finance portion over to you.
Okay. Mr. Chairman, I'd like to make a motion that we pay the bills, which involves 388 invoices and a distribution totaling $15,833,524.25. I'll second it. We got a motion and a second to pay the bills.
Aye. Mr. Chairman, I'll also make a motion that we ratify the interim payments as allowed by Policy 8.1. And this report includes 88 invoices and a distribution totaling $5,624,000. $1,119.73. I'll second it.
Aye. Commissioners, really quick, before we adopt our consent agenda, we have some people here in the audience that I want to recognize for an item that we've already consented on, and This is a monetary donation from the Fly High Goose Foundation. Frank, Caleb, and Amber, Kelly, if y'all would come up to the podium.
I just wanted to say one thing before these people get out of here. I saw at the groundbreaking at the live vote for the playground, it's a toss-up of who's going to do the speaking and all that kind of stuff, and I know it's tough. I just encourage the public to Google the Fly High Goose Foundation website just so you will know exactly what this is about and what this foundation does. Probably one of the most well-developed organizations that gives back to this community that I've ever seen in my life. I was in school with Amber. I have breakfast at Waffle House whenever I can with Kelly. And
Y'all want to say anything? No, I think you said it. You nailed it, Commissioner. Thank you all so much for donating this money to the county.
Thank you. And I hope that everything that we do helps you in your efforts as well. Absolutely.
Thank y'all very much for your kindness.
Thank y'all. You don't have to stick around for all the rest of this that's fixing to happen. We'll spare y'all that, Amber. Thank y'all. All right, so commissioners, before us is our consent agenda. Just remember that we moved item FE1 to the consent agenda. CA7 has a has a replacement item as well as C15 has a replacement item. So that will be noted for the record.
I'll make a motion that we approve our consent agenda as discussed in the work session with the noted items that Chairman just mentioned.
I'll second it. We add a motion and a second to adopt our consent agenda. Unfortunately, I forgot to make a statement about the phones on my last meeting here in Fairhurst. So you'll get away with it today. No jail time today. All right. So we have a motion and a second on the floor. No discussion. All those in favor say aye. Aye. All right. Our consent agenda has been adopted. Now we're moving forward to I'm going to do the retiree presentation. I'm going to do that, and then we've got some other stuff I'm pushing forward.
All right, so congratulations to All right. Well, commission, do y'all want to say anything on the retiree?
I just want to say thank you for 25 years, your dedication to the county and what you've done. So just thank you. Continue doing, if you want to come back and work part-time, I always say that. A lot of people don't, but some people do. But I just want to say congratulations. Enjoy retirement.
Thank you, Gina. I remember when we first got here, you guys were still in that old building, and we worked so hard to get y'all in a new building. And thank you for when you stepped up for leadership when you did. And last week, it's been on my calendar for a while, I was asked to go speak at a little Christian school, second and third graders. And I was like, they wanted to know about county government. And I'm like, well, how do you put that into a second and third grader's mindset and so when I got there fortunately their teacher helped me out and she said you know tell us a little bit abo
Gina, thank you so very much for the time and effort that you put into the animal shelter. I remember when you came here, you know, you made a big difference in our animal control part of it, you know, taking care of the animals and everything and bringing, being the one who went out and caught a lot of these animals that were causing problems. So I just want to thank you for all that and thank you for your services.
Yeah, Gina, absolutely. Thank you so much. I probably can't see me because of these pillars they built in the way of me. So but I remember when you were animal control officers with city and for the county. So I know the job is very taskful and is, is I would not want to do that job. And what you get called out on and stuff and probably assist in our even our police departments and sheriff's department on cases when it comes to animals and stuff so it's just a it's a thankless job and you've done it well for 25 years it's going to be very hard to fill your shoes on the way you had a mindset at
I make a motion that we adopt resolution 2027-025 adopt in the minutes of the August 4th 2020 regular meeting of the Baldwin County Commission.
Got a motion and a second for item GA1 which is resolution 27 slash 25. Any discussion?
I have one thing, Brad. Since I wasn't here on the commission back then, can I just recuse myself for this? Sure. Okay.
All right. So all those in favor, signify by saying aye. Aye. And note for the record that Commissioner McKenzie recused herself from this vote as this was done by the previous commission. All right. Thank you so much. And now we will go into our environmental management portion of the agenda today. We are going to have to recess this regular meeting to go into what's called a waste siting board meeting. How does that work, Brad? Does everybody have to leave?
We've done one of these before and I just wanted to make sure that we didn't have to clear house.
Do we have a motion to recess? So moved.
Got a motion and a second to recess this regular meeting. After the waste siting board meeting, we will be back in session.
All those in favor say aye. Aye. All right, so this meeting has, commission meeting has been recessed. Now we will open up our waste siting board meeting. Terry, are you coming up to the podium?
Commissioner, do you have any questions?
I'd just like for you to explain why they're asking that and also explain that C&D is not hazardous and what it is, just for the record.
Before you answer that, I'm going to add something because I want you to remember this when you answer her question. I'm sorry, I'm with you on this. I want you to answer... What is 500 cubic yards? What would it look like? Because is this something that we've done in the past or is this something just they don't have a C&D? What is it? I mean, I know I'm asking you a lot of questions, but I've already got citizens asking me this and they're concerned. Why are we taking somebody else's C&D?
So if I'm not mistaken, I want you to ask that, right?
Yes. So, OK, let me go ahead and do it. Yeah, that was why I asked you to explain because when I asked you about the agenda item prior to the meeting, I think it's worth giving an explanation to the public. Yes.
Can you tell me, did you say 500,000 cubic yards?
Yeah and I'm not against trying to help our partners and all that but I just feel like that we might be taking and you've already you said it's not going to take a lot of space but in you know ballwood county the way we're growing and everything I and I just can't believe Escambia county over there don't have something I mean when you go across I-10 you get into the line you could see that big old mound that used to be you know I mean I don't know I I got
It is a mound. That's the difference. It's not a pit anymore.
That's what I'm saying. They used it and filled it up.
So to put it in perspective, if you had like the largest dump truck that you could use, which I don't think they have, it's about 25,000 loads.
Well, I'm thankful that we're not taking our own C&D into a landfill right now because, you know, by the grace of God, we dodged the brunt of that storm. And so... I think with the purchase of the McBride area and when we opened up East Fork just in the time frame that we've been on the commission, I think that that gives us a lot of space. And you said there's a lot of airspace for that. And we're not taking anything hazardous or anything like that. And, I mean, they're going to pay us, pay y'all to do it.
Well, and I get that, and I don't really care about the money-wise. I care about taking up space for the future of Baldwin County.
Do you feel comfortable to do this? Yes.
That's right. If Terry Graham feels comfortable doing this, I'm comfortable doing this because I have no idea what she's talking about. So we are going to need a vote on this. The vote will be to adopt Resolution 2027-24, approving the Solid Waste Authority to assist Escambia County, Florida by disposing of approximately 500,000 cubic yards of C&D debris created from the hurricanes.
All right, we have a motion and a second to adopt resolution 27-24. Any further discussion?
I'd just like to say, you know, this goes until December of 2026. So, I mean, they're going to have to move a lot of stuff. So, you know, once it's over, December is finished, and that's it, basically, right?
All right, so all those in favor say aye. Aye. Any opposed? Nay. All right, now we need a vote to adjourn the Vice Siting Board meeting. So moved. Second. And once we do that, we'll simultaneously reconvene the commission. Yes, sir. So once this vote happens, we're back in session for our regular meeting, okay? We got a motion and a second. All in favor say aye. Aye. All right. So regular commission meeting is back in session, and we are confirming that we have adopted Resolution 27-24 of the White Siding Board meeting by vote three to one. All right. We need to do that.
So we need a vote to confirm this in the regular meeting that we're in now.
I'll make that motion that we ratify what the waste siting board just discussed.
Second. A motion and a second to ratify what we just discussed. To approve it. Approve. Prove and ratify. Any further discussion on that, but all in favor say aye. Aye. Any opposed? Nay. Okay. Is that it? I'm glad I don't have to do another one. Yes, sir. Thank you, Terry, for all your hard work and explanation on that. All right. So next up, we're going to go back to what I think everybody's here for, and this is what we call our public hearings. just a note for the for y'all that are here for public hearings today I have seen a signature list and it's real top-heavy for like one specific cas
Can I ask you, Mr. Chairman, you mind if I ask him a question? So what's going to happen after it disapproves and with the existing road and dirt and everything there, the county going to take all of that up or they're just going to leave it? No, sir.
Well, I guess my question is too, is my concern is, and really not a concern, but if you're going to vacate it and give it back to the owners and all that, they got this right away going apart, you know, this utilities going across. Why didn't we make them move them utilities? Could we ever do that?
All right, so... Nothing else from the highway department on this I'm going to open up this public hearing is anybody here to speak on for behalf of this okay
I would gladly make that motion to vacate that right-of-way. I'm so happy to have the new road.
I'll second. Motion and a second to vacate the right-of-way as discussed. Any further discussion? All in favor, say aye. Aye. Next up, we're entering our planning and zoning cases. I will state for the record that probably gonna me as the chairman I'm gonna hear this case all the way through and it's probably one of the longer ones that I got prior engagements that I made a long time ago and I appreciate Matt being able to make it today so I can leave and not break quorum that's what I was worried about so that's why I showed up anyway today so I'm going to be leaving after this case, which, I
Selina, if you would, to the public, would you explain what an estate size lot is?
Okay. Thank you. All right. So thank you. Do you all have any questions for Selena?
Different owner from the very first application, I believe. Correct, yes.
All right, so... We're going to open this public hearing. I have taken a picture of the speaker's list, so if anybody has been added, and not to my knowledge though, right? Has anybody been added to this, Roxanne? Okay. All right, so the first speaker that I have for this particular case is going to be Hunter Smith.
Thank you so much. Thanks. All right, I'm going to try this name. Is it Brian Ishforting?
Thank you so much. Thank you for your time. All right. Thank you so much, sir. Next up, we have Gloria King.
Thank you so much. Next up is Jesse ward.
Thank you. All right, up next is Amber Kilgore.
Hang on just a second. You spoke for the group. That's fine. It's not that you're not allowed to speak, but did you sign these people up without them being here?
Brad, can you do that? No. Okay, thank you so much. No, they need to be here to speak. Thank you. Candice Angulo. I don't know if I pronounced that right. It's close enough. All right.
Sir, the three minutes just went off. Can you wrap it up in a couple seconds?
Do I have any questions for Mr. Lee? Thank you, Mr. Lee. Jewel Campbell.
Mr. Smith, if you don't mind coming up so we can hear you.
And I can go and clarify that for you real quick. That is true. It's 80,000 square foot minimum on an RSFE.
Thank you. I'll make a statement here after, I think that's our last speaker. So some of y'all are talking about a subdivision. That's definitely probably what's coming because y'all been told that that's speculative or this body here's nothing about the subdivision this is about a change of the use of the property from RA to RSFE so anything to deal with flooding concerns traffic concerns any other concerns will be handled in a subdivision meeting which I I would I would dare to say is is difficult to get through sometimes so I just wanted y'all to know that we're not up here today approving
I just want to clarify, one of the speakers that came up said that the scorecard did not, said somewhat, but it strongly supports. I just want to correct that statement. It strongly supports. That's correct.
All right. This public hearing is concluded. Commissioners.
Mr. Chairman, I'll make a motion that we approve item number Z26-37, MLI Corporate Property rezoning request.
All right, we have a motion to second. Any further discussion? All those in favor, say aye. Aye. All opposed? So is everybody going to stay around for the next four cases?
It's approved. It was unanimous. It's three to one. It was top heavy three to one. All right, so I'm going to turn this meeting over to Vice Chairman Gruber for the next public hearing.
We'll get started back here in a few seconds.
We're going to take a five-minute recess. Yeah. All right. The next one we have coming up is ES2, which is case number Z26-25. and Austin Rental Incorporated is property rezoning request. And also with that one is case number PRD 2602. That's a Highway 98 RV park planning residential development site plan approval. So we'll handle those two together.
Okay, we have anybody signed up for case number Z26? and a PRD 2602. All right, please come up. Fabio, go ahead.
Can you go back to the slide where the violation, the code violation, And it looked like, I can't remember, it went quick. Yeah, May 12th of 2026?
Yes, sir. I guess, and I want to be transparent with the other two county commissioners. I did meet with the owner and me, myself, and Jay at the time that was... The director and I'm gonna be honest with her I don't remember what was all said in that meeting because because I we had to take Jay Jay's the expert on it's not me when it comes to stuff like this and I can't remember everything she said but I guess my question to you is has she taken care of any of this violation on hold because of this process.
Most people know in Baldwin County before you move anything especially if you're in a zoned area you better get you better go ask the county and I'm and so I've told her that when we had the meeting but so I'm really Anyway, go ahead. But thank you for clarifying.
Yes, sir. I do have a question. I did not realize that this was a conditional use that was approved in 19, but now it's coming back to me. Can you give us a little more information about exactly what that conditional use contained or tell me where I can look that up? I should have done that ahead of time. I'm usually very, very... Good at taking care of those eyes and crossing those t's but for all my years of being on I won't even say it planning commissions and over 30 years of my life has been involved in this and it never gets easy but I will say that conditional uses are very specific and
And that was approved prior to our updated RV. Regulation regulations is how it doesn't have the paved streets and things like that, as it was grandfathered in under the prior regulations. Is that correct? Cause RVs are considered like a subdivision.
And permanent manufactured homes are not even taxed and stuff the same way, like if it's short term rentals and different things like that. Is that correct? I know you don't regulate that, but there is a specific difference as to why you would have to have a mobile home or a manufactured home designation rather than an RV because an RV is supposed to be six months or less. And if it transitions longer than that, then it's questionable as to whether it's actually
Thank you. Ms. Chairman, do you mind if I ask one more question? Say, hypothetical, this fails, this PRD. What would she have to do to get it compliant? She would have to move all those mobile homes?
And also, just to piggyback on what I asked earlier, if this rezoning and PRD request were to be approved, then I think I heard you say that the existing portion of this RV park would have to come into complete compliance with the current conditions. Is that correct?
as is, but if it is denied, if it was denied, the only thing would have to be is that the non-compliant manufactured housings would have to be removed. Yes, ma'am. They could continue to exist with the gravel park, right? Yes. Okay, I'm clear now. Thank you.
Well, thank you for asking that question. That helps me out, too.
It's not, and it's very, very complicated because of what was happening and how it's transitioned over the years, and it's not easy just to walk in and hear what's happening now with not really understanding how we got to where we are. And I'm gonna say it for the record. Zoning in Baldwin County is a citizen-driven process. This government did not put it on you. But we have to abide by what is law. Zoning is law. So that's all I gotta say.
Announce no, I think between Commissioner Underwood, I think you know her questions and her clarification I think that what I and this is the soft spot on me. I'm concerned if it does Not pass is what she has to and the owner has to Have to deal with but I know that's not what I'm here to do but I'm just wondering is Is there anything else that we can help her with them? I mean, I asked her that question. If we put the tires on it, could she move them? But that still doesn't matter because the state's already recognized it as a matter of fact.
I think what I was trying to process in my head was no matter what transpires today, an approval or a denial is going to create additional financial investment by the property owner. Either removal or which is a financial situation, or bringing the, because that's only a request that they can stay as they were grandfathered in, is that correct?
Okay, okay. It just adds to that heaping mound of complicated situation.
But I'm not clear, so I know Commissioner Underwood is, but tell me, so if we approve this or deny this, I need to know about the gravel, you said about the gravel.
Okay, okay, okay. And correct me if I'm wrong, and if you want her to explain it, that's fine. But it was grandfathered in as an RV park because we changed our regulations on RV parks after 2019, okay? And what they're asking is not just to be approved for this zoning and this PRD, but contained within the PRD is to keep the grandfathered-in gravel. And what my point was is that I thought that I didn't realize that was part of the PRD So what the request is, is to continue the RV park under the old grandfathered in rules and add manufactured housing to it. And so there would be no improvement.
Yeah, and I understand what you're saying, and I thank you for clearing that, helping me out with that. But I say, because what I'm looking at is that the mobile home or the manufactured homes I have a problem with. But the driveway part, because she was grandfathered in, why don't we just, okay, I don't know the census, but to leave, let her keep that.
Well, she can. If it's denied, she just can't keep the manufactured housing. That's the whole problem. That's the whole reason I think we're here. That's correct. Are we here for any other reason? We're trying to fix something with a zoning situation. I just want to make sure I'm
Yeah, and so if we do, and I'm just saying, if it does pass, what are we opening ourself up for the future for the new commission and the new RV places?
Well, I just want to say this to the commission. I really appreciate it because she's really worked hard. I know she spent a lot of money, but at the same time, you've got to do your homework too. And I'm not saying anything to belittle her because I really have a lot of respect for her, but she should have, you know, got up with the county before she started moving in mobile home, little manufactured homes And I hope the citizens are listening in the future. If it's zoned, you better get with the county first before you do anything else.
approve something and then we have a effect for the next four years for the new commission and and for anybody else to start things so thank you I really appreciate it questions of the I'll follow you I'm good okay are you all finished everybody yeah I'm good thank you we do still have a thing so I'm gonna call the public hearing to order do we have anybody signed up Okay, Ms. Gamble, please come forward and state your name.
Is there anyone else signed up? All right. Is there anybody else who would like to speak? All right. Public hearing is now closed. Commissioners? You might have asked one more question. Okay. Okay.
I'll make a motion we deny this request.
All right. Got a motion made by Commissioner Underwood to deny this. Are you here second? Second? All right. All right. Okay. All in favor of denying this motion, signify by saying aye. Aye. Aye. The ayes have it. Okay, next. Okay, yeah. That is denied to re-zone. Now we have to do the part with the PRD.
Oh, they have to be voted on separate? I thought they were contingent on the other.
They are contingent upon one or the other.
I think I'm not mistaken. Then that one was on the first item, which was ES2. Okay, I make a motion that we deny case number PRD 26-02. Okay.
Got a motion made by Commissioner... Underwood, to deny case number PRD 26.2. Any further discussion?
I would like to make some further discussion. I would like to clarify that I was a part of this body that approved the conditional approval for the RV in 2019. The commission has went through a lot of explosive growth over the years, including the last seven years since this happened. And for this PRD to request to do nothing that really a PRD is there for, which is to improve. All we're doing is being asked to change it up so that you can put some manufactured housing in there and not make any of the improvements that were so painstakingly brought forth. And anyone else that will be walking i
Mr. Chairman, we need a second. Yeah, all right.
I just wanted you to be aware of that. Okay, well, I second that motion. All right, now, all in favor of denying this PRD 26-02, signify by saying aye. Aye. Aye. All right, the ayes have it. Okay, our next. We'll have case number Z2635, Gulf Coast Farm, LLC property rezoning request.
Yes. You don't have any questions? No, thank you. Okay, is anyone signed up? Okay.
I just like to make a statement I mean I appreciate you showing us what your your desire is but I do not want the public to be confused that we're here to approve what you've presented and I think that that's why that we usually don't present sketch plans with rezoning cases because all we're doing right now is changing your zoning from rural agriculture to our or or what that's what your request is so I I do want people to understand that even though it's nice to see this it's It can be confusing to the public that we've approved a subdivision. We are not approving a subdivision. So I just wa
I'll make a motion that we approve this request based on the consistency with our
I got a motion made by Commissioner Underwood to approve case number Z2635 Gulf Coast Farm LLC property rezoning request. Seconded by Commissioner McKenzie. Any further discussion? If not, all in favor signify by saying aye. Aye. Ayes have it. Thank you very much. All right, next up is the case number Z2600026. I should say 36, I'm sorry. That's a typo. No, yeah, it's case number Z2636. Yes, sir.
Okay. Commissioner, do you all have any questions from Dana? Okay. Is there anyone signed up to... Okay, hearing no one else, and public hearing is open. Does nobody want to speak or against this? Public hearing is closed. Commissioners?
I'll make a motion that we approve case number Z26-36.
I got a motion made by Commissioner McKenzie, seconded by Commissioner Underwood to approve case number Z26-36, the MAE property rezoning request. Any further discussion? If not, all in favor signify by saying aye. The ayes have it. Okay. That brings us to the press questions. Any press questions? All right. Hearing none. Commission comments? Commissioner...
I just want to say thank you, staff, like we always do. Thank you all for putting this together. This is my last meeting here in Fairhope, and it's been enjoyable. I'm really going to miss you guys, but I'm not going to miss these planning and zoning cases.
I thought you were going to say you're going to miss me.
No, no. I'm going to be nice. You know that. But, no, I just want to say that. I've got to know some friends and got to work with some great people in this county, and it's been an honor. Thank you. I'm not going to go too far from politics, but I'm going to be watching, see what happens. But I just want to do a shout out to Tom. He's not here, but, and Frank and Mark and everybody, Lee, I mean, Brian, all the staff that had anything to do with the hurricane situation. Y'all were top notch. You prepared, you were ready, and I love it. So I'm leaving it in good hands, I should say. But thank y'
Thank you, and this is the last meeting in Fairhope for this commission. And I will miss the commission I'm working with now. That is true, although sometimes we have to move on. And I want to... I've been sick for two weeks, so I've been really tired. But everything that went down with the hurricane, I'm so thankful and grateful that we did not get a direct hit. And if we had to have a live exercise, so be it. But thank God we didn't get hit. And thank you to the staff and to the commissioners and everyone for everything that you guys did. Tom, EMA, Highway, everybody that stepped up. I didn'

all they do to get this meeting underway so that we can conduct the business of the county. I know we had a long meeting today and we covered a lot of ground, though, and I'm glad the way everything turned out. So I just want to, again, thank everybody for what they do in this county. This is a big county. And I want to apologize also for missing the meetings with the storm. I was under the weather. I was not able to make the meetings, but in my heart, I was there with y'all. cheering you all on and just hoping that we'd make the very best of what we did. And then EMA did an excellent job gett
