Good evening, I want to call the meeting to order for the Oxnard City Council for Tuesday, October 20th, 2026. Madam Clerk, may we have roll call and posting the agenda, please.
Thank you, Madam Clerk. Before we continue, Mr. City Manager, just to make note of the interpretation booth, do we have... Are interpreters here or are they on their way?
Okay. Let's move on then. So we've done roll call prior to, excuse me, prior to closed session. We will take public comments on the closed session agenda. Can the city attorney please provide statement prior to closed session?
Thank you, Mr. City Attorney. Madam Clerk, do we have any speakers for the public comments prior to closed session?
Thank you. At this time, the city council will recess to close session. And at 5 p.m., we will begin with two appointment items followed by the regular meeting. Thank you. all right the city council has just emerged from closed session and we'll ask the city attorney for any announcements to make thank you mayor pro tem there are no reportable actions out of closed session this evening okay thank you very much next item on the agenda is appointment item at 5 p.m d1 city manager department subject oxnard convention and visitors bureau ocvb annual report recommendation the city council RECEIVE T
Great. Thank you very much, Ms. Hendricks. So do we have questions from council members? Oh, yes.
Council Member Perillo. Thank you very much for the information. Thank you very much for the information. It's always delightful to hear what your plans are. As I mentioned to Mr. Spillman, there is a couple of things locally. They may not be in the city limits of the city of Oxnard, but this is regional area, and the cash flows across boundary lines. People don't really decide they're going to spend here, not there. There are some things in the local area that might be of interest to consider, even momentarily, advertising. In Camarillo Airport, two council members sit on that body, the Ventu
I think you actually answered this question for me last year, but I'm trying to remember the answer. But it was regarding the Automobile Club of Southern California and Westways Magazines. I think you were doing some sort of experimentation with that or were going to. I'm just wondering if you could talk about that a little bit.
Okay, Mr. City Manager, did you have something to add?
Thank you. The only correction I have for the city manager is getting this city from great to greater But I will say thank you, Ms. Hendricks. Are there any other comments? Oh, I'm sorry, Councilwoman.
I really appreciate everything that's happening, especially with like the arts district recognition from the state of California. I think something else, and again, I haven't gone through the whole marketing, you know, plan and everything. I love that you have something for events. As somebody who goes to a lot of conferences, it's nice to see. a one-stop place where we can see how big the capacity is and what we can use. I would love to see our different festivals highlighted. Like I'm sure you probably have it on your website, but like the insect festival, right? Like the tamale festival. I'
Anyone else? All right. Just a couple of quick points. Thank you. As always, you all do such amazing work. And I say this for recreation as well, but I think it applies to your organization and you can make one dollar look like 10. And so you do some really amazing work given the resources. And we saw the context there for where we are as far as financial resources goes. And you do amazing work. And The proof is in the output. So thank you so much for that. Just a couple more quick points before we move on. First, I want to give congratulations to Michelle as well on her change in role here. A
Great, thank you. And thank you for your work, Michelle. Very well-earned promotion there. So I loved the video, and it really put things into a different context for me because I saw myself in that as somebody who professionally travels regularly for my day job. And wherever I land, wherever clients or whoever is contracting me to go out has me go, I've been to Phoenix, Arizona. I've been to Kodiak, Alaska. I mean, I have been the most... roll of the dice places. And everywhere I go, I like to check out the downtown. I like to check out the different eateries. I'll ask the hotel staff what th
Thank you. So with that, Madam Clerk, do we have any public speakers on this item?
Thank you very much. This is a receiving file, so no action is required. At this point, we will move on to the next agenda item, appointment item D2. Subjects, excuse me, city manager department. Subject, approval of the Downtown Oxnard Improvement Association annual work plan and budget for fiscal year 26-27. Recommendation? that the City Council approve the Downtown Oxnard Improvement Association annual work plan and budget for the fiscal year 26-27. This item did not originate in committee, and we will have a live presentation by Downtown Oxnard Improvement Association Board Chair Angela Wh
Great. Thank you very much. I see the photo you picked there. You had the mayor deep in thought on that one. So questions from council members for our presenters? Councillor Starr.
Yeah. Did you mention how much the budget was last year in comparison?
I think in the report we got on page 61, there was an estimated carryover of 66,000 by the end of June. Yes. By the end of.
But you want to see actuals for last year, right?
Actually, even the budget for last year. I just want to know what the increase is or decrease is.
NEW SPEAKER P. MY QUESTION ON THE SIMPLE SIDEWALKS PORTION OF THAT BUDGET, THE 362,000 AND CHANGE, What portion of that do you think is because of homeless issues?
I guess my question is more along the lines of what portion of this is spent on dealing with homeless issues versus other things that you could do with the money?
One thing I can add. Excuse me, we have Ms. Golden who might have some input on this. Do you want to jump in? Sure.
NEW SPEAKER THANK YOU. BEFORE WE MOVE ON FROM THE QUESTION ABOUT THE CIVIL SIDEWALKS, INCLUDED IN THIS BUDGET IS THIS, I GO THROUGH DOWNTOWN LITERALLY EVERY MORNING IN A CAR OR ON A BIKE. Is this inclusive of the people who are out every morning sweeping, power washing, getting the sticks swept up in Plaza Park, all that? Is that inclusive in this as well, people with the blue vests?
Oh, I'll have to try that. Thank you. OK. Council Member, did you have additional questions? Okay, thank you. Other questions from council? Yes, Councilwoman Rodriguez.
I do have a question. I'm really excited about the poll banner design and installation. I know that we've had conversations about that possibility, so I'm excited to see it potentially launch. When folks sponsor that banner, are you all thinking about having it like for a season, you're around every three months? Is there going to be opportunities for different folks to showcase should they sponsor the banner? Because I know $3,000 is not going to cover the polls in downtown, right?
So if they're half as beautiful as the big belly trash bins, then I'm really excited about that because I think that really brightens up downtown, and I like seeing that. You know, it just really reshapes how you consider a trash bin. So I think people are a little more careful when, you know, tossing on the side of the trash bin. So anyway, thank you all so much for your good work and your advocacy, and just feel free to continue reaching out. Thank you. Thank you.
Thank you. Councillor Perlow. Thank you for the presentation. A couple of questions. With respect to soliciting outside people to help you with funding, do you advertise that you're looking for any businesses that want to donate, potentially have their signage hanging from a banner? Do that or do you consider it the second is when you show the pictures of the power washing of the sidewalk? We can all imagine what that is do we end up with any issues with the stormwater? Going into the beach versus going to the sewer plant are there any issues that are brought up by the state with respect to wa
Back to my first question. I know that there are times especially when tax season comes in there are businesses that look to make a donation How do you get that information out?
Thank you very much. And the Halloween Haunt this weekend.
Thank you very much. Any additional questions?
OK, I'll just say thank you both for the update in this. I know there's an action attached to this. Looking at the items that you've placed here for your proposed work plan, I would say they're certainly ambitious, but I know they're building upon what you've already accomplished. And so I appreciate that you as an organization are looking at how can we do more, do more. And certainly what my attention focused in on was the social media piece of this and a goal to attain 20,000 followers by year's end. But you're currently at 17,900. That's quite an accomplishment for an organization your size
Great. All right. Thank you, Mr. Blum, for that. And I wanted to point out, because that's certainly an attainable goal, but it's a lot of work. And Mr. Cabrera is here in the audience from the previous one. He oversees the digital communications. I can tell you that it's a lot of work to get followers and then keep them and then keep them engaged and then do this and then do this and keep building on it. It's full time work.
All right. There you go. That makes sense. We're partners. All right. So that being said, the last thing I have with regards to your work plan was I appreciate seeing the continued presence there of improvement to our planters and our landscaping and I'm sure that includes drought tolerant California native items that don't require a lot of water and maintenance and really are meant to be here anyhow they don't just look pretty they thrive in our environment that we have so thank you for continuing those efforts All right, at this point, Madam Clerk, I have one speaker here in my hand. So if a
Thank you very much. Okay, my item here says that this is a receiving file, but I believe we do have an action attached to this recommendation that the city council approve the Downtown Oxnard Improvement Association annual work plan and budget for fiscal year 26-27. What's the pleasure of the council?
I move that we adopt, approve the work plan and budget for fiscal year 2026-27. Okay.
We have a motion by council member Starr. Do we have a second? Okay, Madam Clerk, we have a motion by Councillor Starr and a second by Councilwoman Basuwa. May we have the vote?
Great. Thank you again to our friends from Doya and our Oxnard, visit Oxnard folks. Much appreciated. Okay, we have a start time of 6 p.m. We are at 5.57, so we'll take a literally three minute recess and we will start right at six. Thank you, folks. Okay, I'm going to call the meeting to order. Okay. Usually these meetings start without me because I'm out there talking to people, so nice change of pace. Good evening, everyone. I want to call the meeting to order for the Oxnard City Council and Oxnard Housing Authority for Tuesday, October 20th, 2026. Madam Clerk, may we have the roll call and
We will now proceed with the Pledge of Allegiance, followed by a moment of silence in memory of Challenge Neighborhood Council Chair Tom McNally. And at this point, we are going to do the Pledge of Allegiance, and then we will hear from our student today who is leading us, Ms. Jasmine Britt. After that, I will invite the representatives from the Neighborhood Council to say a few words for Mr. McNally. And I'm just gonna, I hope, The council will indulge me in that privilege at this point to give them a moment just to speak at the podium in regards to our moment of silence. Without objection, c
And excuse me, after Ms. Britt finishes the Pledge of Allegiance, we will keep standing for a moment of silence and then we'll turn it back over to her.
Stay here, Ms. Britt. Stay up here. Yes, thank you so much for leading us today and introducing yourself and telling us a little bit about yourself and your journey. Just full disclosure for everybody. Coincidentally, I ran into Ms. Britt at a conference that she was at as one of the young leaders is a peer wellness leader. just a few weeks ago that was through my day job and she recognized me and said hi. But I wanna thank you for being here and eighth grade, 13 years old, you've accomplished so much and have so much initiative. I hope that you're super proud of yourself. I see mom's over the
Thank you so much. Let's give her another show of appreciation. So we have a certificate for you here, Ms. Britt. If you'd like to come up here and then bring any adults you'd like to. We're going to do a quick photo with this.
Okay, so this is a certificate of achievement to Jasmine Britt from Lopez Academy and the Oxnard Police Activities League Youth Directors Council. Whereas the City Council of the City of Oxnard proudly extends its sincere congratulations to Jasmine Britt, a dedicated student at Lopez Academy School and an active member of the Police Activities League Youth Directors Council in recognition of your accomplishments and commitment to youth leadership. and whereas Jasmine Britt's dedication and perseverance in pursuing her goals reflect her commitment to personal growth and her positive contributio
Thank you, Mr. Carter. And thank you, Council. Thank you, Council, for giving us just a moment of space for that to recognize this individual who certainly has contributed to his community and the broader community. Okay, so with that, we're going to move on to item F, the ceremonial items. This evening we have a couple of items. The first one is presentation of a proclamation designating November 11th, 2026 as Veterans Day. And I'd like to welcome the Oxnard Veterans Committee to accept the proclamation. So thank you all for joining us. We have a proclamation here for you for November 11th, 2
Okay. Thank you all so much. Can we give them one more round of applause and show of appreciation? Thank you all for your service again. And it's November 11th, starting at what time? 11-11. It's not. So 11 a.m., Plaza Park. Yeah, we're going to do a photo real quick. Okay, thank you all so much. Our next item is item F2, presentation of a commendation to Santa Clara High School and Santa Clara Elementary School on the occasion of their 125th anniversary. And we have principals, Mrs. Lozano for Santa Clara Elementary and Mrs. Palmi, excuse me, Palmi Sano for Santa Clara High School who accept
And as they're walking up to the podium, I'll go ahead and read the certificate of commendation for Santa Clara High School 125th anniversary. And the proclamation states, Santa Clara High School was founded on September 2nd, 1901, by the Sisters of St. Joseph, establishing its enduring legacy as the oldest Catholic high school in Ventura County. For 125 years, the institution has remained profoundly dedicated to educating young people within a community rooted deeply in faith, family, and tradition. Generations of saints have walked its historic halls, discovering their unique gifts under the
With this next recognition, this recognition is for Santa Clara Elementary School 125th anniversary. Santa Clara Elementary School is celebrating its historic 125th anniversary, marking over a century of dedication to nurturing the minds, hearts and spirits of youth in the city of Oxnard. This esteemed institution was founded on September 2nd, 1901. by the Pioneer Sisters of Joseph under its original name, St. Joseph's Institute. And the school first opened its doors to the children of local farming families at its original location at the corner of 4th and D Streets, operating from a wooden f
Okay, I think we're gonna do a few photos. All right, so we're going to go ahead and move on. Madam Clerk, I see we have some hands up. I'm not sure if they're for this or for the ceremony items, but even if they are for the ceremony items, we use this time for non-action items as well, for items not on the agenda. We're gonna move on to item G, public comments for items not on the agenda. Those who wish to speak may submit a card to the clerk. They are there in blue in front of her. If you are joining us on Zoom, you can hit star nine to indicate you would like to speak. Person may address th
And excuse me, that'll be followed by Anonymous.
Thank you for your comments. Our next speaker is anonymous, to be followed by Mr. Ray Blatel.
Thank you very much. Next speaker is Mr. Ray Blatel to be followed by Ken Tougas.
THANK YOU VERY MUCH. OUR NEXT SPEAKER IS KEN TUGAS TO BE FOLLOWED BY GUIDO GONER.
NEW SPEAKER THANK YOU. Just as a reminder for decorum, we will refrain from doing any audible signals after each speaker, whether that be clapping, booing, hissing. We can show visual support, but let's keep the audio or the audio cues to zero. Thank you. And our next speaker is Mr. Guido Goellner to be followed by Ronnie Miranda.
Thank you. Thank you very much. Our next speaker is Ronnie Miranda. And after this speaker, Madam Clerk, we'll go to the virtual speakers.
Thank you very much. Madam Clerk, can we go to the first virtual speaker?
Madam Clerk, may we have the next virtual speaker? And I'll just let my colleagues know that after the virtual speaker, if there are no further virtual speakers, we have two comments left. I'd like to take them so we can finish up the rest. Oh, we have a few more. Okay. Well, let's take the virtual speaker and we'll see where we go from there. Thank you.
Excuse me, we're going to refrain from audio responses. Thank you. OK, so we're going to go back to the in-person speakers, Madam Clerk. Before we do, I did check. We started public comment at 628. We're coming up in the 30-minute mark. We have six speakers remaining in person. And I want to ask the council what they would prefer to do. Would they like to extend the time to take the remaining speakers, or would you like to have them wait till the end of the meeting?
I would like to move to extend time like we normally do so any other speakers want to speak may speak. Okay.
Do we have a second on Councilmember Starr's motion here to go beyond the 30-minute mark?
So we have a motion by Councilmember Starr, a second by Councilmember Perrello. Madam Clerk, may we have a quick roll call vote on that?
Thank you. At this point, I would like to invite anyone who would like to speak. Please, you may fill out a card with the clerk. If you're online, hit star nine. We'll go to the virtual speakers after the in-person speakers, and then we will call this public comment item, or... portion of the agenda. All right, our next speaker is Arthur Muñoz, to be followed by Greg Runyon.
Thank you, sir. Our next speaker is Greg Runyon, to be followed by Ron Aruejo.
Thank you, Mr. Runyon. Our next speaker is Ronald Arguejo to be followed by Abel Velazquez.
Thank you, Mr. Arguello. And thank you to you and the INCO for all of your work on that in every election cycle. We have the last couple of speakers here. If there are no further in-person speakers, if there are any virtual speakers who would like to speak, you can raise your hand using star nine. Otherwise, we will be ending after we exhaust this list. The next speaker is Mr. Abel Velasquez. Excuse me. Followed by Francisco. Is it Gutierrez? Yes. Okay. Thank you.
Thank you. Our last two in-person speakers, Mr. Francisco Gutierrez, followed by Eduardo Huerta. And then we'll go to the last virtual speaker after that, Madam Clerk.
Thank you. Just out of courtesy to our virtual speaker who's been patiently waiting, I think we should let him speak or her speak and then go on to the rest.
Well, I didn't see it until now, but let's have Mr. Huerta do his three minutes and then we'll finish with that. Speaker, thank you.
Thank you, Mr. Huerta. And that concludes our in-person speakers. Is that correct, Madam Clerk?
And this is the only hand? Yes. This is it then? We're closing it, folks. Thank you.
Thank you, Madam Clerk, and thank you to my colleagues for extending the time beyond the 30 minutes. We took all of the speakers, so now we're going to move on to item H, report of a city manager, executive director, and secretary. Mr. City Manager, you have the floor.
All right, before we take the slides down, Mr. City Manager, can you go back to the first two slides, the first two pictures? Okay, go back to the next one after this. So this is the first one, there's a second one. I was wondering, the mayor looked like he was standing in the same exact spot in the same exact pose. And I was thinking, did you guys AI him in or what? But no, he's actually there. So that's him. Okay. Okay. Or it's not a cardboard cutout of him or anything either, right? Okay. Thank you mayor for representing and thank you code enforcement, thank you planning for all of your wor
ONLY THING I'D LIKE TO REPORT IS THAT THERE'S AN UPCOMING LA COLONIA NEIGHBORHOOD COUNCIL MEETING ON WEDNESDAY, OCTOBER 28th, AND THAT OUR MAYOR WILL BE A GUEST SPEAKER AT THAT EVENT. SO I'M LOOKING FORWARD TO SEEING WHAT HE SAYS. NEW SPEAKER.
OKAY. THANK YOU VERY MUCH. WHAT WAS THE DATE ON THAT, COUNCILMEMBER?
NEW SPEAKER. I HAVE WEDNESDAY, OCTOBER 28th.
NEW SPEAKER. OKAY. THANK YOU. Okay, Councilwoman Rodriguez.
Yes. On the 7th of this month, I had my Gold Coast Transit District, it was like a strategic planning meeting, and we're talking about priorities, especially as like our federal funding is not aligned with like our state priorities so there really are some prioritization process that we should consider and I would encourage folks to give input especially if you use Gold Coast as mode of transportation the big the big buses throughout the city You know many times we think about efficiency and how quickly the bus goes from one point of the city to the other and But then we also need to consider
Thank you very much. And I don't say I'm biased. I say, I don't pick favorites, but I really like Oxnard College. So there you go. So, okay. Commissioner, do you have any updates? No, okay. Councilwoman Perez.
Thank you. Just a recap of activities since our last council meeting. I sit on the Air Pollution Control District Board, and we approve funding to extend air pollution monitoring in South Oxnard, and I believe it covers Port Hueneme as well. So really excited for that effort and want to just appreciate all of the organizations who are part of that effort. I also joined other colleagues on the dais as well for the Ventura County Community College State of the District yesterday. And then just as a quick update, I will be circling back to hold another meeting with our neighborhood council chairs
Thank you, Councilwoman. Council Member Perlow.
Thank you very much. Thank you to the speaker that has spoken. Since the last meeting, I've attended the Ventura Regional Sanitation District. attended a little bit of the Wilson neighborhood council and have walked in districts and had the fortunate opportunity in the Cabrillo neighborhood to watch the Halloween float. Tremendous impact with kids, a lot of kids. It's amazing, you look back and you think that you were once at that age and how you danced and everything when they gave the candy out, just like the kids do today. Very little changes in that respect. THE NEIGHBORHOOD COUNCIL MEETIN
NEW SPEAKER THANK YOU, COUNCILMEMBER PERLOW. AND COUNCILWOMAN BASUA.
NEW SPEAKER THANK YOU. I WANT TO THANK Lemonwood School PTA and those parents for their invitation to participate in some of their events. It is really telling to be out in the community, especially with the kids. I have a soft spot for kids. I also did not have an opportunity to go to today's march. AT THE COURTHOUSE, SO I DO WANT TO ACKNOWLEDGE THAT I AM A BIG SUPPORTER OF THOSE RIGHTS. UNFORTUNATELY, I DID HAVE TO WORK, AND I HAVE A STANDING MEETING ON TUESDAY THAT PREVENTED ME FROM ATTENDING THAT MARCH AND SUPPORTING 7-2-1. AND I FURTHER, I WANT TO ECHO SOME OF THE COMMENTS THAT COUNCILMEM
THANK YOU, COUNCILWOMAN. ALL RIGHT. FOR MY COMMENTS HERE, WE HAVE A NEIGHBORHOOD COUNCIL MEETING THIS THURSDAY, THE 22ND, 6 P.M. AT CURRENT SCHOOL. And then Councilwoman Perez and I will be having our next session for Voices of Oxnard Youth between now and the next council meeting. And we look forward to where they go. We're going to, as a continuation of their last session, we will now be whittling down kind of their big priorities they have to land on some things they would like to try and address as a group, as a cohort for this session. I also want to thank, I see he's still here, Mr. Arau
Those are my comments. So let's go ahead and move on then. Thank you. Thank you to my colleagues. Thank you, Madam Clerk. We're now going to move on to review of the information consent agenda. Members of the legislative body will consider whether to remove information consent agenda items for discussion later during the meeting. Do any council members have any consent items they wish to discuss? I'll just share that I did check in with our directors who have items on the consent agenda tonight. There was a question for housing, but I don't believe that that one's going to be pulled for discus
everyone else said that there had not been any questions or inquiries ahead of the meeting but hearing that do we have any items that would like to be pulled for discussion yes counselor star yes if there's any my understanding is that l4 that somebody wants to speak on that uh so if if if that's correct uh i'd like to have that as a separate item if there's anybody else that is signed up to speak for any other item, I would ask that those items also be separately considered.
Thank you. I'd actually, we have one speaker here for L5 and then one for L4. Considering that those are specific, we'll go ahead and take those comments on the next portion here where we take public comments on the info consent agenda. But would you still like to pull L4 for discussion?
I just want to hear the public comments. Okay. That's fair.
We'll hear it. Okay, so we're just gonna hear that comment that it sounds like we're not gonna pull that item. If there are no other items, seeing and hearing none, I would like to disclose that for the item regarding the opioid settlement funds, I will need to recuse myself just due to the nature of my work and a professional relationship that I have with the County of Ventura. And so I just want to disclose that and have it recorded in the minutes that I will be recusing from that particular vote for the consent items, all right? Okay, so that being said, let's move into public comments on i
Eric Andrews, please play my video for L4.
Thank you very much. Our next speaker for the consent items is Alicia Purcell.
THANK YOU, HONORARY DEPUTY TREASURER PURCELL. AT THIS TIME, If there are no further public comments, Madam Clerk, can we confirm that?
Go ahead, Council Member Cesaro. Mayor, actually I have some questions on L4 now that I've seen what the public commenter was saying.
So before we move on then, let me just check in with the city attorney just to make sure we're on the clear on this. We did have a chance to pull items. I did ask if we wanted to pull it. He wanted to hear the speaker, but is this at the discretion of the chair or do we have anything against us here considering that we had the opportunity, we chose not to pull anything.
If you'd like to pull L4 now, we can do that.
Yeah, I just, I guess what I wanted to understand and, is how time sensitive is this decision? The speaker did bring up some points. Maybe they're valid, maybe they're not. But if it's not time critical, I would prefer that those issues be addressed at some point.
And we'll have our community development staff come up and maybe speak to that.
Would it be somewhere around, I guess no later than July 1st because that's when the assessments are determined. Do you think that it's possible that there's some margin of time between now and July 1st where this can be decided?
Well, if it's not going to impede anything, I would ask that this IME brought back at whatever council meeting is appropriate, but certainly well before the December 31st so that we can make a decision based on all these facts. Like I said, I don't know if the speaker's comments were valid or not, but he brought up some issues that I thought, well, it seems like he researched it, looked into it. MAYBE HE'S GOT GOOD INFORMATION, MAYBE HE DOESN'T, BUT I'D FEEL A LOT MORE COMFORTABLE IF WE BROUGHT IT BACK AND WE COULD RESOLVE THAT BEFORE WE VOTE ON THIS. I WOULD NORMALLY BE IN FAVOR OF VOTING FOR
May I comment? I think that because it is a third party and it has really nothing to do with the commenter except for his comments, I DON'T SEE WHY WE SHOULD, YOU KNOW, BRING THIS BACK. THIS IS THE LANDLORD OF THIS PROPERTY HAS SEEN THIS. THEY AGREE. I DON'T SEE WHY WE SHOULD HOLD A LANDLORD THAT HAS NO PROBLEM WITH THIS, HOLD HIM UP JUST BECAUSE SOMEBODY ELSE HAS AN ISSUE WITH IT THAT HAS NOTHING TO DO WITH THE PROPERTY.
SO THE ISSUE IS THE PROPERTY TAX THAT WE'RE GIVING AWAY. THERE IS A PUBLIC ISSUE INVOLVED IN THIS. IT'S NOT JUST THE PROPERTY OWNER. AND IF THERE'S A QUESTION AS TO WHETHER WE SHOULD BE GIVING THIS PROPERTY TAX SUBSIDY, IF YOU WILL, TO THIS OWNER, AND THERE'S SOME QUESTIONS ABOUT WHETHER THESE ARE APPROPRIATE, I THINK IT'S STILL AN APPROPRIATE DECISION TO LOOK AT, I GET YOU DISAGREE, BUT THAT'S HOW I'M SEEING IT. THANK YOU, COUNCILMEMBER.
WOULD YOU LIKE TO MOTION THEN TO DELAY THIS ITEM TO A FUTURE DATE?
I THINK THE POINTS ARE BROUGHT UP TREMENDOUSLY, BUT I'D LIKE TO ASK MR. PENGALY, DO YOUR STAFF HAVE A FAIR AMOUNT OF WORK? DO YOU HAVE EXTRA TIME TO LOOK INTO THIS? BECAUSE AS I LISTENED TO THE PRESENTATION, And I do appreciate bringing it out as a third party, not directly involved. It sounded to me like, and I could go back and watch the presentation to be 100% accurate. It sounded like he's casting a net for everything in the area that may have avoided having taken the benefits of the opportunity or not taking the benefits of the opportunity for the city of Oxnard. Would you have enough tim
THANK YOU FOR THAT THANK YOU FOR THAT INFORMATION.
Well, I think the speaker did bring up a few questions and I'm wondering if you had answers to any of the questions that were brought up. I specifically was thinking like the route, for example, right? If we're expecting a Super El Nino storm, like are some of these things time sensitive that need to happen and is holding this to next month's first council meeting something reasonable or is it, you know, I'm trying to understand the timeline and some of the aspects of the modifications that are being asked.
And the technical thing is I know there's a tax credit, right? But that doesn't, for the next 10 years there could potentially be this tax credit. making the improvements doesn't go into effect until that happens, or is it contingent on conducting the refurbishing or maintenance that needs to happen?
And then the other question I had was a technical question about the historical references that were alluded to in the video. I don't know if in the review of that board, sorry, the one that happened on August 10th, the historical CHP, the CHB hearing if any of those historical facts were cross-referenced or what kind of, in the hearing, how much theft there was. But those are my two questions.
Well, I know that there's several questions brought up in the presentation, right? And we also got a memo that, you know, I think there's maybe 12 pages or so. The one that really stood out to me was like the roof, for example, right? And I'm just considering logically with El Nino happening
OK, thank you. And the other question was about the historical references. Have those been cross-referenced? And do we feel confident enough that after the CHB hearing, the historical references are accurate?
Okay, thank you. What I'm hearing is the architecture not ownership necessarily.
Thank you. Thank you. Do you have a question?
Before we leave the podium, thank you very much for that information. When it comes to something like this, is the city responsible for being the ultimate, as Councilmember Rodriguez asked, the authority on history, correct? Or it's this cultural thing, the county, that's more responsible? It sounds to me, and correct me if I'm wrong, please, that there's another agency that's responsible for that. It's not your responsibility, not that you're shirking the job. It's just not your responsibility. Is there a policy that says yes or no?
Then very similar to the city council. We're not experts, but we refer to the experts. Thank you very much.
I guess at this point if we were to vote on this right now, I would have to abstain because I feel like there's still information that I'd like to know or at least I want clarity on what's really the case here. If my colleagues would like me to be able to vote in favor of this and I want to, I would ask that it be postponed for staff to bring it back as long as it sounds like we can bring it back well before December 31, that'd be my preference. So if my colleagues are open to that, I would, I think it would be appropriate to postpone it until then. So that would be my motion.
Sure. So there's a motion to postpone this item. Do we have a second?
SEEING AND HEARING NONE I'M SORRY I HAVE A QUESTION IF WE WERE TO POSTPONE HOW QUICKLY WOULD ANY OF THESE BECAUSE I KNOW THERE WAS A LOT OF QUESTIONS BEING ASKED AND I THINK THAT SOME OF IT MAY BE IN OUR PREVIEW AND OTHERS MAY BE COUNTY OF VENTURA SO WOULD THIS BE REALISTIC TO COME BACK AT THE NEXT MEETING TO ANSWER THAT WE WOULD NEED TO KNOW WHAT SPECIFIC QUESTIONS COUNCIL HAS AND WE WOULD WANT THAT DIRECTION FROM COUNCIL GOT IT OKAY MR. CITY MANAGER I JUST WANT TO CLARIFY BECAUSE I THINK I HEARD THAT
Mayor, I don't think that's fair. I think that the whole point is to give the public 12 days to review if the public comes in with a concern on the 12th day, I think it's their right to do that. I think it's good that we give people 12 days. I don't want to give the public like a much shorter timeline in order to, you know, inject a thought into this process.
Thank you. If I understand correctly from the staff report, the Cultural Heritage Board hearing was on August 10th. Is that correct? OKAY. AND THIS WAS CALENDARED TO COME TO US AT SOME POINT AND IT'S HERE BEFORE US IN OCTOBER. YES. OKAY. COUNCILMEMBER BUSUAY, DO YOU HAVE SOMETHING ADDITIONAL?
MY CONCERN IS I APPRECIATE THERE'S SOME QUESTIONS, RIGHT, THAT A THIRD MEMBER OF THE COMMUNITY WHO HAS A VESTED INTEREST BECAUSE HIS HOME IS WITHIN THE HISTORIC DISTRICT HAS. AND I THINK THAT IN THE NEAR FUTURE, WELL, WE SHOULD TRY TO ANSWER THOSE QUESTIONS, BUT MY FEAR IS THAT BY HOLDING THIS ITEM UP IS GOING TO CREATE UNINTENTIONAL CONSEQUENCES NOW THAT THE OWNER, IF THEY'RE NOT HAPPY, IT'S GOING TO JUST, I DON'T WANT TO HOLD THIS UP. SO I APPRECIATE THE QUESTIONS. I THINK IT'S SOMETHING FOR NEXT TIME OR MAYBE MOVING FORWARD, QUESTIONS THAT COULD WORK WITH THE THIRD PARTY IN REGARDS TO IT, B
Okay. Before we move forward with that, did we have a second for Councilmember Starr's motion to delay this item, or postpone it, excuse me?
Seeing and hearing none, the motion dies. Thank you, Councilmember. And were you going to make a motion, Councilwoman Basuwa?
I'll make the motion to move this item forward.
Yeah, Mayor, I just want to make sure this is a separate vote because I'm going to need to abstain from this. Like I said, I'd love to vote for it, but. Let's get a second first.
Well, should there be a second, then this would be its own item, and then the remaining would be a separate item.
Yeah, we pulled this item, and I realize it went out of order. We didn't take the balance of the consent agenda. Let's settle this one, and then we'll move on to the balance of consent. So we have L4. We have a motion by Council Member Basuwa for the recommended action for this. Is there a second?
Exactly she's the official caretaker custodian, and I'd like to have her weigh in on things get lost in the shuffle Thank you mayor pro tempter on and council members So there is a motion on item l4 the motion was made by council on basu and we're looking for a second
And I'll read the recommendation. Thank you, Council Member. We jumped right into this and I didn't do that portion. I apologize to everyone. So the recommendation for this item, excuse me, the subject is request to engage in a Mills Act contract with the city for the ongoing rehabilitation and preservation of a contributing home IN THE HISTORIC DISTRICT LOCATED AT 160 SOUTH G STREET PLANNING AND ZONING PERMIT NUMBER 26-680-01 MILLS ACT AGREEMENT APN 202-0-030-200. THE RECOMMENDATION THAT COUNCIL MEMBER SUIT IS MOTIONING HERE IS MOVING FORWARD. THE CITY COUNCIL, ONE, FIND THE PROJECT TO BE CAT
Okay, thank you to my colleagues for helping us unwind that. Thank you to our community development staff. Let's go back to the info consent items now. We have the balance of the consent agenda. It has been requested that we please combine the housing items in the motion for those who make it. In addition to that, as a reminder, I'm recusing myself from item L1 for the opioid settlement funds. What is the pleasure of the council?
We have a motion by Council Member Parillo, second by Council Member Basuwa. We are combining the housing vote as well on this. So the commissioners will be voting on this as well. And I am recusing myself from L1. Madam Clerk.
THANK YOU VERY MUCH. OKAY. AT THIS TIME THE COMMISSIONER ANDRADE IS EXCUSED FROM OUR HOUSING COMMISSION BUSINESS. THANK YOU FOR YOUR SERVICE AND YOUR HELP. ALL RIGHT. WE'RE NOW GOING TO MOVE INTO ITEM M1. THIS IS A TIME AND PLACE SET FOR A PUBLIC HEARING ON ITEM M1, COMMUNITY DEVELOPMENT DEPARTMENT. Subject River Park specific plan amendment recommendation that the City Council, one, conduct a public hearing, two, certify addendum number 16 to final environmental impact report number 00-03, together with the previously certified final environmental impact report and subsequent agenda, and dete
disclosures regarding this matter to state for the record. no none none okay i will only add that when mr dozier had emailed he emailed me directly as well as the city clerk i did reply to him with responses from staff on some of the items he stated which a few of them did not pertain to this particular item and so he got additional information and sent an amendment to his previous written comment so you all should have received that but just FOR THE SAKE OF FULL DISCLOSURE, I DID COMMUNICATE WITH HIM, I DID RESPOND TO HIS RESPONSE TO US, OR HIS MESSAGE TO US. NEXT WE HAVE A LEVINE ACT NOTICE,
Okay. Thank you very much. An example in this particular case would be potential developers or commercial property owners who might have a stake in this. Is that correct?
Thank you for that explanation, Mr. City Attorney. Yes, Councilwoman Rodriguez.
I am so sorry. I have a technical question about that. So, for example, it's campaign season, and if folks unknowingly received a donation, would we still meet quorum if folks, let's say, I'm not saying because it's three, but let's say four people were running for office, they got donations, and now only three folks would be allowed to vote, but would that mean that we don't meet quorum as a council? Or is it of the eligible people who can vote, then the decision would be made?
I'm not sure that answered my question though. Because if somebody receives during a campaign, receives the maximum allowed, which is a little bit over $500, now they receive an email, they potentially would have to step out, which is fine. Does our quorum get affected by that?
It's not. It's not. I'm just trying to understand the Levine Act as we move forward and other election seasons will happen. So again, I believe in grassroots fundraising, but things can come up.
Sure. And I'll just say that there are... some carve outs or exceptions to who is in this that's in the statute itself as I recall. We don't have to get into that.
Understood, thank you. And we have Council Member Perillo and Council Member Starr with, this question's on the Levine Act before we move forward? Yes.
Okay, go ahead. City Attorney Fischer, you've kind of danced around the rule of necessity, and I compliment you on that. Might as well cross the line. If it came to a rule of necessity, those that could not vote, it would be a straw boat to pick which one would vote.
As having the opportunity now to clarify to the thousands that are watching this.
Let's go ahead and move forward with the item, because that is going further down the hypothetical.
You're not going to let me get the answer to my question. I don't appreciate that. But if you are supported by organized labor, and organized labor is in support of construction. So then you would have to recuse yourself if you took an amount larger than the individual amount.
Tri-County Laborers has endorsed me, and Tri-County Laborers covers a lot of unions, and they are advocates for construction. And so if there's, I didn't deal with a developer, I've had no outside consultation, but I could see that someone, possibly a member of the council, would challenge me if I vote on this because I took something from organized labor that would have an interest in having construction and don't disclose that I have a conflict.
So then I have a clean bill of health on this.
Okay. We'll take Council Member Starr and then let's move on.
Actually, Council Member Perrello asked the question that I was going to ask. I was very curious whether there was a carve out for unions in this pay for play law. Yeah.
And we can take, possibly a future appointment item to have all the fun with the deep dive into the Levine Act. So hearing what we've heard, do we have any disclosures from any council members regarding the Levine Act? No.
Seeing and hearing none, I do not either. Okay, members of the public were invited to sign up to speak on this item on the city's website and a person who did not sign up may do so now by submitting a speaker card or following the instructions posted on the agenda for this meeting and at the city's website, oxnard.gov slash city hyphen meetings. Jamie Peltier is the planning supervisor, and she posted a video presentation regarding this item and is available to answer any brief clarifying questions council members may have before we take public testimony on this item. The council will delibera
Okay, thank you, that's my only question. All right, we'll now open the public testimony portion of the public hearing. Speakers have three minutes to speak on this item. Madam Clerk, do we have any speakers for this item?
Okay, if there are no speakers for this item, then we'll go ahead and close the public hearing. and the public hearing is now closed. Do we have a council member who wishes to comment on this item? Seeing and hearing none, I'll entertain a motion to approve the recommended actions.
Second. Okay. Madam Clerk, we have a motion by Council Member Perlow and a second by Councilwoman Rodriguez.
Thank you very much, Madam Clerk. The next item on the agenda is item N1. This is the fire department subject approved budget appropriations for awarded federal emergency management agency FEMA grants Recommendation of the city council approved budget appropriations for two FEMA fiscal year 25 assistance to firefighters grants in the amount of $1,550,786.20, including a 140,000, excuse me, 140,000, $140,980.57 local match requirement. I was gonna commit you to a big number there, chief. This item- Maybe Javier. Yes, this item is not in committee as it is a continuation of an item previously ap
Did you have something? I was just going to say if there are no questions, no comments, I'll move the recommended action.
Okay. Let's go to Council Member Starr then.
So while the firefighter EMTs are spending this nine-month period to become paramedics, who backfills them and does this grant cover those backfilling costs?
Okay. And I assume, I don't know this, I assume that when a firefighter upgrades his skills to be a paramedic from being an EMT that there's a change in his compensation?
Do you have kind of a ballpark of what that might be?
My only comment was just giving kudos for securing these grants I see this as a great investment in the community and just the paramedic program, I think, complements really well with the work that's already on the ground, especially when we need more in the region.
So again, just kudos because that's a pretty hefty dollar amount, so thank you.
Yes. She has something additional, Council Member Starr. Before we go to you, are there any other questions from council members? Go ahead, Council Member Starr.
Just a question about the distinction between EMT and a paramedic. What can a paramedic do that an EMT cannot do?
Okay, we had a motion by Council Member Perlo. Is there a second for this item? Oh, excuse me. Do we have any public speakers, Madam Clerk?
Thank you very much. Okay, Council Member, you had made a motion. And we have a second by Council Member Wimperis. Madam Clerk, may we have the vote?
Thank you so much. Thank you very much. Thank you, Chief. And Madam Clerk, I believe we have removed item N2 from the agenda, right?
Okay, thank you very much. We will move on to item N3, Public Works Department. Subject, agreement 32700117 with Garcia's Landscaping Maintenance Inc. for on-call tree maintenance services, specification number 26-86. Recommendation that the City Council approve and authorize the Mayor Pro Tem to execute an agreement with Garcia's Landscape, excuse me, Garcia's Landscaping Maintenance Inc. for a five-year term which includes options to extend for a total not to exceed amount of $6 million for on-call tree maintenance services. THE PUBLIC WORKS AND TRANSPORTATION COMMITTEE APPROVED TWO TO ZERO
COUNCILMEMBER STARR. THANK YOU. I APPRECIATE THE FACT THAT WE'RE CONTRACTING OUT TO SAVE MONEY AND TO EXPAND WHAT WE CAN DO. My question is, I know we have five full-time employees in the Public Works tree crew, and I'm wondering might it be less expensive to expand upon the use of this outside service provider instead of using city employees? In other words, for the same amount of money, could we trim more trees by using this firm as opposed to doing it in-house?
Somewhat. So would it be fair to say that the type of work that the employees are doing that it's more cost effective for us to have employees do that rather than contracting out what they're doing today.
Would you see any advantage to having, say, more employees instead of the five we have now?
Thank you. That information is very helpful for me. Thank you.
And Mr. City Manager, do you have something additional?
Great. Thank you very much. In addition to that, Mr. Hallett, I'd imagine emergencies are referenced on here too. There could be, we had a significant Santa Ana speeds this week, and I'm sure a number of private and public trees had a number of limbs fall or crash down because of that. But we also have a super El Nino ahead of us. Does it seem that an on-call contract like this can add scalability to the work that has to happen in order to clean up limbs or even fallen trees get cleaned up and out of the public right of way, et cetera?
with respect I hadn't heard in my district I've driven through and I didn't see anything but it was mentioned by Mayor Pro Tem the high winds my knowledge we haven't had any big trees fall and I think that's a credit to the THAT'S A CREDIT TO THE POLICIES THAT HAVE BEEN IN PLACE AND THE PEOPLE THAT YOU'VE GOT WORKING ON THIS. HAVE WE HAD ANY MAJOR TREES FALL DURING THIS LAST WIND EVENT?
Thank you, and the only thing to add to the council is the fruits of the palm trees that end up falling. It's a 3-1-1 opportunity, but I did not know and I appreciate Mr. Howlett and Public Works letting me know some of the areas where those trees are dropping it on the cement are the obligations of the property and are not the City of Oxnard.
YOU'RE DOING IMPRESSIVE WORK. THANK YOU.
NEW SPEAKER. I JUST WANTED TO THANK YOU IN the responsiveness of your emails. You know, there was a request for tree pruning in the south end at one of the parks, and your team was just very responsive and out there pruning the tree. So appreciate that.
Great. Any additional questions? Madam Clerk, do we have any speakers?
Thank you. What's the pleasure of the council on this item?
Mayor, I move the recommended actions. Okay.
Okay, we have a motion by Council Member Starr and a second by Council Member Rodriguez. Before we go to the vote, I want to thank you, Mr. Howlett. I will say, I know you and I have had a number of conversation about trees and I feel like I learn something new every time, but thank you for this work. I appreciate Council Member Parello pointing out that this wind event, we at this time did not have any fallen trees or major issues. I think that speaks volumes to your team and the work that you've done in our grid pruning program. And last thing as a fun fact for folks, if you go onto F Street
Thank you very much. Before we close the meeting, I do just want to disclose, I don't know if it was, if we were on the video when it happened, Councilor Parillo did show me a note or pass me a note, and he was asking about item N2, if we had pulled it, and I told him yes we did, just so people don't think we're, passing notes to each other up here, but he just confirmed that we pulled the item and I confirmed that for him. So with that, there being no further business on the agenda and without objection, we are adjourned. Thank you everybody, have a good evening.
